IHC dismisses petition challenging ban on cricketer Sharjeel Khan

ISLAMABAD: The Islam*abad High Court (IHC) on Monday dismissed a petition filed by cricketer Sharjeel Khan against imposition of a five-year ban on him over a spot-fixing scandal.

The anti-corruption tribunal of Pakistan Cricket Board (PCB) had last year imposed the ban on the left-handed batsman over charges of spot fixing in Pakistan Super League (PSL). He was accused of playing two dot balls in one of the PSL matches.

Justice Aamer Farooq of the IHC dismissed the cricketer’s petition for want of jurisdiction.

During the hearing, Deputy Attorney General Raja Khalid Mehmood Khan raised the objection that the IHC lacked territorial jurisdiction to entertain the petition since the tribunal, which convicted the cricketer, had conducted the trial in Lahore.

In his petition, Mr Khan had cited the ministries of law and inter-provincial coordination, PCB chairman, independent adjudicator of NCA Lahore and PCB’s anti-corruption tribunal chairman as respondents.

The counsel stated that petitioner Sharjeel was an international cricketer who made his debut in 2013 and was charged by the PCB for committing violations of the board’s anti-corruption code. He added that the notice of demand was issued to the petitioner on Feb 13, 2017 under Article 4.3 of the code to appear before the PCB’s security and vigilance department on Feb 17.

The petitioner’s so-called interview was conducted on the above-mentioned date and then on Feb 18 a notice of charge under Article 4.6 was issued to Sharjeel Khan.

What a team; Batting all the way down, 4 genuine seam options, 5 if you include Talat, and 2 spinners, not including Fakhar Zaman. If Talat improves, you could conceivably drop a front-line seamer and bring in a spinner. Because there's loads of bowling options, you could drop someone like Imad and play Sohail Akhtar...?

If only Sharjeel wasn't so greedy.
Also, I hope that when he does come back, he'll be a lot fitter than we remember him. He has no excuse not to be if he's serious about playing for Pakistan again.
 
Sharjeel never spot fixed, this is about Sethi who messed up and opened his big mouth (as per usual) to shriek "look at us we are anti-corruption angels and have caught another fixer" in order to score brownie points in respect of "reputation" with ICC and the rest of the cricketing world.

Sethi screwed up when he realised he opened his mouth too soon, so for the sake of his ego and not be viewed as an inept and incompetent individual - him and his PCB cronies went out of their way to get this guy convicted.

Pakistan may have won the CT last year but they still don't have a second opener. The likes of Azhar Ali, Babar Azam, Haris Sohail, Umar Amin, Inzy's nephew et al are just not good enough. Unfortunately PSL 3 has failed to unearth another prodigy in respect of an opening batsman. We all had a glimmer of hope for Sahibzada but he simply isn't ready and his example makes a great case study with the difference in standard in PSL and other domestic Pakistani T20 (and list A) tournaments where he has been immense.

You have to remember the talent pool is watered down due to the greater number of teams (and no foreign stars), which allows players like Farhan (who are not ready for internationals) to dominate the lesser bowlers + poor, less fit fielders and vice versa with the case of bowlers.

Didn't intend to bring politics into this but perhaps if there is a change of govt whenever the next election is, we will see Sethi and his team gone with new PCB staff who will expose their sins but more importantly bring an innocent player ideally ASAP because he will be needed in the WC next year.

I agree Farhan isnt ready yet but our next Intl limited over commitments are the worst WI team of all time and a tour of Zimbabwae. Asia Cup may be tough but aside from India and Rashid Khan the bowling by the teams will be quite poor. The real test is Aus in UAE later on in the year. So I think its prudent to give him a go. He isnt going to improve in domestic List A/t20s

As there are no other viable options then yes instead of leaving him rotting in domestics might as well play him and see if he can make it by 2019 WC.
 
To put in perspective Sharjeel is alleged to have blocked two balls and he was banned for 2.5 years. However, Smith and Warner did blatant and pre-planned cheating but ICC banned Smith for one test and CA banned them for 1 year. Mashallah.



So cheating the game isn't bringing it into disrepute?

Apparently cheating isnt a big deal because it doesnt make you less patriotic ( you dont sell your country). ICC doesnt care much until you are patriotic enough.

Unbeleivable...on one hand Aussie fans are outraged about the whole saga and this over the top reaction got them a ban of 1 year which I feel is a little harsh but that’s fine

and on the other hand Pakistani fans are saying the punishment for fixing which is a much worse crime is too harsh :))

Fixing and spot-fixing are two different instances. Also to this day no proof has been presented of Sharjeel's/Latif's guilt. They PCB/Authorities promised proof would be released but nothing was provided, hence they replies you see here.

If he was found guilty, with actual proof you'd see more fans wanting the punishment to stand and be adhered to.

Where's the proof on Sharjeel and Latif? This was Sethi's ruling and he still hasn't presented anything. That's the point.

Agree on the last paragraph. It's more-so to do with how the country is. When the country is based on corruption and relaying blame, the sports is the mirror of said country.

If another Australian tampers the ball, he will be banned for life.

After the trio's spot fixing, Pakistan and Misbah were instrumental in keeping the game clean. Sharjeel, with a sureshot place in the playing eleven, spot fixing especially after all the turmoil and education is just inexcusable.

