PML-N's Hamza Shehbaz has been elected the new chief minister of Punjab following a chaotic session at the provincial assembly that saw Deputy Speaker Sardar Dost Muhammad Mazari attacked and PML-Q leader Chaudhry Parvez Elahi injured.

Hamza garnered 197 votes to beat Elahi — his rival for the position, whose party PML-Q and PTI boycotted the election that began after more than five hours of delay and following a number of altercations and melees on the floor of the House throughout the day.

Announcing the results of the election, the deputy speaker said the day represented a "success of democracy" and lauded the "positive role" of the MPAs who took part in the voting despite today's events. , The session was scheduled to begin at 11:30am but got underway a little after 5pm, following which the deputy speaker ordered that the doors of the legislature be closed and commenced the proceedings for voting.

I heard nothing happens in Punjab especially Lahore without Hamza Shahbaz approval. Even a chaprasi can't get a job there without Hamza Shahbaz approving it. Thats how much power and approval the Sharifs wield

Btw do you think elahi really broke hsi hand? For a fracture the guy was able to move his arm easily and have a fractured casing in place quite quick. Oh and i mever knew oxygen is used when you get an arm fracture.

The only good thing about the Punjab elections were that 26 defectors would now be de-seated due to floor crossing and hopefully disqualified by SC.

After de-seating of these defectors PTI should submit resignations from Punjab assembly too. Together with defectors and resignations from both PTI and PMLQ hopefully there would be sufficient empty seats to dissolve this farce called Punjab Assembly.

The SC has let PK down by not deciding the Presidential reference. A month later we are still waiting for a decision, a decion that would havd avoided the chaos yesterday. If any says that the SC isnt a mafia laundry mat, they need a:facepalm::facepalm:
 
Punjab Governor Omar Sarfraz Cheema has “delayed” the oath-taking ceremony of Chief Minister-elect Hamza Shehbaz due to the ruckus that took place in the assembly a day earlier.

Cheema, in a press conference Sunday, condemned the violence that took place in the Punjab Assembly one day prior and said that such incidents set a very wrong precedent.

“I am a political worker and have fought elections. This a very wrong precedent being set,” said the governor.

It should be noted that during yesterday's session, 197 MPAs had cast their votes to elect Hamza Shehbaz as the chief minister.

The Punjab governor accused the CM elect of using “state power” on the polling day against his rival the PTI and PML-Q.

“I believe if Hamza Shehbaz had enough votes, then he should not have made the election controversial like this,” said Cheema.

The governor also questioned whether the elections for the Punjab chief minister were conducted as per the directives of the Lahore High Court and said that he had summoned a report from the secretary of the Punjab Assembly related to the ruckus and violence that took place during the session yesterday.

Cheema added that Deputy Speaker Dost Muhammad Mazari acted in a "partisan way".

The governor said that his office will write letters to the advocate-general of Punjab as well as the speaker related to the polls.

“Sitting in a constitutional office, I cannot endorse an unconstitutional act. I will start these [oath-taking proceedings] once I am satisfied that these elections were conducted according to the Constitution and LHC’s order,” said the governor.

'PM has no right to remove me'
While the governor was holding the press conference, reports started circulating that he has been removed from office by the federal government.

Sources had told Geo News that Prime Minister Shehbaz Sharif had sent a summary to President Arif Alvi for the removal of Governor Cheema. The summary was moved under the discretionary powers given to the premier.

The news was also confirmed by PML-N spokesperson Marriyum Aurangzeb.

When Governor Cheema was asked to confirm the story, he said that PM Shehbaz Sharif has "no right to remove him from office."

“PM has no right to remove me, he sends a summary to the president. I am holding this office with the pleasure of the president and until the president does not notify this, I will continue to hold this office,” said Governor Cheema.

LAHORE: The ruling PML-N has decided to move the Lahore High Court against Punjab Governor Omer Sarfaraz Cheema's refusal to administer oath to the newly elected Chief Minister Hamza Shehbaz, The News reported Tuesday.

The publication stated, citing sources, that the decision was made at the party's core committee meeting where senior party leaders discussed the matter with constitutional experts.

Sources said that the meeting agreed that declining oath to a CM-elect was contempt of court as well as a constitutional violation.

'PML-Q tried to kill deputy speaker'

Meanwhile, PML-N leaders Attaullah Tarar, Owais Leghari and Malik Muhammad Ahmad Khan said during a press conference that the PML-Q MPAs tried to torture Punjab Assembly Deputy Speaker Dost Muhammad Mazari during the ruckus on the day of the chief minister's election.

They said the assembly security staff recruited from Gujrat and Mandi Bahauddin by Parvez Elahi in black uniform was clearly seen torturing other assembly members.

They said that Cheema and PTI Chairman Imran Khan had violated the Constitution.

“Omer Sarfraz Cheema, you have time till night. Action will also be taken against you,” Tarar said, claiming that the no-confidence motion against Punjab Assembly Speaker Pervaiz Elahi would get 210 votes.

He said a new video had emerged about the events in the Punjab Assembly.

“I challenge you, if there is any video of our torture, bring it out [...] Monis Elahi has caused irreparable damage to the PML-Q,” he said.

Tarar claimed that Parvez had initiated violence against the deputy speaker under his supervision. He said that our member Amjad Farooq was pressured by the police to leave the party while assembly employees were also involved in the attack.

“Parvez Elahi is trying to create some kind of crisis by using his position of speaker. For God's sake, go home and accept defeat,” Leghari said, adding that Article 6 should be applied on them and action would be taken against Assembly officers involved in violence.

There is no executive in the province and no one is able to order bureaucracy, he said, adding that no one has the right to take the province away from the true rulers and this right should be given to the PML-N’s chief minister.

He said that the farmer was not able to sell his grain because there was no one to watch over the system.

“We are peaceful people, we have exercised restraint despite violence but they are bent upon ending this democratic system.”

He said the punishment was mandatory for violating the Constitution
 
LAHORE: The oath-taking of the newly elected chief minister of Punjab, PML-N's Hamza Shahbaz has been postponed for the second time despite all preparations, The News reported Sunday.

Everything was done and dusted and Hamza was expected to be sworn in as Punjab CM with Senate Chairman Sadiq Sanjarani administering the oath to him in a ceremony at Governor House, Lahore on Saturday night. However, the ceremony had to be deferred once again as the Senate chairman couldn't reach Lahore.

Emergency measures had been taken for the ceremony as per the orders of Lahore High Court. Sources within the Governor House said that all the preparations for the oath-taking had been made after receiving verbal instructions from the President' Office but no written order had been received.

After the cancellation of the ceremony, the PML-N has decided to approach the court again.

Meanwhile, PML-N Deputy General Secretary Ataullah Tarar said that Punjab Governor Omar Sarfraz Cheema would be remembered in history as a violator of the Constitution.

"It has been decided to file a contempt of court petition against him," he added.

The statement came during a press conference flanked by Owais Leghari, Malik Ahmed Khan, Rana Mashood Ahmed, Khalil Tahir Sindhu and Khawaja Imran Nazir at the party's central secretariat.

Tarar said that the largest province in terms of the population had been without a chief minister and cabinet since April 1, 2022.

"If the Constitution is violated, a civilised citizen has no choice but to go to court," he said, adding the LHC in its judgment had ordered that the oath-taking could not be delayed.

"Omar Sarfraz Cheema has disrespected the post of governor. He has been admitted to the hospital. The order of the LHC had been received by the President of Pakistan at 6pm on Friday but despite the passage of the whole day, the President continued to consider it,” he maintained.

