Seems almost every other day there is a threat made to arrest Imran Khan or some new charges are filed.

Question really is, is this all for show or is the PML-N Gov actually has the guts to arrest/try Imran Khan?
 
Former interior minister Sheikh Rashid Ahmed has warned that if the Supreme Court did not look into the cypher issue, the whole situation could deteriorate very quickly.

In a recent tweet, the leader of the Awami Muslim League while expressing his sentiments said every decision of the ‘dimwit’ rulers turns out to be against them.

Rashid stated that Foreign Minister Bilawal Bhutto Zardari has been ‘enjoying himself’ in America for the past two weeks and is not concerned about the flood victims in Sindh at all.

The former federal minister stated that the decision of Pakistan's political future is now linked with the superior judiciary, and that the hearing of the NAB amendments case, scheduled for October 4, is also 'important'.

He warned that if a decision on the call of Pakistan Tehreek-e-Insaf (PTI) chief Imran Khan is made on the streets, then the entire system will be wiped out.

Rashid clarified that there is a need to address people's problems rather than inking a deal with the 'thieves,' adding that the month of October has a significance in terms of the country's political landscape, with important decisions to be made by November 15.

The Islamabad High Court (IHC) is likely to formally frame charges against PTI Chairman Imran Khan for his controversial remarks against a female judge today (Monday).

A larger bench, headed by IHC Chief Justice Athar Minallah, will resume the hearing at 2:30pm.

The former prime minister is facing contempt charges for his controversial remarks about Judicial Magistrate Zeba Chaudhry during a rally in Islamabad on August 20.

The IHC was initially scheduled to indict Khan on September 22, but he surprisingly apologised before the court and assured it that he would not issue such a statement again — leading the court to delay his indictment.

Later, on October 1, Khan submitted his affidavit assuring the court that he is willing to explain and clarify before the female judge that neither he nor his party sought any action against her, and he would "never do anything in future" that would hurt the dignity of any court and the judiciary, especially the lower judiciary.

However, he avoided tendering an unconditional apology. Although mentioning that he "might have crossed a red line while making a public speech", Khan fell short of apologising for his remarks in his latest response.

The case

Khan was booked in a case for threatening judicial magistrate Zeba Chaudhry and police officers at a rally in F-9 Park on August 20, to “terrorise” police officials and the judiciary.

The main aim was to prevent the police officers and judiciary from carrying out their legal obligations, stated the FIR. The FIR was registered on the complaint of Magistrate Ali Javed at Islamabad's Margalla Police Station under Section 7 of ATA.

However, the IHC quashed the terror charges and directed to transfer the case to a relevant court under the remaining sections in the FIR on September 19.

On September 22, during a hearing of a contempt case in IHC, Imran Khan also requested the court to allow him to apologise to judge Zeba Chaudhry in person.

The Islamabad High Court (IHC) on Monday dismissed the show-cause notice issued to PTI chief Imran Khan for his controversial remarks against Additional District and Sessions Judge (ADSJ) Zeba Chaudhry at an August 20 public rally.

A larger bench, headed by IHC Chief Justice Athar Minallah and comprising Justice Mohsin Akhtar Kayani, Justice Minagul Hassan Aurangzeb, Justice Tariq Mehmood Jahangiri and Justice Babar Sattar, heard the case today.

During the proceedings, Imran’s lawyer told the court that a third reply had been submitted to the court.

“We have read your affidavit. Is there anything else you would like to add?” Justice Minallah asked Imran. He went on to say that prima facie this was a contempt of court case but it was being dismissed due to Imran’s conduct.


“We take a lot of care in contempt of court cases,” Justice Minallah went on to say. He said that the IHC was “dismissing” the notice issued to Imran, effectively ending contempt proceedings against the PTI chief.

“This is the unanimous decision of the larger bench,” he remarked.

However, the attorney general opposed the court’s decision to dismiss the show-cause notice issued to Imran as he pointed to the cases involving Nehal Hashmi, Daniyal Aziz and Talal Chaudhry.

“Are you saying you support the judgements in these cases?” Justice Minallah asked and subsequently told the attorney general to submit a written copy of his reservations in court.

Talking to reporters after the hearing, Imran said: “Justice Athar Minallah has taken great decisions [in the past].” He also said that he would appear before the court if needed as he had done in the past.

Earlier today, Imran reached the court amid tight security.

Other party leaders Asad Umar and Shah Mahmood Qureshi also arrived at the IHC. Speaking to media persons, PTI leader Babar Awan said that it seemed that the case would be decided today.

