PTI leader Shahbaz Gill on Monday claimed that a pair of cell phones belonging to PTI Chairman Imran Khan were stolen from the Sialkot airport after the party held a power show in the city last Saturday.

He made the claim on Twitter two days after Imran, during his Sialkot speech, said his life was under threat and that he had recorded a video message naming "all conspirators", which will be released in case of his assassination.

Gill said the former prime minister was deliberately not provided security during the rally held over the weekend, adding that his phones were also stolen.

"You are completely befuddled," the former adviser to the PM said, without addressing anyone in particular. "The video statement that Imran has recorded will not be found in these phones."

He alleged that Imran's phones were "ordered to be stolen" from the airport when he left for the venue.

On Saturday, the PTI chief had reiterated that his life was in danger. He had also said that he had recorded a video in which he had named those who "conspired against me" since last summer.

"There is a conspiracy hatched against me in closed rooms in and outside the country, and they want that Imran Khan's life [is lost]," he said.

"I knew of the conspiracy hatched against me ... so I have recorded a video and kept it in a secure place. If something happens to me then this video will be [made public] in front of the nation. In it, whoever has conspired against me, whoever is complicit since last summer, I've named everyone," the ex-PM said.

"They think 'Imran Khan can be an obstacle in our path and needs to be removed.' And that's why I've recorded this video because I think this is jihad and not politics. If something happens to me then I want all my Pakistanis to know who was complicit in this conspiracy.

"I've named everyone who planned and [revealed] how, through a foreign conspiracy, this corrupt lot, together with them, and others who were with them, ended my government. I recorded the video because it's [part of the] history of how the powerful are never brought under law and always remain safe. Those who betrayed this country, I want their faces to come in the open," the PTI chairman said.

The purported threat to Imran's life was first spoken of by Faisal Vawda during the last few weeks of his government in late March.

MUZAFFARGARH (Dunya News) – Pakistan Tehreek-e-Insaf (PTI) leader Shahbaz Gill was detained by the police from a factory in PP-272 in Muzaffargarh on Sunday.

Punjab Home Minister Attaullah Tarrar while reacting to the arrest of Shahbaz Gill said that armed persons were present with the PTI leader and the arms are completely banned in Punjab.

He said Section 144 had been imposed on possession and display of arms. Commandant FC has stated that no FC official was accompanying Gill.

Tarar said that the question arises as to who the armed people were who were wearing FC uniform. The provincial minister said Gill has resorted to illegal activities to gain cheap fame and action will be taken against them as per law.
 
ISLAMABAD: Pakistan Tehreek-e-Insaf (PTI) senior leader and chief of staff of former prime minister Imran Khan, Dr Shahbaz Gill has been arrested from Islamabad, ARY News reported.

The news was confirmed by the former federal minister and PTI leader Murad Saeed on his Twitter handle.

As per reports, Shahbaz Gill was taken into custody when he was going to Bani Gala to meet PTI chairman Imran Khan.

Talking to ARY News, Fawad Chaudhry alleged that he was taken into custody by the personnel in civil dress and he was tortured at Bani Gala Chowk.

He was dragged out of the vehicle, Fawad Chaudhry said and added they have no information who has arrested his party fellow and charges are yet to be unknown.

Earlier, Pakistan Tehreek-e-Insaf (PTI) leader and former SAPM, Dr Shahbaz Gill had warned Interior Minister Rana Sanaullah of arrest if he fails to appear before a committee probing incidents of torture over Azadi March participant.

Dr Shahbaz Gill in his tweet said that the committee will initiate action in the upcoming few days in the May 25 torture incidents.

Interior Minister Rana Sanaullah on Tuesday confirmed that PTI leader Shahbaz Gill was arrested by the Islamabad police “in accordance with the law” on charges of sedition and inciting the public against the state institutions.

“He will be presented before a court tomorrow,” he said, adding that a first information report (FIR) had been registered against the PTI leader on behalf of the state.

Sanaullah revealed that the case was registered at Magistrate Ghulam Murtaza Chandio’s complaint under sections 34 (common intention), 109 (abetment), 120 (concealing design to commit offence punishable with imprisonment), 121 (waging war against state), 124-A (sedition), 131 (abetting mutiny, or attempt to seduce a soldier, sailor or airman from his duty), 153 (provoking to cause riot), 505 (statement conducing to public mischief) and 506 (punishment for criminal intimidation) of the Pakistan Penal Code.

Earlier in the day, PTI leader Fawad Chaudhry claimed that Gill had been “abducted” from the Banigala Chowk by unidentified personnel in cars with missing number plates.

In a tweet later, he had added that Gill’s whereabouts and the details of the case against him were still unknown.

In a press conference alongside Information Minister Marriyum Aurangzeb today, the interior minister claimed that PTI chief Imran Khan had been working on a “narrative” to “create divisions in the military” after realising that he had been “trapped” in the foreign funding case and Toshakhana Reference.

“To remove the public’s attention from this, a narrative was formed in a meeting with Imran,” he said. “[During the meeting] Fawad Chaudhry and Shahbaz Gill were given the responsibility of spreading this narrative.

“A private news channel was also involved in this conspiracy,” the minister said, referring to ARY News. The channel had been issued a show-cause notice by the Pakistan Electronic Media Regulatory Authority (Pemra) yesterday for airing “hateful and seditious” remarks made by Gill.