Owais Leghari said that the president was bound by the advice of the prime minister.

“Now President Alvi has written a letter to the Prime Minister's Office asking what we should do in the light of the decision of the LHC.”

He said that everything was stopped for the sake of one person.

Hamza moved the LHC for the third time on Friday as his oath-taking ceremony was deferred on several grounds despite him being elected with a clear majority of 197 votes from the Punjab Assembly on April 16.

Moreover, just hours before the oath-taking ceremony, Punjab Governor Omar Sarfaraz Cheema, in a surprise move, "rejected" the resignation of Usman Buzdar saying Constitutional requirements were not fulfilled.

Hamza drove himself to the Governor House, while PML-N Vice President Maryam Nawaz also accompanied the CM-elect.

PTI petitioners claim LHC single bench decision 'beyond facts', violation of Constitution

The Pakistan Tehreek-e-Insaf (PTI) challenged on Saturday the Lahore High Court (LHC) single bench’s decision directing the National Assembly speaker to administer oath to Punjab chief minister-elect Hamza Shahbaz Sharif.

The party deemed the decision "beyond the facts of the case" and a "violation of several articles of the Constitution".

A day earlier, LHC’s Justice Jawad Hassan directed the speaker to administer oath to Hamza Shehbaz Sharif at 11:30am today to put an end to the crisis in Punjab. The province had been functioning without a cabinet since the resignation of former Punjab chief minister Usman Buzdar last month.

However, the PTI filed an intra court appeal that led to the LHC constituting a division bench comprising Justice Sajid Mehmood Sethi and Justice Tariq Saleem Sheikh.

Read Hamza nowhere near taking oath as CM

At least 17 petitioners, including PTI MPA Muhammad Subtain Khan, filed the appeal in the LHC though their advocate, Azhar Siddique.

The petitioners contended that "the high court’s single bench in the absence of any pleadings by any single party to be arrayed as respondents in the writ petition, on the very first day, has reserved judgement".

The PTI appellants stated that such conduct was unprecedented and in sheer deviation from the Constitution.

“These proceedings have created havoc and turmoil,” they argued as a third writ petition was filed on the same cause of action - which has already been decided upon twice in earlier writ petitions.

The petitioners argued that the judicial proceedings of the single bench comprised “rude remarks against constitutional officers such as the Governor of Punjab and the President of Pakistan in the reserved judgment.”

“The haste and the procedure manifest an absence of justice,” they maintained, adding that the matter must be heard by a larger bench comprising not less than seven judges.

The appellants stated that the impugned order passed by the single bench was not “based on facts” and claimed it was in violation of Articles 48, 87, 133, 187, 190, 204, 248 and 255 of the Constitution.

"Article 248 of the Constitution provides protection to the president, provincial governors, the prime minister, federal ministers, ministers of state, chief ministers and provincial ministers. It states that the aforementioned shall not be answerable to any court for the exercise of powers and performance of functions of their respective offices or for any act done or purported to be done in the exercise of those powers and performance of those functions," the petition maintained.

Earlier, LHC’s Chief Justice Muhammad Ameer Bhatti had passed two orders. Initially, the President of Pakistan Dr Arif Alvi had been directed to nominate someone to administer the oath to CM-elect Hamza Shahbaz.

After the president failed to comply, CJ Bhatti advised the Governor of Punjab Omar Sarfaraz Cheema to ensure administration of the oath, but no constitutional obligation was rendered.

Upon the governor’s failure to ensure his oath administration, Hamza requested the court to “nominate any person” for the oath-taking at the Governor House, "as the coercive arm of the state be set in motion for the implementation of court orders".

ISLAMABAD: Hours after PML-N leader Hamza Shahbaz was sworn in as the chief minister of Punjab, capping a long drawn legal and political battle, PTI leader Fawad Chaudhry called for immediate termination of the oath, urging the Chief Justice of Pakistan to step the constitutional crisis before it deepens further.

The oath came as Punjab remained deadlocked for weeks over the chief minister’s election controversy which mushroomed into a constitutional crisis and left the political heartland in limbo and with no effective government.

However, it seemed the political actors were in no mood to concede and stop pressing for their competing courses of action to the limit.

“I strongly condemn the illegal occupation of Governor House Lahore. In this regard, the provincial administration has clearly violated the Constitution and the law,” Fawad said in a tweet while demanding immediate termination of the oath.

The former information minister urged the Chief Justice of Pakistan (CJP) to step in and take notice of the constitutional crisis in Punjab, adding the matter pertaining to the “illegal oath” should be adjudicated upon after listening to all parties.

“A person who managed to secure an interim bail went on to take over the grounds of the Governor House to take oath in a private ceremony and began referring to himself as the chief minister. Who will accept this act?” he asked.

On the other hand, reacting to the criticism, Federal Minister for Information Marriyum Aurangzeb said the hue and cry will not alter the fact that Hamza Shehbaz has finally taken over as the chief minister.

“Alhamdulillah, prison doors will be opened for only those who resorted to hooliganism against the Constitution, parliament and courts,” she said adding that they made a mockery of law and the Constitution.

She said it was possible to listen to a party but "not thugs and violators of the Constitution".

Meanwhile, as the oath-taking ceremony went on in the Governor House, Governor Cheema urged the chief justice to take notice of the "ghunda gardi" at the Governor House, saying the "drama of a fake chief minister's oath" was being performed in an "unconstitutional" manner.

In its appeal, the former ruling party deemed the decision "beyond the facts of the case" and a "violation of several articles of the Constitution".

The division bench, headed by Justice Muhammad Sajid Mehmood Sethi and comprising Justice Tariq Saleem Sheikh, heard the intra-court appeal against its decision.

The observation read: "Although while passing the judgment this court has enunciated the principles of law having binding effect under Article 201 of the Constitution which have been disregarded not only by the president of Pakistan but also by the Punjab governor, causing nonfulfillment of his constitutional duty thereby violating Article 5 read with article 189 and 201 of the Constitution.”

The matter will be taken up after Eid holidays. However, the bench admitting the plea issued notices to the respondents.
As the proceedings commenced, the appellant’s counsel was asked how this appeal was maintainable under the law when impugned judgment had already been implemented.

PTI’s counsel Azhar Siddique argued that if this bench came to the conclusion that the judgment was nullity in the eye of law, any superstructure built thereon would automatically fall to the ground and would be of no legal effect.

He argued that neither President Dr Arif Alvi nor Punjab Governor Omar Sarfaraz Cheema were included as respondents in the constitutional petition, nor any notice of hearing was issued enabling them to controvert the contentions raised there, but despite that adverse remarks had been passed against them, which were liable to be expunged.

He submitted that important legal and constitutional questions raised by learned counsel for appellants over maintainability of constitutional petition had neither been noted nor repelled with reasons in the impugned judgment.

"Since interpretation of various constitutional provisions was involved, notice in terms of Order XXVII-A of CPC was required to be issued to learned attorney general for Pakistan and advocate general of Punjab, but the mandatory provisions of law were not complied with and learned single judge passed the impugned judgment without due process guaranteed under articles 4 and 10-A of the Constitution of the Islamic Republic of Pakistan, 1973," Azhar added.

He argued that the high court had no authority to nominate any specific person, including the speaker of the National Assembly, for administration of oath to the newly elected Punjab chief minister, thus the impugned judgment, being in violation of various provisions of the Constitution as well as applicable law, was unsustainable.