On Sunday, the IHC had granted Imran pre-arrest bail in connection with the case, following the issuance of a warrant for his arrest.

Imran submits affidavit, admits he ‘might have crossed a line’
On Saturday, Imran had submitted an affidavit in line with the court’s directions, saying he had realised he “might have crossed a line” in his criticism of Judge Chaudhry and was willing to apologise to her “if she got an impression” that he had crossed a line.

The court had sought the affidavit during a hearing on September 22, when Imran had offered to tender an apology to Judge Chaudhry. Imran’s offer to apologise had seen him escape the indictment.

In the affidavit, Imran said he had “realised during these (contempt) proceedings before the honourable court that he might have crossed a red line”. However, he added, he never intended to threaten Judge Chaudhry and “there was no intention behind the statement to take any action other than legal action”.

He said he wanted to assure the IHC that he was willing to explain and clarify before Judge Chaudhry that“ neither he nor his party seeks/sought any action“ against her and he was willing to apologise to her “if she got an impression that the deponent (Imran) had crossed a line”.

The PTI chief assured the court that in future he would not do anything that would hurt the dignity of any court and the judiciary, especially the lower judiciary.

He also expressed his willingness to take any further steps that the IHC deemed necessary and appropriate. Imran further assured the court that he would always stand by his statement in the affidavit in letter and spirit.

Contempt case

The case goes weeks back to August when Imran, while addressing a rally in Islamabad’s F-9 park, had criticised Judge Chaudhry after she had approved an extension in the physical remand of his close aide Shahbaz Gill in a sedition case.

Imran had warned the judge, as well as the judiciary, of dire consequences for what he had described as their “biased” attitude towards his party.

Subsequently, the decision to initiate contempt proceedings against Imran was taken by the IHC’s Justice Aamer Farooq on August 22 while hearing a petition challenging Gill’s physical remand. The court had summoned Imran on August 31 and issued him a show-cause notice.

A day before the hearing, the former prime minister had submitted a reply before the IHC wherein he had expressed his willingness to “take back” his words about Judge Chaudhry if they were “regarded as inappropriate”. He had pleaded before the IHC that the judges who had agreed to initiate the case against him should consider withdrawing themselves from the bench as, according to him, they had pre-judged the matter.

However, the IHC had deemed the response to be “unsatisfactory” and asked the PTI chief to submit a “well-considered” response.

Following this, Imran had submitted another reply to the court. In the revised response, Imran had stopped short of rendering an unconditional apology.

On September 8, the IHC had decided to indict Imran, once again calling his response “unsatisfactory”.

However, at the next hearing on September 22, when it was expected that charges would be framed against the PTI chief, Imran had offered to tender an apology to Judge Chaudhry and escaped the indictment.

Following his statement in the court, the larger bench hearing the case had said that it was “satisfied” with the apology and asked the PTI chief to submit an affidavit.

Prior to submitting the affidavit, Imran had appeared before an Islamabad sessions court on Friday to personally apologise to Judge Chaudhry, but his apology was left hanging as the judge was on leave.

Imran targeting ‘state institutions’ in bid to escape punishment: PM Shehbaz

ISLAMABAD: Prime Minister Shehbaz Sharif on Monday accused Pakistan Tehreek-i-Insaf (PTI) Chairman Imran Khan of trying to “create chaos in the state institutions to escape punishment” in the cases pending against him.

According to a statement issued by the Prime Minister’s House, PM Sharif referred to the audio clips of the former premier and said these clips had revealed the “conspiracy” against the state and its institutions.

PM Sharif said altering a diplomatic cipher was equivalent to putting national security at stake and vowed to hold those who “played” with the national security accountable. “Being a popular [leader] does not mean being exempt from the law; the law is equal for all,” the PM said as per the statement.

Denouncing Imran Khan’s campaign targeting the state institutions, Shehbaz Sharif said, “A thief who has been caught red-handed is maligning state institutions just to escape punishment.” “After creating unrest in the nation, the conspirator [Imran] is trying to create chaos in [the] state institutions,” the premier added.

Sana vows to ‘defend’ Red Zone from PTI protesters

The premier’s remarks about the cipher came days after the federal cabinet formed an inquiry committee to probe the controversy in the wake of the two leaked audio clips of Mr Khan and his aides. The committee comprising officials of the FIA will frame criminal charges against the PTI chief for purportedly using the cipher for his political advantage.

Separately, Interior Minister Rana Sanaullah vowed to defend the Red Zone amid reports that the PTI chairman will announce his march towards Islamabad for ‘real freedom’ within one week.

