Azam Swati gets pre-arrest bail in six May 9 cases

An anti-terrorism court (ATC) on Thursday granted pre-arrest bail to PTI leader Azam Swati in six cases of May 9 riots as he surrendered after almost a year long abscondence.

Swati, who recently secured a protective bail from the Peshawar High Court, appeared before the ATC along with his lawyer.

The counsel told the court that the petitioner wanted to join the police investigation to prove his innocence.

He asked the court to grant bail to the petitioner in six cases, including attack on Jinnah House, Askari Tower, offices of PML-N in Model Town and burning of police vehicles during the May 9 protests.

The court had previously declared Swati a proclaimed offender for his non-appearance in the cases.

Judge Arshad Javed allowed the bail petition and restrained the police from arresting the PTI leader till May 21.

Talking to the reporters, Swati said: “I condemn the May 9 incident.”

He said the former prime minister Imran Khan and his party were not involved in the violence. He said those who conspired for the May 9 riots damaged the country’s economy and dignity.

Swati claimed that no deal would be made.

“When a 76-year-old Swati is not making any deals, neither will the PTI founder,” he maintained.

The PTI leader emphasised that all institutions and their people were respectable.

May 9 ‘conspiracy’ hatched by Mohsin Naqvi, Punjab IGP: Asad Qaiser
“The nation has buried your narrative of May 9 on February,” the PTI leader said, calling for establishment of judicial commission to probe the incidents.

Speaking on the National Assembly (NA) floor, Asad Qaiser said that all four chief justices of provincial courts should be part of the judicial commission and probe the May 9 conspiracy, which according to him was hatched by Mohsin Naqvi and Punjab IGP.

He also questioned the incumbent government’s ‘double standards’ in allowing political parties for organising public gatherings, saying that Pakistan People’s Party (PPP) gets permission to hold rally but when PTI wants the same Section 144 is imposed.

“Holding public gatherings and rallies is our constitutional right,” Qaiser said, asking under which law PTI was not allowed to hold meetings. “You [the government] is answerable for sabotaging constitution and law.”

Asad Qaiser further said that cases were registered against PTI MNAs, including Barrister Gohar Ali Khan, over peaceful protests, while lawmakers from Sunni Ittehad Council (SIC) were arrested.

The PTI leader emphasised the need for a strong parliament and the rule of law in Pakistan. “We want a strong parliament, where the people’s representatives can work effectively,” he said, calling for an independent judiciary and civilian supremacy, which are essential for a “healthy democracy”.

Arrest warrants for 14 for skipping May 9 cases trial

An anti-terrorism court (ATC) on Friday issued bailable arrest warrants for 14 suspects, who are on bail, for skipping trial proceedings of two cases related to May 9 riots.

Judge Arshad Javed ordered the police to ensure the appearance of nine suspects in the Jinnah House attack case, and five others in Askari Tower case, on May 15.

The judge also ordered the suspects to furnish fresh bail bonds before appearing in the court.

The suspects include Attaur Rehman, Abdul Rehman, Ikramullah, Abdul Hadi, Amanullah, Ali Hassan, Shahbaz Siddique, Rubina Rizwan, Irfan Jamil, Saeed Shah, Mohsin Gull Agha and Muhammad Parvez.

BAIL: An ATC on Friday granted interim pre-arrest bail to the Pakistan Tehreek-i-Insaf former leaders Jamshed Iqbal Cheema and his wife Musarrat Iqbal Cheema in seven more cases pertaining to May 9 riots, and directed them to join the investigation.

Judge Arshad Javed allowed the bail petitions of the couple till May 21, subject to furnishing of surety bonds worth Rs100,000 each.

They had sought bail in the cases of attacks on Askari Tower, Shadman police station, party offices of the PML-N and others.

The couple had surrendered before the court in February as they had been declared proclaimed offenders in several cases of May 9 riots against them.

May 9 not just about army but entire Pakistan: DG ISPR Maj-Gen Ahmed Sharif

Inter-Services Public Relations (ISPR) Director General (DG) Maj-Gen Ahmed Sharif addressed a press conference in Rawalpindi on Tuesday.

The army spokesperson’s press conference came just two days before May 9 — a day that holds significant importance in the country’s political landscape as it was on this day last year when military installations came under attack following PTI founder Imran Khan’s arrest, which formed the basis of a severe state crackdown against him and his party.

