ISLAMABAD: In an unprecedented move, the special court hearing high treason case against General (retd) Pervez Musharraf has given the federal government the go-ahead to suspend passport and CNIC of the former military ruler.

“In case the accused fails to submit his written request as mentioned hereinabove the ministry of interior and all other departments, divisions and agencies of the government of Pakistan are to take positive steps in ensuring the arrest of the accused and attachment of his properties abroad, including suspension of the CNIC and passport of the accused,” reads four-page order of the special court, a copy of which is available with The Express Tribune.

If the federal government suspends his passport and CNIC, Musharraf will not be able to travel to any country.
The court had earlier directed the interior ministry to approach Interpol for arrest of former President.

The three-member bench, headed by Peshawar High Court (PHC) Chief Justice Yahya Afridi and comprising Lahore High Court CJ Yawar Ali and Justice Tahira Safdar of the Balochistan High Court, had conducted the last hearing on March 8. However, the written order was issued later.

Treason case: Court summons FO officials to bring Musharraf back

Since 2013, the special court is hearing the treason case against Musharraf for subverting the constitution on November 3, 2007. The next hearing of the case has been fixed for March 21.

The order says that Akhtar Shah, the counsel for Musharraf, stated that his client intends to appear before the court but he should be provided security by the defence ministry.

“This court is alive to the request made by counsel for accused and in case, the accused intends to appear before this court on March 21, he may within seven days approach the ministry of interior in writing for the requisite protection that was offered by the head of prosecution on May 19, 2017,” the order read.

The special court in its order has directed that in case Musharraf fails to submit his written request seeking security, the interior ministry and all other departments, divisions and agencies are to take positive steps in ensuring the arrest of the accused and attachment of his properties abroad, including suspension of the passport and CNIC of the accused.

Legal experts believe that the special court’s order to suspend his CNIC and passport is very significant as it will halt the movement of Musharraf abroad.

Musharraf treason case: Special court to resume hearing on March 8

Advocate Akhtar Shah while talking to The Express Tribune claimed that he had already sent two applications through courier to the ministries of interior and defence for providing foolproof security to his client, Musharraf, on his arrival to ensure presence in the court. He, however, stated that they have yet to receive any response from the two ministries.

On the other hand, prosecution head Akram Sheikh said that ministry has yet to receive any application by Musharraf’s counsel. He also urged the interior ministry to start process for the suspension of Musharraf’s CNIC and passport, adding that the former army chief’s movement will be completely stopped after the suspension of passport.

The special court in its order has expressed dismay at the inaction of the federal government in taking positive steps to ensure the arrest of Musharraf, who has already been declared proclaimed offender.

“In this regard, the court was informed that the accused is presently residing in United Arab Emirates and that there is an extradition treaty between government of UAE and government of Pakistan which could be invoked to ensure the arrest of the accused and attachment of his properties in UAE,” says the order.

The court also asked the federal government to make requisite request to Interpol for the issuance of appropriate warrant for his arrest and for his production before the court.

The case hearing will resume on March 21.

Prosecution head in treason case against Musharraf quits

ISLAMABAD: The high treason case against former military dictator retired Gen Pervez Musharraf suffered a blow on Monday as head of the prosecution Mohammad Akram Sheikh tendered his resignation.

In his resignation letter sent to the interior secretary, Advocate Sheikh expressed his inability to proceed with the case after the imminent change of government at the Centre.

The Pakistan Muslim League-Nawaz government had appointed Akram Sheikh as head of the prosecution in the high treason case in November 2013.

Initially, the legal team of Gen Musharraf challenged Advocate Sheikh’s appointment as chief prosecutor, but the special court seized with the high treason case as well as the Islamabad High Court (IHC) dismissed the challenge.

The special court indicted Gen Musharraf for high treason in March 2014. The prosecution laid its evidence by September same year. However, thereafter, the special court could not proceed against the former dictator as the IHC issued a stay order and then Gen Musharraf left the country after the superior courts removed his name from the Exit Control List.

The special court declared the accused a proclaimed offender and ordered confiscation of his properties which could not be attached due to the litigation in courts.

The special court earlier this year resumed proceedings in the treason case and ordered that Gen Musharraf’s computerised national identity card (CNIC) and passport be blocked. The outgoing PML-N government in May executed the court order and blocked his CNIC and passport.