Earlier, the LHC CJ had passed orders twice. The first was to President Alvi to nominate anyone for administering the oath to Hamza but the order was in vain. The second time, the LHC chief justice had advised the Punjab governor to ensure the swearing-in of Hamza, but the constitutional obligation was not followed.

The PML-N leader for the third time knocked the LHC doors over not being administered his oath. LAHORE: A day after urging Chief of Army Staff (COAS) General Qamar Javed Bajwa to play his "role" in the implementation of the Constitutional framework in Punjab, Governor Omar Sarfaraz Cheema Thursday said that he will arrest CM Hamza Shehbaz Sharif if provided “a subedar and four soldiers”.

In a statement on Twitter, Omar Sarafarz Cheema said that the crisis-hit province has been taken hostage by force.

The PTI loyalist said that the silence of mainstream political parties on the constitutional crisis in Punjab is "extremely worrying" and added that Awab Alvi, President Arif Alvi's son, will be the next chief minister of Sindh if such practices become the culture of our politics.

Refusing to administer the oath to Hamza Shehbaz, he also earned the ire of the Lahore High Court which later ordered National Assembly Speaker Raja Pervaiz Ashraf to do the job.

Governor appeals COAS to play his 'role'
A day earlier, Omar Sarfaraz Cheema had penned a letter to COAS Qamar Javed Bajwa urging him to play his due role in the implementation of the constitutional framework in the province.

He had appealed to the army chief to play his role to restore people’s confidence in provincial and federal governments.

He also sent copies of his letter to the prime minister and the president.

Earlier, Omar Sarfaraz Cheema had written a letter to Prime Minister Shehbaz Sharif about the political and constitutional crisis in the province.

In the letter, the Punjab governor vowed to protect the country’s Constitution by utilising all of his skills and abilities.

“No power can bar me from stopping your son's unconstitutional actions,” the governor had told the PM.

Declaring Usman Buzdar’s resignation as controversial, Cheema had accused the PML-N of securing the support of PTI’s dissident lawmakers and added that the turncoats were even presented before the media.

“Hamza Shahbaz has taken advantage of being the son of the prime minister.”

The governor had said that the Punjab Assembly secretary had apprised him about the violations of laws relating to the “fraud election” for the post of the chief minister.

“You, as prime minister, dragged the country towards political crisis by using your powers unconstitutionally,” Cheema had stated.

“You, your son and Maryam Nawaz are nominated in criminal cases”, the governor had said, adding that it is the country’s "bad luck" that the PM and Punjab CM were on key posts despite being on bails.

Governor Punjab announces sending reference against LHC Judge Jawad Hassan

LAHORE: Punjab Governor Omar Sarfraz Cheema has announced to send a reference against Lahore High Court’s (LHC) Justice Jawad Hassan to the Supreme Judicial Council (SJC) for what he called an “illegal decision” of directing the National Assembly speaker to administer the oath to Chief Minister-elect Hamza Shehbaz.

Addressing a press conference in Lahore, Cheema said he had decided to take legal action against the judge after consultations with professionals over the last two days.

Last month, Justice Hassan had issued a nine-page verdict after Hamza approached the high court for the third time, ending a days-long deadlock over the chief minister’s office in Punjab. Hamza was elected as Punjab’s chief minister on April 16.

After the court decision, Hamza was administered the oath by NA Speaker Raja Pervaiz Ashraf on April 30.

In his press conference today, Cheema termed the LHC judge’s verdict “illegal”, saying that according to the honeycomb principle, no institution could “interfere” in the working of another institution.

There was no provision in the Constitution that stated that anyone besides the president or the governor could issue a notification regarding the new chief minister, he added.

The governor also shared that he had requested meetings with the president and the army chief to discuss the situation in the province.

He also advised Prime Minister Shehbaz Sharif to make his son, Hamza, aware of how to contest the election for the chief minister in a constitutional way, stressing that he would administer the oath himself if Hamza did that.

The SJC is a specialized forum created under Article 209 of the Constitution specifically for determining complaints of misconduct received against judges.

Earlier in the day, Cheema claimed that if Chief of Army Staff Gen Qamar Javed Bajwa provided him with one subedar and four jawans, he would arrest recently sworn-in Chief Minister Hamza, who he termed “illegal, unconstitutional and counterfeit”, and throw him in jail.

In a series of early morning tweets, he said that the province, which was facing a constitutional and legal crisis, had been “taken hostage by force” and termed the political parties’ silence “very concerning”.

If everyone had accepted the Hamza Shehbaz “formula” for becoming the chief minister in Punjab, the other provinces should start worrying for themselves, he added.

LAHORE: PPP — the key party of the ruling alliance — has prepared a power-sharing formula for a collation government in Punjab.

As per the new power-sharing formula, the PPP will seek four ministries and the chairmanship of the Senate. However, it has been decided in principle to give the post of governor to PML-N in the province, Daily Jang reported Saturday.

Sources privy to the matter said that a PPP delegation will meet Punjab Chief Minister Hamza Shahbaz today and will place the proposals before him.

A day earlier, National Assembly Speaker Raja Pervaiz Ashraf, Makhdoom Ahmed Mehmood, Makhdoomzada Hassan Mehmood, Qamar Zaman Kaira, Hassan Murtaza met PPP Senior Vice-Chairman and former prime minister Yousaf Raza Gillani over dinner and discussed the power-sharing formula.

The party sources said that Hassan Murtaza’s name was finalised for the slot of ‘senior minister’ while Ali Haider Gillani, Mumtaz Chang and Syed Usman Mehmood will be inducted into the provincial cabinet as ministers.

However, former prime minister Yousaf Raza Gillani’s name has been finalised for the slot of Senate chairman.

Hamza Shehbaz took the oath of the office last Saturday after much delay and has been working without the cabinet.

Punjab Chief Minister Hamza Shehbaz on Saturday said "free and fair elections" were the only solution to the political crisis in the country, as he expressed confidence that the PML-N was prepared to face PTI chairman Imran Khan in the political battleground.

At a media talk in Faisalabad, he said that Pakistan was presently facing several challenges when it came to the economy and governance. "In the last four years, they (the PTI) did nothing but lie. Imran Khan never fulfilled his promise of a 'naya Pakistan' and instead destroyed the old one."

So now, Hamza continued, the governments — both federal and provincial — have begun the journey to revive the old Pakistan where "the growth rate was 5.8 per cent, labourers were paid on time, and essential food items were available".

"We will work with our allies and take steps that will be beneficial for the public," he vowed. "And I believe that in the upcoming period, whenever economic reforms are completed, free and fair elections are the only solution to the crisis in the country.

"I am hopeful that despite all these challenges, God will pave a path and God-willing, we will make this country Quaid-e-Azam's Pakistan," he said, adding that the PML-N was prepared to face Imran in the political battleground.

But some people, Hamza went on to refer to the former prime minister, want to start a "civil war" in the country.

"I have always said that Imran Khan is a man who is wearing a suicide vest to damage the Constitution of Pakistan and trample the law," he said, citing examples of the ruling of the National Assembly deputy speaker on the no-trust motion and the Punjab CM elections.

"Unlike Imran, we don't believe in the politics of revenge, but we won't forgive Imran for making people wait in queues for sugar, wheat and medicines. We will reveal how he raided the pockets of the people and make him pay for it," Hamza added.

Also i dont know if you heard but they are saying the court will give a verdict on the turncoats by Thursday this week allegedly and if they are all disqualified, the president will ask Hamza to go for a confidence motion again. And we know he cant win that. Rumours that he wont last beyond May but i think he will carry on for now..I also hear he is not very bright and many a civil servant despairs at this dudoo and his finger wagging..

