ISLAMABAD: Stressing the need for building water reservoirs to overcome the acute shortage of irrigation water, the Supreme Court told the government to immediately start work for the construction of Diamer-Bhasha and Mohmand dams.

“The need for water reservoirs is not only expedient but also essential for the survival of the people and economy of Pakistan. All those present in the court, including officials of various departments and experts on the subject, are unanimous in this regard. They are also unanimous on the point that according to the decision of the Council of Common Interest (CCI) the Diamer-Bhasha dam and pursuant to the approval of the ECNEC both (this and) and Mohmand dam must be built on an urgent basis by the federal government. In this regard, there is no dispute or discord of any nature amongst the provinces”, the four-judge bench, headed by Chief Justice of Pakistan Mian Saqib Nisar, stated in its order on Wednesday.

The bench had been formed to hear a petition on the controversial Kalabagh dam.

The SC also formed an oversight panel headed by the chairman WAPDA for the construction of these dams.

The Implementation Committee will also comprise of experts and officials of the federal and KP governments, including (i) the federal Additional Secretary (Budget), Finance Division, (ii) Joint Secretary, Water Resources Division, (iii) Joint Secretary, PM Office (to be nominated by Secretary to the PM), (iv) Senior Chief (Water), Planning Division, Federal Government, (v) Chief Secretary Gilgit-Baltistan, (vi) Senior Member Board of Revenue, KP, (vii) Additional Chief Secretary (Development), KP, (viii) the committee can co-opt any members/ experts.

The court also directed the federal and provincial governments, WAPDA and all executive authorities responsible for the building of the two dams to take necessary steps for immediately commencing the construction and early completion of these dams.

The court asked the committee concerned to submit a comprehensive report in this regard within a period of three weeks.

The bench also appealed to the nation for making contributions, whether in foreign or local currencies, directly to an account opened solely for this purpose.

Funds in the account, operated for the time being under the SC orders, would be utilized solely for the construction and establishment of these dams on the recommendations of the Implementation Committee.

These funds, the court warned, could not in any way be diverted or utilized for any purpose other than the construction of these dams.

Individuals contributing to this fund will be exempt of any scrutiny by all authorities, including the tax officials.

“The utilization of the said funds shall be subject to audit as per directions of this court.”

The order stated that the establishment of water reservoirs was not just a question of quality of life, but it also ensured the continuity of human existence itself, the court stated.

“Therefore, in terms of the provisions of Article 184(3) of the Constitution read with Article 9 and as guardians of the fundamental rights of the people of Pakistan, this court has the jurisdiction to issue necessary directions to the government for the practical enforcement of the primordial right to life.

“Under the provisions of Article 78 … Any funds deposited in the Public Account of the Federation can be dedicated for a specified project or purpose. We, therefore, direct the establishment of an account, for the time being in the name of the Registrar of the Supreme Court, for collecting funds donated by the people for the construction … of the … dams”

The court also expected assistance from foreign financial agencies for the construction of the dams.

Commenting on a political leader’s remarks, the CJP said that the Constitution and the nation empowered the apex court in such a way that no one had the courage to defy its order.

He also expressed hope that the people will show the same enthusiasm they had demonstrated during the 1965 war. He also donated Rs1 million in this regard.

According to him, the director-general of FIA was working on repatriating funds amounting to Rs900 billion to the country.

Lamenting that Pakistan was burdened by foreign debts of more than $100 billion, the CJP wondered why no new dam was built over the past 40 years.

During the court proceedings, the chairman WAPDA said that the total estimated cost of Diamer-Bhasha dam was $11 billion.

Btw, how can the court and the army sideline the elected government like this?! I’m not questioning the intention but who gave them this power? The court is basically giving orders to the government. It’s the people who should react to the lack of development; not the court. The court doesn’t represent the people.
 
30 years too late but Pakistan would need a heck of lot of dams around a good few at least to battle the shortage of water all across the country.

Supreme Court employees to donate two days' salary to dams fund

Employees of the Supreme Court (SC) that are at Basic Pay Scale (BPS)-16 or above will donate two days' salary to the Diamer-Bhasha and Mohmand Dams Fund 2018 — an account created by the Finance Ministry in compliance with the top court's orders — a press release by the SC public relations officer said on Wednesday.

During a hearing last week, the SC had observed that water resources were crucial for survival and directed authorities to take immediate and effective measures to build two dams — Diamer-Bhasha and Mohmand. Furthermore, it had appealed to the general public, including Pakistanis residing abroad, to donate to the cause.

