[PICTURES/VIDEOS] Imran Khan a mosaic in Pakistan's political history

Imran throws down the gauntlet

As the ruling coalition mulls constitutional amendments aimed at sweeping judicial reforms, PTI founder Imran Khan on Saturday threw down the gauntlet, warning the government that the opposition party would resist any move to erode the judiciary's powers tooth and nail.

"Sacrifices are essential for freedom. Democracy is being slaughtered, and they are about to enslave the nation", said PTI founder Imran Khan while talking to journalists after a hearing of the £190 corruption case.

The former prime minister lambasted the ruling coalition for its alleged attempt to extend the term of incumbent Chief Justice of Pakistan Qazi Faez Isa through a constitutional amendment.

"They want to protect human rights violations and electoral fraud. The new constitutional amendment is being made to bring in Qazi Faez Isa. There is no democracy left in the country. When a party with less than 20 seats was seated in parliament, that was the end of democracy," he said.

According to Imran, there are restrictions on the media, and judges are being threatened.

Criticizing the ruling PML-N, he said: They talked about respecting the vote [democracy], but in reality, they honored the boot [army].

"An FIR has been filed against me for a social media post. Why don't they also read the Hamoodur Rahman Commission Report to the nation? If they had implemented that report, martial law would never have been imposed in Pakistan," he added.

The former prime minister said his party was getting prepared for a street movement and will hold a rally in Lahore, come what may. "Holding a rally is our democratic and constitutional right, but for the past year and a half, we have not been allowed to do so. Has Punjab become a police state where we are not allowed to hold a rally?" Imran said

He said authorities put up lots of hurdles but the PTI managed to hold a huge rally in Islamabad last week on September 8. He said people have to make sacrifices in the struggle for "independence".

According to Imran who is incarcerated at Rawalpindi's Adiala Jail since last year, the ruling PML-N and PPP are not doing politics but are engaging in servitude.

"I am ready to sacrifice my life, but I will never accept anyone's subjugation. What is happening to us today could happen to them tomorrow as well," he said.

The PTI founder condemned the recent arrest of PTI lawmakers from inside the Parliament House and described it as unprecedented.

When a journalist noted that police had entered the Parliament Lodges also during the PTI's rule, Imran said was not aware of any such incident. "No one has ever been taken from parliament until now," he said.

He said Prime Minister Shehbaz Sharif was about to be convicted in a money laundering case, but former army chief General Qamar Javed Bajwa saved him.

When another journalist referred to a drugs case registered against PML-N leader Rana Sanaullah during the PTI's government, he said the case was made by the Anti-Narcotics Force (ANF), whose head is a major general. "I called the ANF head, and he presented evidence against Rana Sanaullah during a briefing to the cabinet."

When a journalist mentioned that some PTI leaders had said the drugs case against Rana Sanaullah was false, and asked if he also considered it false, Imran said, "The case was made by the ANF, and they were the ones who told us that the drugs were seized from Rana Sanaullah. How would we know?"

Barrister Gohar

Pakistan Tehreek-e-Insaf (PTI) Chairmain Barrister Gohar Ali Khan has criticised the government's potential move to introduce a constitutional amendment bill, stating that such action without following due procedure is against parliamentary rules.

Speaking to the media in Islamabad on Saturday, Gohar expressed frustration with the government's tendency to pass legislation "under the cover of darkness."

"We have always said that if you want to legislate, follow the proper procedure. The Constitution clearly outlines the legislative process, and we must adhere to the law and the Rules of Business," he remarked.

Gohar highlighted that private member bills first go to a committee, requiring permission a month prior, before being placed on the agenda. "Government bills are handled by the ministry, then passed through the cabinet with the prime minister's signature. Rules of Business 16 and 27 require the Ministry of Law and Parliamentary Affairs to advance these bills," he explained.

He further criticised the current government's approach: "There has been no cabinet meeting, no approval. If the bill is introduced without these steps, it will be a clear violation of the rules."

Zartaj Gul, a PTI leader, also condemned the government's actions, referring to the abduction of the wife, daughter, and aunt of Faisalabad MNA Saadullah Baloch. "They were told to present themselves before unknown entities. Imagine, present themselves to whom?" she questioned.