Omar Sarfraz Cheema warns of 2007-like movement against ouster

ISLAMABAD: Former Punjab Governor Omar Sarfraz Cheema threatened the government on Wednesday that a 2007-like “save judiciary movement” could be launched against his “illegal removal” from office earlier this week.

Addressing a press conference on Wednesday, Mr Cheema described the present rulers as a “Sicilian Mafia” and said they should not be allowed to appoint the next army chief.

“In case no solution is proposed to end the prevailing crisis in Punjab, we will go for a protest campaign like 2007 when the whole nation had taken to the streets,” he said.

“I am consulting different groups, including the lawyers’ community, media and civil society, to launch a similar movement under which former chief justice Iftikhar Chaudhry was restored in 2007,” he added.

Mr Cheema said he would not sit idle like former chief minister Usman Buzdar and would resist all attempts to remove him.

Earlier this week, the federal government, in a late-night announcement, notified that Mr Cheema had ceased to hold office as the Punjab governor on the advice of the prime minister sent to the president on April 17 and reinforced on May 1.

President Dr Arif Alvi earlier rejected Prime Minister Sharif’s advice to remove Mr Cheema.

In his presser on Wednesday, Mr Cheema claimed that he was still the Punjab governor and thanked President Alvi for continuously supporting him.

“Though my security, vehicles and other facilities have been withdrawn, I am still the governor and want to clarify that I will not quit as [former] CM Punjab Usman Buzdar did,” he added.

Soon after the cabinet division’s notification in the wee hours of Tuesday, security and official vehicles of Mr Cheema were withdrawn and he was barred from entering Governor House.

He said he had been writing letters to the quarters concerned for the last 37 days, informing the nation that Pakistan Muslim League-Nawaz (PML-N) government in the centre had thrown the country’s biggest province into crisis.

He even claimed that Pakistan Tehreek-i-Insaf (PTI) leader Usman Buzdar was still chief minister of the province as his resignation was accepted “unconstitutionally”.

“Former governor Punjab Chaudhry Sarwar had accepted his resignation in haste because the governor had already joined the PML-N’s camp,” he said.

The acceptance of Mr Buzdar’s resignation by Mr Sarwar was challenged in the Lahore High Court (LHC) on April 20, but the court rejected the petition. “Punjab has two chief ministers these days,” Mr Cheema claimed.

Mr Cheema said PML-N lawyers had misled the court over the issue of oath-taking of incumbent Chief Minister Punjab Hamza Shehbaz and urged bar councils to act against these lawyers.

He said after his security was withdrawn, he asked Interior Minister Rana Sanaullah for security guards of Rangers or Frontier Constabulary, but his request was turned down.

Mr Sanaullah “is not performing like the country’s interior minister and is rather behaving like a PML-N worker,” Mr Cheema said.

The provincial government restrained Advocate General Punjab Ahmad Awais from representing the government in the courts a day prior to the hearing on the appeals against Chief Minister Punjab Hamza Shehbaz Sharif’s oath-taking by a larger bench.

The Lahore High Court (LHC) bench will take up the three intra-court appeals filed by the Pakistan Tehreek-e-Insaf (PTI) over the oath administered to Hamza on the orders of the LHC.

It may be mentioned that Awais was stopped from appearing in the court on behalf of the government but he did not pay heed to the instruction. Subsequently, the government issued a letter, telling him, “You are directed not to appear in any court on behalf of the provincial government.”

Meanwhile, Additional Advocate General Jawad Yaqoob has been asked to take charge of the AG office and conduct the routine business till the new appointment of the new top lawyer.

It may be noted here that a summary seeking the removal of Awais from the AG office was sent to the governor by CM Hamza last week. It had asked the governor to sack Awais.

Larger bench

Lahore High Court (LHC) Chief Justice Muhammad Ameer Bhatti has constituted a larger bench to hear an appeal against an order by the same court that had directed the National Assembly speaker to administer the oath to Chief Minister Hamza Shehbaz.

The bench comprises Justice Sadaqat Ali Khan, Justice Shahid Jamil Khan, Justice Shehram Sarwar, Justice Sajid Mehmood Sethi and Justice Tariq Saleem Sheikh.

The decision to form a five-member bench was taken in response to a petition by the PTI lawmakers that had requested the high court to set aside Justice Jawad Hassan’s verdict for being “illegal as well as beyond the facts of the case”.

The plea had also asked to expunge the “rude remarks” passed by Justice Jawad against the constitutional officers such as the governor of Punjab and the president of Pakistan in his judgement.

The other two appeals are against Chief Justice Muhammad Ameer Bhatti’s decision wherein he had first ordered the president of Pakistan to nominate anyone to administer an oath to Hamza Shehbaz and in the second instance, he had advised the governor to ensure the administration of the oath.

'Resign, majority lost,' PTI leaders tell PM Shebaz, Punjab CM Hamza after SC verdict

  • SC says dissident members cannot vote.

The PTI — which was removed from power last month through a vote of no-confidence — rejoiced the Supreme Court's verdict on Article 63(A) and demanded Prime Minister Shehbaz Sharif and Chief Minister Punjab Hamza Shabaz resign from office.

The PTI had, before the no-confidence motion, said that the defected members of the parliament should not be allowed to vote and called for unseating them.

In a 3:2 split decision, three judges — Chief Justice of Pakistan Umar Ata Bandial, Justice Ijazul Ahsan, and Justice Munib Akhtar — agreed that dissident members' votes should not be counted. But Justice Jamal Mandokhail and Justice Mazhar Alam Khan Miankhel disagreed with the verdict.

'This is Imran Khan's win'
Responding to the verdict, former information minister and PTI leader Fawad Chaudhry said PM Shehbaz Sharif and Punjab CM Hamza Shahbaz have "lost the majority".

The PTI leader, in a press conference, said the PML-N has already lost three out of 173 votes, while if President Arif Alvi summons a session for a vote of confidence, then the prime minister will have 169 votes. Similarly, according to Chaudhry, Hamza also has fewer votes than required.

"As a result of this decision, the governments of both — Shehbaz Sharif and Hamza Shahbaz — have come to an end," the ex-information and law minister said, asking them to resign.

He then urged President Alvi to dissolve the National Assembly and Punjab Assembly as heading towards new elections was the "only way for Pakistan to achieve stability."

"This is Imran Khan's win. It has been confirmed that these people [dissidents] votes will not be counted and they have been disqualified," the PTI leader added.

'Lotay farigh'
Former federal minister and PTI Secretary-General Asad Umar congratulated the people of Pakistan and said: "Lotay farigh (turncoats have been defeated)."


The PTI leader, in a tweet, asked the government to resign immediately as it did not "have the right" to rule the country for another day.

'PML-N comes to an end'
While addressing PTI's jalsa in Kohat, Senator Faisal Javed said after the Supreme Court's interpretation, the "PML-N has come to an end".

Hamza is no more the chief minister, Javed said, adding that after Punjab, the incumbent government in the Centre would also fall.

'Immediate elections'
In a tweet, former foreign minister and PTI Vice Chairman Shah Mahmood Qureshi welcomed the Supreme Court's decision, noting that it would help curb horse-trading in the future.

"From today onwards, there is no standing of the incumbent Punjab government," the PTI leader said.


He added: "The imported federal government, which came to power through a foreign conspiracy with the help of a curse like floor-crossing, should also announce immediate elections."

Article 63(A)
Article 63(A) of the Constitution of Pakistan deals with the defection of parliamentarians.