Sanaullah went on to say that a preplanned programme had been aired on the news channel yesterday and Gill was taken on call. “He read out the entire narrative from a script.

“The sentences that were said are such that I think it is not in the national interest to repeat them,” he stated, claiming that the PTI leader went to the extent of “seducing people towards rebellion” and “inciting mutiny and sedition in the Pakistan Army ranks and files”.

Gill, the minister reiterated, had been arrested according to the law and through a proper procedure. “And I assure you we will treat him in accordance with the law.”

He also said that a “fair and transparent investigation” will be conducted, adding that a team had been formed.

Meanwhile, in response to a question, Sanaullah alleged that Gill’s comments had proven that the PTI was responsible for running the negative social media campaign on the tragic incident of army helicopter crash amid flood relief operation in Balochistan.

“Their [the PTI’s] social media was behind it […] and now people, who have been caught, are spilling everything.”

He said that the matter was “grave”, warning that whoever was found guilty would be arrested, irrespective of their position.

Pakistan Muslim League Zia-ul-Haq (PML-Z) head Aijaz-ul-Haq met with Pakistan Tehreek-e-Insaf Chief Imran Khan at his residence on Tuesday, ARY News reported.

According to details, the PML-Z leader briefed ARY News about his meeting with the PTI Chief. Both the leaders conversed about the current political situation and the recent arrest of PTI leader Shehbaz Gill from Islamabad.

The PML-Z Chief said that such state-backed terrorism should be avoided, if someone has said something offensive then things should be sorted via dialogue, he added.

He added that the government is not in its senses, such steps will pollute the political atmosphere of the country. Such incidents would continue until elections, he added.

He added that the establishment has an important role to play, it does not conflict with anyone. Things can be sorted if PTI and the establishment have a dialogue, he added.
 
The Pakistan Tehreek-e-Insaf (PTI) has decided to approach the Federal Investigation Agency (FIA) and Islamabad High Court (IHC) against the arrest of PTI leader Shehbaz Gill, ARY News reported.

According to the details, PTI has prepared an application against the arrest of Shehbaz Gill. The application has been prepared by PTI leader Ali Awan. While PTI leader Fiasal Chuadhry announced that the party will approach the IHC against the arrest.

He added that despite multiple inquiries they have not been informed about where the PTI is detained. They have visited five police stations, but have not been able to locate Shehbaz Gill, he added.

Faisal said that they approached the FIA as well but could not know Gill’s location.

ARY News administration on Tuesday issued a statement regarding the countrywide suspension of the channel’s transmission, saying the channel’s ideology is only ‘Pakistan’.

According to the statement, the ARY administration has condemned the suspension of its transmissions, saying the network is being victimized by the federal government. Shahbaz Gill’s statement was his personal opinion and had nothing to do this the channel’s policy, it added.

The news televised was between the Pakistan Muslim League Nawaz (PML-N) and the Pakistan Tehreek-e-Insaf (PTI). Shahbaz Gill joined to give PTI’s opinion on the subject, however, no PML-N representative joined due to their boycott of the network.

The statement added that comments or opinions of any individual televised by the network do not represent the channel’s policy. Shahbaz Gill’s statement was his personal opinion not ARY’s editorial policy, it added.

It added that the federal government is trying to victimize ARY Network.

Islamabad court grants police two-day physical remand of PTI’s Shahbaz Gill

A district and sessions court in Islamabad on Wednesday granted police two-day physical remand of PTI leader Shahbaz Gill, a day after he was arrested by police on charges of sedition and inciting the public against the state institutions.

Police were also directed to produce Gill before the court on August 12 (Friday), while the investigating officer was told to get the PTI leader medically examined.

Gill, who is PTI chief Imran Khan’s chief of staff, was arrested from Banigala Chowk on Tuesday — an act that the PTI has termed as an “abduction”.

The arrest came in the wake of the Pakistan Electronic and Media Regulatory Authority issuing a show-cause notice to ARY News for airing controversial remarks by Gill, which the authority described as “highly hateful and seditious” and tantamount to inciting the “armed forces towards revolt”.

On Wednesday, Gill was presented before Duty Magistrate Umar Bashir by Kohsar police, which submitted an application to the court for his physical remand.

Before the hearing began, police barred journalists from entering the courtroom, saying that it was the judge’s instructions.

According to the court order, a copy of which is available with Dawn.com, the investigating officer sought Gill’s physical remand for 14 days for further investigation “in respect of other persons allegedly involved in the commission of the offence”.

The order said Gill’s remand was also sought for the recovery of the “mobile phone allegedly used for the commission of the offence” for the purpose of voice matching through forensics, and to verify that “the interview given by the accused from the head office of the media house which is situated in Karachi”.

Moreover, the order stated that the remand was sought for the “verification of the video from the media house”.

Gill’s lawyer, Faisal Chaudhry, argued that there were no grounds for his client’s physical remand as he had been in police custody for approximately 24 hours. He also told the court that his client had been tortured and requested a medical examination for Gill.

The court initially reserved its judgement on the police’s application but later granted them two-day physical remand of the PTI leader.

Speaking to the media outside the courtroom, Gill that there was nothing in his controversial remarks that caused embarrassment, adding that he was a patriot.

He also asserted that he did not try to instigate anyone. “Officers within the bureaucracy, who are saying the wrong thing, I talked about them,” he said.