She also raised concerns over the disappearance of another PTI member, Aurangzeb Kachhi, stating, "For three days, we've had no news of him. The PML-N's unconstitutional actions will not only harm Pakistan but also damage parliament."

Constitutional amendments intend to give extension to 'three umpires': Imran Khan

Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan has alleged that a constitutional amendments are being pursued to extend the terms of three top officials, including Chief Justice Qazi Faez Isa, Islamabad High Court’s chief justice, and the Chief Election Commissioner.

Speaking to the media at Adiala Jail, Imran claimed that the government, despite losing previous political battles, is now resorting to these amendments to safeguard fraudulent election results and protect officials in power.

"They are amending the constitution to extend the terms of three umpires,” Khan said.

He warned that if Chief Justice Isa is removed, investigations into the May 9 protests and the alleged rigged elections will be launched.

Imran criticised the delay in addressing the May 9 events, accusing the government of trying to dismantle his party.

He pointed out that he had been targeted with over 140 legal cases before May 9, adding that attempts to remove him only intensified after the date.

Imran expressed concern that if the new chief justice takes office, the true events of May 9 will come to light.

He also criticised the government for undermining Pakistan's judicial and electoral processes and delaying the tribunal decisions on the February 8 election.

Imran Khan attempts to play down Afghan diplomats' disrespect of Pakistani national anthem

Former Prime Minister Imran Khan criticised the attention on the Afghan diplomat issue, calling it trivial compared to the country's pressing concerns.

Speaking informally to journalists at Adiala Jail, Imran Khan argued that the nation's future is at stake, while the government is preoccupied with minor matters.

The Pakistan Tehreek-e-Insaf (PTI) founder emphasised that the situation in the country requires urgent attention, adding, “We are facing major issues, yet you’re focused on this.”

He also addressed the current political landscape, particularly the debate over constitutional courts.

When asked about his past support for the Charter of Democracy, which included the establishment of such courts, he said the context has changed.

“At that time, it was about saving Justice Qazi Faez Isa. What’s happening now is against the Constitution,” he added.

He also warned that the upcoming Lahore rally will be a "do or die" moment for his party, instructing his supporters to prepare for a decisive movement.

“No matter what they do, we’ve told the entire party to get ready. It’s time to come out,” he added.

Previously, Afghan Consul General in Peshawar, Hafiz Mohibullah Shakir, caused outrage at the Rehmat-ul-Alameen Conference by remaining seated during Pakistan's national anthem, flouting diplomatic protocols and showing what experts have called "utter disregard" for the host nation.

The conference, hosted by Khyber-Pakhtunkhwa Chief Minister Ali Amin Gandapur, saw Afghan consular officials in attendance.

However, as the national anthem played, Shakir and his colleagues remained in their seats, a move widely condemned as a breach of diplomatic decorum.

"By not respecting the national anthem, the Afghan Consul General has shown blatant disrespect to Pakistan and its people. This is an extraordinary incident and contrary to the very essence of diplomatic conduct," said a political analyst, adding that such behaviour would be deemed unacceptable in any civilized society.

Meanwhile Foreign Office spokesperson Mumtaz Zahra Baloch condemned the Acting Consul General of Afghanistan for disrespecting the host country's national anthem, describing it as a violation of diplomatic norms.

In response to media queries about the Afghan envoy's disrespect towards the national anthem at a Peshawar event, Ms Baloch, stated that a strong protest is being conveyed to Afghan authorities in both Islamabad and Kabul.

Later, the Afghan Consulate in Peshawar defended the actions of its Acting Consul General, Hafiz Mohibullah Shakir, who remained seated during Pakistan's national anthem at the Rehmat-ul-Alameen Conference in Peshawar on Tuesday.

The spokesperson for the consulate clarified that the decision was due to the presence of music in the anthem.

In an official statement, the spokesperson said, “There was no intention to disrespect or demean Pakistan’s national anthem. The Consul General did not stand because of the music in the anthem.”

The consulate also noted that Afghan authorities have imposed a ban on the use of music in their own national anthem. "Had the anthem been presented without music or by children, the Consul General would have stood and placed his hand on his chest," the spokesperson added.

Dismissing any claims of disrespect, the consulate firmly stated, “The idea of disrespecting Pakistan or its national anthem is out of the question.”