According to the article, a lawmaker can be disqualified on the grounds of defection if they vote or abstain from voting in the House contrary to any direction issued by the parliamentary party to which they belong.

However, this is restricted to three instances where they have to follow the party’s directions:

Election of the prime minister or chief minister;
Vote of confidence or a vote of no-confidence;
Money bill or a Constitution (amendment) bill.
Per the article, the head of the party is required to present a written declaration that the MNA concerned has defected.

However, prior to presenting the declaration, the head of the party will have to give the MNA concerned a chance to explain the reasons for defection.

Following that, the party chief will then forward the written declaration to the speaker, who would, in turn, hand it over to the chief election commissioner (CEC).

The CEC will have 30 days at their disposal to confirm the declaration. Once confirmed, the MNA concerned will no longer be a member of the House and their “seat shall become vacant".

PTI leader and former information minister Fawad Chaudhry on Wednesday said the Pakistan Tehreek-i-Insaf had decided to challenge the election of Hamza Shehbaz as the Punjab chief minister in the Lahore High Court (LHC), accusing him of occupying the top provincial office "illegally".

Talking to media in Lahore, Fawad said a quo-warranto petition (a plea questioning the authority of a public office holder) will be filed with the LHC on Thursday "and the court will be requested to remove Hamza as the provincial chief executive and order election on the coveted seat at the earliest".

The PTI leader urged the court to take up the petition and conduct its hearing on a day-to-day basis, saying "we all know that courts are open 24 hours."

The ex-minister said the speaker of the Punjab Assembly could have issued a notification, but the party decided to adopt a legal way to contest its case.

"Instead of an administrative action, we decided to approach the court and request it to sack the illegal chief minister."

He reiterated the PTI's demand to the government to hold early elections, insisting that it was the only solution to the current political crisis.

Fawad said the president could also ask Prime Minister Shehbaz Sharif to hold a session on the no-trust motion, as the federal government also now allegedly lacked the 172 votes required in the lower house of the parliament to form or retain the government.

The PTI leader was of the view that the country was suffering after Imran was sent packing under an "international wish", leaving the national economy reeling, with the dollar reaching the Rs200 mark.

"Whoever is elected the next chief minister will have to move towards the dissolution of the assembly," he said.

In response to a question, Fawad said he was not sure whether the establishment was pressing the government to hold early elections. "But any patriotic Pakistani can feel the damage the country is suffering, and immediate elections are the only solution".

He also said the government must hold elections preferably in September.

Meanwhile, PML-N leader Ataullah Tarar dismissed the debate regarding the Punjab government's purportedly impending departure as "baseless rumours". "Those making such claims will have to prove everything," he added.

He quoted the PTI lawyer as telling the ECP during a hearing that the party had asked its legislators in a meeting on April 1 to vote for Pervez Elahi. "In response, our lawyer asked for the written affidavit from Imran that the meeting in question actually took place."

Tarar said the meeting record could have been verified from CCTV footage, but said no such evidence was available.

He said the PTI later retracted its statement and instead said it was a parliamentary meeting wherein such directions were issued.

"The case is open and shut and we are not worried about it," Tarar said as he insisted the current Punjab government will continue as it was in "majority".

Hamza Shehbaz's troubles far from over after defection verdict

LAHORE: As Pakistan Peoples Party (PPP) provincial lawmakers met beleaguered Punjab Chief Minister Hamza Shehbaz on Wednesday to form a joint strategy in the wake of the Supreme Court verdict on defecting lawmakers, the Pakistan Tehreek-i-Insaf (PTI) announced moving the court to oust the provincial chief executive.

The PTI has also hinted at accepting the offer of the PML-N-led government in the Centre to hold talks on electoral reforms, but only after the date for next elections is announced. The party also met the PML-Q leaders to devise their own joint strategy to oust Hamza.

PPP lawmakers — led by Hasan Murtaza — met the chief minister and discussed the situation arising after the SC verdict. In the current situation, the PPP is eying at least four ministries and some advisory positions in Punjab after being apparently ditched by the PML-N for the Punjab governor and assembly speaker’s slots. The PPP lawmakers assured Hamza of their support and told him not to worry in case a run-off poll for CM was held.

Both CM Hamza and the PTI provincial leadership held separate meetings with legal experts to discuss the impact of the apex court’s decision, which declared that votes of defecting lawmakers will not be counted.

In view of this development, the PML-N says it is ready to go for a run-off election for a new chief minister, if such a situation arises in light of the SC verdict. The PTI, on the other hand, believes Hamza ceases to be the CM after a “clear verdict” of the Supreme Court on the status of turncoats. If he does not resign forthwith, the party will be approaching the court to send him home.

Federal Law Minister Azam Nazeer Tarar however maintained that Hamza would not quit. “Both the federal and Punjab governments will complete their tenures (till Aug 2023),” he stressed.

PML-N deputy secretary general Ataullah Tarar also said: “In case the PTI proves (in the Election Commission of Pakistan) that its parliamentary meeting was held and the lawmakers were advised to vote for Chaudhry Parvez Elahi (the joint PTI-PML-Q candidate for CM), we still have the majority to win the run-off election for the office.”

He said the PML-N with the support of the PPP, independent and Rah-i-Haq party lawmakers will be able to clinch 173 votes in the Punjab Assembly, as compared to the PTI-PML-Q’s 168. However, the PML-N’s 161, PPP’s seven, three independent and the lone Rah-i-Haq Party MPAs combined make 172 votes, and any eventual run-off poll could turn out to be a neck-and-neck contest as no party can now poach lawmakers from other parties.

PML-N Punjab secretary general Awais Leghari has asked President Dr Arif Alvi to play his role to end the constitutional crisis in Punjab and appoint a governor so that a provincial cabinet could be formed. Prime Minister Shehbaz Sharif had already sent a summary to the president nominating party loyalist Balighur Rehman from Bahawalpur for the governor’s slot, but President Alvi was not accepting it.

Meanwhile, in a media talk here, former federal minister Fawad Chaudhry of the PTI said that after the SC’s verdict no government existed in Punjab. “The PTI has decided in principle to file a petition in court to oust Hamza in light of the apex court’s decision,” he said, adding that despite losing the votes of 26 PTI lotas (turncoats), the PTI-PML-Q still had a majority in the Punjab Assembly with 173 votes, while the PML-N had 172.

“The SC’s verdict in the Mustafa Impex case has decided that a government in a province comprises a chief minister and the cabinet. The CM alone cannot take administrative and financial decisions, thus there is no government in Punjab at the moment and any such decision by Hamza is against the law,” he maintained.

Mr Chaudhry said President Alvi might ask PM Shehbaz to take a vote of confidence, as the latter did not have the required support of 172 lawmakers in the National Assembly. To a question, he said: “The PTI is willing to hold talks with the government over the electoral reforms provided it announces a date for fresh elections,” he said.

PTI-PML-Q meeting

Meanwhile, the PTI’s Punjab leaders Sibtain Khan, Dr Murad Raas, Makhdoom Hashim Jawan Bakht and Syed Alamdar Abbas called on Punjab Assembly Speaker Parvez Elahi and former federal minister Moonis Elahi of the PML-Q at their residence here on Wednesday and discussed a joint strategy to oust CM Hamza.

A statement issued after the meeting said: “The fake government of Hamza Shehbaz has come to an end after the decision of the SC. At present, the status of Hamza in the chief minister’s house is nothing, but that of an occupant.”

The meeting also demanded Hamza vacate the CM office immediately.