In the question and answer sessions, Gen Sharif was asked about May 9, to which he said: “Firstly, May 9 is not just the Pak Army’s case but the entire country.

“If, in any country, an attack is launched on its army, symbols of its martyrs are insulted, its founder’s house is set on fire, hatred is created between its army and public, and if the people behind it are not brought to justice, then there is a question mark on that country’s justice system.

“We believe that if we have to maintain trust in the justice system of Pakistan, then May 9 perpetrators — both the doers and those commanding them — must be sentenced according to the Constitution and the law.

“Nothing is hidden about May 9. The public and the army and we all have irrefutable evidence. All of us saw this incident unfolding, we all saw how everyone was [brainwashed] against the army, its leadership, agencies, institutions through lies and propaganda.”

The army official said that on May 9, “some political leaders” issued orders to their supporters to selectively target military installations.

“When this became public, another lie and propaganda was created that this was a ‘false flag operation’ and ‘we do not know what happened or who did it’.

“For such people, it is said: ’you can fool all the people some of the times, some of the people all the times but you cannot fool all the people all the times.

“The question is: has this happened for the first time in the world? Incidents of lesser degree have been done in the past so what do other countries do?

“In August 2011, London riots took place, and after that the criminal court system came into action. They even punished children under the age of 18.

“In Capitol Hill riots […], there was no judicial commission. The people were identified and sentenced strictly. On June 27, 2023, Paris riots happened and their judicial system immediately came into action.

“I have given the examples that our elite does not get tired of quoting. [The punishments were given] so that such an incident was not repeated, so that such cliques, with incitement and specific political and poisonous aims, do not get the chance to attack the state whenever they want.”

Regarding the PTI’s demand that a judicial commission be created to ascertain the facts of the May 9 riots, the DG ISPR said: “Fine, we are ready, make a judicial commission but if you have to, then go to the root of this entire incident.

The judicial commission should also determine what the goals of the 2014 dharna (sit-in) were and how the Parliament was attacked. It should also look into the PTV attack that how people were encouraged to stand against the state, indulge in civil disobedience, burn utility bills.“

The Commission, the army spokesperson said, should also investigate “how Islamabad was attacked in 2016 with KP’s federal resources, and then again in 2022.”

“It must also see how letters were written to the IMF and lobbying was conducted abroad so that Pakistan would not be given loans and fall into a state of default.”

PTI reiterates demand to hold judicial probe into May 9 riots

Pakistan Tehreek-e-Insaf (PTI) Chairman Barrister Gohar Ali Khan on Tuesday reiterated its demand to hold a judicial inquiry into the May 9 violence ahead of the anniversary of the unprecedented violent protests that broke out in the country last year.

“Even today, we are demanding to form a judicial commission [to probe] the May 9 events,” he said while speaking to the media after meeting founding chairman Imran Khan in Rawalpindi's Adiala Jail.

Barrister Gohar said the PTI would hold rallies across the country to mark the May 9 anniversary. “We will hold peaceful protests on May 9 and the ticket holders will lead them.”

The May 9 events refer to violent protests triggered by the arrest of former prime minister Imran Khan in a corruption case from the premises of Islamabad High Court (IHC) last year.

During the protests, alleged PTI supporters damaged public and private properties and also attacked military installations in different parts of the country.

Speaking about the May 9 incident earlier today, Director General Inter-Services Public Relations (DG ISPR) Major General Ahmed Sharif Chaudhry said that the perpetrators and facilitators of the riots need to be punished as per the Constitution and law of the land to preserve the credibility and faith in the country’s justice system.

"The issue of May 9 riots is not limited to the Pakistan Army but [in fact] concerns the whole nation," the military's spokesperson said while addressing a press conference in Rawalpindi.

Speaking about his meeting with the party founder, Barrister Gohar said he held consultations with Khan on political and legal matters.

Referring to the Supreme Court’s order suspending the Peshawar High Court’s (PHC) ruling depriving the PTI of its reserved seats, Gohar said he provided guidance to the incarcerated party founder in the light of the verdict.

“We hope that our 78 snatched seats will be returned," he said referring to the February 8 general election.

