I have a soft spot for the Sher however even i find it remarkable that Sharif is just carrying on here as if nothing has happened. At the very least she should step down and call for early elections. Let the electorate judge him and his party.

Military to play 'due role' in SC JIT probing Sharif family

The Army's senior command resolved at a Corps Commanders' Conference at General Headquarters on Monday that the military would play its 'due role' as part of the Supreme Court-ordered Joint Investigation Team (JIT) which will probe Prime Minister Nawaz Sharif and his family's business dealings abroad.

Inter-Services Public Relations (ISPR) in a statement said the forum had discussed the apex court's Panamagate verdict with special reference to the JIT.

"The forum pledged that the institution, through its members in the JIT, shall play its due role in a legal and transparent manner, fulfilling [the] confidence reposed [in the military] by the apex court," the ISPR said.

If so, keeping Nawaz in place, but using the JIT to not allow the issue to move to the backburner, helps achieve both goals. The issue remains in the news, so much so that the 2018 polls come along, and Nawaz has no excuse for not having turned things around in spite of having had the full five years, and consequently loses. Another issue is that Nawaz, his venal corruption, shameless nepotism and incompetence notwithstanding, has delusions of being a statesman. There's a part of him that wants to be remembered for having made his mark at the international stage. Yet The Boys have him on the back foot, and have had him there since the 2014 dharna. They now have even more leverage on him, and will continue to do so until at least this time next year. Why would they want such a compromised PM to leave? The next one, even if it is from within the PMLN, won't necessarily have all of Nawaz's baggage.

Many stories are out in the market so it's getting interesting but it's pretty clear now that Dawn Leaks in a few days will give us the clear picture about what's going to happen in other cases and the mood of civil-military relationship.
 
SC concerned over FIA official recommended for JIT to probe PM, sons: sources

ISLAMABAD: Chief Justice of Pakistan (CJP) Mian Saqib Nisar on Tuesday formed a special cell for the constitution of a six-member Joint Investigation Team (JIT) to probe Sharif family’s alleged corruption in the Panama Papers case.

The special cell, which will work as a liaison office between the JIT and a special bench of the apex court, will be headed by the top court’s Additional Registrar Muhammad Ali, sources told The Express Tribune.

Sources further said there’s been a delay in the formation of the JIT as the apex court has expressed concern over the name of a Federal Investigation Agency (FIA) official recommended for inclusion in the six-member investigation team.

The sources, however, said the apex court may notify the JIT later in the day. “The court is also reviewing names of officials sent by Inter-Services Intelligence and Military Intelligence.”

NAB claims to have suggested formation of JIT

In its April 20 judgment, the apex court had ordered the formation of the JIT to probe offshore assets of the prime minister and his two sons. The JIT, according to the court ruling, would comprise representatives from the National Accountability Bureau (NAB), Federal Board of Revenue (FBR), Security and Exchange Commission of Pakistan (SECP), FIA as well as officials from the MI and ISI.

The JIT shall submit biweekly reports before a special bench – a request for its formation is part of the judgement. It has also been given a sixty-day deadline to file its final report.

It is rare and unprecedented that a sitting prime minister would be quizzed by officials from civil and military institutions for his offshore companies. The premier has all along denied any wrongdoing since the scandal first surfaced when documents from a Panamanian legal firm was leaked by a consortium of international investigative journalists in April last year.

Although the majority of judges ruled against Premier Sharif’s sacking, the 545-page ruling did raise serious questions about the failure of the prime minister and his legal team to justify his family’s offshore holdings.

JIT set to begin inquiry into Sharifs’ assets

ISLAMABAD: The Pak*istan Tehreek-i-Insaf (PTI) on Monday demanded that the inquiry into the assets of the Sharif family not be held in camera as the joint investigation team (JIT) constituted under a Sup*reme Court order conduc*ted an orientation visit to its newly-allocated secretariat.

“We will not accept in-camera proceedings of the JIT,” PTI spokesperson Fawad Chaudhry told Dawn.