Meanwhile, his lawyer said that Gill’s clothes were stained with blood and questioned where the PTI leader had been detained prior to being presented before the court.

Gill’s controversial comments
A day ago, Pemra had issued a show-cause notice to ARY News for airing comments from Gill, that it said were “highly hateful and seditious” remarks tantamount to “incite armed forces towards revolt”.

The notice went on to say that Gill was invited via a telephonic call for his comments and during his talk with the channel, Gill had alleged that the government was trying to provoke the lower and middle tier of the army against the PTI, saying the families of such “rank and file” support Imran Khan and his party “which is fuelling rage within the government”.

He had also alleged that the “strategic media cell” of the ruling PML-N was spreading false information and fake news to create divisions between PTI chief Imran Khan and the armed forces.

Gill had said the government leaders, including Javed Latif, Defence Minister Khawaja Asif and former National Assembly speaker Ayaz Sadiq, had lambasted the army in the past “and they were at the government positions now”.

“The statement made by the guest on ARY News is a violation of Article 19 of the Constitution as well as Pemra laws. Airing of such content on your news channel shows either weak editorial control on the content or the licensee is intentionally indulged in providing its platform to such individuals who intend to spread malice and hatred against state institutions for their vested interests,” the watchdog stated.

“Dr Gill tried to malign the federal government, claiming the government functionaries are spearheading a campaign through social media cell for propagating anti-army narrative.”

Senior PTI leader Asad Umar on Wednesday accused the PML-N-led coalition government of attempting to create discord between the PTI and the army — an effort he said was bound to fail.

Addressing a press conference in Lahore, Umar said cases were being filed against his party in a manner as if it was “a threat to Pakistan”.

He said Imran’s political rivals see him as a threat to the “entire old system”, adding that “foreign powers, who have a habit of dictating Pakistan, also see Imran as a threat”.

The PTI leader said it was a historic turnaround that the people had taken to the streets and rejected foreign interference as they saw Imran as their “hope”.

Umar said a “condemnable” tweet was posted from a Twitter account that merely had 50 followers, “and it was played up by accounts with huge following only to add fuel to the fire”.

He said the top brass of the ruling coalition, including Nawaz Sharif, Maryam Nawaz, Asif Ali Zardari and Maulana Fazlur Rehman had been criticising the army until the recent past. “Was any action taken against them?” he questioned.

He said Imran had even emphasised the need to have a strong army after losing the government. “Our chairman had categorically said Pakistan needs its army more than Imran Khan.”

The PTI leader insisted that the nation had realised its power. “If decisions for the future of Pakistan are taken, it will only be made by people and not anyone else,” he added.

‘Govt needs new constitution to knock Imran out’
The former planning minister dismissed the possibility of Imran being sidelined from mainstream politics.

“There is no 62-1(f) [Article of the Constitution] sword hanging on him and also there is no room for a technical knock. They [the government] will have to write a new constitution to knock Imran out,” Umar said in response to a question.

Article 62(1)(f), which sets the precondition for a member of parliament to be “sadiq and ameen” (honest and righteous), had provided the grounds for the disqualification of former prime miniser Nawaz Sharif from holding public office in the July 28, 2017, judgement on the Panama Papers case handed down by the apex court.

Shahbaz Gill has the right to defend himself

Umar said the incarcerated party leader Shahbaz Gill has all rights to explain and justify whatever he had said.

“He has the right to clear his position under the law.”

The PTI leader asked whether any action was taken against Nawaz Sharif who had been rebuking the army’s top brass. “Why was not he arrested or his party banned?”

‘Flaws’ in ECP verdict

The PTI also berated the Election Commission of Pakistan for treating the PTI with “sheer discrimination” through its verdict in the prohibited funding case.

He recalled that the ECP had “dropped” the use of the phrase “foreign funding”, saying how did it start using it again when it was not even mentioned in the law.

He claimed that the ECP verdict was “baseless, misinterpreted, discriminated and the commission overstepped its authority while jotting down remarks in it”.

Umar said several individuals who funded the party had now been sending their recorded video statements and affidavit only to confirm their identity and the source of money, but the ECP was turning a blind eye to them “only because it issued a verdict against us with a mala fide intent”.

He explained there was a difference between a certificate and an affidavit. “Imran had his signatures on a certificate and the ECP cannot take any action against him just on the basis of it.”

The ex-minister said the prohibited sources of funding were clearly mentioned in the Political Order of 2002. The case of business tycoon Arif Naqvi dates back to 2008-13 while the Election Act was amended in 2017, and the ECP misinterpreted the law while levelling false accusations in this connection, he alleged.

“Bill Gates Foundation was investing in Naqvi’s company in 2013 and the British royal family was also involved in business with him. Did they know in advance that Naqvi will turn out to be a criminal in 2018?” he asked.

He said the ECP’s scrutiny committee also failed to find sources of Rs350-400 million funds given to the PML-N, adding that the watchdog took no action and served as a tool for the PDM to target the PTI.

In a televised address on Wednesday, PTI Chairman Imran Khan said that Shahbaz Gill should be given a chance to clarify himself in court.

“Shahbaz Gill should be charged if he has said anything that goes against the law,” said Khan, defending his party member and claiming that his driver was attacked and his vehicle’s glass was smashed.