The account was opened in pursuance of the SC order to the federal government, Wapda and the executive authority to take effective measures in light of unanimous decisions of the Council of Common Interests (CCI) to develop the 4,500MW Bhasha dam and 700MW Mohmand dam.

Chief Justice of Pakistan (CJP) Saqib Nisar led the way, formally depositing Rs1 million as a donation in the account from his personal account last week.

Today's statement said that SC employees between BPS-2 and 15 will also contribute to the dam funds by donating a day's salary to the fund.

The legal fraternity in Lahore answered the chief justice's call for donations to the fund as well, with senior lawyers like Chaudhry Zafar Iqbal and Malik Maqbool Siddiq donating cheques of Rs100,000.

Other lawyers also chipped in by submitting cheques to a Bank Al-Habib branch manager, who collected donations in the Lahore High Court (LHC). The lawyers who submitted donations in the LHC belong to both the SC and the LHC.

Not possible to completely prevent fraud in dams fund: SBP governor
During a hearing regarding the dams fund at SC's Islamabad registry, Justice Faisal Arab observed that the court was also receiving messages from private cellphone numbers.

At this, Pakistan Telecom Authority officials informed the court that the fraudulent numbers can be blocked upon reporting.

CJP Nisar meanwhile observed that there should have been one account number (for donation) for every bank, which would reduce the chances of fraud.

But State Bank of Pakistan (SBP) Governor Tariq Bajwa informed the bench that upgrading the banking system to accommodate the same would take time.

The CJP then offered that the owners of all banks could be summoned tomorrow. He observed that the court often receives cases of bank fraud.

The SBP governor said the real objective was to facilitate the public. "It is not possible to prevent fraud 100 per cent," he added.

He informed the court that besides the armed forces, several banks have also announced donations for the fund.

“The officers of army, navy and air force will contribute their two days’ pay, while soldiers [will be donating] one day’s pay to the announced fund for this national cause,” read a statement tweeted by Inter-Services Public Relations chief Maj Gen Asif Ghafoor.

Punjab interim Chief Minister Hassan Askari also donated Rs0.5m via cheque on Tuesday. Officials from Wapda and SNGPL have announced they will donate two days' salary to the fund, while employees from BPS 1-16 will donate one day's salary.

The Ministry of Finance last week opened the account titled "DIAMER-BHASHA AND MOHMAND DAM FUND –2018" to accept funds for construction of the dams.

The account bears Account No.03-593-299999-001-4 and IBN No.PK06SBPP0035932999990014.

An SC announcement said that payments in the fund will be received at all branches of the SBP, all treasuries and branches of the National Bank of Pakistan and all other scheduled banks

I still can't get my head around how stupid that comment about corruption is. A corrupt person's main aim is to pocket as many as he can, his main aim is to benefit himself. The aim of an elected official is to have peoples' needs first, not his or hers. So a corrupt person who is elected by definition will never put the country first. That is the main problem in our country, when these looters don't put the nation infront of their own pockets Pakistan is what you get. Every decision, every action a corrupt person makes is first for their own needs, not the country's. Those are the last people we should have leading us.

Go to any office in Pakistan. The only people you'll find working are those who pocket some money on the sides. They will come early and stay till late in the night.

Then there will be some who will reach at 9, browse facebook, drink chai, gappay all day. Leave at 3 and then pat themselves on the back for being saaf shafaf.

If the CJP and establishment hold musharaff and kiyani acoountablr for their corruption and confiscate stolen money from them. We will be able to build more than just one dam. Poor low ranking officers always bearing the brunt.

Boxer Amir Khan to donate Rs 1mn for dams fund

British boxer of Pakistani descent Amir Khan has announced a donation of one million rupees for dam fund. The announcement was made in a video message posted on social media by the renowned player.

Amir said, Pakistan is facing the severe water shortage and I urged the celebrities and common Pakistanis to contribute to the fund.

Recently the Chief Justice of Pakistan, Justice Saqib Nisar set up a fund to build the Diamer-Basha and Mohmand Dams to resolve the prevailing water crisis in the country.

Admiring the Pak Army and other government officials role in contributing the fund Amir said he will donate more in the fund after his next fight.

Former Pakistan cricket team captain Shahid Khan Afridi has also announced to donate RS 1.5 million to the fund.

CJP Saqib Nisar himself donated RS 1 million in the fund to build Diamer, Mohmand dams.

Although i respect people for raising awareness and contributing for this but to be honest, these donations are more like saving up $1 a day to buy a brand new Ferrari. Eventually it will happen but will take about decades which does not resolve Pakistan's problems.
 
CJP tells govt to generate funds for dams through water pricing

ISLAMABAD: Chief Justice of Pakistan Mian Saqib Nisar has asked the government to generate funds for construction of future dams through water pricing and contended that 25 per cent funds required for a major reservoir could be acquired from people.