However, Chief Justice of Pakistan Mian Saqib Nisar, during hearing of a case related to disqualification of Gen Musharraf, allowed him to return and restored his travel documents.

Advocate Sheikh repeatedly requested the special court to conclude the trial and issue a verdict in the absence of Gen Musharraf, citing recent examples where the accountability court is conducting trial against former finance minister Ishaq Dar in absentia.

However, after the general elections and possible change of government where it is obvious that Pakistan Tehreek-i-Insaf (PTI) is going to form the government, Advocate Sheikh mentioned in his resignation that the next government could engage a lawyer of its choice.

Talking to Dawn, Advocate Sheikh confirmed that he had submitted the resignation to the interior ministry. If the PTI wanted to continue with the case, it could engage a lawyer to proceed with the case, he said.

He, however, ruled out the possibility that any government may withdraw the treason case against Gen Musharraf.

“It will be tantamount to aiding and abetting the accused person,” he said.

The All Pakistan Muslim League (APML) of Gen Musharraf withdrew its candidate in support of Imran Khan from NA-53, Islamabad.

APML head Dr Mohammad Amjad had filed his nomination papers, but later he withdrew in favour of the PTI chairman.

ISLAMABAD: A special court on Friday scheduled the hearing of the high treason case against former military ruler Pervez Musharraf for August 20.

On July 6, lawyer Akram Sheikh stepped down as the head of the prosecution team tasked by the previous federal government to prosecute Musharraf under Article 6 of the Constitution.

According to sources, a meeting held on August 1 between the three-member bench, headed by Peshawar High Court (PHC) Chief Justice Yahya Afridi and comprising chief justices of Lahore and Balochistan High Courts, decided to resume the case which pertains to the imposition of extra-constitutional emergency in the country in 2007. The judges will be holding another meeting on August 13 in Lahore.

Legal experts call the case – pending since 2013 – a big test for the superior judiciary. Major party leaders were also voicing concerns over why the courts were are not taking cognisance of the case, arguing that treason is a graver offence than others, including corruption.

The former military dictator was indicted in March 2014 after he made an appearance before the court, rejecting all charges against him in front of the three-member special bench. The charges read out to Musharraf were the same that were slapped by the government in 2013 at the time of the formation of the special bench – subverting and circumventing the Constitution by imposing emergency on November 3, 2007.

On March 18, 2016, the former president flew to Dubai for medical treatment shortly after his name was removed from the Exit Control List (ECL) on the Supreme Court’s directives.

On May 11, 2016, a three-judge bench, headed by former PHC CJ Mazhar Alam Khan Miankhel, declared former president Musharraf a proclaimed offender (PO) in the high treason case. The special court had directed the interior ministry and the Federal Investigation Agency (FIA) to advertise the court verdict about the confiscation of his property.

A year later, a special court restrained Musharraf’s counsel from presenting his arguments, noting that it could not hear the lawyer of an absconder.

In May 2017, Musharraf had expressed, through a plea, his willingness to face the high treason trial under the army’s protection, and on the assurance from the court that he would be given a safe passage to return to Dubai.

In April last year, the federal government requested the special court to proceed with the trial of former military ruler Pervez Musharraf in the high treason case, which was initiated against him for abrogating the Constitution in November 3, 2007.

ISLAMABAD: The special court seized with the high treason case would resume the stalled trial of former military dictator retired General Pervez Musharraf on Aug 20.

The three-judge special court comprises Lahore High Court (LHC) Chief Justice Justice Yawar Ali, Balochistan High Court (BHC) Chief Justice-designate Justice Tahira Safdar and Justice Nazar Akbar of the Sindh High Court (SHC).

The trial against Gen Musharraf has been at a standstill since March 2016 when the ex-president left the country following the removal of his name from the Exit Control List (ECL).

The previous government of the Pakistan Muslim League-Nawaz (PML-N) lodged the complaint against Gen Musharraf in December 2013 for holding the Constitution in abeyance on November 3, 2007.

It may be mentioned that head of prosecution in the treason case Mohammad Akram Sheikh had tendered resignation on July 30, saying that it was up to the new government of the Pakistan Tehreek-i-Insaf (PTI) to engage a lawyer of their choice to proceed in this case.