During his address to PTI supporters via video link, Khan slammed the coalition government for conspiring against his party.

“They [government] had issues with the fact that the army and the PTI were on the same page. Even India used to acknowledge that," Khan said.

The former premier claimed that Israel and India were “overjoyed” after his ouster in the wake of the regime change conspiracy.

Khan added that PTI’s social media wing, largely comprised of youth, exposed disinformation campaigns against the country.

“The EU DisinfoLab exposed how India had been plotting against Pakistan, and those in the current government were also part of the disinformation campaign against the country,” the PTI chief alleged.

Commenting on the foreign funding case, Khan claimed that there was no substance therein.

“PTI has held political fundraisings. We have provided the names of 40,000 donors to ECP, who are now being termed foreigners by ECP,” he complained, adding that his party has provided every detail to the commission.

Targeting other political parties of hiding their funding sources, Khan said that corrupt parties can never raise funds.

“People gave us donations and we have audit books to prove that, while other political parties have no evidence to show how they received funds,” he remarked, commenting that these parties have nothing to prove how they get their funds.

The former premier termed the ECP’s report “fake” and said that the commission was biased against PTI as it only investigated his party despite a court order.

“They [government] tried to technically knock us out by collaborating with ECP,” he claimed.

ECP also said that the commission was on the government’s side during the by-elections. “All their plans failed during the by-elections,” he commented, adding that they [government] were sure to win the elections but the nation decided to go against them.

He accused the government to have campaigned to pit the PTI against the army. PTI chairman said that doing so was “extremely dangerous” for the country.

“Today, it’s being said that we are against the army and now they’ve [the government leaders] become the patriots who are calling us traitors," he said, adding that he cares about Pakistan, and those who care about the country want their army to be strong.

“They tried to break our party,” he said, claiming that foreign elements toppled his government because they did not want to see a strong Pakistan.

“Those conspiring against the PTI are a part of an external conspiracy,” he added.

He also revealed that the party leaders were receiving threats from the banned Tehreek-e-Taliban Pakistan (TTP).

The former premier said that the only way to take the country out of the crisis was through free and fair elections.

While addressing the Toshakhana controversy, Khan said the ruling coalition had merely tried to malign his reputation through the reference.

“They are just trying to trap me in a case and instil fear so that no one listens to my point of view,” he said.

“Everyone has received gifts and should be investigated. Asif Ali Zardari took three cars from the Toshakhana, while Nawaz Sharif took one,” he revealed, claiming that he only took the Toshakhana gifts after “completing all legal formalities”.

While calling Shahbaz Gill’s comments on ARY News “outrageous,” Information Minis*ter Marriyum Aurangzeb on Wednesday alleged that the script read out by Mr Gill was actually written by PTI chairman Imran Khan.

She addressed a press conference immediately after Mr Khan’s address in which he said that a conspiracy was afoot to “cut the PTI to size” and “pit the country’s largest political party against the army.”

“ARY News defied all journalistic requirements and aired it without any interruption,” the minister said while claiming that Mr Gill tried to incite a rebellion within the army and expressed disregard for those who lost their lives in the helicopter crash last week.

Ms Aurangzeb said that if there was anyone who was harming PTI, that was Mr Khan himself.

She added that Mr Khan was nervous because he had campaigned against the martyrs through his party’s social media trolls.

This information was revealed by those arrested by investigation agencies who were probing the malicious campaign against the martyrs following the crash, she claimed.

The social media trolls arrested by the agencies claimed that the campaign was launched at Mr Khan’s behest, she added.

She also claimed that ARY News has launched a campaign against the government “to sidetrack this issue”.

After damaging his own party and the country, Mr Khan was now trying to tarnish the reputation of the army, she said.

While referring to his address, Ms Aurangzeb said that fear and panic was visible on Mr Khan’s face as he repeatedly claimed that efforts were being made to place curbs on his party.

The minister said that Mr Khan’s entire politics was based on hatred, sedition, anarchy and hooliganism.

“This is the mentality of Imran Khan. He wants to set the country on fire and called for a rebellion within the army.”

The Pakistan Tehreek-e-Insaf (PTI) seems to be distancing itself from Shahbaz Gill – the party leader arrested on August 9 on charges of sedition and incitement against institutions.

Talking to Javed Chaudhry on Express News, senior PTI leader Fawad Chaudhry said on Wednesday that Gill’s narrative was “not the party’s stance” and added that “every person has their own opinion”.

He, however, still insisted that “Shahbaz Gill should be forgiven after withdrawing his statement”.

“Those that know him [Gill] personally, know him to be a patriot,” said Chaudhry as he also insisted that the PTI was a party with a “pro-Pakistan policy”.

The former information minister's statements have come following the controversy sparked allegedly by Gill’s comments and opinions expressed on a private TV channel after a helicopter crash in which six army officers, including Quetta Corps Commander Lt General Sarfraz Ali embraced martyrdom.

Earlier, the army had strongly condemned what it called “hurtful and derogatory” comments made by a certain group of people following the incident.

A joint inquiry team formed by the government on Wednesday had detected a total of 774 social media accounts responsible for a bulk of the misleading claims and smear campaign against the military, with many of them found to be operating from India as well as from within the country.

Meanwhile, the PTI chief Iran Khan had claimed that a “conspiracy” was being hatched to pit his party against the military.