He said US Ambassador to Pakistan Donald Blome had requested a meeting with PTI and added that the envoy was briefed on the alleged human rights violations in the country.

These clowns make no sense. On the one hand they tell us they aren't involved in politics and then do press conferences to defend their role in politics. The problem for them is that no one believes them. They did what years of propaganda could never do and that is to openly bring contempt from the people of PK. PK needs a strong professional army that defends its borders.

They were always involved and they will always be there when it comes to Pakistan politics. No one can deny the fact that they do not manipulate and sabotage the elections for their own benefit. incidents like 9 May were always something that would go down against them.

But today they look desperate- the respect has gone and they could only threaten and terrorise. Establishment will hold onto their privileges a little longer. NS and SS will also go into exile and the likes of Billo and Nani will also have to face the music for their role in the murder and torture of innocent people.

It is an irrelevant question. You can ask such “what if” questions for any historic event.

The reality is that PTI supporters have proved themselves to be the biggest cowards this country has ever seen.

They have been exposed as paper tigers who wilted under pressure. They had no problem hoarding the streets when they were backed & protected by the establishment, but as soon as the tide turned, they covered.

Imran has been let down by his cowardly supporters who have the heart of sparrows. Some of them are hiding in foreign countries and have restricted themselves to social media battles while others are hiding in their homes in Pakistan, worried for their lives.

Cowards cannot bring revolutions. If PTI supporters were to bring the French Revolution, they would have retreated after the first cannon fired by the French royal military and the monarchy would have prevailed.

It takes courage and guts to fight. It takes resilience. None of these traits can be found in PTI supporters.

PTI asks judiciary to expedite May 9 accused cases

The Pakistan Tehreek-e-Insaf (PTI) reiterated its demand on Monday to nullify military trials of civilians involved in the May 9, 2023 violence. The party urged the judiciary to expedite cases of individuals who have been detained for over a year.

Speaking to reporters, PTI spokesperson Raoof Hasan highlighted that despite the Supreme Court ruling declaring civilian trials in military courts unconstitutional, many young individuals remain unjustly detained, suffering under state oppression.

Hasan emphasized the urgency of the situation, noting that it has been over a month since the request to form a larger bench for appeals against the apex court ruling was made. However, the case remains unscheduled since the last hearing on April 24.

The spokesperson pointed out the immense suffering endured by the families of these victims due to inhumane conditions faced by those unlawfully imprisoned. He also highlighted the violation of fundamental human rights, particularly during the harsh summer conditions.

Hasan underscored that the Constitution prohibits the trial of civilians in military courts, especially by appointing defense ministry employees as judges. He asserted that in any civilized democratic society, civilian trials in military courts are nonexistent.

He condemned the practice of falsely accusing citizens and prolonging their military trials, labelling it a systematic attack on human rights. The Supreme Court, he urged, should immediately establish a larger bench to hear intra-court appeals against military court trials and proceed with these cases urgently.

The Supreme Court must ensure protection of both the Constitution and fundamental rights, and should order the release of those currently in military custody, the spokesperson added.

Meanwhile, the PTI spokesperson underscored the significance of May 28, commemorating Pakistan's successful nuclear tests as a testament to national determination, sacrifice, and unity. However, he criticised certain groups for exploiting Pakistan's peaceful nuclear programme for political gain.

Driven by the principles of maintaining a minimum defence capability and balancing regional power, he said, the nation made significant sacrifices to develop its nuclear programme. He lauded the dedication of Pakistani scientists who worked tirelessly, prioritising national security over personal interests.

“Public support and participation are crucial at every stage, from inception to completion,” he said. Given Pakistan's economic constraints and the need for defending against a significantly larger adversary, this effort is essential,” he stressed.

He condemned those who prioritise personal gain in politics, asserting that the nation had firmly opposed any reckless actions concerning the nuclear programme. He cited testimonies of key figures associated with the programme, including former Foreign Minister Gauhar Ayub Khan and Dr Abdul Qadeer Khan, who revealed how Nawaz Sharif's resolve wavered after the nuclear tests.

According to the spokesperson, the nation unequivocally demanded action, blocking any escape routes for Nawaz Sharif and insisting on the nuclear tests. He dismissed claims that those who enriched themselves by looting the national treasury were also responsible for the country's nuclear achievements, calling such assertions misleading.