Speaking during a TV show, Mr Sanaullah warned that Mr Khan was “unaware of what will happen to him and his supporters if they tried to enter the highly-secured Red Zone”.

FIA team formed to probe Imran over audio leaks

ISLAMABAD: The Federal Investigation Agency (FIA) on Wednesday formed a team to investigate former prime minister Imran Khan and his aides over an alleged audio leak with regard to a diplomatic cipher.

According to a notification, FIA director, Islamabad Zone, will head the inquiry team and will investigate Imran Khan, his ministers and principal secretary Azam Khan. The inquiry team will also include members from Inter-Services Intelligence (ISI), Military Intelligence (MI) and Intelligence Bureau (IB).

Earlier on Sunday, the federal cabinet decided to take legal action against PTI Chairman Imran Khan and his aides. The federal cabinet had formed a committee over the leaked audios on September 30, which recommended legal action over the audios of Imran Khan, Azam Khan and others on October 1.

The recommendations of the committee were presented for approval of the cabinet in a circulatory summary, which was formally approved.

ISLAMABAD: A district and sessions court in Islamabad granted interim bail to former prime minister and Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan in a case related to his threatening remarks against a female judge, ARY News reported on Thursday.

According to details, the former premier appeared before Sessions Judge Kamran Bashart’s court, seeking interim bail in a case related to his threatening remarks against female judge Zeba Chaudhry.

During the hearing, Imran Khan’s counsel – Babar Awan – noted that his client has appeared before the court. “This is the first bail application and another case was also scheduled for October 13,” the counsel added.

After hearing the arguments, the judge accepted the PTI chief’s bail application and ordered him to submit surety bonds of Rs50,000. The court also issued notice to police until the next hearing.

FIA RAIDS PTI LEADER TARIQ SHAFI’S HOUSE IN KARACHI

KARACHI: The Federal Investigation Agency’s (FIA) State Bank Circle team raided Pakistan Tehreek-e-Insaf leader Tariq Shafi’s house in Karachi.

PTI officer-bearer and close aide of former prime minister Imran Khan Tariq Shafi, nominated in the case of alleged illegal transfer of money from foreign countries to Pakistan.

The FIA team has camped outside the house of the PTI leader.

According to FIA sources, the team would begin the search of the house of Tariq Shafi after getting a search warrant from the court.

The FIA’s State Bank Circle team reached the house of PTI office-bearer, however, the family members of Tariq Shafi maintained that he was not at home.

According to FIA officials, FIR No. 14/2022 has been registered in this regard on October 5 in State Bank Circle Karachi.

Syed Arif Masood Naqvi, PTI official Tariq Shafi and Muhammad Rafi Lakhani are named accused in the case.

Domestic and foreign companies involved in illegal transfer of funds have also been included in the FIR.

Imran, other PTI leaders booked in prohibited funding case
FIA Commercial Banking Circle registers the case in Islamabad

The Federal Investigation Agency (FIA) has booked Pakistan Tehreek-e-Insaf (PTI) leaders including its chairman Imran Khan, the party’s financial team and a manager of a private bank in a prohibited funding case.

According to Express News, the case was lodged by FIA Commercial Banking Circle Islamabad.

Besides Imran, PTI leaders Senator Saifullah Niazi, Sardar Tariq, Syed Younis, Aamir Kayani, Tariq Shafi and members of the party’s financial team and manager of a private bank have been nominated in the case.

FIA sources have confirmed the development, saying that the investigation into the case is underway.

According to a first information report (FIR), the former ruling party leaders have violated the Foreign Exchange Act and they were declared as the beneficiaries of suspicious bank accounts.

The FIA claimed that Abraaj Group also transferred $2.1 million to the bank accounts of the PTI.

According to the FIA sources, the PTI submitted Arif Naqvi’s “forged” affidavit to the Election Commission of Pakistan (ECP) in which the party claimed that all amounts collected by Wootton Cricket Ltd (WCL) were submitted into PTI’s account in Pakistan.

The affidavit turned out to be false as two more transactions were also made from WCL to two different accounts in Pakistan in May 2013, the FIA sources said.

It also accused the head of a private bank of assisting the PTI in concealing details.

The development came three days after the PTI challenged the FIA inquiry regarding the prohibited funding case in the Islamabad High Court (IHC).

In the petition, the PTI called for the FIA to be restrained from making arrests and conducting raids in connection with the case.

The party accused the FIA of "harassing" party leaders on a political basis, urging the court to restrain the agency from investigating the prohibited funding case.

The PTI maintained in its plea that the party raised funds to run an anti-government movement after the 'regime change'. All funds sent from abroad were received as per the law, argued the PTI.

