Panamagate Case: Supreme Court disqualifies Prime Minister Nawaz Sharif in unanimous verdict

thats probably the last thing I would expect from them, far behind moustache twiddling and gratuitous antiquated not-really-legalese latin.

I find Laltains earthy and rustic and not in the least bit gratuitous. Besides, in this case, the Justice outdid himself, like the Hafeez innings today. Centuries later, when the judgement is being endured, historians will pore over his words and realize how they were a prophecy in plain sight.
 
Nothing is going to come off this case. It's been more than a month why is the result taking this long? I think the judges know Nawaz is guilty but they are employing the classic Pakistani delaying tactics and soon other issues will take precedence and nobody would even care about this Panama case.
 
IT has been a long wait for the Panama case judgement which is likely to change the country’s political dynamics. More than six weeks have passed since the court concluded the hearing and went into a huddle. There was no short judgement and it does take some time to arrive at a decision especially when there are five highly independent-minded judges examining all the legal aspects of this extremely complicated case with serious political ramifications. The nation seemed to have been put on hold waiting anxiously for the outcome.

Not only does Prime Minister Nawaz Sharif’s political fortune hang in the balance, the impending ruling will also define the future course of Pakistani politics. What has heightened the suspense is the observation made by Justice Asif Khosa, the head of the bench during the hearing, that the judgement would be remembered for the next two decades. Surely it would be historic, but one is not sure how.

It is also the judges who seem to be on trial. It is not just the legal aspect of the case, but the politics of it that makes things much more complicated. Although all sides across the political divide repose confidence in the apex court, there are obviously partisan expectations in such a high-profile case implicating the country’s most powerful political dynasty. The past baggage of the doctrine of necessity and allegations of politically biased judgements too cast their shadows on the judiciary. Surely the pressure is enormous.

It is more than a year since the Panama leaks, about offshore companies and expensive real estate owned by the prime minister’s children caused a political maelstrom to erupt in the country. The series of conflicting and self-contradicting statements given by the prime minister and his children in their defence added to the tumult and provoked a call by the opposition for an impartial inquiry into the leaks.

A dubious letter from a Qatari prince revealing a family business connection with the Sharifs turned the whole episode into a political comedy. The judiciary appeared compelled to take up various petitions filed by the opposition political parties against the prime minister and his family. A more simplistic explanation is that the failure of the investigative agencies left the country’s highest court with no other option but to intervene in the matter. But one tends to believe that it was more to do with opposition political pressure that finally worked in getting the court’s attention. Not surprisingly, the case became the centre of a political battle.

While the judges heard the arguments, the PML-N and PTI fought it out outside the courtroom and on TV talk shows every evening accusing each other of corruption and declaring victory even before the hearing was concluded. Matters seem to be getting more intense and extremely bizarre with the expectation of the judgement any day.

No doubt, the political stakes are high for both the government and the opposition, particularly the PTI, the prime mover of the Panama petition. But it is the prime minister and his family who stand to lose the most in case of an unfavourable judgement. The scandal has already caused him huge political damage and it is extremely hard to recover from it even if the court spares him the ultimate humiliation of being removed from office. There is certainly a precedent where the Supreme Court disqualified a sitting prime minister, but few believe it could happen to Sharif. That is perhaps also the reason for the confidence of the ruling side.

But some would argue that the present court is very different from courts in the past with far more independence allowing it to bear pressure even from the most powerful executive. The observations made by the judges during the hearing reinforce that perception.
Surely the judges are not supposed to decide the case along political lines but on its legal merits. Most legal experts agree that the Sharif family has failed to prove the money trail to the offshore companies and the London properties that it owns. But is this sufficient to declare the prime minister guilty of wrongdoing? This is for the judges to decide. Whatever the ruling may be, it is not hard to envision the political fallout.

It could not have come at a worse time for Nawaz Sharif, as he finally looked politically more stable with civil-military relations seemingly better and no real threat from the opposition political parties. His supporters appeared extremely confident of the coming elections. But it may not be that easy any more irrespective of whatever the ruling may be.

There seems to be no good scenario for Sharif even if he is personally not held guilty. It appears that it will be hard for the courts to grant a clean chit to the entire family with so many anomalies in their statements. One thing is certain — Sharif cannot get out of the Panama scandal unscathed. What are his choices in case of an unfavourable ruling?

There is strong speculation he will dissolve the National Assembly and call early elections. But that would be quite risky. One is not sure that all the provinces will follow suit. Such a situation could create greater political chaos. It may be true that the party is still deeply entrenched in Sharif’s stronghold of Punjab.

But an adverse judicial verdict could change the electoral situation quite drastically. There is a big question mark about whether the party could retain its unassailable position in Punjab and hold on to the periphery in other provinces. He may well have to wait for the general elections that are only one year away.

It is now just a matter of time when the judges will come out with their ruling on the Panama scandal. The judgement will surely be remembered for many decades with Sharif’s political fate at stake.

ISLAMABAD: A copy of the Panama case verdict, written by the head of a five member bench of the Supreme Court of Pakistan has reached Prime Minister Nawaz Sharif.