He was reacting to reports that JIT members, led by Federal Investigation Agency (FIA) Additional Director General Wajid Zia, had visited the Federal Judicial Academy — the premises selected by the apex court for the team — for an orientation.

Media reports suggested that JIT members examined security arrangements as well as the facilities being provided to the team under the May 4 Supreme Court order.

The team is expected to commence regular meetings in a couple of days, since it has to submit progress reports to the Supreme Court every fortnight.

On May 4, a three-judge special bench of the Supreme Court, headed by Justice Ejaz Afzal Khan, had announced the composition of the six-man team.

Led by FIA DG Zia, the team will consist of State Bank of Pakistan officer Amer Aziz, Securities and Exchange Commission of Pakistan Executive Direc*tor Bilal Rasool, National Accountability Bureau’s Balochistan Director Gene*ral Irfan Naeem Mangi, retired Brig Mohammad Nauman Saeed of the Inter-Services Intelligence (ISI) and Brig Kamran Khurshid from Military Intelligence (MI).

The JIT was constituted in line with the April 20 Supreme Court judgement in the Panama Papers case.

The court has already ordered the federal government to apportion a fund of Rs20 million so that JIT can function independently and does not feel handicapped in its working.

“We are concerned that the JIT did not issue any handout on Monday after holding its maiden meeting,” said PTI’s Fawad Chaudhry, adding: “There*fore, nobody knows what transpired during the meeting”.

He said that PTI would never accept a closed-door meeting, and warned that the party could petition the Supreme Court or hold protests demanding live coverage, or at the very least, open proceedings of the investigation team. “This concerns the 20 million people, being a public interest case,” he said.

When the JIT commences its work, it will enjoy the power to engage and associate local or foreign experts to facilitate both the investigation and the collection of evidence, in line with the letter and spirit of the Panama Papers case judgment.

The JIT will also have all powers given under laws relating to investigation, including those available in the Code of Criminal Procedure (CrPC) 1898, National Accountability Ordinance 1999 and the Federal Investigation Agency Act, 1975.

As the JIT, in essence, is acting on the directions of the Supreme Court, all executive authorities throughout Pakistan are supposed to act in its aid.

If and when any person fails or refuses to associate with or appear before the JIT or refuses to cooperate or provide oral or documentary information, the same should be immediately brought to the notice of the Supreme Court for taking appropriate action, the order had said.

ISLAMABAD: The Joint Investigation Team (JIT) constituted in compliance with the Supreme Court’s verdict in the Panama Papers case would concentrate more on uncovering new facts than on reinvestigating the available record, sources said.

The sources, however, said it was unlikely for the JIT to complete the task in the allo*tted period of two months, and rather it would need “several months” to do the job.

They said the JIT would try to get hold of verified documents of the London apartments owned by the family of the prime minister as well as certified details of the offshore companies used to buy them.

The team would try to get these documents through diplomatic channels and for the purpose would send letters to relevant ministries and departments.

The JIT would request the country’s missions abroad to get the requisite documents attested by foreign ministries of the countries concerned and then send them over to it.

The team of investigators also decided that the two letters of Qatari prince Hamad Bin Jassim Bin Jaber Al-Thani about the London properties would be verified, the sources said.

However, the entire exercise was unlikely to be completed within the stipulated period of two months, the sources said.

“If the JIT decides to investigate all the allegations levelled in connection with the properties, then it will need several months to complete the probe,” said a senior officer who has led many high-profile investigations.

In his opinion if the JIT decided to find facts about all the questions raised by the apex court it would need at least three months to complete the task.

According to him, the difference between finding the appropriate facts and investigating something was that the latter was considered more comprehensive as it was carried out under the criminal procedure code (CrPC) and could be used in the trial court as valid evidence.

However, in its order of May 5 the Supreme Court empowered the JIT to invoke provisions of the CrPC 1898, National Accountability Ordinance 1999 and Federal Investigation Agency Act 1975 to summon the prime minister, his sons, ministers or any other person required.

The sources said that in order to verify the information contained in the available record, the JIT might call some witnesses involved in the Hudabiya mills case.