“Water pricing mechanism should be improved to get revenue for construction of dams,” the chief justice conveyed, according to minutes of a recent meeting, to the ministries of planning, water resources, energy, law and justice, climate change and the cabinet division, besides professional and technical agencies and provincial governments.

Presiding over the meeting of the Law and Justice Commission of Pakistan (LJCP) attended by senior representatives of the ministries, Indus River System Authority, National Engi*neering Services Pakistan, Water and Power Develop*ment Authority (Wapda) and Indus Water Commis*sion and private experts, the chief justice said the issue of water scarcity had reached an alarming level that was fatal to the lives and livelihood of the citizens of Pakistan.

He said resolution of the issue was “responsibility of the executives and failure to discharge this responsibility has resulted in taking up of this issue by the superior judiciary as breach of fundamental right i.e. right to life”.

The Planning Commission told the meeting that the national water policy approved by the Pakistan Muslim League-Nawaz government had identified 30-40 areas for urgent works that would take four to five years to achieve all goals. It recommended a six-month action plan and noted that Pakistan had limited water resources of its own as all water was coming from neighbouring countries.

“It is the need of the time to devise a strong mechanism to defend our water resources to get our fair share out of trans-boundary water,” the commission quoted the water policy as saying and added that Pakistan was losing each and every case at the forums of World Bank and international arbitrations due to wastage of water and hence construction of dams was being prioritised.

It was argued that wastage of available water was the main cause of its scarcity which had to be addressed by improved water administration, pricing and punishments. “It is equally important to fix the price and tax water and take necessary legal action against the violators and defaulters,” the commission said.

Chief Justice Nisar asserted that the judiciary would find a solution to the water shortage in the country. He said it was very crucial because he had been told by experts during the course of hearing of a related case that Pakistan could not survive in this situation of water scarcity and that all research reports showed Pakistan was going to face severe shortage of water or even out of water by 2024.

Therefore, the CJP told the participants, new dams had to be constructed without further overburdening the nation with the curse of debts and the “apex court will also extend financial support but subject to submission of action plan”. He contended that “1/4th expenses on construction of a dam can be acquired from the people of Pakistan”.

He said every construction settlement and housing societies should have water sewerage systems and asked for an action plan to address the issue of waste water management.

Former Wapda chairman and provincial minister Shamsul Mulk reported that 60-70 million acre feet (MAF) of water was going to the sea due to non-availability of dams and the country would have no water in future if this continued. He called for building small, medium and large dams to save water and asserted that Kalabagh dam was crucial to the country and its importance could not be overlooked.

Mr Mulk contended that if Kalabagh dam was not constructed, Khyber Pakhtunkhwa would not be able to get its share of water in future and reiterated that this dam “is the only cheapest power generation source in the country and due to its non-construction, Pakistan is losing Rs196 billion every year”.

He explained that one MAF of water contributed $2bn to the United States economy while in Pakistan it contributed $600 million. “Therefore, if 60 MAF water is wasted, this results in $36bn losses annually and if the average is taken for 70 years then it equals $2.520 trillion,” the former Wapda chief said.

The LJCP meeting’s minutes revealed that the chief justice, Shamsul Mulk and all other stakeholders “unanimously resolved that Kalabagh dam, without any doubt, is indispensable to meet water and electricity needs of the country”.

Former director of Kalabagh dam Engineer Mumtaz Ahmed criticised the performance of the Indus Water Commissioner for Pakistan for “underperforming” and being “a mud of corruption” and requested the CJP to constitute a judicial commission for a probe into the matter. He alleged that black sheep and traitors were working in the system as Pakistan had lost the case against construction of Kishanganga dam and could be defeated again.

Syed Mehr Ali Shah, the Pakistan Commissioner for Indus Waters, said the country had suffered $19bn losses over the past six years due to floods and $38bn losses since 1950. He said that 1.3 million tube wells had drastically reduced the groundwater level while 40pc of extracted water was hazardous to health. He suggested that tube well be brought under the legal framework and taxation and pricing system.

I hope any government which comes next allows public to chip into schemes like this to reduce burden of loans.

Oh and collect tax properly, and I don't mean just Nawaz and co. Some very wealthy landowners in Punjab and Sindh that don't pay a dime.

The problems with things like this is that just one corruption, embezzlement or misappropriation of funds scandal in these schemes and you can forget about calling people to donate for causes like this.

Pakistan is one of the most philanthropic nations in the world but the trust deficit between the govt and the people is a real problem. Imran Khan can host a fund raiser for one evening and he can collect all the proceeds that he needs for his Shaukat Khannum Hospital because of his credibility.
 