However, the government had accused PTI chief Imran Khan of diverting the public attention away from its prohibited funding case by running a malicious campaign against the army on social media.

Addressing a press conference on Tuesday following Gill's arrest Interior Minister Rana Sanaullah had said that the "conspiratorial role" of a private TV channel has also come to the fore, adding that Shahbaz Gill, former information minister Fawad Chaudhry and the channel's administration played the role on the instruction of Imran Khan.

Furthermore, a judicial magistrate yesterday granted police two days’ physical remand of Gill, after he was presented in front of a district and sessions court in Islamabad following his arrest.

Islamabad police confirmed on Thursday that they had raided a house where PTI leader Shahbaz Gill’s driver, Izhar, was staying and arrested his wife along with another individual on charges of rioting, assaulting a police party and theft.

Izhar has also been nominated in the first information report (FIR), a copy of which is available with Dawn.com.

A district and sessions court in Islamabad on Friday rejected the police’s request to extend PTI leader Shahbaz Gill’s physical remand and sent him to jail on judicial remand.

Gill was arrested on Tuesday afternoon at Banigala Chowk in the capital after a video clip of his remarks made about the army, aired on ARY News, went viral on social media. He was subsequently booked under charges of sedition and inciting the public against the state institutions.

On Thursday, another charge of disappearing evidence and giving false information was added to the first information report registered against Gill, officials from capital police told Dawn.

Gill was presented before judicial magistrate Umar Shabbir today upon the expiry of his two-day physical remand, while PTI members gathered outside the court and raised slogans in Gill’s favour.

Application for extension of physical remand
When the hearing began, the investigating officer (IO) submitted an application to the court seeking the extension of Gill’s physical remand by 12 days.

According to the court order, a copy of which is available with Dawn.com, the IO stated in the application that Gill had made disclosures during the course of investigation and revealed that his mobile phone contained data regarding the commission of the offence.

“But he is intentionally causing hindrance in the progress of the matter,” the order said, quoting the application.

The order further said the court was informed that a transcript of Gill’s remarks aired on ARY News was obtained from the Pakistan Electronic Media Regulatory Authority and sent to the Federal Investigation Agency’s cybercirme wing for voice matching, the report for which had come out positive.

But further physical remand was necessary for the arrest of others involved in the offence and the recovery of the mobile phone used by Gill for the commission of the offence, the IO contended, according to the court order.

The “IO has also submitted in his application that the accused is continuously telling lies [and] hence, physical remand may be granted for his polygraph test,” the order read.

Gill objects to application
For his part, Gill objected to the IO’s application, claiming that police were “using [the] physical remand only for the purposes of torture”, and that he had been “pressurised” to only give statements of the “prosecution’s liking”.

According to the order, he maintained that no mobile phone was used for his comments to ARY News, pointing out the remarks during the live transmission were aired on August 8, which was the ninth day of Muharram, when mobile phones services remained suspended.

Instead, Gill said, he was speaking during the news bulletin via the landline phone installed at his Banigala office and therefore, “there is no justification for [the] grant of physical remand”.

“The grant of further remand would only mean handing over the accused in the hands of the police for the purposes of further torture,” the order read, attributing the statement to Gill.

Gill’s controversial comments
Earlier this week, the Pakistan Electronic Media Regulatory Authority (Pemra) had issued a show-cause notice to ARY News for airing comments from Gill, that it said were “highly hateful and seditious” remarks tantamount to “incite armed forces towards revolt”.

The notice went on to say that Gill was invited via a telephonic call for his comments and during his talk with the channel, Gill had alleged that the government was trying to provoke the lower and middle tier of the army against the PTI, saying the families of such “rank and file” support Imran Khan and his party “which is fuelling rage within the government”.

He had also alleged that the “strategic media cell” of the ruling PML-N was spreading false information and fake news to create divisions between PTI chief Imran Khan and the armed forces.

Gill had said the government leaders, including Javed Latif, Defence Minister Khawaja Asif and former National Assembly speaker Ayaz Sadiq, had lambasted the army in the past “and they were at the government positions now”.

“The statement made by the guest on ARY News is a violation of Article 19 of the Constitution as well as Pemra laws. Airing of such content on your news channel shows either weak editorial control on the content or the licensee is intentionally indulged in providing its platform to such individuals who intend to spread malice and hatred against state institutions for their vested interests,” the watchdog stated.

“Dr Gill tried to malign the federal government, claiming the government functionaries are spearheading a campaign through social media cell for propagating anti-army narrative,” the authority said.

Defence authorities are considering approaching the government with the request to hand over the custody of Shahbaz Gill to the military establishment for court martial.

Informed sources said the defence authorities are discussing the option seriously in view of what Shahbaz Gill had uttered a few days back. Inciting mutiny in the military is an extremely serious offence and it is being considered in the defence circles that the accused of such a serious crime should be tried by the military court under the Army Act.

These sources said that if the defence authorities reach this decision, they would approach the government through the Defence Ministry seeking the custody of Shahbaz Gill for court martial proceedings. The final decision will be taken by the civilian government.

Trial of civilians under the Army Act has always generated controversies and raised the question whether a civilian could be tried by a military court. According to a legal mind, the Section 2(1)(d) of the Army Act provides for trial of civilians in such cases. But senior lawyer on human rights and military matters Col (retd) Inam ur Rahim said that there was nothing in the Army Act to arrest and conduct the trial of any civilian. Only those civilians can be tried who are serving in operational areas only to the extent of violation of a secret act, he said.