Meanwhile, Pakistan has officially rejected Afghan Consul General Hafiz Mohibullah Shakir's explanation for not standing during the Pakistani national anthem at an event in Peshawar, terming the action a violation of diplomatic norms.

In a statement, the Foreign Office spokesman emphasised that disrespecting the host country's national anthem goes against diplomatic protocol.

"We have lodged a strong protest over this," the spokesman said, adding that the Afghan consul general enjoys diplomatic status in Pakistan and holds a valid visa.

Former PM Khan warns of ‘filling jails’ if Lahore rally is halted

Former prime minister Imran Khan warned of “filing jails” if the government tried to prevent his party’s Lahore rally scheduled for September 21.

“The upcoming Lahore rally is critical. It is a ‘do or die’ situation for us,” he told reporters in an informal conversation at the Adiala Jail on Thursday. “Do whatever you want to do, PTI and the whole nation will come out.”

He urged the people not to fear going to jail, asserting that if they are prevented from holding the rally, they should fill the jails.

Khan criticised the government, claiming that the constitutional amendment aims to protect the incumbent chief justice of Pakistan. He warned that if the Supreme Court was dismantled, Pakistan would become a “banana republic.”

The former prime minister stressed the need for thorough discussion regarding constitutional matters, stating that the Supreme Court was the “last institution” in which the public has faith.

“I knew this amendment was coming. Whatever needs to happen should be done after full consultation, not in the dead of night, as it reveals their true intentions,” Khan said and criticised the “decision-makers as fools and ignorant.”

In response to a journalist’s question about his previous endorsement of the Charter of Democracy, which included the establishment of constitutional courts, Khan did not directly address the stance he now holds.

When asked, the PTI founder said that every situation has its context.

He expressed his readiness to remain in jail for a longer period if necessary, encouraging the people not to fear imprisonment. “If we are stopped from holding this rally, we will fill the jails.”

Khan criticised those who profess to honour votes while actually undermining democracy, stating, “Democracy cannot function through force or by enslaving people.”

Will turn Lahore rally into a protest if government refuses permission: Imran Khan

Incarcerated Pakistan Tehreek-e-Insaf (PTI) founding chairman Imran Khan has said if the government refused permission, the party's rally in Lahore then "we will turn the rally into a protest."

Imran, during an informal conversation with journalists at Adiala jail earlier today said, "If the rally is stopped, the entire nation will protest at Minar Pakistan".

"For a year and a half, rallies have not been allowed in Lahore. Destroying democracy means ending freedom, and having a rally is our constitutional right," the PTI chairperson noted.

The PTI founder alleged the PTI's rally at Minar-e-Pakistan is "aimed at protecting democracy and freedom", and is endorsed by the Supreme Court, but is being blocked once again.

"Despite the guarantee, containers were placed and obstacles set up at the Islamabad rally".

"Has anyone in the world ever given time to end a rally? We were deceived regarding the Islamabad rally," the PTI leader questioned.

"If the Deputy Commissioner of Lahore does not permit the rally, we will protest at Minar Pakistan," he stated.

The PTI founder alleged that even during Musharraf's martial law era, the media and political rallies were not banned from expression.

"Musharraf's election was free and fair compared to theirs, and he also did not impose bans on the media and rallies".

Speaking more on permission regarding rallies, he said, "Whatever their requests are, they are being heard, and ours are being rejected".

"There should have been an investigation into the commissioner's statement; it is also possible that he was wrong. It should not be the case that instead of investigating the commissioner's statement, it is dismissed".

Imran claimed that the CJP Isa and the chief election commissioner "are conspiring together to commit fraud".

"Today, on one side of the line is democracy and those who respect votes, and on the other side are those who respect power".

"Qazi Faez Isa is directly beneficiary of the constitutional amendments; he wants an extension. He takes every election case upon himself".

Imran said that he discusses the Hamoodur Rahman Commission report because the "same conditions" exist in the country today.

"These conditions in the country were not present even during the times of Musharraf and Zia-ul-Haq," he alleged.

He concluded the talk by stating that the nation is standing on one side, while the "small ruling class is destroying democracy" on the other.

It’s pretty interesting what Ahsan Iqbal brought up about Imran Khan and the Israeli lobby. According to him, there’s an article in an Israeli newspaper that suggests Khan is the "preferred" figure for the Israeli lobby in Pakistan, which is a heavy accusation. If that’s true, it definitely makes you wonder about the kind of international support he’s attracting and what’s driving it.