The PTI representative warned that the current leadership, by mishandling the economy and disregarding the people's mandate, is exposing Pakistan's national security to serious threats. He urged the decision-makers to abandon official narratives and take serious, practical steps in light of the current delicate situation, emphasising the need for responsible governance and prudent actions.

Lahore ATC remands PTI’s Shah Mahmood Qureshi for 9 more days in May 9 cases

A Lahore anti-terrorism court (ATC) extended incarcerated PTI leader Shah Mehmood Qureshi’s physical remand by nine days in eight cases related to the violence that erupted in the country after party founder Imran Khan’s arrest on May 9 last year, it emerged on Tuesday.

Qureshi’s lawyer advocate Rana Mudassar told Dawn.com that the remand was granted on extension requests by the police for eight cases.

Countrywide protests erupted on May 9 last year after the paramilitary Rangers whisked away Imran from the Islamabad High Court in a corruption case.

While the protests were underway, social media was flooded with footage of rioting and vandalism at various spots, including the Lahore Corps Commander’s residence and General Headquarters, the army’s head of office in Rawalpindi.

Qureshi in December was implicated in at least 12 different cases registered by the Rawalpindi district police in connection with the May 9 violence. Qureshi was granted bail in 13 cases in February. He is currently serving his sentence in the Adiala Jail in the cipher case.

ATC Judge Khalid Arshad presided over the hearing on Monday. The court order dated May 27, a copy of which is available with Dawn.com, said Qureshi was produced via video link for the case on Friday when the court had initially granted police a three-day remand which lapsed on Sunday.

It added that the police requested an extension in Qureshi’s physical remand by 30 days in Monday’s hearing with the investigation officer (IO) saying that the USB containing “provoking speech” by the PTI leader was sent to the Punjab Forensic Science Agency while photogrammetry and voice matching tests were still pending.

He contended that the police required an extension to recover the mobile phone used by Qureshi to allegedly post inciting messages on X and other social media platforms.

Qureshi’s lawyer advocate Rana Mudassar opposed the request and said that the former foreign minister was falsely implicated in the case to delay his release from Adiala Jail.

He said that Qureshi was not present in Lahore on the day of the incident, and neither any video or USB was available to support the IO’s claims.

As per the court order, Qureshi himself asserted that he was implicated in the case after a year to “humiliate him” and that he was innocent in the matter.

According to the order, two prosecution witnesses had implicated Qureshi on May 12 last year in the planning, abetment and instigation of the incident’s occurrence.

The court order said the photogrammetry and voice matching tests were “essential to ascertain the credibility” of the evidence in the case and thus granted a further physical remand of nine days to the police, adding that the investigation must not be interrupted in the interest of justice.

The hearing was adjourned till June 5.

Court acquits Imran in two May 9 cases

A district and sessions court in Islamabad acquitted PTI founder Imran Khan on Thursday in two more May 9 cases.

Judicial Magistrate Umar Shabbir announced the reserved verdict citing the acquittal of the former premier on grounds of insufficient evidence.

Two cases were lodged against Imran in the Shahzad Town police station, following his arrest on May 9 from the Islamabad High Court (IHC) premises that sparked nation-wide protests including attacks on military installations.

PTI lawyers Mirza Asim Baig and Naeem Panjotha were representing Imran in these cases.

Baig stated that an unauthorized person registered an FIR against the PTI founder adding that Imran was accused of section 109 but no evidence could be provided in the cases.

On May 20, Imran was acquitted in another May 9 case registered at Khanna Police Station.

The judicial magistrate's verdict stated that, according to the FIR, the PTI founder incited others and was accused of playing a role in incitement.

However, the evidence on record was not sufficient to prove the allegations against him.

The court cannot proceed with the case against the PTI founder based on such evidence, it added. The verdict further stated that an accused cannot be deprived of their legal rights without a cause.

Considering the facts, the prosecution's story has become highly questionable. Proceeding with the case based on the current evidence would waste the court's valuable time, it added.

Almost the entire PTI leadership was booked under various charges after the violent protests that erupted on May 9, 2023, following the arrest of former prime minister Imran Khan from the premises of the IHC in a corruption case.

Lahore ATC to start jail trial in four May 9 cases next week

An anti-terrorism court (ATC) said on Saturday it will commence from next week the jail trial of four cases relating to torching police vehicles during the May 9 riots.