The team might also summon the magistrate who recorded the confessional statement of Ishaq Dar to verify it. Mr Dar was an accused in the corruption reference pertaining to the Hudabiya Paper Mills Limited (HPML) that was instituted by the National Accountability Bureau (NAB) soon after the then army chief General Pervez Musharraf had toppled the government of Nawaz Sharif.

Later, Mr Dar became an approver and submitted an application to the NAB chairman on April 20, 2000 and appealed for a pardon in the case.

In his statement Mr Dar said: “...The detailed statement of facts, circumstances and events etc leading to accumulation of Rs642 million in the accounts of HPML is enclosed herewith for your kind perusal and consideration.”

However, after re-emergence of the Pakistan Muslim League-Nawaz on the national scene, Mr Dar backtracked from his statement.

Meanwhile, the JIT has sought details of income tax returns of Prime Minister Sharif from the Federal Board of Revenue, the sources said.

The JIT also examined the details of assets of Mr Sharif and his son-in-law Captain Mohammad Safdar on Friday and after taking certain decisions for its next meetings, it adjourned further proceedings till Monday.

London properties: British firm to conduct forensic audit of documents

ISLAMABAD: The Joint Investigation Team tasked by the Supreme Court with probing the offshore financial assets of the Sharif family decided on Monday to hire the services of a UK-based firm for forensic audits to validate the information the ruling family would submit about its London properties.

Bilal Rasool – who represents the Securities and Exchange Commission of Pakistan in the six-member JIT – has been assigned to look for a suitable firm for the purpose, according to media reports.

The JIT held its seventh meeting at its secretariat in the Federal Judicial Academy. During the meeting it was decided that the JIT would only treat authenticated and certified copies of relevant record as ‘admissible evidence’.

The decision came after JIT members scrutinised the 17-year-old Hudabiya Paper Mills and other related records submitted by the National Accountability Bureau. The record was non-certified.

The JIT sent a letter to the FBR on Friday seeking detailed and certified tax returns of the prime minister. The JIT continued deliberations on a proposed questionnaire, which would be sent to individuals named in the case, including the Qatari prince and PM’s cousin Tariq Shafi.

The team would probably finalise the questionnaire before May 22 and get it endorsed by the top court’s three-judge special bench for the implementation of the Panamagate verdict. The special bench will hold its hearing on May 22 where the JIT would inform it about the progress in the ongoing investigation.

Once approved, the questionnaire would be dispatched through the Ministry of Foreign Affairs and Pakistani missions abroad to the persons concerned.

The JIT members also examined asset statements filed by the prime minister and his son-in-law for the period between 2013 and 2016 by the Election Commission of Pakistan.

It was also decided that within this week, the JIT would write to the Foreign Office to contact foreign countries to obtain certified record of the Sharif family’s properties and offshore companies.

Sharifs start playing cat and mouse game with JIT

ISLAMABAD: As the Joint Investigation Team on the Panama case is geared up to collect evidence against the prime minister and his children, the ruling Sharifs are all out to play cat and mouse game with the investigators.

To get the JIT on the back foot, already objections have been raised by the Sharifs not
only on some members of the Joint Investigation Team but also on its working. On Tuesday, the objections over the JIT came from the PM’s son, Husain Nawaz, and his cousin, Tariq Shafi. Today, the prime minister’s spokesman, Dr Musaddaq Malik, showed his reservations on the working of the JIT. Dr Malik said that the JIT’s working was not in line with the law of the land.

This situation is upsetting for the JIT, whose two members have been named as biased by the Sharifs. Sources said that following these objections already made public, the two officers -- Amir Aziz of SBP and Bilal Rasool of SECP -- are disturbed over this situation.

In the past, the Sharif family had opted to forgo its defence over the maintainability of the petitions filed against them in the Panama case before the apex court. Prime Minister Nawaz Sharif, as well as his party leaders, had also announced that they would present all documents and details about their wealth, businesses and properties,

However before the JIT, the Sharifs and their representatives now intend to restrict the probe within the parameters of law and the Constitution. It means that the concessions, immunities and defence available to any defendant/accused as per the law of the land, would be availed by the Sharifs. Such a stance on the part of the Sharifs will make the probe difficult for the JIT.