Iqbal also pointed out how Khan has been pushing a narrative of hate and division since 2013, which, honestly, is something we’ve all seen create major divides in Pakistan. The fact that Khan even opposed a Pakistani-origin candidate for the London mayoral race is another thing that raises eyebrows. Feels like there’s more going on behind the scenes than what meets the eye.

Where’s the divide lol? The recent elections showed that the country was united with PTI.

What hate did he spread, hatred against corruption is something we should all stand up for.

Israeli newspaper puts Imran in a tight spot

While Israel is becoming a pariah state due to its brutal invasion of Gaza that has resulted in the death of over 43,000 people mostly women and children since October last year, The Jerusalem Post has published a rather optimistic opinion piece about the "growing" recognition of the Zionist state in the Muslim world.

According to the article penned by Harry Richer, figures like incarcerated former premier Imran Khan can play a central role "in changing both public opinion and military policy" in Pakistan towards Israel.

Titled "Redrawing Israel's geopolitical map on Abraham Accords' anniversary", it contended that Pakistan has maintained a policy position that was pro-Palestinian for a long time but "recent years have seen an occasional sign of its desire to improve relations with Israel". "Former prime minister Imran Khan – despite his strong rhetoric against Israeli policies – hinted at Pakistan needing to forge its own foreign policy path. This was particularly pertinent at a time when the rest of the Muslim world began to normalize ties with Israel on the basis of self-interest," it said.

Referring to the PTI's phenomenal performance in the February 8 general elections, it said the influence of Imran Khan or perhaps the emergence of another like-minded and equally pragmatic leader could bring opportunities for reevaluating the extent to which Pakistan can afford to reconsider its historic hostility toward Israel, particularly in the face of its ongoing deep economic crises.

Enumerating the benefits Pakistan might have in the areas of economy, technology, agriculture, cybersecurity, and defense, in case it "normalises" ties with Israela broad euphemism for Pakistan does not recognise Israelthe writer highlighted how trade between Israel and the UAE jumped 124% to $2.59 billion year-on-year alone in 2022.

According to the writer, a more diversified foreign policy on Pakistan's part could also bring with it strategic benefits as it navigates its own complex relationships with both India and Afghanistan.

This is planted story(you can pay to have stories written in Isreali papers) with no basis in fact. IK was under huge pressure from establishment and the Saudi/UAE to recognise Isreal and categorically stated no and in public. It's one of the reasons he was overthrown. In Sept 2022 NS and establishment did send a delegation to Isaacs. Can you post that and explain why

Challenge accepted

Firstly, they want to create a new court called the Federal Constitutional Court, which will only deal with stuff related to the constitution. It's like a specialized court to handle those kinds of cases.

Next, they're thinking of raising the retirement age of judges in this new court to 68, which is higher than the usual 65. And, get this, judges in this court will only serve for a maximum of three years! It's like a term limit, which is pretty interesting.

Also, the way judges are appointed is changing. Right now, it's a commission that recommends names, but in the future, the president will appoint the chief justice of this new court, based on the prime minister's recommendation.

Lastly, they're trying to reverse a previous ruling that said if a legislator votes against their party, it won't count. Now, they want to allow legislators to vote freely, even if it goes against their party's line.

Yes he was. He is a spokesman for the establishment. Look at his tweets and you will see the same propaganda that you and your ilk spread. What action was taken against him for breaking PK law? Just imagine what action would have been taken against him if he was PRO IK. So tell me why the Generals sent him. Imran Khan denies allegations of supporting ties with Israel

Former prime minister and PTI founder Imran Khan, currently incarcerated, has dismissed allegations of being a proponent of establishing relations with Israel, accusing detractors of twisting the narrative based on a recent Israeli newspaper article.

Khan, who is facing several legal battles while in detention, addressed the media at Adiala Jail on Monday, labelling the claims as part of a "propaganda campaign."

"Since yesterday, there has been a propaganda blitz, citing an Israeli newspaper that I am the biggest advocate for relations with Israel," Khan said. "These claims are absurd. The article did mention me, but clearly, some people do not understand English."

