The National Assembly will go to vote on Sunday (today) to decide the fate of Prime Minister Imran's government amid a looming threat of political heat tipping over into a full-blown clash.

Apparently, the joint opposition parties have more lawmakers on their side after the ruling party’s numerical strength evaporated following the decision of its key allies to side with the opposition.

Nevertheless, the embattled prime minister remains sanguine about his prospects, insisting that he will turn the tables on the opposition at the last minute. On the eve of the fateful session, PM Imran walked back on his earlier directions to his party members to not attend the fateful session and allowed them to attend it. The premier also urged the masses to stage peaceful protests against “traitors”.

At a time of already profound political polarisation around extremely sensitive issues, the open calls for protests against the “traitors” and stoking fears about a “foreign conspiracy” may prove to be a potential recipe for chaos and mayhem – Pakistan’s own Capitol Hill moment.

Political observers have expressed fears that PM Imran’s supporters might manage to break into the Red Zone and besiege the Parliament building, leading to a volatile situation. In order to keep the Red Zone secure and bar protestors from entering it, the capital’s administration has blocked all the roads leading to Red Zone.

The authorities have also decided to deploy roughly 8,000 police Rangers and Frontier Constabulary (FC) officials to avert the rallies, if any, from entering the sensitive area and besieging the parliament. The traffic police also issued a traffic plan, according to which only Margalla Road would be opened for traffic to enter into Red Zone.

Apart from resorting to name-calling, labelling the other side as traitors and alleging that the opposition parties’ no-confidence motion was being backed by foreign powers, PM Imran has also filed a petition in the Supreme Court seeking a lifetime electoral ban on the lawmakers who abandoned him at this crucial moment.

How does a no-confidence vote work?

Out of the total 342 members of the assembly, a prime minister is elected if he/she secures 172 or more votes. The premier would continue if the opposition fails to produce 172 or more lawmakers in the assembly for any reason.

If PM Khan loses the vote, parliament would continue to function and the lawmakers in the National Assembly will elect a new prime minister to serve until August 2023, after which a general election is due within 60 days. However, the new premier can go for early elections before August 2023. Though the opposition parties have shown their strength in the assembly in the previous session and insisted on voting on the motion without having the support of PTI’s disgruntled members, the deputy speaker had adjourned the session for April 3 – Sunday at 11:30am.

Under clause (2) of Article 95 (vote of no-confidence against Prime Minister) of the Constitution, “a resolution referred to in clause (1) shall not be voted upon before the expiration of three days, or later than seven days, from the day on which such resolution is moved in the National Assembly.” Clause (4) of Article 95 adds that “If the resolution referred to in clause (1) is passed by a majority of the total membership of the National Assembly, the Prime Minister shall cease to hold office.”

Rule 37 (6) (Resolution for a vote of no-confidence against the Prime Minister) of Procedure and Conduct of Business in the National Assembly, 2007, also state that “the resolution shall not be voted upon before the expiry of three days, or later than seven days, from the day on which the resolution is moved in the Assembly.”

Voting procedure

The Second Schedule of the NA rules defines the procedure for recording votes. Before voting commences, it states, that the speaker shall direct that the bells be rung for five minutes to enable members not present in the chamber to be present. Immediately after the bells stop ringing, all the entrances to the Lobby shall be locked and the Assembly staff posted at each entrance shall not allow any entry or exit through those entrances until the voting has concluded.

It adds that, "the Speaker shall then read out the resolution before the assembly and ask the members who wish to vote in favour of the resolution to pass in single file through the entrance where tellers shall be posted to record the votes. On reaching the desk of the tellers, each member shall, in turn, call out the division number allotted to him under the rules.

The tellers shall then mark off his number on the division list simultaneously calling out the name of the member. In order to ensure that his vote has been properly recorded, the member shall not move off until he has clearly heard the teller call out his name. After a member has recorded his vote, he shall not return to the Chamber until bells are rung under paragraph 3.

"When the Speaker finds that all the members who wished to vote have recorded their votes, he shall announce that the voting has concluded. Thereupon the Secretary shall cause the division list to be collected, count the recorded votes and present the result of the count to the Speaker.

The Speaker shall then direct that the bells be rung for two minutes to enable the members to return to the Chamber. After the bells stop ringing, the Speaker shall announce the result to the Assembly," it adds.

The joint opposition on Sunday submitted a no-confidence motion against National Assembly Speaker Asad Qaiser hours before the voting on the no-confidence motion against Prime Minister Imran Khan in the lower house of parliament.