Judge Khalid Arshad made it clear that a jail trial does not mean there would be no justice.

The judge was hearing the cases when PTI social media activist Ayesha Ali Bhutto and former MNA Rubina appeared before the court. The judge issued bailable arrest warrants of those suspects who despite being on bail did not attend the hearing.

Incarcerated PTI leaders, including Senator Ijaz Chaudhry, Dr Yasmin Rashid, former governor Omar Sarfraz Cheema and former provincial minister Mian Mahmoodur Rashid, were not brought from jail to the court.

The defence lawyers expressed their concerns about the jail trial, however, the judge assured that a trial in jail doesn’t imply injustice.

“Decisions are made with fairness and justice,” Judge Khalid Arshad asserted.

He remarked that innocent people should not be afraid. He said the jail trials were safer in terms of security. He said the location doesn’t matter, trials can be conducted even in mosques and parks.

The judge ordered the prosecution to ensure the appearance of the suspects on the next hearing on June 6 in Kot Lakhpat jail.

WARRANTS: An anti-terrorism court on Saturday issued bailable arrest warrants for the investigating officers (IOs) and the SHOs concerned for not presenting record of May 9 cases in bail petitions of PTI leaders – Dr Yasmin Rashid and Senator Ijaz Chaudhry.

Judge Khalid Arshad directed a special prosecutor to ensure the appearance of the police officials along with the record of the cases on June 4.

The judge was hearing bail petitions of Dr Yasmin in five cases of May 9 riots, including Askari Tower. Senator Ijaz sought bail in eight cases, including attack on Jinnah House, Shadman police station and Askari Tower.

PTI founder’s bail pleas rejected in three May 9 cases

An Anti-Terrorism Court (ATC) on Tuesday rejected Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan’s bail pleas in three cases pertaining to May 9 riots including the attack on Jinnah House, ARY News reported.

The judge Khalid Arshad announced his verdict reserved on three separate bail pleas on July 6. The court had reserved the verdict after hearing the arguments from both sides, the prosecution and the defence.

Imran Khan had filed bail applications in the Jinnah House, Askari Tower and Shadman Police Station attacks cases.

The ATC ordered the PTI founder to attend the hearing via video link, but the attendance of the former prime minister could not be arranged.

The jail superintendent maintained that Imran Khan’s attendance via video link could not be arranged due to internet issues.

Earlier on May 30, the PTI founder was acquitted in two May 9 violence cases by the District and Sessions Court in Islamabad.

The District and Sessions Court heard the bail pleas, where Judicial Magistrate Omar Shahab announced the verdict on two May 9 cases registered at Shahzad Town Police Station.

The court acquitted the PTI founder in both cases due to insufficient evidence. Imran Khan’s counsel Mirza Asim Beg and Naeem Panjotha had completed their arguments on the bail pleas.

The FIR was registered by an unauthorized person and the PTI founder was charged under Section 109, but no evidence was presented, said the lawyer.

It is pertinent to mention here that the former prime minister has been behind bars since August 2023 and was later convicted in Toshakhana, Cipher, and cases Iddat.

Imran Khan’s convictions in the Toshakhana and Cipher cases have been suspended while he is still in prison in the Iddat case.

An anti-terrorism court (ATC) on Monday indicted Pakistan Tehreek-e-Insaf (PTI) leader Shah Mahmood Qureshi in May 9 riots case

The court had summoned the PTI leader, who was brought to Kot Lakhpat jail from Adiala jail under tight security, to initiate indictment proceedings against him.

The court has ordered to present witnesses in the next hearing, which is scheduled to take place on July 22.

Sources said that Shah Mehmood is booked in several May 9 riots cases in Lahore and police have interrogated the former foreign minister in jail.

Former foreign minister, currently behind bars at Rawalpindi’s Adiala jail, faces additional charges in eight new cases related to the May 9 violence.

These charges come on top of existing ones, and are linked to the violent clashes that swept across the country following the arrest of deposed Prime Minister Imran Khan in the £190 million settlement case.

Notably, a special court had previously sentenced Qureshi to 10 years in prison in the cipher case under the Official Secrets Act, but the Islamabad High Court (IHC) overturned this conviction in June.