In a series of tweets, Moonis Elahi said: “We (PTI-PML-Q MPAs) are 173 to start with. Insha’Allah when total count (in run-off CM election) is done we will be much more than 173.

Add five as three women and two minorities seats will be filled again.”

In reply to a journalist’s tweet, he further claimed the PTI-PML-Q had not boycotted the CM election on April 16. “As you know this election is done through division of the House. Since the ayes side where PTI’s members’ going was blocked by police and they couldn’t enter. Hence they couldn’t vote,” he added.

Punjab Chief Minister Hamza Shehbaz on Thursday announced Rs160 reduction on 10kgs bag of wheat under the Rs200 billion subsidy for the province to provide relief to the masses.

The announcement comes amid the controversy over Hamza's election as chief minister following the Supreme Court of Pakistan’s decision that defecting lawmakers’ votes could not be counted. The PML-N leader was elected to the post with the help of the votes of 24 PTI dissident MPAs.

Addressing a press conference in Lahore earlier today, Hamza said that he will stand by his people in difficult times

"Today, with immediate effect the 10kg bag of wheat that was costing about Rs650 would now be priced at Rs490 in Punjab," he said.

He also claimed the current administration has met its wheat procurement target for the next year.

"The rate of wheat is $500 per tonne or Rs4,000 per maund, in the international market. But we procured 4.5million tonnes of wheat at Rs2,200 per maund," he added.

The decision to provide relief in wheat prices also comes at a time when the Pakistani rupee devalued to the much anticipated Rs200 against the US dollar in the inter-bank market on Wednesday.

The country’s foreign exchange reserves have also depleted to the critically low level of $10.3 billion which covers just six weeks of imports compared to the usual three-month import cover.

‘Imran paralysed economy’

The Punjab CM said that former prime minister Imran Khan had paralysed the country during his tenure. He maintained that Imran was trying to divide and disrupt the nation through his political rhetoric.

"Imran Khan says that family members of the armed forces will be in his rallies. What is he trying to do by trying to involve state institutions in politics? If you want to fight then do so on the political front," said Hamza.

The provincial chief executive decried that he had not been able to form a cabinet due to the 'disease' that was in the form of the Punjab governor and the one that is 'sitting in the office of the president'.

"Both are working on the whims of Imran Khan and yet he asks why the courts were open late at night [on the of the no-trust move against Imran]. If the courts had not opened that night, then we all would have been in a banana republic by now," the CM said.

Hamza added that it was Imran who said that he would not go to the IMF for any loan and later accepted their every term.

"It was Imran who made the people of the country suffer by making them stand in line for basic commodities like wheat, sugar and rice," he alleged.

The Lahore High Court (LHC) on Friday issued notices to Hamza Shehbaz and others on separate petitions filed by the PTI and PML-Q's Chaudhry Parvez Elahi requesting the court to declare his election as Punjab chief minister "illegal" and to restrain him from working in that capacity.

The PTI had filed a petition yesterday, while Punjab Assembly speaker Elahi submitted his today, which his lawyer, Safdar Shaheen Pirzada, said in a comment to Dawn.com is identical to PTI's.

During the hearing, LHC Chief Justice Mohammad Ameer Bhatti clubbed the petitions together.

Hamza was elected as the Punjab CM on April 16, during a provincial assembly session that was marred by mayhem. He received a total of 197 votes — 11 more than the required 186 — including from 25 dissident PTI MPAs that were crucial for his victory.

The PML-N leader faced several delays in assuming charge of the CM Office because of then Punjab governor Omar Sarfraz Cheema's refusal to administer him oath.

Hamza approached the LHC thrice, seeking directions for his oath to be administered. He was finally sworn in on April 30, by National Assembly Speaker Raja Pervaiz Ashraf.

During the hearing today, PTI's counsel Barrister Ali Zafar argued that in order to win the election for the chief minister, a candidate requires 186 votes.

He referred to the Supreme Court's interpretation of Article 63-A, related to the disqualification of lawmakers over defection, in which the apex court said the vote of defecting lawmakers would not be counted.

Subsequently, the court issued notices to the respondents which include Hamza, Punjab chief secretary, Punjab Assembly Deputy Speaker Sardar Dost Mohammad Mazari, Punjab governor's principal secretary and Punjab Assembly's secretary.

Justice Bhatti also asked that the court be informed from when the SC's interpretation of Article 63-A would be applicable.

The hearing was then adjourned till May 25.

Elahi's plea
In his petition, Elahi, who was also the PTI-PML-Q's candidate for the CM Office, requested the court to declare that Hamza was not the chief minister since he had failed to secure the requisite number of votes in light of the SC's interpretation stating the votes of defecting lawmakers would not be counted.

Therefore, the April 16 election, its results and the certificate issued by the Punjab Assembly deputy speaker to Hamza declaring his victory had "no legal effect", the petition stated.

The petition requested the high court to declare "all consequential actions taken by [Hamza] in his purported capacity as the chief minister Punjab and all and any other communications made, orders passed and notifications issued etc., consequential upon the declaration of the afore-mentioned result and issuing the set certificate ... to be null and void".

PTI's petition
The PTI petition was filed by MPAs Mohammad Sibtain Khan, Zainab Umair, Mian Mohammad Aslam Iqbal, Syed Abbas Ali Shah and Ahsan Saleem Baryar.

It stated that the session held for conducting the election witnessed "immense chaos and most unfortunate events".

Deputy Speaker Mazari took "unlawful" aid from the police and provincial officials for holding a "sham and fraudulent" election, following which he communicated that Hamza had won, the petition said.

It noted that votes of 25 dissident PTI MPAs were also counted in the final tally for Hamza. While the then governor Cheema had refused to accept the election results, Hamza was administered the oath due to "judicial overreach", it contended.

"As per the investigation conducted by the [then] honourable governor of Punjab, the respondent secretary of the provincial assembly has tendered a report detailing the various dimensions of the election held on 16.04.2022 and has categorically informed the [then] honourable governor that the referred elections were/are unlawful; thus consequently the certificate issued by the respondent deputy speaker/acting speaker was/is without any lawful sanction/legal authority," the petition reads.

According to the petition, Hamza's election was in violation of the Constitution and the Rules of Business of the Punjab Assembly. It recalled that Hamza had approached the LHC for holding the election, adding that he treated it as an urgent matter because he had the support of 25 dissident PTI MPAs, which was a violation of Article 63 of the Constitution.

An analysis of the Supreme Court's interpretation would lead to the conclusion that the chief minister's election was unlawful, it stated.

"On this ground alone and keeping in view the scope and intent behind Article 63-A of the Constitution, the election held on 16.04.2022 [should] be declared as being without lawful authority and consequently be struck down."

The petition also claimed that the election had lost its sanctity because the assembly floor was occupied like a "beehive by private unwanted persons, including civilians, ghundas (thugs), guests, persons of various agencies and local police".

In addition, voters had been intimidated and forced to cast their votes in Hamza's favour, it stated.

The petition also stated that members who were going to vote for PTI-PML-Q's candidate Chaudhry Parvez Elahi were "pushed out" from the gallery and therefore, could not participate in the election.

The petition requested the LHC to declare Hamza's election void ab initio (illegal) "in the interest of justice and fair play".

It also requested the court to declare the office of the chief minister vacant and stop Hamza from working and portraying himself as the chief executive.

Here, PML-Q's lawyer objected that the matter shouldn't be delayed any further, contending that Punjab was functioning without a cabinet and the province was undergoing a constitutional crisis.