The resolution was submitted by Pakistan Muslim League-Nawaz (PML-N) MNA Murtaza Javed Abbasi to the National Assembly Secretariat and seeks the removal of the speaker from office.

The PML-N leader’s notice stipulated that the speaker would be removed from office under Article 53 of the Constitution of the Islamic Republic of Pakistan with Rule 12 of the Rules of Procedure and Conduct of Business, 2007.

Murtaza furthered that as required by sub-rules (1) and (2) of Rule 12, the notice must be circulated to all members of the National Assembly, and be tabled within seven working days.

The opposition is not happy with the speaker regarding his attitude towards the usual legislative business, especially the no-confidence motion tabled against PM Imran, in the National Assembly.

The meeting of the joint Opposition started with the leader of the Opposition in the National Assembly Shahbaz Sharif in chair to plan its strategy regarding the crucial NA session.

The meeting is attended by 177 people including PPP Chairman Bilawal, Asif Ali Zardari, Akhtar Mengal, Khalid Magsi, MQM-P leader Khalid Maqbool Siddiqui, Shahzain Bugti and others.

The legal team is briefing the meeting on the legal points regarding the vote of no-trust motion against PM Imran Khan.

Omar Sarfaraz Cheema appointed new Punjab governor

PTI leader from Punjab Omar Sarfaraz Cheema has replaced Chaudhry Mohammad Sarwar as the new Punjab governor, soon after the latter was sacked this morning.

The federal government removed Sarwar from the post hours before the crucial session in the National Assembly for the vote of no confidence against Prime Minister Imran Khan.

"The announcement regarding new Punjab governor will be made later, while deputy speaker of [provincial assembly] will be the acting governor in the meantime," Federal Minister for Information and Broadcasting Fawad Chaudhry wrote on Twitter.

Sources within the federal government said that Sarwar has been removed from his post on PML-Q leader Chaudhry Parvez Elahi's request, for allegedly campaigning for Hamza Shahbaz in the election of the chief minister.

Opposition submits no trust move against NA Speaker Asad Qaiser

The joint opposition has submitted a no-confidence motion against National Assembly Speaker Asad Qaiser, on the day of vote on a no-trust motion against Prime Minister Imran Khan.

After submission of a no-confidence motion against speaker Asad Qaiser, the National Assembly session will now be chaired by Deputy Speaker Qasim Khan Suri.

Pakistan Tehreek-i-Insaf (PTI) has changed its strategy to deal with no-trust move as Prime Minister Imran Khan and all party MNAs will now be attending the National Assembly proceedings tomorrow.

Previously, it was decided that MNAs from treasury benches will remain absent on the voting day of a no-confidence motion against Prime Minister Imran Khan.

The opposition is also claiming to have numbers more than the magic number of 172 MNAs after it was backed by Balochistan Awami Party (BAP), Muttahida Qaumi Movement-Pakistan (MQM-P) and as many as 22 estranged members of the PTI.

The National Assembly convened to take up the vote of no-confidence against Prime Minister Imran Khan kicked off under the chairmanship of Deputy Speaker Qaiser Suri on Sunday.

Earlier, the opposition leaders, including PPP Co-Chairman Asif Ali Zardari and PML-N President Shehbaz Sharif, arrived in the house along with other lawmakers.

After his arrival, PPP chief Zardari as an act of goodwill visited the benches of the government and shook hands with the ministers present. Zardari also went to the chair of NA Opposition Leader Shehbaz Sharif to greet him.

The opposition is in a comfortable position to remove PM Imran through a vote of no-confidence as it enjoys the support of at least 176 members, including two members of the PML-Q, in the lower house.

Meanwhile, Prime Minister Imran Khan chaired a meeting at the Prime Minister's House. He held consultations with his close aides before the vote and would likely arrive in the house in some time. Currently, only 22 PTI MNAs were present in the NA hall.

Earlier in the day, the opposition parties held a parliamentary meeting attended by at least 174 members. Out of them, 84 belonged to the PML-N, 56 belonged to the PPP, and 14 belonged to the Muttahida Majlis-e-Amal (MMA).

Similarly, Awami National Party (ANP) has one lawmaker, Balochistan National Party-Mengal (BNP-M) has four, Muttahida Qaumi Movement (MQM-P) has six lawmakers, Balochistan Awami Party (BAP) has four, and the Jamhoori Watan Party (JWP) has one lawmaker present in the house. At least four independent MNAs are also sitting on the opposition benches.

In a shock move, National Assembly Deputy Speaker Qasim Khan Suri on Sunday dismissed the no-trust move against Prime Minister Imran Khan, terming it against Article 5 of the Constitution.