It is said that the strategy, to be adopted by the Sharifs in regard to the JIT, is being decided by their lawyers. However, the government’s legal minds say that under the law, neither the sons of the prime minister could be asked about their foreign businesses for being non-residents nor the business dealings of the late Mian Sharif, father of Prime Minister Nawaz Sharif, could be reopened and questioned.

In this situation, it is said, the Sharifs will share only those documents which suit their case. If summoned, the prime minister and his sons would appear before the JIT but their response would be calculated and to the point. They won’t be forthcoming before the JIT.

Legally speaking, it is explained by a government’s legal mind, the Sharifs' wealth, including Saudi-Dubai mills and London flats and the offshore companies, have never been in the name of Prime Minister Nawaz Sharif. It is said that it was deliberately done to save Nawaz Sharif from controversies relating to the Sharifs’ wealth and businesses.

For the last few days, the government, as a strategy, is bringing pressure on the JIT. On Monday last, PML-N MNA Talat Chaudhry expressed reservations about the proceedings of the JIT and said that the prime minister will exercise all his rights which he had voluntarily withdrawn from the Supreme Court's proceedings.

“We hold the right to exercise the constitutional rights which are given to every Pakistani citizen. We hope that the Supreme Court's JIT will not apply different laws for Nawaz Sharif. We didn’t take immunity before nor now,” he said, adding, “Hassan and Hussain Nawaz should be given the rights which are enjoyed by any non-resident Pakistani.”

A day later, Husain Nawaz approached the apex court with his reservations about the JIT. Consequently, the Supreme Court of Pakistan on Wednesday admitted for hearing his petition raising objection against two JIT members -- Amir Aziz of SBP and Bilal Rasool of SECP. A special bench of the Supreme Court will hear the petition on May 29.

On Tuesday last, Prime Minister’s cousin Tariq Shafi had moved a complaint against alleged ‘misbehaviour’ of some members of the JIT. In his complaint filed to the JIT’s head Wajid Zia, Shafi alleged that he was harassed by some JIT members. On Wednesday, Shafi’s letter was leaked to the media to fuel the controversy surrounding the JIT.

Panama probe: JIT grills Hussain Nawaz for five hours

Hussain Nawaz, the elder son of Prime Minister Nawaz Sharif, on Tuesday appeared again before the joint investigation team (JIT) probing the Panama Papers case, reported DawnNews.

Hussain Nawaz was grilled by the JIT members for almost five hours at the National Judicial Academy. Earlier, he had appeared before the Supreme Court appointed JIT on Sunday May 28.

The premier's son had refused to answer any question put forth by the JIT, saying that the JIT's status was 'sub judice' as he had already filed a petition before the apex court regarding two of its constituents.

On Monday, the apex court turned down Hussain's objections against two of the JIT members. He, through his council, had argued that the two called him a liar during the interrogations. He had also asked the country's top court to disassociate the two from the JIT.

He had objected to the inclusion of two members — Securities and Exchange Commission of Pakistan’s Bilal Rasool and State Bank of Pakistan’s Amer Aziz — accusing them of being close to the PML-N’s political rivals. The three-member bench of the court declared that the JIT could not be reconstituted merely over reservations.

The JIT had issued another summon on May 28, directing Hussain Nawaz to appear before the team again on Tuesday along with all relevant records, documents and material for the recording of his statement and an examination by the JIT.

Following his hours-long interview by the JIT, Hussain told journalists that he responded to all the questions asked by the JIT members. He further said that he was being questioned under a legal process and he was responding to the questions to prove that he respected the law.

He, however, made it clear, "I will approach the court again if I felt that I was not being dealt fairly."

In response to a question, Hussain said that he will appear again before the JIT if asked and added that he was not served with any new summon as yet.

Can't answer in detail right now but in short, 2 judges have already given their verdict, all it takes now is ONE judge out of three that they are not satisfied with responses and Nawaz is gone.
Qatari prince will NEVER come and present himself for grilling and even if he does, his words won't be enough, he will have to show transactions.