"The FIA inquiry and raids are illegal and should be stopped immediately," the petition said, adding that the FIA raided PTI Senator Saifullah Nyazee's house and harassed him.

The FIA kicked off its probe against the PTI in August this year after the Election Commission of Pakistan (ECP) had declared in its verdict that the party had indeed received illegal funding.

The case had been filed by PTI founding but disgruntled member Akbar S Babar which had been pending since November 14, 2014.

The written order of the ECP stated that the political party had received illegal funds from foreign countries including the US, UAE, UK and Australia.

PTI leader Azam Swati ‘arrested’, says Babar Awan

PTI leader Babar Awan claimed on Thursday the former federal minister Azam Swati had been “arrested” by men who identified themselves as Federal Investigation Agency (FIA) personnel.

“Midnight jackals came to his house and identified themselves as FIA personnel,” he said while speaking to the media.

Awan said he was condemning the “arrest” on his, the nation’s and the PTI’s behalf.

Last week, the PTI had said that a number of its leaders — including Senator Saiful*lah Khan Nyazee, Hamid Zaman and Tariq Shafi — had been picked up by the Federal Inves*tigation Agency (FIA); a claim that the agency had initially denied.

Later, during a press conference, Interior Minister Rana Sanaullah had said that Saifullah Nyazee and Amir Zaman had been taken into “protective custody” for interrogation, adding they might be arrested after due diligence, if necessary.

He said that the two men had not been appearing in the prohibited funding case.

Meanwhile, PTI founding member Hamid Zaman’s arrest by the FIA in a connection with a prohibited funding case in Lahore was also confirmed.

According to the FIR lodged against him, both Hamid and Shafi are accused of being accomplices of Abraaj founder Arif Masood Naqvi.

The FIR alleged that Naqvi had “siphoned off Rs9.1bn from funds of Abraaj Group and its subsidiary companies abroad and funnelled to the Aman Foundation’s accounts through Foreign Telegraphic Transfers (FTTs) with unexplained money trail.”

The FIR lodged in Lahore also names Karachi-based Tariq Shafi, whose residence was also raided by FIA and during an hour-long search and seized, “different items” were seized. However, while the PTI claimed he had been arrested, the agency denied making any arrests.

A special court in Islamabad granted former prime minister and PTI Chairman Imran Khan interim bail till Oct 31 in a case registered against him and other party leaders by the Federal Investigation Agency (FIA) in connection with their party allegedly receiving prohibited funding.

Special Judge Raja Asif Mehmood heard the petition, which was filed earlier today. The court directed Imran to submit a bail bond of Rs100,000.

In the petition, a copy of which is available with Dawn.com, Imran stated that since his political rivals could not find any charge of corruption against him, the "investigating agency in questionable exercise and abuse of its powers has made hectic efforts to register false and fabricated case against the petitioner based on a serious allegation".

Last month, the Election Commission of Pakistan (ECP) had issued its verdict in the prohibited funding case — previously referred to as the foreign funding case — against the PTI, which stated that the party did indeed receive prohibited funding.

In the verdict, the commission noted that the party “knowingly and willfully” received funding from Wootton Cricket Limited, operated by business tycoon Arif Naqvi. The party was a “willing recipient” of prohibited money of $2,121,500, it said.

The ECP said that the party “knowingly and willfully” also received donations from Bristol Engineering Services (a UAE-based company), E-Planet Trustees (a Cayman Islands private registered company), SS Marketing Manchester (a UK-based private company), PTI USA LLC-6160 and PTI USA LLC-5975 which were “hit by prohibition and in violation of Pakistani laws”.

The PTI, however, claims that all money it received was actually donations from Pakistanis living abroad and did not fall under the premise of illegal funding.

Subsequently, the FIA registered a case naming Imran, Sardar Azhar Tariq Khan, Saifullah Khan Nyazee, Syed Yunus Ali Raza, Aamer Mehmood Kiani, Tariq Rahim Sheikh, Tariq Shafi, Faisal Maqbool Shaikh, Hamid Zaman and Manzoor Ahmad Chaudhary as signatories/beneficiaries of the PTI account in question.

The Islamabad High Court (IHC) had granted the PTI chairman protective bail in the case till October 18 (tomorrow). In the order, the IHC had said, "the petitioner may approach the court of learned special judge in order to avail remedies provided under the law."

In the petition filed today, Imran argued that "not a single penny was received or withdrawn by [him] in his 'personal bank account' and neither does the FIR disclose any 'personal gain'."