The article in question, published by The Jerusalem Post, discussed Khan's influence in the Muslim world and the West, speculating on the potential impact he or a similar leader could have on Pakistan’s foreign policy, particularly in relation to Israel. However, Khan was quick to clarify that his position on Israel remains firmly pro-Palestinian.

"My stance on Israel has not changed. The Palestinian people are enduring genocide. Any discussions with Israel are contingent upon a ceasefire and a genuine commitment to a two-state solution," Khan asserted. He accused his political opponents of misinterpreting the article to undermine his credibility.

Entire system, including Supreme Court and economy, collapsing: Imran Khan

Pakistan Tehreek-e-Insaf (PTI) Founder Imran Khan expressed grave concerns over the current state of the judiciary and the overall governance system in Pakistan.

In an informal interaction with the media at Adiala Jail, he claimed that the entire system, including the Supreme Court and the economy, is on the verge of collapse, and accused the government of deliberately trying to undermine the judiciary.

"Everyone knows what is going on in the Supreme Court since yesterday," he remarked.

The former prime minister alleged that the government is bent on destroying the Supreme Court by ensuring that judges from both the Supreme Court and high courts become subservient. "They have destroyed the country and are now focused on destroying the Supreme Court," he claimed.

Imran Khan also criticized Chief Justice Qazi Faez Isa and Chief Election Commissioner Sikandar Sultan Raja, claiming that they are "one and the same." He further alleged that the chief election commissioner is aware that he could face charges under Article 6 of the Constitution for his role in alleged election fraud, which is why he is brushing the matter under the carpet.

"Their aim is that their fraud is not exposed and the PTI does not see a rise in popularity," Imran claimed.

The PTI founder claimed the entire world had recognized the February 8 election as fraudulent. He raised questions about the May 9 incidents, where violence broke out following his arrest, and demanded to know the whereabouts of CCTV footage from that day. "They themselves set the fire during the May 9 incidents," he alleged.

Imran Khan also accused the government of suppressing PTI by preventing the party from holding public meetings and rallies. "It's the chief justice's job is to protect fundamental rights," he remarked. Imran questioned whether political rallies in the summer ever ended at 6pm.

The PTI founder also emphasized the role of the Chief Justice in protecting fundamental rights and expressed concerns over the judiciary's independence. "What is happening since yesterday is clear—the Chief Justice and the Chief Election Commissioner are one," he asserted.

The PTI leader concluded by reiterating that the government’s primary objective is to prevent the exposure of electoral fraud and to keep PTI from rising to power. He criticized the government's handling of the economy, which he said was spiraling towards collapse, and reiterated that the nation was fully aware of the ongoing issues within the judicial system.

Pakistan Tehreek-e-Insaf (PTI) jailed founder Imran Khan has said his party is completely backing Supreme Court's Justice Mansoor Ali Shah to become the country's next top judge

"The appointment of the next chief justice should be announced soon. [We] completely back Justice Mansoor Ali Shah," the former prime minister said while speaking to journalists informally in Rawalpindi's Adiala Jail on Wednesday.

Khan, who was removed from power via a parliamentary vote in April 2022, said that the purpose of the "constitutional court is to end the power" of the Supreme Court's chief justice, adding that the "government is bent on destroying the judiciary".

"They want their own judges to cover the [2024] election fraud," the PTI founder insisted, stressing that the government "does not want the PTI to rise at any cost".

The ousted premier made these comments in light of the ongoing saga surrounding the constitutional package chalked out by the ruling coalition which allegedly provisions regarding extension in the retirement ages of the high court and supreme court judges.

The government pushed the proposed constitutional package amid speculation about a potential extension in the tenure of Chief Justice of Pakistan (CJP) Qazi Faez Isa, who is set to retire in October this year, following the PTI's request last month for the early issuance of a notification regarding the appointment of the next top judge.

However, the Pakistan Muslim League-Nawaz (PML-N), despite having the support of its allies such as the Pakistan Peoples Party (PPP) and others, had postponed introducing the constitutional amendments in the parliament despite claiming to have secured the "magic number" earlier.

The deferment came after Jamiat Ulema-e-Islam-Fazl (JUI-F) refused to lend its support to the ruling coalition, short of 13 votes in the National Assembly (NA) and nine in the Senate as the said legislation, aimed at amending the Constitution, requires a two-thirds majority in both houses.