A special court on Wednesday resumed hearing the high treason case against retired Gen Pervez Musharraf and sought assistance in proceeding with the case if the former military dictator continues to abscond.

Secretary Interior Yousaf Naseem Khokhar, present for the hearing, told the two-member bench led by Justice Yawer Ali that a letter had been written to Interpol for Musharraf's repatriation, but Interpol officials had refused to issue a red warrant, saying that Interpol does not deal in political cases.

"How can the court decide the case if Musharraf avoids turning up on the next hearing?" Justice Ali asked.

He asked authorities to inform the court on the next hearing if they can record Musharraf's statement via video conference or if the case can be pursued without recording a statement.

The court also directed the interior secretary to submit a copy of the letter it wrote to Interpol.

The next hearing of the case has been deferred to Sep 10.

Prosecutor recuses himself

During the hearing, prosecutor Akram Shaikh submitted an application to the court saying he wanted to detach himself from the case.

He also contended that the new government should decide whether to continue with the case or not.

He added that Musharraf's counsel had become a part of the government and the interior ministry would have to decide the future course of action pertinent to the case.

The court granted his plea. Shaikh had been pursuing the case for the last five years.

He had in the past repeatedly requested the special court to conclude the trial and issue a verdict in the absence of Gen Musharraf.

Sheikh had submitted his resignation to the interior ministry after the election, saying: "If the PTI wants to continue with the case, it can engage a lawyer to proceed with the case."

He had ruled out the possibility that the government would withdraw the treason case against Gen Musharraf. “It would be tantamount to aiding and abetting an accused person,” he had said.

Judicial commission to record Musharraf's statement in treason case

After former military dictator retired Gen Pervez Musharraf ─ who has been out of the country since March 2016 ─ declined to record his statement in a treason case via video link, a special court on Monday ordered the formation of a judicial commission that will go abroad to record his statement in accordance with Section 342 of the Code of Criminal Procedure.

The former president's lawyer told a special court bench comprising Justice Yawar Ali, Justice Tahira Safdar and Justice Nazar Akbar seized with a high treason case initiated against Musharraf for suspending the Constitution on Nov 3, 2007 ─ an offence for which he was indicted on March 31, 2014 ─ that his client was was unable to record his statement via video link since he is indisposed.

Justice Ali asked the lawyer whether Musharraf had been diagnosed with cancer, to which the counsel responded that the former military ruler had been diagnosed with heart problems.

"He says he is not a coward. He wishes to appear before the court himself and present the evidence in his defence," the lawyer added.

Justice Yawar Ali deliberated whether the case could proceed in the absence of a statement recorded by Musharraf under Section 342 and asked the prosecution lawyer if it was possible to do so.

"The accused is in a foreign country right now. According to his lawyer, he is very ill," Justice Ali noted.

"Pervez Musharraf's previous record is before us," the prosecution lawyer said. "He is not ready to record a statement via video link."

"We are told that Pervez Musharraf cannot appear in court due to his illness," the bench observed. "He wishes to record his statement in the treason case."

Subsequently, the court decided to order the formation of a judicial commission that will travel abroad in order to record Musharraf's statement in the case.

The members of the commission and its scope will be decided later, the bench maintained, adding that if anyone had objections, they could challenge the formation of the commission before the high court.

This is also Justice Ali's last hearing of the case, as he will be retiring soon. Future case proceedings will either be heard by a new special court bench or by the high court, DawnNewsTV reported.

The case was adjourned until Nov 14.

Musharraf is a shadow of the loud boisterous general he was in his prime now. Illness has taken away his fury, now is the perfect time for all his opponents and enemies to pounce on him which will be unfair.

An special court in Islamabad on Thursday admitted former military dictator retired Gen Pervez Musharraf's plea for adjournment of the hearing of a high treason case against him till the end of the holy month of Ramazan.

Gen Musharraf is facing a treason trial under Article 6 of the Constitution as well as Section 2 of the High Treason Act on a complaint moved by the federal government. In line with the earlier directive of the Supreme Court, the trial court was scheduled to record Gen Musharraf’s statement under Section 342 of the Criminal Procedure Code to complete the treason trial but the former dictator could not appear before the court due to medical reasons.