"Hence, no scheduled offence had been made out and the FIA, in sheer haste, has abused its authority. Such repeated nomination of the petitioner in various FIRs only reaffirms the inclination of 'state functionaries' towards exercise of authority in achieving undue and unlawful advantages."

The petition stated that the allegations in the FIR were based on assumptions and conclusions and criminal proceedings were started against Imran without any investigation. While the FIA had stated the transactions through the account were proceeds of crime, it had "nothing" to establish it, the petition said.

"Another prime aspect is the absence of any action, or conduction of enquiry, by the respondent (FIA), against Arif Masood Naqvi. Such ignorance and silence of respondents towards this alleged crime for a considerable time period of eight years, coupled with the registration of several FIRs, tantamount to malafide intentions."

The petition also stated that the party had filed an appeal against the ECP verdict in the IHC and the matter was sub-judice.

"The bare perusal of the FIR reveals that the petitioner (Imran) is absolutely innocent and has committed no criminal offence, hence qualifying the petitioner for bail until the matter is further probed."

During the hearing today, Imran's lawyer, Salman Safdar, informed the court that 10 people were nominated in the FIR. "The IHC has to determine the jurisdiction."

At this, the judge asked about the charges levelled in the FIR, observing that it would come under the court's jurisdiction if the matter was related to a government employee. "This court does not jurisdiction [in a case] related to a banker."

Judge Mehmood said he was granting interim bail on the "IHC's directions". He also instructed Imran's counsel to convince the court regarding jurisdiction at the next date of hearing.

The FIR over alleged false affidavits, lodged by the FIA in Islamabad, includes sections 420, 468, 471, 477-A, and 109 read with sections 5 and 23 of the Foreign Exchange Regu*la*tion Act 1947.

According to the FIR, the Abraaj owner transferred $2,121,500 of his "ill-gotten" money to a PTI account in the UBL. The signatories of the UBL account included Imran Khan, Saifullah Nyazee among other PTI leaders.

“The purpose stated in the swift messages of the transactions is ‘agreed transfer’ to disguise the true nature, origin, location, movement and ownership of these funds. Arif Masood Naqvi is also the founder/owner of Abraaj Group, UAE, which collapsed in 2018. Arif Masood Naqvi lied about the performance of Abraaj’s funds by inflating their value,” the complaint added.

“Therefore, Dubai Financial Services Authority (DFSA) imposed penalties on two Abraaj Group companies for carrying out un-authorised activities in Dubai International Financial Centre (DIFC) and misusing investors’ money. The regulator imposed penalties amounting to $299.30 million on Abraaj Investment Management Limited and Abraaj Capital respectively.

“PTI submitted an affidavit of Arif Masood Naqvi before the Election Commission of Pakistan stating therein that all the amounts collected in the accounts of WCL were submitted into PTI’s account in Pakistan. This affidavit has been proved to be false/forged as two more transactions were also made from WCL to two different accounts in Pakistan in May 2013.”

Earlier this month, two of the accused — Saifullah Khan Nyazee and Hamid Zaman — were taken into “protective custody” by the FIA.
 
TERRORISM CASE: ATC EXTENDS IMRAN KHAN’S INTERIM BAIL TILL NOV 9

ISLAMABAD: An anti-terrorism court (ATC) on Monday has extended interim bail of former prime minister and Pakistan Tehreek-e-Insaf (PTI) chairman Imran Khan in a terrorism case until November 9, ARY News reported.

As per details, the ATC judge Raja Jawad Abbas Hasan resumed the hearing. The PTI chairman’s counsel Babar Awan filed a plea in the court and asked for an exemption from personal appearance in the terrorism case.

The honourable court also extended the former prime minister’s interim bail till November 9.

Upon accepting Imran khan’s plea for personal exemption the court adjourned the case till November 9.

Earlier, an Anti-Terrorism Court (ATC) in Islamabad extended Pakistan Tehreek-e-Insaf leaders’ interim bail till November 7, violating the section 144 case.

While hearing the case the ATC judge Raja Jawad Abbas accepted PTI leaders’ plea for exemption from personal appearance.

Furthermore, the ATC while extending the interim bail of the PTI leaders adjourned the hearing of the case until November 7.

‘Violating Section 144’

The Islamabad police had filed a case against PTI chief Imran Khan and other party leaders for violating Section 144 during their rally in Islamabad held last month.

According to the first information report (FIR), the police had made announcements through loudspeakers that Section 144 was imposed in the city, however, the rally had continued. The party leaders had participated in the rally to protest PTI leader Shahbaz Gill’s arrest.