During the Ayub Khan’s era following countrywide protest against the dictator, Ayub was apprehensive that a mutiny could take place in the army against him, he got the Army Act amended and inserted Section 2(1)(d) under which any civilian who instigates the ranks against the command and commits any offence under the provision of secret act can be tried by the army.

Col (retd) Inam said that Ayub, however, could not try any civilian during his tenure. During Bhutto’s tenure, a retired Brigadier was arrested for writing letters to the army command. The retired Brigadier, he said, was tried by the military court and sentenced to jail.

The lawyer further explained that during Zia’s tenure, Ahmad Faraz and Farkhanda Bukhari were arrested by the military authorities but the LHC had intervened and released both of them. The high court said the procedure was not adopted.

During Nawaz Sharif’s tenure, Col (retd) Inam said that a constitutional amendment was introduced to allow the army to conduct trial of civilians involved in terrorist activities. The said amendment had a sunset clause, which led to its lapse after four years.

In a recent decision of the LHC in Hasnain Inam vs Federation, he said, it was decided that the military authorities cannot arrest a civilian. In the SC, he said, the attorney general on behalf of the Defence Ministry insisted that still the army could conduct the trial of civilians under the Army Act. On this, the SC observed that the Constitution is superior to the Army Act and the Constitution gives certain guarantees on the issue of fundamental rights of citizens of Pakistan on the issue of arrest and trial. The petition was withdrawn.

Inam, however, said that the son of a retired major general was recently tried by the military court under sedition charges and awarded five-year rigorous imprisonment. The decision has been challenged in the Islamabad High Court. The case is presently pending there.

So they have nothing after torturing. And if SG is handed over, all Nooras in Punjab and Fazlu in KP, AZ in Sindh must be arrested and put on trial. So apparently police from 3 police stations in substantial numbers raided the driver's house. The raid was conducted in the wee hours of the morning. There they encountered his wife, her brother and a 10 month daughter.

According to details, the PTI Chief said that he would talk about his future plans in the public gathering in Lahore tomorrow. Their government was outsed by a conspiracy, and conspiracies can not succeed without Mir Jafer and Mir Sadiq’s help, he added.

He added that the country is suffering from severe inflation since these thieves took charge. People who have multiple cases have been imposed upon the nation, he added.

The PTI chief said that they succeeded in the Punjab by-polls despite rigging, which is why the government is trying to knock them out technically. The government has launched propaganda against PTI, their plans would damage the country, he added.

He added that Nawaz Sharif, who looted the country for 30 years, is being compared to him over the toshakhana case. I have not been part of any deal, which is why they are trying to oust me, he added.

He added that Shehbaz Gill’s statement was questionable, he should not have said that. They are campaigning to cause a fight between PTI and the establishment, he added.

He added that a similar thing had happened in East Pakistan which led to the creation of Bangladesh.

PTI leader Dr Shahbaz Gill on Friday told a court in the capital that investigators had focused their interrogation on the frequency of his meetings with Lt Gen Faiz Hameed, and “compelled him to testify against party chairman Imran Khan” in connection with his controversial statement about the army.

Judicial Magistrate Omar Shabbir, after hearing arguments from both sides, rejected Kohsar police’s plea to extend Mr Gill’s phy*sical remand for further investigation, and sent him to the judicial lock-up of Adiala Jail.

In a related development, Judicial Magistrate Salman Badar granted post-arrest bail to the spouse of Mr Gill’s driver.

Unlike previous hearings, PTI workers and some leaders, including Fawad Chau*dhry, Ali Nawaz Awan and Kanwal Shau*zab, were on the court premises to cheer up the party chairman’s chief of staff.

Court rejects police plea for physical remand; driver’s spouse gets bail

Advocate General for Islamabad Barrister Jahangir Khan Jadoon had argued that Mr Gill’s physical custody was required for recovery of mobile phones, voice matching and conducting polygraph test to ascertain whether the suspect is telling the truth or otherwise. Defence counsel Faisal Hussain and Advocate Ali Bukhari objected to advocate general’s presence, saying this shows the government was keen to keep their client behind bars.

Mr Gill told the court that he had been subjected to torture and accused the police of asking “irrelevant” questions. He said investigators were even interested in Imran Khan’s diet plan.

As regards his objectionable remarks, Mr Gill said his statement had been taken out of context, adding that he “respects army and never intended to ridicule” the institution.

The prosecutor said police had planned to conduct Mr Gill’s polygraph test at the Punjab Forensic Science Laboratory which would require four to five days.

He said some other suspects were to be arrested and for this purpose police needed Mr Gill’s custody for 12 days.

Later, the prosecution filed an appeal before Additional District and Sessions Judge Mohammad Adnan against the rejection of plea seeking extension of Mr Gill’s physical remand.

However, after hearing the arguments, the ADSJ dismissed the plea.

Separately, Judicial Magistrate Salman Badar granted post-arrest bail to the wife of Mr Gill’s driver. The court accepted the bail plea against surety bonds worth Rs30,000.

Moreover, PTI’s legal team filed a petition in the Islamabad High Court, seeking to quash the FIR registered against Mr Gill as well as the administration of private television channel ARY News in connection with airing of his statement.