According to sources, the judgment bears the signatures of four judges and the fifth judge has to sign it. The judgment was written by head of the bench, Justice Asif Saeed Khosa. The fifth judge will write a dissenting note, that is why he has not sign it yet. The government has planned a strategy to use the media in its favour after the announcement of the verdict. It will try to highlight the dissenting note of the judge in the media to taint the whole verdict. Through the media, the government will try to malign the superior judiciary.

The government has already tasked its media team to mislead the people through the mainstream and social media on the verdict. It will try to prove that the court could not find any evidence of corruption, money laundering or power abuse against the ruling family. Besides ministers, legislators and legal teams, the PML-N media team will also start a smear campaign against PTI leaders and other petitioners in the Panama case, so that the attention of the public was diverted from the judgment.

Chaudhary Ghulam Hussain said on his program that the decision is coming this week. He is a pretty reliable source going by the past.

I think he is still one of very few decent PMLN leaders and could well be Prime Minister soon.

It is amazing how people are waiting for this verdict, anything against PM and his family will severely dent their image and people are actually keen on verdict. May not make huge difference in elections as people tend to vote based on local gali mohalla politics rather than national interests. Whatever the decision maybe but Sharif family is not going to get a clean chit after what people witnessed during hearing so PTI should be ready to pounce on anything that comes out.
 
It annoys me that everything nowadays gets "gate" attached to it. Panamagate makes no sense.
 
There is a perception that a commission will be formed along with recommendations for institutional and structural changes in national
institutes.
 
Khosa is in the opposing judgement. Does that mean it goes for pmln as I thought he was the most hard on government lawyer

The Supreme Court on Thursday gave a split judgement on the highly anticipated Panama Papers case, issuing an order for the formation of Joint Investigation Team (JIT) to probe how the Sharif family transferred money to Qatar, according to media reports.

Defence Minister Khawaja Asif told reporters outside the apex court that the verdict was split 3-2. "They have said what the PM already said in his letter ─ that a commission should be constituted to investigate the matter," he said.

"We are ready for all kinds of investigation," Asif said. "It has been established today that any evidence or sacrifices given by our opponents in the SC were not enough. We have succeeded."

Railways Minister Saad Rafique asserted that the PML-N would "fully cooperate with the JIT and the court's decision will be respected."

The Pakistan Tehreek-i-Insaf (PTI) should also respect the court's decision, Rafique said, among slogans of "Go Imran, go."

Minister for Planning and Development Ahsan Iqbal termed it a "historic victory" for the PML-N. "The minority judgement shows that the PTI represents a minority in Pakistan."

A five-judge bench, comprising Justice Asif Saeed Khosa, Justice Gulzar Ahmed, Justice Ejaz Afzal Khan, Justice Azmat Saeed and Justice Ijazul Ahsan, had examined arguments presented by the PTI, the Jamaat-i-Islami (JI), the Watan Party and the All Pakistan Muslim League, who framed the case out of court as a campaign against corruption.

Justice Asif Saeed Khosa began announcing the final verdict in the case against Prime Minister Nawaz Sharif and his family at Courtroom 1 at the apex court. Justice Ejaz Afzal authored the 540-page verdict, according to TV reports.

The final verdict is split 3-2 among the bench, DawnNews reported, with two dissenting notes in the judgement by Justice Khosa and Justice Gulzar. The two judges ruled against PM Nawaz Sharif, whereas the other three were in favour of forming a JIT.

We will fully cooperate with the JIT and the court's decision will be respected.

Justice Khosa asserted that the Federal Investigation Agency and National Accountability Bureau were unsuccessful in playing their role effectively.

The JIT is to include officials NAB, FIA, Securities and Exchange Commission of Pakistan, Inter-Services Intelligence and Military Intelligence, the bench said, and will be led by a director-general level FIA officer. The names of members of the JIT must be announced within seven days.

A special bench will examine the case under Section 184/3 of the Constitution.

A letter from a Qatari royal submitted to court as evidence by Sharif's lawyers was dismissed by the bench, which said that the transfer of money to Qatar must be examined by the court.

Prime Minister Nawaz Sharif, Maryam Nawaz, Hasan Nawaz, Hussain Nawaz, retired Capt Muhammad Safdar (the PM's son-in-law) and Finance Minister Ishaq Dar are the respondents in the case.

The petitioners had touted the revelations brought forth in the Panama Papers, published by the International Consortium of Journalists on April 3, 2016, as 'evidence' that the premier had lied to the nation in an address to Parliament where he 'explained' his position following the leaks.

Panama leaks
The Panama Papers, which refer to a massive trove of secret documents leaked from Panamanian law firm Mossack Fonseca — which specialised in helping the global elite stash wealth in offshore tax havens — had said that the PM's children, Maryam, Hasan and Hussain Nawaz "were owners or had the right to authorise transactions for several [offshore] companies".

At least eight offshore companies were found to have links to the Sharif family in the documents that were leaked.

The fallout
The revelations had raised serious concerns regarding the legitimacy of the family's wealth, offshore holdings and business interests, and catalysed opposition parties to rally for the investigation or resignation of the prime minister and his family members.