In my opinion all 5 judges were convinced NS was involved in all sort of crimes but JIT was formed only because it is a massive deal to kick out a sitting PM on corruption charges so this is more to show that every bit of chance was given to Sharifs to prove innocence.

Also, if Sharifs had anything more solid then they wouldn't have provided long time ago.

Only a background deal, immense foriegn pressure can save Nawaz otherwise he has absolutely no chance.

Fact of the matter is that the courts cannot touch Nawaz Sharif as his name wasn't in the papers. Those who believe that the decision of the JIT will effect Nawaz or Shahbaz or the party in general in any way or form are highly mistaken

2. Under strict definition of Qanoon-shihadat, Qatari prince's mere appearance and statements will not be taken as the truth without any money trail, banking records.

3. This is what the JIT set out to investigate and is looking at the available evidence.

All of this is moot if it can't be proven in court. What do you want the courts to do? They can't do anything nor can anyone else. It's time people started accepting the facts. Like I said in my earlier reply to you. Either prove it court or stop whinging about it because that is not going to accomplish anything.

The SC bench is very angry and rightly so, because the fool said things which he should not have under any circumstances, but I think in their anger they went a wee bit overboard when they said they stood up to military dictators.

They forgot that they hung a PM in a judicial murder - one of the judges on the bench later admitted to the fact. Another bench allowed a dictator to amend the constitution single handedly and that too for a period of 3 years. God was kind and the dictator got so busy that he forgot to tinker with it.

Much earlier they introduced the Law of Necessity which turned out to be a master key. I believe it's very important they don't talk and give judgements only, which will certainly help reduce the unnecessary tension and make them less controversial.

I agree overall.


But Judges are Human beings. They are also Pakistani. They belong to the same culture aswell. They are one of Us. The main Problem I see is " The Media " and there access to Courts. They should not be reporting statements of Judges.


As far as ZAB hanging is concerned it was a 3-2 Judgement. Only God knows whether those 3 really believed He was the Culprit behind the Murder or whether they were forced to do that by Army/ISI or whether they were bribed to do that is something we do not know. They know and Allah knows. We cannot say anything with certainty.


Chief Justice SC Mushtaq Hussain is on Record saying years Later that some people say that it was Bhutto's Lawyers and Legal advisors who paved the way for this Judgement but the fact of the matter is that Allah is the greatest Judge and Bhutto's Judgement was written on the Heavens.


From a Worldly perspective majority Lawyers & Jurists Worlwide believe that as per Pakistani Law and as per International Law even if Bhutto was involved in the murder (planning) even than at most He could have been Jailed for that but the Death penalty was very harsh & unjust. So it was a Judicial murder.


Than it was again the same courts which Punished Nawaz Sharif sahib. Again it all happened under Marshall Law. Whether they were forced or bribed to convict PM sahib in Plane hijacking case is again something we do not know. The same courts overturned the Judgement and punishments later on. It was 25 years Jail Imprisonment.


I hope these people are also held equally accountable infront of Courts

Granted the leak is something that should not have happened and now that it has it should be dealt with but it was under N control to begin with so they can blame themselves for this.

I just came across this on FB and it was captioned, "Hussain Nawaz being questioned by the JIT". Remains to be seen if he was waiting for the JIT or being questioned.

These Geo anchors are the biggest hypocrites on this planet. Their channel kept playing JIT videos of Dr Asim and other with exclusive tag and now they are jumping up and down because of a leaked pic of their sponsor?
 
First Nawaz Sharif created doubts against JIT members who are experts in white collar crimes.

Then there was this fake story about SC registrar nominating JIT members which SC clarified was their choice.

Then there was attack from close aides of Nawaz Sharif threatning Supreme Court judges and their children of dire consequences for which they were labelled Sicialian mafia.

Now intentionally leaked pictures to create an impression that Sharif family is being harassed supported by Nawaz's favourtite journalists MOSTLY from Geo/Jang.


If judges were against Nawaz Sharif, they would've disquaified alongwith other 2 judges and many felt even JIT formation was not required since Sharifs provided ABSOLUTELY no proofs.