Suri chaired today's session after opposition parties, in a surprise move, filed a no-confidence motion against Speaker Asad Qaiser.

According to Article 5:

Loyalty to the State is the basic duty of every citizen
Obedience to the Constitution and law is the [inviolable] obligation of every citizen wherever he may be and of every other person for the time being within Pakistan

Taking the floor shortly after the session began, Information Minister Fawad Chaudhry said that loyalty to the state was the basic duty of every citizen under Article 5. He reiterated the premier's earlier claims that a foreign conspiracy was behind the move to oust the government.


"On March 7, our official ambassador was invited to a meeting attended by the representatives of other countries. The meeting was informed that a motion against PM Imran was being presented," he said, noting that this occurred a day before the opposition formally filed the no-trust move.

"We were told that relations with Pakistan were dependent on the success of the no-confidence motion. We were told that if the motion fails, then the upcoming path for Pakistan would be very difficult. This is an operation for a regime change by a foreign government," he alleged.

The minister questioned how this could be allowed and called on the deputy speaker to decide the constitutionality of the no-trust move.

Opposition lawmakers earlier appeared confident of the success of the no-trust move as they made their way to Parliament House.

The opposition needs the support of at least 172 lawmakers from a total of 342 to oust the premier through the no-trust move.

A PM who is facing no confidence motion cannot rule dissolve assemblies however that no confidence motion was dismissed before PM dissolved assemblies. So all legal. Opposition wanting supreme court to intervene but they can't do much as this is legal.

As per sources, Govt is going to file cases against some of the opposition leaders on the grounds of pics/videos proofs that they are involved with foreign forces.

Also, assemblies has been dissolved, new elections are coming.

Let the awaam decide what they want.

No supreme court, no opposition, no one can go against this decision because this all is constitutional.

Correct. Also there is a ruling by SC in 1989 where SC said that since assemblies are dissolved and new elections happening imminently the SC decides not to intervene in Parliamentary happenings.

PPP's Mustafa Nawaz Khokhar termed the government's move a "blatant violation" of the Constitution and the rules.

"The Supreme Court cannot and should not sit by as a mere spectator. Chief Justice should immediately take to the bench and save the country from a constitutional crisis!"

PML-N's Ahsan Iqbal said PM Imran had proven to the world that he does not possess even an "iota" of decency, grace and honour.

"Having lost the majority in National Assembly, [he] chooses to bulldoze constitution. He will be defeated with unprecedented humiliation in history," he said.

They even made the opposition ask for security and closed down the red area so Fazlur Rehman could not even bring out his goons. All the political parties were outplayed without using any illegal act and all of it was done without breaking the law.

Dismissed because the meeting between Biden and our mission in the US took place on March 7th. Opposition submitted the motion for no confidence on March 8th. As per Article 5 - citizens have to be loyal to the country. Speaker ruled that as the motion for no confidence was influenced by a foreign power, hence the opposition violated Article 5.
 
IK ordered his pti MNAs to come to the assembly today because he wanted to see who sold himself for horse trading. Only 80 pti members turned up today.

Chaudhry Sarwar was fired today because he was secretly helping out the opposition. Master stroke by IK. The man knows what he is doing.

IK has played this beautifully. He has singlehandedly taken on everyone, the opposition, military, Western establishment ! and is still standing.
 
IK has thrown heavy punches today this will knock the opposition out of next elections. IK is going to ride this massive support wave now. Before next elections if IK manage to get Shahbaz and Hamza in custody then PMLN campaign is going to be severely hampered and effectively PMLN politics is dusted.

Sindh will be interesting as lets see if PPP and MQMP coalition will exist for another day or not.

I have got a question here. If opposition takes this to SC can the Govt. then link this with sedition case on opposition leaders? Can SC then hear both cases in tandem as they both relate to same subject. In that case I'm sure opposition would back out of this SC hearing.

PS - I know SC cannot overrule on Parliamentary law. Also in 1989 SC passed a ruling in favour of assemblies dissolved when Zia did it.

It just seems wrong that a governing party can dissolve the parliament before the term expires without allowing other parties to stake a claim to form the government. A dangerous precedent.

I read that line above and it's nonsense. Actions of the speaker is not the same as actions/decisions/rulings of parliament.

Need more clarity on this.

You can't have elections till you have an interim govt. You can't have interim govt if assembly is dissolved.

This will get challenged in SC. But nice move nonetheless.

Have to say, if the Pakistani constitution is roughly similar to UK/India on these procedural matters, the supreme court would eventually have to settle the matter.