Maryam Nawaz had initially dismissed the documents as a distortion of information, but the prime minister had to eventually relent and order a judicial probe into the allegations raised by opposition parties.

In a televised address, the premier also attempted to document his family's financial history and said he was open to a probe.

Legal action and court proceedings
What followed was a protracted tussle on who would lead the commission (the PTI had wanted the sitting chief justice, while the PML-N approached at least 5 ex-SC judges; each of them refused) and the terms of reference of the inquiry (which neither government nor opposition could come to terms on); a second televised address (in which the premier said he would resign if proven guilty); a landmark parliamentary speech (in which a sitting prime minister defended himself on the floor of the National Assembly); and mounting pressure from the Army and opposition parties, after which the case finally landed in front of the Supreme Court.

The case settled on Thursday had been initiated on January 4, 2017 under a reconstituted bench comprising the five judges mentioned earlier in the story after former Chief Justice Anwar Zaheer Jamali, who initially took up the case, retired midway into the proceedings and was succeeded by the incumbent.

The case reviewed four petitions filed by Advocate Tariq Asad, JI chief Sirajul Haq, PTI chairman Imran Khan and Awami Muslim League leader Sheikh Rashid Ahmed, who had petitioned the Supreme Court to disqualify Prime Minister Nawaz Sharif for making misstatements in his speech in the National Assembly on May 16 and in his address to the nation on April 5 last year regarding investments made by his children in offshore companies that led to the purchase of four upscale flats in London.

After hearing the arguments from both sides, the bench had reserved its ruling on Feb 23 with the observation that their judgement would remain relevant and valid for at least 20 years.

Judgement day
The landmark judgement was made public 57 days after the case was last heard by the court. The federal capital was abuzz with excitement ahead of the pronouncement as the country waited for the historic verdict.

Islamabad's Red Zone, where the Supreme Court is located, had been on 'red alert', with around 1,500 police, Rangers and Frontier Constabulary personnel deployed in and around the area for security and to maintain peace. Police officials, including Special Branch officials, were deployed for intelligence gathering and timely responses.

Heavy contingents of security forces personnel had been deployed in and around the Red Zone. Strict checking was implemented at entry points into the Red Zone, where only concerned individuals, including government officials and residents of the area were being allowed entry.

Only individuals with passes were allowed onto court premises. Ordinarily, there are about 60 to 70 reporters at the apex court on a daily basis, but many more today turned out to witness the judges deliver the historic verdict.

PML-N and Pakistan Tehreek-i-Insaf (PTI) leaders had gathered outside the Supreme Court ahead of the announcement and made charged statements on their hopes for the outcome.

The prime minister himself followed the proceedings with his family and senior party officials from his residence.

Exactly I see this as a loss for Nawaz Sharif. The decision for a commission might not be what people wanted but it looks even worse for Sharif as none of the judges has faith in his innocence.

PTI should play sensibly in media because 80% decision is in their favor with 2 upcoming chief justice giving decision against nawaz and other 3 also didn't find him or his family innocent. PMLN media team is making it look like a victory by managing the media really well.
 
Any respectable politician from a western state would have resigned the moment the case was registered against him let alone when an inquiry commission is set up to look into his past activities.
 
We should accept whatever court decided. Even i am disappointed, however things happened for good.

Let this government finish its tenure.

Thats because the awam wont vote them back, it doesn't work like that in south asia example Laloo,Mulayam,Badals.

In summary, 2 judges agreed that the PM is corrupt and 3 said it needs to more investigation. In any self respecting country it would mean resignation of any Minister but in PK the PMLN supporters are claiming victory. It just shows their low morals but Allah knows best.

CPEC has nothing to do with any civilian government, it has and will happen under Army. It is the life-line for our country now, hence cannot be trusted with any civilian government. Same with Zar-b-Azb, all happened without the government, so it makes no difference. Hence why army officials make more trips to China than any civilian government.

They (a 5 judges) today labelled Qatari letters as fake, letters which were the basis of the ENTIRE defense from the government. In any country it'd meant a disqualification.
 
Do you think that an ordinary person would got away with the fake evidence provided ( and acknowledged by the SC) by the Sharifs? If no, then the 3 judges deserve all the humiliation.

how do we know those are fake evidence? Again point is to respect Judges and court decision.

CPEC has nothing to do with any civilian government, it has and will happen under Army. It is the life-line for our country now, hence cannot be trusted with any civilian government. Same with Zar-b-Azb, all happened without the government, so it makes no difference. Hence why army officials make more trips to China than any civilian government.

Unless the Army has started employing Lawyers ,economists, statisticians not sure how that will be going ahead, the times of Zia,Mushraff were different businesses and Unions probably worked under him.

I don't know how much you know of Pakistani politics, in our country the foreign affairs are pretty much run by the Army. While the domestic affairs by the civilians.

Army operations and Pakistan's foreign policy is an indicator. A sad system but the politicians really leave little choice and seem content with the arrangement as long as they can loot away. After Musharraf the army doesn't interfere in domestic affairs.