The May 9 riots resulted in the arrest of hundreds of PTI workers and senior leaders for their alleged roles in violence and attacks on military installations.

Apparently the evidence against IK is a policeman that joined a PTI meeting and heard all the conspiracy. This is the pathetic level these idiots have stooped to. When are they going to have a judicial commission, where is the CCTV? How many Police and Soldiers died? Who benefited from the supposed insurgency?

Any leverage to May 9 perpetrators will further foment chaos, says ISPR DG

Inter-Services Public Relations Director General Lt Gen Ahmed Sharif Chaudhry on Monday addressed an important press conference.

The ISPR DG started his press conference by saying that the purpose of this communication was to clarify the army’s stance on some important matters, adding that organised propaganda was being amplified by certain quarters who spread false and concocted news against the armed forces in recent times.

He said it had become necessary to speak about these issues from time to time.

Briefing the media on the efforts of the security forces against rooting out terrorism, he said the security forces carried out 22,409 intelligence-based operations which resulted in elimination of 31 high-profile terrorists. He said 137 personnel embraced martyrdom during these operations.

He said the security forces were conducting 112 operations on a daily basis.

Responding to a question regarding ‘Operation Azm-i-Istehkam’, he said it was unlike previous opeartions. "No one is going to be displaced this time round," he added.

Elaborating on the Operation Azm-i-Istehkam, he said an announcement was made on June 22 last following a meeting headed by the prime minister in which all stakeholders were involved.

He said it was unanimously agreed in the meeting that the National Action Plan (NAP) of 2021 would be implemented in letter and spirit to cleanse Pakistan of terrorism.

He further said as many as 16,000 seminaries were registered and 50 percent were not registered yet, adding that no one knew who was running these.

He also touched upon the establishment of the anti-terrorism courts in Khyber Pakhtunkhwa and Balochistan for uprooting terrorism.

The army spokesman also lashed out at the "elements involved in illegal smuggling along the border of Afghanistan."

As for the May 9 perpetrators, Lt Gen Sharif said people who were responsible for attacking military installations were the ones stoking ‘digital terrorism’. He criticised those who were falsely labelling these ‘digital terrorists’ as heroes, saying "no one knows how this sort of terrorism is being spread."

“Any further leverage to the May 9 perpetrators will foment chaos. It has become necessary for us to take action against this kind of fascism,” he made it clear.

He blamed foreign terrorists and digital terrorists in the same breath.

Answering a question about the recent incident in Bannu, he said there were few armed men marching along with demonstrators in Bannu, adding that they were moving towards the Bannu Cantonment to attack security personnel, to which soldiers swiftly responded according to the standard operating procedures (SOP).

Imran Khan didn't confess to May 9 riots: PTI leaders

PTI leader Salman Akram Raja along with former National Assembly speaker Asad Qaiser have stated that PTI founder Imran Khan has made no admission regarding the May 9 events.

After meeting Imran Khan in Adiala Jail, Salman Akram Raja spoke to the media, saying that a unanimous decision was made at Zaman Park that protests would occur where necessary following the Rangers' action.

"We are ready to talk for the betterment of the country, we are ready to move forward. We do not want chaos in Pakistan; we want the country's economy to develop, and we want the people to be free from poverty and inflation. The environment being created in the country is leading to destruction.

"You cannot achieve the welfare of the state by distancing it from the people. It is essential to move forward with the public and their elected leadership. The PTI founder has stated that the news circulating about admission is completely baseless," said Salman Akram Raja.

Raja also condemned the events of May 9, calling for the punishment of those responsible. He claimed it was a premeditated plot and called for a judicial inquiry.

May 9 case: Aliya Hamza released from Gujranwala jail

In the May 9 riots case, Pakistan Tehreek-e-Insaf leader Aliya Hamza was released from Gujranwala Central Jail following the court’s order.

Her release orders were submitted earlier in the day and she left the jail with her family.

The Lahore High Court had barred law enforcement agencies from arresting Hamza in any case till August 29.

LHC's Justice Ali Baqar Najafi issued the ruling while hearing a petition filed by Hamza Jameel, Aliya Hamza's husband, who sought protective bail to prevent further arrests in cases she was unaware of.

"No agency will arrest Aliya Hamza without permission of the Lahore High Court," Justice Najafi declared.