In the National Assembly, the ruling coalition needs 224 votes to pass the constitutional amendments, whereas in the Senate the number stands at 64. Currently, as per reports, treasury benches have 211 members against the opposition's 101 MNAs.

Although JUI-F chief Maulana Fazlur Rehman has so far remained seemingly unwilling to back the amendments, which he, in fact, has termed a bid to protect the coalition government,

Adviser on Political and Public Affairs and PML-N leader Rana Sanaullah had hinted at evolving "minimum consensus" among political parties on controversial judiciary-centric constitutional amendments that also included the proposal to establish constitutional court — which PPP Chairman Bilawal Bhutto has said would be introduced "come what may".

The PM's aide also said that the consultation process with other political parties on the judicial package has not stalled as the Bilawal Bhutto-Zardari-led PPP and Maulana Fazlur Rehman-led JUI-F were working on their draft amendments.

He added that the drafts could be discussed in the forthcoming consultative sessions after Prime Minister Shehbaz Sharif's return from the United States and opined that the government would table the constitutional package after developing a "minimum consensus".

Imran questions CJP's 'mental fitness'

PTI founding chairman Imran Khan has lashed out at Chief Justice of Pakistan Qazi Faez Isa, accusing him of biased behaviour and questioning his mental fitness.

During a conversation with media representatives in Adiala Jail on Friday, the PTI chief remarked, "No chief justice in the world has acted the way Pakistan's chief justice is behaving. He does not seem mentally sound to me."

Khan claimed that the verdict to strip PTI of its electoral symbol was biased as "the SC verdict in the reserved seats case has vindicated our stance."

The CJP had protected the election fraud and now he is trying to deprive PTI of its seats, said Imran Khan.

The PTI supremo alleged that the CJP was attempting to crush PTI for extension in his tenure, adding PML-N and PPP are family-based parties but no one asks about their party elections while PTI's three intra-party polls were nullified.

The former premier further claimed that the chief justice and chief election commissioner were hands in glove for winning extension in their tenure.

Why the Rawalpindi commissioner was not summoned after his statement on election rigging?" Khan asked, criticising the lack of accountability.

Referring to the ongoing power struggle, Khan stated, "The so-called third umpire also seeks an extension, and for that, they need PDM's support. They are destroying democracy and the rule of law to maintain power, while the nation begs for a single dollar."

On the current political climate, Khan said, "There is a moral collapse in the country, and institutions are being dismantled. They will never grant us a No Objection Certificate (NOC) for our protests, and if they do, they will push us outside the city, blocking roads and restricting us to a 6pm deadline." He urged the nation to come out for the sake of the country.

He isn't mental( from all reports he is a bit loopy), the guy is immoral and corrupt. He and his wife took bribes and laundered it from PK to the UK. His wife even used a Foreign ID-Serena Isa used a Spanish name to launder money from PK. Her Spanish nationlaitu name was Zarina Montserrat Carrera. This was done to avoid getting caught for money laundering. Her Husband claimed that their children were independent and brought the property independently but on the paper work they put the reason for sending money as Kids education expenses. What a corrupt and evil man

Imran named in terrorism cases over Pindi protests

The Rawalpindi police on Sunday registered three new terrorism cases against PTI founder Imran Khan and chairman Barrister Gohar Khan following the violent protests on September 28 at Liaquat Bagh on Murree Road.

The cases, which include serious allegations of inciting violence against national institutions, also named Khyber-Pakhtunkhwa Chief Minister Ali Amin Gandapur.

The FIR accuses the PTI chairman of calling for protests from Adiala Jail, with Gandapur actively participating.

The cases, filed under the Anti-Terrorism Act (Section 7), also include charges of attempted murder, violations of Section 144, and other terrorism-related offenses.

The PTI chairman and K-P CM have also been directly named in the cases for abetment under Section 109 of the Pakistan Penal Code.

The New Town and Civil Lines police stations lodged these cases.

In addition to criticising the Punjab government and national institutions, protesters are accused of vandalism, rioting, and stone-pelting.

Cases were filed across Rawalpindi, including two cases at City Police Station, where 15 leaders were named and 300 protesters remain unidentified.

Article 63-A review: SC dismisses objection raised over bench by Imran’s counsel

The Supreme Court on Wednesday dismissed an objection raised by PTI founder Imran Khan’s counsel over the bench hearing a review petition against its 2022 verdict related to the defection clause under Article 63-A of the Constitution.