Impractical or not, Whether the project is going to cost Trillions of Ruppees or Billions of Dollars or not, Embezzlement fears or not, atleast it is a step in the right direction and at the end of the day the least we can play a part in solving the water problems of the country.

Building dams not judges’ job, says CJP

ISLAMABAD: Chief Justice of Pakistan (CJP) Mian Saqib Nisar has said it is not the judiciary’s job to build water reservoirs in the country, and that it is the responsibility of the executive.

His comments came weeks after he had initiated the donation fund for the Diamer-Bhasha and Mohmand dams. The CJP said that the apex court could only maintain a supervisory role — concerning the collection of funds for such special projects — in the name of transparency.

“The Supreme Court will not interfere in awarding contracts, nor will it meddle in the designing and structural plans of the two dams, but will ensure that no one makes illegal commissions, or embezzles the funds allocated for the projects,” the CJP said while heading a three-judge bench hearing a case pertaining to the fund-raising for the dams.

On July 4, the Supreme Court had ordered that an account be opened for the purpose of collecting donations, directing the government, the Water and Power Development Authority (Wapda), as well as the executive to take immediate action after the Council of Common Interests unanimously decided to construct the two dams.

Senior counsel Barrister Aitzaz Ahsan also suggested during the hearing that the court maintain an advisory role, and let the executive take responsibility for the construction of the dams.

The court, however, seems to have deliberately avoided talking about the Kalabagh dam considering its controversial status among the provinces. Nevertheless, the bench observed that the Kalabagh dam would require a consensus among the nation.

The CJP further explained that it was not the job of the judges to collect funds, but did claim that someone had handed him a cheque for Rs500,000 — in a recent visit to a shrine — to be donated into the fund. The CJP added that he believed people in the country had realised the importance of water conservation, and were also determined to contribute to the fund. However, overseas Pakistanis, he claimed, were finding it difficult to make donations.

State Bank governor Tariq Bajwa informed the court that contributions from expatriates had started pouring in from the United States and Germany, but those living in the Middle East were having some problems considering they must gain an approval for sending money to Pakistan.

Justice Umar Ata Bandial, a member of the bench, said that the court had to take up the issue of constructing the dams because it was a matter of national importance — one that was critical for the unity of the nation.

Moreover, he said, the people have severe apprehensions over the transparency mechanisms in the fund collection process — especially after their experience with the 2005 earthquake funds that were misappropriated. Justice Bandial also said that it would be a good idea to get schoolchildren involved in collecting the funds.

The court also dropped hints of taking up the issue of taxes and surcharges on electricity prices, pointing out as an example, a monthly bill of Rs23,000 that included a major chunk of Rs8,000 in taxes. Instead of curbing power theft, the authorities are dishing out inflated bills to people who cannot even afford a decent life, the court regretted.

This looks like a PR campaign to raise awareness for the need of dams, you cant collect funds to build a $10 billion project from the people scarpping togeher a few hundred ruppees, however the need to raise awarness is needed as we now what happened when Musharraf tried to build kalabagh and basha dams.

Its a stupid strategy but even in this stupid strategy they dont plan to raise who amount on chanda

Usually they will finance 50-75% on debt.

But yea whatever this raises will be like a drop in the ocean and pretty pointless in the grander scheme of things

Not that pointless actually, all the money coming from abroad will go into our depleted foreign reserves. Obviously they don't plan to finance the whole thing on charity alone. This is like two birds with one stone type of deal.

My calculation was wrong. Sorry for that. With 3 months for 1 billion it should have been 3*599 months in total. But lets assume one month for one billion. That would mean 599 months. That accounts for 50 more years. And buddy this thread was opened around 10th july. So its definitely not 1 month for 1 billion.

Indeed they need to look at other options rather than begging from overseas Pakistanis. Whole world makes fun of us esp India
 
Of course when only 800 000 people pay their taxes the country will struggle.

They need to take taxation policy serious. This will Finance alot of challenges they are facing.
 
I agree that a proper taxation policy needs to be put in place asap with the FBR ripe for reform but it does show once again how much people trust IK.

Saw the status today and there was a spike of about 900 million ruppees in one day from yesterday to today.


At Rs. 2.9 billion now. Inshallah we should be at 10 billion by the end of the year.

Lol, that means at this rate it will take another 90 plus years to get the remaining funds.

I fear the govt will have to look at other ideas to get the funds.

The CJ and PM never said the entire dam will be funded from it. Infact they only need a certain critical amount to initiate construction upon which it would be easier to secure funding from abroad.