Nawaz stands disqualified. There was no need for a JIT, if they wanted it to look more legit, WhatsApp spoiled it. However, what next?

Informed PPP rats make a beeline for PTI, they are welcomed, dry-cleaned but in the process the party, looks like a new dhara...PPP (IK). PML-N will also see some desertions and a new IJI is in the making to end corruption.

The question is whether PML-N will be 'allowed' to continue till next year, or do we see a march towards Islamabad for immediate elections? Or, are we going to have that proverbial interim setup which will clean the system one day in the future followed by an election, sometime beyond the mandatory 90 days.

The situation is too tense for anyone's liking. Both PML-N and PTI are on the edge of a cliff. Pressure on the judiciary is mounting (whether they take it or not is another matter)- this is not normal, something has to give. The country has been through similar stressful situations - in August 1988, and then there was that air crash.

In 1993, there was a confrontation between Nawaz and the President (both had to step down). In 1999, again, the pressure mounted and a legitimate PM was ousted through a coup. In 2007, the pressure was on again and then in December, there was an assassination. How will the present tension be released? Something has to give.

This is not sustainable. Who will be the casualty? The PML-N or PTI or both? I dont see any other likely casualties.

Govt depts tampering with records to help Sharifs, Panamagate JIT tells SC

ISLAMABAD:
The joint investigation team (JIT) probing the ruling family’s offshore wealth has alleged that the records related to the Panama Papers case were being tampered with by some government departments to assist the Sharifs.

“The JIT has alleged that certain institutions are altering records. Even forgery has been carried out,” remarked Supreme Court judge Justice Ijazul Ahsen on Monday. “There are serious allegations levelled by the JIT in its application.”

The remarks were made after the three-judge bench of the apex court went through an application filed by the investigation body, highlighting impediments being faced by its members during its probe.

Another judge, Justice Azmat Saeed Shaikh, observed that there would be far-reaching consequences in case of forgery. “You are representing the federation, not the government,” the judge told Additional Attorney General Waqar Rana.
The top court directed Rana to submit a reply on the JIT’s application.

Earlier, Khawaja Haris, the counsel for Prime Minister Nawaz Sharif’s son Hussain Nawaz, appeared before the bench to take up the issue of his client’s photo interrogation being leaked and request a ban on the video recording of witnesses during their questioning.

The bench, however, told him that the JIT had submitted an inquiry report on the picture leak that would also be forwarded to the AGP and he could share it with the counsel. Later, the hearing of the case was adjourned till Wednesday.

ISLAMABAD: The Joint Investigation Team set up by the Supreme Court of Pakistan to probe the offshore business dealings of the ruling family has leveled serious allegations against state institutions including the Intelligence Bureau, Securities and Exchange Commission of Pakistan, National Accountability Bureau, Federal Board of Revenue and the law ministry.

The report said the officials of Intelligence Bureau intimidated Bilal Rasool, a member of the JIT, and hacked facebook accounts of his family members.

It said the JIT sought records of all inquiries held against Chaudhry Sugar Mills and Sharif Family, but the SECP denied any inquiry was held against Sharif family, with its chairman stopping his institution from searching the records of inquiries.

“Record of Chaudhry Sugar Mills was tempered at the behest of SECP chairman and Executive Director Ali Azeem changed it from past dates”

According to the JIT report Azeem was also nominated by the SECP chairman for inclusion in the JIT as its member to sabotage investigations," it noted.

The report said the law ministry caused five-day delay in responding to its letter that was written in order to carry out investigation abroad.

It accused NAB of exerting pressure on JIT member, Irfan Mangi by issuing him a show cause notice on April 25, for his deputation in the country’s anti-corruption watchdog.

The panel said in its report to the Supreme Court that the FBR provided record of Shairf family from last five year when it was asked to provide record since 1985.

It accused the government of of leaking details of JIT correspondence with institutions.

The JIT report said Tariq Shafi was asked by the chairman of Ittefaq Group to visit Prime Minister House prior to his appearance before the JIT.