It just seems wrong that a governing party can dissolve the parliament before the term expires without allowing other parties to stake a claim to form the government. A dangerous precedent.

Pakistan constitution goes one step further to not allow question on actions of parliament. That's another dangerous proceedings.

I was thinking the same. The power play is bad in India, but at least the rules are clear and political parties stick to it.

True democracy can never reign in Pakistan unless their laws are clear and not so random.

PTI supporters might be happy as IK will remain/return in power. But this also means that by chance if someone else (non PTI) gets into power they can keep playing the same card and remain in power. Does not bode well for the long run.

Institutions should not depend on one person or the messiah factor. The institutions need to be strong bz themselves. IK might have good intentions, so its good to bring him back. But the next might not have the best of all Pakistanis in mind. And these laws could be used by that person.

Will get challenged but will be put to the public vote. THE ELECTIONS. Imran to get a strong majority.

btw the interim government is installed after a government completes its term or assemblies are dissolved.

So now President, PM and Opposition leader will pick a caretaker PM following consultation(s)
 
ISLAMABAD: President Dr Arif Alvi has dissolved the National Assembly on the proposal of Prime Minister Imran Khan.

In a surprise move, Prime Minister Imran Khan on Sunday said that he has advised President Alvi to dissolve all the assemblies.

This major political development came shortly after NA Deputy Speaker Qasim Suri rejected voting on the no-confidence motion against PM Imran Khan, calling "unconstitutional".

An official notification dissolving the Assembly has been issued.

According to sources, elections will be held within a period of 90 days.

In a brief address to the nation after the no-confidence motion was rejected, the premier congratulated the nation and said that he had sent a proposal to the President to dissolve the NA and the nation should prepare for the next elections.

Special Assistant to the PM Dr Shahbaz Gill then confirmed that the assembly has been dissolved.


PM Imran Khan's brief public address was telecast shortly after a crucial National Assembly session that was set to vote on the no-confidence motion against him was abruptly adjourned as the deputy speaker deemed the no-trust vote "unconstitutional". The premier skipped the NA session.

Pleased with the NA deputy speaker's ruling, the premier congratulated the nation over the development.

“The NA speaker has rejected the move intended at changing the regime and I congratulate the entire nation on it.”

“Pakistan came into existence on 27th Ramzan, and this nation will not let such a conspiracy get successful."

He said that after the decision the NA deputy speaker made using his constitutional right, he [PM Khan] has suggested President Arif Alvi to dissolve the assemblies.

“In a democratic society, the democrats go to the people, elections are held and the people decide who they want to rule.”

The prime minister said that all the money spent on buying loyalties will get wasted. He told the people who have taken this money that they still have the chance to spend it on charity.

He told the nation to prepare for elections.

“No foreign power or any corrupt elements, but only you have to decide for this country.”

He said that as soon as the president receives his suggestion, the assemblies will be dissolved and the process of a caretaker government will start.

The no-trust vote against the Imran Khan government was rejected on national security grounds

The Opposition front in Pakistan will stage a sit-in at the national assembly till the no-trust vote against the Imran Khan government is held, Pakistan Peoples' Party leader Bilawal Bhutto Zardari said today.

Taking to Twitter after the Deputy Speaker of Pakistan's national assembly, Qasim Suri, rejected the no-trust vote on grounds of national security, Mr Bhutto Zardari tweeted, "Government has violated constitution. did not allow voting on no confidence motion. The united opposition is not leaving parliament. Our lawyers are on their way to Supreme Court. We call on ALL institutions to protect, uphold, defend & implement the constitution of Pakistan."

In the accompanying video address said the world knows that the Opposition has the numbers to win the vote of no-confidence. "At the last moment, the Speaker took an illegal step. Pakistan's law was broken. As per law, the no-trust vote is to happen today. The united opposition has decided to stage a dharna in national assembly till we are given our legal right. Our lawyers will reach the Supreme Court to ensure that the no-trust vote happens today," he said.

"The Parliament cannot be dissolved, (the government) must face the no-trust vote," Mr Bhutto Zardari added.

"Imran Khan has exposed himself with this juvenile act," he added.

In an address to the nation shortly after the no-trust vote motion was rejected, Imran Khan asked the people of Pakistan to "get ready for elections". "The conspiracy to take down this government has collapsed," he added.

"The people should decide what they want, not foreigners. Buying people's support with money has resulted in this (situation). Put that money into something better, for orphanages etc. I implore the nation to prepare for elections. You will decide the future of this nation, not foreigners or corrupt people," Mr Khan said in his address.