Once again I state, if the proof is shown [it still hasn't] then ban all concerned for life. Pakistan already went through a tough process of winning hearts & minds of cricket fans. But the issue here is Sharjeel/Latif's lawyers, respectively, have asked the the proof to be shown to the courts, to them, and the public and they've been rejected. Why would that be?!

If the evidence was so clear and damning why not share and show these crooks what they did and how they went about doing it.

There's just more to this than the punishment and bans. Sethi, himself, went on live television and stated the evidence would be presented for everyone to see. It's been more than 1-year and nothing was ever shown.

Firstly there is no public evidence that Sharjeel fixed AT ALL.

I can see why some defended Amir because of the “young and impressionable” argument.

IDK if anyone defended Asif who was just as much, if not more of an ATG talent.

A verdict at trial doesn't always mean a rightful conclusion as to a being guilty/not guilty. Especially one that is in Pakistan, and one that involves cricket.

Also, When The head of the Senate Standing Committee on Sports [ Dr. Ashok Kumar] has expressed doubts over involvement of Sharjeel. But anyway...

Imo if there was evidence, then the PCB would have released it straight away to the world. Perfect way for Sethi to satisfy his ego.

Why would PCB ban a gun opener that they deaperately need? What happened to the case?
 
TBH, the spot fixing cases are difficult to prove. Look at Sreesanth or Azhar in India. IIRC, they have been acquitted by the courts.

Amir got the golden boy treatment despite all the evidence against him but Sharjeel has hardly been judged / punished objectively, the case had been incoherent and lacked professionalism

I have seen posters say what Smith and Bancroft did is worse than what Amir did.

Some Pakistanis have serious judgement issues. Comparing that to what Amir, Asif & co did is a joke. But I guess it's also them taking some steam off after all these years.

0 tolrenace for corruption but allows fixers to return to cricket lol. PCB haven't been harsh enough on fixers in the past.

Get over this victim mentality. Taking money in return for a commitment to not play your best is very different from altering the condition of a ball to increase the chance of winning a game.

Sharjeel hasn't kicked and screemed of his innocence or about it being a fair trial.

The casual viewer perception will be that he fixed it doesn't matter what we think. If his ban is over turned I'll be the first one admitting I was wrong but until then he's been caught. Sharjeel was known to be in contact with a bookie for a few years so he is hardly squeeky clean.

He's pleaded his innocence throughout. He went infront of the cameras and stated as much too. If that isn't "kicking & screaming" I don't know what is.

No-one said that meeting wasn't made. He along with Latif said they heard the offer but didn't think twice about it. Where's the supposed proof of the Whatsapp chat that showed Sharjeel agreeing on the dot-balls? Where's the proof that Irfan stated Sharjeel fixed? Irfan was testifying against Shahzaib, not the Sharjeel.

Also not one person suggested anything was neat-and-clean. We're suggesting provide the proof and then ban them. Only in Pakistan is everything upside-down. A guilty person, with enough proof against them is let off, and a questionable/innocent person is proved guilty without actual proof being shown.

Can someone please lay down the case, the evidence and the motivations clearly. The whole thing ranges from Sharjeel guilty to half and half to Najam Sethi vandetta.
 
Still waiting on the so called evidence that made expert witnesses such as Yousuf, Dean Jones and Aquib not count towards the end result of the case.

I never once suggested tampering is worse than fixing. My point on Sharjeel/Latif stands. No matter what the casual fan [even one that has been here for numerous of years...] would think, the facts are there for everyone to see and read. Once the evidence comes to light and they are indeed proven to have spot-fixed then we can move on and ban these players from ever representing Pakistan again. Until then though...

He has been banned for 5 years, but it can be reduced to 2.5 years if goes through rehab and is on his best behavior (I guess in terms of cricket). I think he returns in July-August of next year.

given that there was no concrete video evidence against him like there was with Salman Butt, and public opinion on Sharjeel is still favourable - I definitely see him back in the LOI team by 2020 at the latest
 
The Lahore High Court (LHC) on Monday accepted cricketer Sharjeel Khan's petition to remove his name from the Exit Control List (ECL), DawnNewsTV reported.

Justice Shahid Waheed heard the petition to decide the maintainability of the case. The petition, filed on Khan's behalf by his counsel Ejaz Ahmed, says that the cricketer was unable to go to perform Umrah and meet his brother in Dubai due to travel restrictions placed on him. It further argues that the interior ministry illegally placed Khan's name on the ECL.

The Pakistan Cricket Board (PCB), interior ministry and the Federal Investigation Agency have been nominated as respondents.

The high court office had earlier dismissed the petition as non-maintainable. The LHC, however, overturned that decision. Even if a petition is declared as non-maintainable by court office, the case is sent to a judge.

Khan was slapped with a five-year ban from playing cricket by a PCB-appointed Anti-Corruption Unit last year after he was found guilty of spot-fixing in the second edition of the Pakistan Super League.

The fact that his name was on the ECL proves something fishy happened, doesn't make any sense whatsoever. They really did not want him to take his case abroad.

I suppose his offense is different - otherwise Mr Warner is also playing (or walking off from) club cricket.

Lol, I am picturing what happened in the meeting. Sharjeel shed tears and plead his innocence while Mani was like sorry but we have a policy of zero tolerance towards corruption?