A three-member bench, headed by Justice Tahira Safdar, granted Musharraf's appeal after his lawyer Salman Safdar told the court that doctors had advised him to avoid travelling due to his health issues. Safdar maintained that although Musharraf wished to return to the country, his health did not allow it, and appealed to the court to grant the plea on humanitarian grounds.

The counsel also submitted medical reports and snaps of Musharraf's treatment in a hospital abroad. He said that the 76-year-old is suffering from several diseases, including a life-threatening disease.

The application stated that, in view of Gen Musharraf’s serious condition, the former president was sincerely apologetic for not appearing before the court.

He added that the case had been lodged against Musharraf in 2007. Despite the cases against him, Musharraf came back to his homeland in 2013, the lawyer said, adding that his client had been indicted in the case in March 2014. He said that Musharraf had been in the country for 2 years and three months but the prosecution could not prove its case.

The counsel said that Musharraf was unable to move as he had been admitted to a hospital 40 times during the last two years.

"Musharraf should be given an opportunity to appear so as to fulfil the requisites of justice," the counsel said, adding that currently the former dictator was unable to speak and that he could not respond to the questions in court without his client's assistance.

The prosecution raised objections over the plea but was overruled.

The special court issued a notice to the government over a plea for acquittal of Musharraf in the case. The hearing of the case has been adjourned till June 12.

On April 1, the apex court had directed the special court to proceed with the trial on the next date of hearing (May 2) and in case the former president surrendered and appeared before it, he would be entitled to record his statement.

But if he failed to appear, being a PO (proclaimed offender), the special court is empowered to proceed against him even in his absence under Section 9 of the High Treason (Punishment) Act, 1973, the top court had held.

According to the latest assessment of April 29, undertaken by Dr Faraz Khan at the American Hospital, Dubai, Gen Musharraf’s health was been termed unsafe in case he discontinued treatment and travelled, the application argued.

Moreover, the permission to undertake exertion and travel had plainly been refused by the medical practitioner, the application said, adding that the former president was suffering from cardiac amyloidosis (congestive heart failure), chronic kidney disease (high creatinine in renal system), excessive somnolence (hypersomnia), spinal injury and fracture.

The application pleaded that the former president was extremely apologetic for the inconvenience caused to the special court due to his absence.

NAB receives fresh evidence in Musharraf corruption case

Islamabad : NAB has received fresh evidence in its probe against former dictator Pervez Musharraf on misuse of authority and illegal allotment of multiple expensive plots to his favorite officers worth about Rs1000 billion.


The evidence includes a list of 10 prime properties worth billions of rupees which Musharraf held in his name and in the names of his family members.

The fresh evidence was submitted by a retired army officer colonel Advocate Inamur Rahim on Tuesday to the deputy director coordination of the National Accountability Bureau (NAB), Rawalpindi.

A NAB official has confirmed to The News that the Bureau is examining the evidence against the former military ruler in an inquiry into “misuse of authority” by Musharraf. Earlier, NAB’s deputy director coordination Nasir Raza had sought documentary proof from Col Inam in an inquiry against the former dictator under NAB Ordinance 1999. However, NAB has yet to issue summon to the former dictator in the case.

“One can safely calculate that by allotting thousands of plots/Govt lands reserved for defence purposes caused losses of more than one thousand billions to National Exchequer and at least one **** Bagh Dam could be constructed with that amount therefore, it is requested that a suitable direction should be given to DG WR, (Welfare and Rehabilitation) to provide the complete record of the land allotted and gifted by Pervaiz Musharaf and be cancelled and retrieved to Govt of Pakistan as all the lands situated in the country belongs to the public of Pakistan,” the letter says.

The fresh letter submitted to the NAB, a copy of which is available with The News, lists more than 10 properties held by Musharraf and his family members in various parts of the country and the worth of only two properties is Rs1 billion.

The lost of the plots in the name of Musharraf and his family includes, Plots No 172 and 301 (2000 yards each and worth Rs500 million each) Khayaban-e-Faisal DHA, Karachi, Two houses in Army Officers Housing Society Zamzama, DHA Karachi, A plot in Sector D, DHA Islamabad, Corner plot No. 1A DHA, Islamabad, Plot No. 15A Sector D, DHA Islamabad and Plot No. 15B Sector D, DHA Islamabad.