Justice Bhatti, however, said that the case couldn't proceed without listening to the arguments of the respondents. "Once the responses are submitted, we will hear the case on a daily basis," he added.

The hearing was then adjourned till May 30.

Punjab Chief Minister Hamza Shehbaz submitted his response to the Lahore High Court (LHC) on Monday requesting it to dismiss the pleas, with costs, challenging his election as the Punjab chief minister.

On May 25, the high court had imposed a fine of Rs100,000 on Hamza, the Punjab government, Punjab Assembly Deputy Speaker Sardar Dost Muhammad Mazari and others for not complying with LHC orders.

LHC Chief Justice Muhammad Ameer Bhatti had sought replies from the aforesaid by May 25 on different petitions filed for declaring the contest held on April 16 for the Punjab CM’s slot as null and void. However, the parties did not respond to the court.

Hearing on the petition filed by PTI lawmakers and Punjab Assembly Speaker Pervez Elahi against the Punjab chief minister’s election resumed today.

In his written reply, Hamza prayed that the election of the chief minister was held in accordance with the Constitution and law, in light of the orders of the high court and before the interpretation of Article 63-A by the Supreme Court.

Therefore, the SC’s interpretation would not affect the said elections, maintaining that the apex court’s decision was not retrospective.

“The investigation into the election of the Chief Minister by former Governor Omar Cheema was illegal and the Secretary Assembly also has no authority to inquire into the election,” the reply further stated. “Petitions against the election of the Chief Minister should be dismissed with costs,” the Punjab CM maintained.

The Punjab government also submitted a reply to the court order wherein it said that the court had been requested not to make the fine a part of the record as it was a matter of employment of officers.

The court accepted the petition of the Punjab government's counsel.

President Arif Alvi on Monday approved the appointment of PML-N's Balighur Rehman as the new Punjab governor, ending a weeks-long deadlock with the premier over the constitutional office.

The president gave approval on the advice of Prime Minister Shehbaz Sharif under Article 101 (1) of the Constitution.

Earlier, on May 7, PM Shehbaz sent a summary suggesting Rehman's appointment which President Alvi rejected.

Rejecting the first summary. the President replied that Omar Sarfraz Cheema was still holding the post of Governor of Punjab and there was no justification for the new appointment, under Article 101 (2) of the Constitution whereas the current situation in the country demands that the incumbent governor retain his post.

Prime Minister Shahbaz Sharif should reconsider his advice regarding the appointment of the Punjab governor in accordance with Article 48 (1) of the Constitution, he had further stated.

The prime minister then sent the second summary to President Alvi a week ago.

The then PTI government had sacked Chaudhry Muhammad Sarwar as Punjab governor and had appointed Omar Sarfraz Cheema.

Cheema had created many difficulties for the new PML-N government and had refused to administer the oath to Hamza Shehbaz as Punjab's chief minister.

Rehman has served as the federal education minister in PML-N's previous government.

The Lahore High Court (LHC) on Thursday declared the election of PML-N leader Hamza Shahbaz as chief minister of Punjab void after it accepted Pakistan Tehreek-e-Insaf's petitions in the matter.

The PTI, in their writ petitions, had stated that Hamza's election in the Punjab Assembly was "illegal" and did not follow due processes and that his notification as the chief of Punjab must also be set aside as it was not in line with the law. A third petition pleaded that Hamza's oath-taking be declared illegal.

The five-member larger bench gave a 4:1 decision on the matter.

"The decision by August Supreme Court of not counting votes of defecting members of a political party is squarely applicable to the election of Chief Minister held on 14th April 2022," said the judgement.

According to the written judgement from the LHC, it was an "undeniable fact" that 25 PTI MPAs had voted in favour of Hamza Shahbaz, despite the party nominating PML-Q leader Pervez Elahi as its candidate. The dissident lawmakers' move went against Article 63 A(1)(b) of the Constitution.

"The emphasised part of the order, ibid, discloses the intent behind the decision that possibility of defection from the Party line, policy or direction isto be curbed, at the time of poll by the Presiding Officer, regardless of declaration or action by Party Head. It is understood that presence in the House, enlistment on voter list and casting of vote is not prohibited, however the vote so cast, is held not countable."

Sethi Muhammad Sajid Mehmood Sethi declared that all acts and actions taken by Hamza Shahbaz as chief minister would "not be adversely affected" by the high court's order.

PTI moves SC against LHC order to recount votes for Punjab CM election

The PTI moved the Supreme Court on Friday against the Lahore High Court's (LHC) order to recount the votes cast in the Punjab chief minister election held on April 16 excluding those cast by 25 dissident PTI lawmakers.

The LHC had passed the order on Thursday while hearing the PTI and the PML-Q's pleas against Hamza Shehbaz's election as Punjab CM.

According to the high court, if the required majority for Hamza — which is 186 votes in the 371-member strong house — to stay the CM is not secured, the election will be held again under Article 130(4), unless another candidate has majority votes.

According to Article 130(4), in the second round of voting, a member will not require 186 votes but simply needs a majority of those "present and voting" to be elected the chief minister. For this purpose, a session of the Punjab Assembly (PA) has been convened today at 4pm.

In the PTI's petition, the province of Punjab through the chief secretary, PA Deputy Speaker Sardar Dost Muhammad Mazari, the principal secretary to the Punjab Governor, the PA secretary and Punjab CM Hamza have been made respondents in the case.

PTI members Mohammad Sibtain Khan, Zainad Umair. Mian Muhammad Aslam Iqbal, Syed Abbas Ali Shah and Ahsan Saleem Bharyar asked the apex court to modify the LHC order to the "extent of provision of adequate and sufficient time to hold [the Punjab Assembly] session" so that members could be issued notices and were able to "exercise their right to vote for the election of the Punjab chief minister in [a] fair and transparent manner".

The petitioners urged the court to remove Hamza as CM pending the election process and requested it to issue directives for holding a "free and fair" election for the post of the province's chief executive.

Moreover, they requested the court to suspend the election process till the pendency of their petition.

And "since the 25 votes of defectors are admittedly not to be counted, there is no need to repeat that exercise of recounting and hence the notification issued for the chief minister is liable to be quashed as duly noted in the minority judgment," the petition added.

Punjab CM Hamza Shehbaz and Speaker Pervaiz Elahi, who appeared before the top court via video link on Friday gave consent to one of the options the apex court had given them.

The orders came after a day-long deliberations on how to move forward following the Lahore High Court’s (LHC) decision to re-count the votes polled during the April 16 election for the post of the provincial chief executive. The LHC had ruled to re-count the votes excluding those polled by 25 PTI dissidents.

The PTI has challenged the LHC's decision, calling it 'flawed'.

“All parties have agreed to hold the election of the chief minister on July 22,” Chief Justice Umar Ata Bandial remarked while concluding the hearing on the case. The apex court said that detailed verdict of the case will be issued by tonight.

Justice Ahsan stated that the two parties should stop complicating the matter, adding that they were not here to create a constitutional crisis.

Khan, he added, wanted Punjab police chief, provincial election commissioner and chief secretary of the province to abide by law.

Earlier, the CJP had asked Chaudhry Pervaiz Elahi to contact the PTI chief regarding the matter of re-election, announcing a half an hour break in the hearing.

The SC had summoned Hamza and Pervaiz Elahi via video link, at 3:45pm, as it announced a short break while hearing the PTI's plea challenging the LHC's decision.

Chief Justice of Pakistan (CJP) Umar Ata Bandial, who presided over the bench hearing the petition, had said that the apex court will announce the verdict by 4pm, after having heard the two candidates in the run for the CM’s post.