Through its May 17, 2022 verdict, the SC had declared that the vote cast contrary to the parliamentary party lines under Article 63-A should not be counted.

Article 63-A aims to restrict the voting powers of lawmakers by making them bound to the decision of the “Party Head” — whoever is formally declared the head of the party. The penalty for violating Article 63-A is disqualification from the National Assembly and the vacation of the defecting lawmaker’s seat, the Constitution states.

The review plea, filed by the Supreme Court Bar Association (SCBA), was on Tuesday taken up by a five-member bench — headed by Chief Justice of Pakistan (CJP) Qazi Faez Isa and also including Justices Justice Naeem Akhtar Afghan, Aminuddin Khan, Jamal Khan Mandokhail, and Mazhar Alam Khan Miankhel.

Justice Afghan had been included after Justice Munib Akhtar — part of the bench that originally heard the case — and senior puisne judge Justice Syed Mansoor Ali Shah successively chose not to sit on the larger bench.

During the hearing on Tuesday, SCBA President Shahzad Shaukat presented his arguments, with CJP Isa poking holes in the opinion rendered by the previous larger bench on the presidential reference filed by then-president Arif Alvi.

Today, Senator Ali Zafar appeared before the court as Imran’s lawyer while Shaukat and Pakistan Bar Council Vice Chairman Farooq H. Naek were also present.

At the outset of the hearing, Zafar said he would present “solid” arguments and seek more time to present them, saying he needed to consult the former prime minister on the case.

The counsel sought the court’s permission to meet with Imran to discuss the case with him, at which CJP Isa directed him to begin his arguments.

“If you had to consult with him, then you should’ve told us yesterday; we could’ve issued an order [in that regard],” the top judge said.

Here, Mustafeen Kazmi, who said he was a PTI lawyer, came to the rostrum and was told to go back. Following a harsh exchange of words with CJP Isa, Kazmi said the five-member larger bench was unconstitutional, as well as the inclusion of two judges in it.

“There are 500 lawyers standing outside [the SC]. Let’s see how a decision against us would be made,” the lawyer said, at which the chief justice ordered that the man be escorted out of the courtroom.

The development led to CJP Isa inquiring Zafar about the lawyer’s behaviour and censuring him.

“What is happening Ali Zafar sahib? You come and insult us? We will strictly not tolerate this,” the chief justice asserted.

Distancing himself from Mustafeen and attempting to calm the air, the PTI senator replied that he was presenting his arguments very respectfully and that Justice Isa was also listening to him with patience.

Zafar then continued with his arguments, saying that it was necessary for the respondents to be issued notices in the case.

“This manner is not right; the bench is not lawful. It is not even right according to the amendment ordinance,” Zafar argued, objecting to the bench formation.

“Now you are threatening us,” the top judge observed.

“Do you want to run the institutions in this manner? Every day it is said that there are two groups of judges,” Justice Mandokhail chimed in.

At one point during the hearing, Zafar contended that according to the Supreme Court Practice and Procedure Act, benches were to be formed as per the majority view of a three-member committee of judges.

“There is no scope in the law that two members of the committee form benches,” Imran’s lawyer asserted.

Referring to a recent ordinance promulgated, the top judge said: “The amendment ordinance has not been challenged before us (SC).”

Zafar pointed out that Justice Shah’s letter, wherein he had expressed displeasure with the ordinance, called for a full court to deliberate the matter. Later during the hearing, CJP Isa said: “I have no issues with summoning a full court.”

“Now, there would neither be authoritarianism in the country nor in institutions,” the top judge observed.

At one point, Zafar urged the court to first decide whether the bench hearing the case was “lawful”, adding that he could present his arguments only once it had been decided.

Subsequently, the court dismissed the objection raised by Imran’s counsel. “We all have unanimously decided to dismiss your objection on the bench,” the CJP said.

Zafar then requested the court again that if the court had “decided to not include the verdict’s author” — Justice Akhtar — in the bench, then he be allowed to meet his client.

The court accepted the lawyer’s plea, ordering the additional attorney general to make arrangements for Zafar’s meeting with Imran to discuss the case.

The hearing was then adjourned until 11:30am tomorrow (Thursday).