The petition referred to the judgements of superior courts that ruled as illegal the registration of more than one FIR in a single incident and requested the high court to quash the FIR registered with the Memon Goth Police Station, Karachi.

Meanwhile, the PTI chairman condemned the alleged torture of Mr Gill and the arrest of the head of ARY News, asking the judiciary to take notice of “violations of all laws with impunity” by the present regime. “Strongly condemn the torture being inflicted on Shahbaz Gill. Under what law & under who’s orders is this being done? If he [Gill] broke any law then he should be given a fair hearing. But just to salvage Imported government of crooks the Constitution & all laws are being violated with impunity,” he tweeted.

PTI’s senior vice president Dr Shireen Mazari in a statement urged the UN Human Rights Council to take notice of this “inhuman act”.

Another senior PTI leader, Asad Umar, tweeted: “Hearing that after judicial remand, Shahbaz Gill instead of being sent to Adiala is being taken to unknown location. Complete mockery of law. It’s not about Gill. It’s writ of judicial system being challenged,” he said.

An Islamabad district and sessions court issued notices on Saturday to the investigating officer and prosecutor on the post-arrest bail plea of Pakistan Tehreek-e-Insaf (PTI) leader Shahbaz Gill.

Gill was arrested earlier this week from Bani Gala Chowk in Islamabad after a video clip of his controversial remarks made on a private news channel went viral on social media. He was subsequently booked on charges of sedition.

Additional Sessions Judge Muhammad Adnan Khan has issued notices for Monday, August 15, seeking responses from the investigating officer and prosecutor on the plea.

According to the petition filed by Gill’s counsel, the incumbent coalition government had filed false cases to “settle scores” with the PTI, and that their “false FIR” was filed to achieve political objectives.

The petition requested the dismissal of the order of the judicial magistrate and asked for approval for Gill's physical remand.

It stated that the court should declare that the order given in Gill’s case was "not a judicial order but an administrative order".

The petition further maintained that during the investigation, the police could not prove any allegations against Shahbaz Gill.

It requested that the PTI leader be granted post-arrest bail

President District Bar Hafeezullah Yaqub, lawyer Faisal Chaudhry and Ali Bukhari appeared before the court.

Judicial remand of driver's relative

The police produced Shahbaz Gill’s driver’s relative, Nauman, before Judicial Magistrate Mohammad Naveed Khan. The judge ordered to send the accused to jail on judicial remand.

The police informed the court that the investigation of the accused was complete and requested that his judicial remand be approved.

His lawyer Niazullah Niazi said that the accused had “no role” in the case and should be discharged. He maintained that the theft clause was not pertinent to the case and the rest of the clauses were bailable.

A day earlier, a sessions court had rejected the police’s request for an extension in Gill's physical remand and sent him to jail on judicial remand on charges of inciting ranks and files of armed forces towards revolt.

Later, the court dismissed the review petition filed by the police against the rejection of their application for Gill’s physical remand, declaring it “inadmissible”.

Gill was presented before Judicial Magistrate Umar Shabbir upon the expiry of his two-day physical remand, while PTI members gathered outside the court and raised slogans in his favour. Before the hearing began, his handcuffs were removed and he was allowed to meet his legal team.

Judicial Magistrate Shabbir, after hearing the arguments of the prosecutor and the accused's lawyers, decided to reject the request for further physical remand.

Prime Minister Shehbaz Sharif’s focal person on digital media and technologies Ahmad Jawad has proposed that the PTI leader Shahbaz Gill – who on Friday was remanded in judicial custody — should be tried in a military court for inciting mutiny in the army.

The prime minister's aide, who was recently appointed to fight the battle of narratives and counter PTI on social media, said that the army should initiate the process as “a window has opened up” and “there is no harm to explore possibility under the law to try Shahbaz Gill in a military court".

“The filth we have seen in the past few months from Shahbaz Gill cannot be accepted,” Jawad shared with The Express Tribune. “It’s not politics…it’s not freedom of expression…its sedition and an attack on the solidarity of the country. It must be tried under the law and [he] should be tried in a military court if the law permits.”

Jawad while repeatedly emphasising that he was no legal expert and it was only his personal view said that “clear and vicious attempt of dividing the military is a most serious crime. If not taken to task, this could lead to further serious repercussions for the solidarity of the country".

'Civilians cannot be tried under military law'

A debate concerning the trial under military court started after PM’s focal person tweeted that a civilian can be court-martialed under Section 31-D of the Pakistan Army Act of 1952, claiming that senior politician Javed Hashmi was sentenced under the army act and why can’t Gill be sentenced under the same.

However, a renowned lawyer and a former military officer who served in the Pakistan Army, Col Inamul Rahiem said that “civilians can’t be arrested and tried under The Pakistan Army Act of 1952 because the procedure of arrest is missing from it".

The legal expert also clarified that Hashmi was never tried under the army act, saying he was tried under the Pakistan Penal Code (PPC) even when military ruler Gen (retd) Pervez Musharraf was in power.

According to a news report, a district and sessions court in Islamabad had sentenced ARD president Javed Hashmi to 23 years in prison and fined him Rs42,000 for inciting mutiny in the army. Hashmi was convicted on seven counts, with a maximum of seven years on one count, running concurrently.