The other two judges hearing the case include Justice Ijaz ul Ahsan and Justice Jamal Khan Mandokhail.

The CJP had asked the PTI counsels to prepare for the case before earlier postponing the hearing of the case for half an hour.

“The PTI must inform the court on how a provincial government will be run without a chief minister,” the CJP observed, adding that, according to the Constitution, only elected representatives can run a provincial government.

Justice Bandial maintained that a caretaker government can only be set up in the face of the assembly being dissolved. The chief justice asked the PTI counsels to put their heads together and prepare.

CJP Bandial stated that the deadlock in Punjab should not be a matter of egos, rather an issue concerning the country. “If there is no chief minister, uncertainty will prevail,” he added.

The chief justice criticised PTI counsellors for not referring to the Constitution regardless of the deadline stipulated by the LHC. “Had the counsels read Article 130, they would have known the solution,” the CJP said referring to the LHC judgment that mentions the requirement of a majority vote in the assembly to secure the post of chief minister.

Justice Ijaz ul Ahsan stated that it was likely the election for the post of Punjab CM will not be held today at 4pm however, adding that deferring the vote for seven days was too long. The judge instead advised the court to set a time limit of 24, 36, or 48 hours.

Counsel for Punjab Assembly Speaker Chaudhry Pervaiz Elahi requested the court for more time, arguing that six members of the provincial assembly were currently performing Umrah while there notifications concerning five important seats were still pending.

In response, Justice Ijaz ul Ahsan stated that, “The world will not end after this election.” The SC justice furthered that if the PTI managed to secure a majority in the Punjab Assembly, a no-confidence motion could be exercised.

Justice Ahsan remarked that a re-election does not warrant stagnation of the provincial government.

Moreover, Justice Mandokhail commented that the court had to refer to the Constitution and not the wishes of party members. “We must not do anything that can be misused,” he observed.

Hamza, Elahi called to rostrum

As the court resumed the hearing, Hamza and Pervez Elahi were summoned to the rostrum via video link from Lahore.

Chief justice Bandial remarked that, “The question before the court is not the timeframe for re-polling, rather who will run the government during that time?” He added that the court was informed of Elahi’s lack of objection towards Hamza Shahbaz retaining the position till the re-election.

However, the speaker denied the statement, expressing his distrust in the chief minister. “Even today the house is in control of the police. The assembly is not complete at the moment; any accident can happen,” Chaudhry Pervaiz Elahi stated.

To this, Justice Ijaz ul Ahsan responded that time cannot be provided till the arrival of all members who were out of the country.

“The country cannot be left like this permanently,” the justice remarked, adding that such uncertainty would not benefit anyone.

Upon Elahi’s insistence that he did not accept Hamza Shahbaz as chief minister, CJP Bandial commented that a legal solution could be detrimental to his [Elahi’s] goals too.

On the other hand, Hamza Shehbaz while addressing the bench said that ensuring all members remained in the country was Elahi’s duty as Punjab Assembly speaker, adding that re-election could be held on July 17.

Justice Ahsan asked the two leaders whether they would prefer to settle the matter amongst each other or consent to directing the Punjab governor to appoint a caretaker.

Hamza Shahbaz rejected Elahi's suggestions, stating that he could not believe the two would reach a consensus.

“If the court holds the election of chief minister on July 17, the house will be complete,” Hamza added.

To this Justice Ijazul Ahsan stated that the issue of the incumbent chief minister remained. “You are not the chief minister at present according to the law,” he stated

Hamza Shehbaz argued that he continues to enjoy a majority in the house to which Justice Ahsan responded: “You do not have a majority; that is why a re-election is taking place. If it is delayed till Monday, you cannot remain the chief minister.”

“Let the re-election take place today if that is the case,” Hamza Shahbaz responded.

However, Justice Ijaz u l Ahsan stated that it was necessary to give a proper time for re-election.

PTI challenges decision

Earlier in the day, the PTI had challenged the LHC decision in the apex court, and had requested for the plea to be heard urgently.

Punjab Assembly Deputy Speaker Sardar Dost Muhammad Mazari, Hamza Shahbaz, and others were made party to the petition.

Following the filing of the appeal, CJP Bandial formed a three-member bench and fixed the petition for hearing at 1:30pm.

In its appeal, the PTI has stated that while the LHC had accepted the party’s position, the order to convene a meeting of the provincial assembly on short notice would prove detrimental.

The petition dubbed the LHC’s decision "unconstitutional", stating a suitable timeframe must be provided to convene a meeting of the assembly so that all members may attend as votes are to be recounted on July 1 (today).

The PTI further called for Hamza Shahbaz to be suspended from his post and removed from office so that “fair and transparent elections” can be held.

In light of their stance, the PTI called for the order of election to be suspended immediately, seeking their appeal be heard by the apex court on an emergency basis.

'Beyond comprehension'

Addressing the media after filing the petition, PTI counsel Faisal Chaudhry said that the appeal highlighted the “many ambiguities” present in the Lahore High Court’s decision.

Chaudhry added that the “rights of the speaker of the Punjab assembly Chaudhry Pervez Elahi had been disregarded".

The barrister furthered that if a chief minister is to be elected, an appropriate time should be provided as some PTI lawmakers have left to preform Umrah.

“The decision of the Lahore High Court to hold elections so soon is beyond comprehension,” he added.

He further hoped that the Supreme Court would hear the “important issue” today, adding that the deputy speaker was a “controversial figure”.

“If the first election was wrong then how can there be a second round?” he questioned.

'Easy win'

The LHC's decision to re-count the votes of the recent Punjab chief minister election will in all probability provide an easy win for provincial chief Hamza Shehbaz who would most likely secure an easy win in the second round of polls for the slot.

The PML-N sits in a comfortable position in the Punjab Assembly, with a majority of around nine votes. The PTI and their ally PML-Q, who do not have any real fighting chance in the upcoming Punjab CM election, have decided to approach the Supreme Court against the decision and reportedly announced boycotting the polls.

Hamza, on the other hand, will continue to hold his office as the LHC has instructed the presiding officer to recount Punjab CM votes subtracting 25 votes of PTI defectors, and proceed to the second round of elections.

The LHC's decision of vote re-count was wrongly interpreted in the first place as some people thought that the Punjab CM election had been declared null and void and Hamza disqualified. They further believed that Usman Buzdar had become Punjab’s caretaker CM again.

The court’s decision was hailed as the PTI’s success by its leaders. Mian Mehmoodur Rashid said the verdict called for celebration as Hamza was no more the CM.

However, after careful reading of the order, the PTI leaders and many others came to know that the provincial government was still intact, and so were the chief minister and his cabinet. The court in its decision had only ordered the re-counting of votes sans 25 disqualified PTI parliamentarians.

Even with the facts available before the court, it was evident that Hamza did not have a simple majority. However, the court abstained from assuming the role of presiding officer and ordered a recount of the votes today.

The Bajwa, LHC and the ECP have done everything to save the crooked Kuukri. This verdict on the face of it was fair but they knew that many of the members are on Hajj and cant vote. The PTI reserve seats also havent been restored when the same court declared they should. No wonder [MENTION=135038]Major[/MENTION] and other mafia/fascist supporters have gone quiet.

When the LHC gives a verdict, which on the face of it was against the Sharifs, you have to look at each letter in word. This court is a disgrace and has to be disbanded.
 
The LHC is so corrupt that even when it seemed they were actually dispensing justice they were in fact protecting the Sharifs at the behest of Bajwa