NAB has been told that Ex General Pervaiz Musharaf introduced a unique policy that on the last date of service as Army Chief when he would sign the last letter, it would accompany allotment letter of special plot, called as Good Signature Plot/ Last Signature Plot. By this way not only his successors, General (R) Kiyani and General Raheel Sharif got benefited, even General (R) Yousaf also got last signature plot as Vice Chief.

The Bureau was also informed that also introduced secret policy that on retirement every army chief would be gifted fully furnished and well equipped with all luxuries, pant house of 2 Kanals. The special pant houses were constructed and furnished from the state budget at golf club, DHA Lahore. The complainant disclosed that a two-Kanals x Pant House No. 185, Phase 2, at Defence Raiya Golf Club Lahore was gifted to former Army Chief General Kiyani and a similar Pant House No. 68, Phase No. 1, at Defence Raiya Golf Club, Lahore, was gifted to General Raheel Shareef.

The letter alleges that General (R) Musharraf injected corruption in the senior hierarchy of armed forces. To win the support of senior officers he made a policy that every general officer shall be allotted 5 plots as well as 50 acres of land.

“The land of Deh Okiwary presently Cricket Station Karachi was taken over by British Govt during Second World War with a Commitment that after six months of the War it would be returned back to its original owners. However after introduction of KDA Scheme, the above said land was handed over to city government for establishment of Cricket Stadium project,” says the letter.

NAB was informed that during 2002, Ex General Musharaf illegally decided to allot 18 acres of said land to senior officers over and above their entitlements. The original owners challenged the illegal allotment in the form of suit No 814/2002 pending before Sind High Court, but even then an illegal Society in the name of Army Officer Housing Society PT II National Stadium Karachi was introduced and allotted to senior officers. Names of few of those allotees are: i. General Ehsan-Ul-Haq ( Two plots of Two Kanals each- Plot No-29 and Plot No-15), ii. He was also allotted 2 plots at DHA Islamabad, “it is worth mentioning that General Ehasn was DG ISI when Dr. Aafiya Siddiqui was handed over to Americans at Islamabad”, iii. Lt General Salah Udin Satti Plot No 115, xv. Lt General Syed Ather Ali Plot No 113, xvi. Lt General Nadeem Taj Plot No 33, xvii. Lt General Ijaz Bakhshi Plot No 34, xviii. Lt General Anis Abbas Plot No 20, xix. Lt General Arif Hayyat Plot No 2, xx. Lt General Tahir Qazi Plot No 12, xxi. Major General Khalid Zaheer Akhtar former DG NLC Plot No- 54 (Major General Khalid Zaheer Akhtar who was allegedly involved in NLC mega corruption case and Parvez Musharaf allowed him to remain as DG NLC for continuous 7 years), xxii. Major General Ehtisham Zameer Plot No 26, xxiii. Major General Mohsin (DG WR) was allotted 3 Plots in sector D, DHA Phase-1, Islamabad, xxiv. Lt General Ahmed Shuja Pasha former DG ISI was also allotted 2 Kanals plot in cricket stadium land Karachi, xxv. General Parvez during his complete tenure illegally allotted commercial plots to all the Major Generals, Lt. Generals, and Generals serving with him, and xxvi. Major General Shahid Hashmat was the only Senior Officer who refused to get plot in Karachi Stadium on the plea that the land belongs to the locals and he doesn’t deserve that land.

The Complete List along with site plan of plots was also submitted with NAB.

The letter also accuses Musharraf further allowing the senior officers to use army resources after allotment of the agriculture land. “They can use the army resources to develop their lands. The dozens of the engineer units, their man power and even the fuel meant for the armed forces were badly misused by the senior officers in development of their agriculture lands.” NAB was told that defence analyst Lt. General Amjad Shoaib, was also one of the beneficiaries. He may be requested to disclose his assets, residential plots, commercial plots and agricultural land and he should also apprise the general public that how he developed his agricultural land.

The Bureau was told that General Musharaf allotted completed phases of different DHAs to senior officers to get their support and as the result they are still standing with him and supporting him for their commercial interest.

General Parvez also allotted thousands of kanals of land in DI Khan to certain politicians to get their support on the issue of uniform whereas the said land was reserved for the families of Shuhada. In that regard, a separate complaint filed by Shafqat Mehmood Senator from PTI is already pending with the chairman NAB.