Rahiem, who has long been fighting the legal battle for the recovery of missing persons and against the administrative orders of the armed forces, said that a civilian can’t be arrested and tried without amending the Constitution, saying the Supreme Court has already ruled it in his own case.

He was picked up by the military authorities from his residence in Rawalpindi on Dec 17, 2019, and later the apex court declared his detention illegal and unlawful.

The retired colonel, who had also served as a lawyer in the military’s Judge Advocate General branch, said that under the original army act only those civilians could be tried under the army act who were employed in operational areas, saying that too only to the extent of the provisions of the Official Secret Act of 1923.

Under the law, Rahiem said, an army officer can be tried in a civilian court but not vice versa, adding the army can request the civilian court to transfer the trial of the accused to a military court.

He said that the military dictator Ayub Khan had amended Section 2(1)(D) of the army act to try civilians under the army act after the 1965 war where spies and anyone inciting mutiny could be arrested and tried in military courts without having the right to appeal in higher courts.

“Such a law allowing the army to try civilians doesn’t exist anywhere in the world,” he said.

With the passage of time, he said, the courts have not only questioned but ordered release of civilians, including renowned poet Ahmed Faraz, who were arrested under the army act. He said the case of Hasan Askari, the son of a retired major general, who was sentenced to five years for his criticism over the army chief's extension, was pending before the capital’s high court on this very question that a civilian can’t be tried under the army act.

The information minister as well as PTI leaders could not be approached for their comments on the matter.

Gill was arrested on Tuesday at Banigala Chowk in the capital after a video clip of his controversial remarks, aired on ARY News, went viral on social media. Later in the day, he was booked on charges of sedition and inciting the public against the state institutions.

On Thursday, another charge of disappearing evidence and giving false information was added to the first information report registered against Gill, officials from capital police told Dawn.

Subsequently, Judicial Magistrate Omar Shabbir rejected the police’s request to extend Gill’s physical remand and sent him to jail on judicial remand.

Later, the prosecution filed an appeal before Additional District and Sessions Judge (ADSJ) Mohammad Adnan against the rejection of the plea seeking an extension of Gill’s physical remand. However, after hearing the arguments, the plea was dismissed.

Today, Islamabad Advocate General Jahangir Khan Jadoon filed a petition in the IHC, naming Gill, the sessions judge and the judicial magistrate as respondents.

The petition argued that the investigation in the case was not complete, according to the prosecution, and therefore, the judicial magistrate had “completely halted” the ongoing investigation by remanding Gill into judicial custody.

Resultantly, it said, the prosecution’s case was “seriously prejudiced” and it could not bring further results of the investigation on the record.

The petition said that the session judge’s order was “perverse and without jurisdiction” since Shabbir passed a judicial order, instead of an administrative order, and thus had the power to exercise his revision jurisdiction if any illegality came to the court’s knowledge.

Jadoon argued that the judicial magistrate did not take into account that “valuable evidence will not be collected” unless Gill cooperated with the investigation and the police had yet to recover his cellphone and the data from it.

He added that Gill’s physical custody was also required to obtain information about the other suspects in the case. Jadoon argued that the judicial magistrate had not realised the “gravity of the offence” and sent Gill to judicial custody without considering the police’s request for his physical remand on merit.

The petition said the orders of the two judges were “capricious, perverse and against the provision of applicable law”, adding that if it was not accepted for hearing, then the state institution would face “irreparable loss” and Gill would be “acquitted”.

It requested the IHC to set aside the orders of the two judges, grant Gill’s physical custody to the investigating agency for the collection of further evidence and declare that the judicial magistrate’s verdict was a judicial order and open to revision by the sessions judge and the IHC.

The IHC registrar accepted the petition and fixed it for hearing on August 15 (Monday) by Acting IHC Chief Justice Amir Farooq.

ISLAMABAD: Pakistan Tehreek-e-Insaf (PTI) senior leader and chief of staff of former prime minister Imran Khan, Dr Shahbaz Gill has been arrested from Islamabad, ARY News reported.

The news was confirmed by the former federal minister and PTI leader Murad Saeed on his Twitter handle.

As per reports, Shahbaz Gill was taken into custody when he was going to Bani Gala to meet PTI chairman Imran Khan.

Talking to ARY News, Fawad Chaudhry alleged that he was taken into custody by the personnel in civil dress and he was tortured at Bani Gala Chowk.

He was dragged out of the vehicle, Fawad Chaudhry said and added they have no information who has arrested his party fellow and charges are yet to be unknown.

Earlier, Pakistan Tehreek-e-Insaf (PTI) leader and former SAPM, Dr Shahbaz Gill had warned Interior Minister Rana Sanaullah of arrest if he fails to appear before a committee probing incidents of torture over Azadi March participant.

Dr Shahbaz Gill in his tweet said that the committee will initiate action in the upcoming few days in the May 25 torture incidents.

ISLAMABAD: The Islamabad Advocate General filed a petition in the Islamabad High Court (IHC) on Saturday against the rejection of police’s request to obtain further physical remand of PTI leader Dr Shahbaz Gill in hate speech case by the court.

The AG filed a petition, claiming that the accused nominated in the FIR had made statements against the Pak Army and they were based on ill designs.

According to the prosecution, the investigation in the case was not complete and the police were yet to recover the accused’s cellphone and collect data to identify other suspects.

It further said the statement given by the accused was sent to him on his WhatsApp and that’s why, he was reluctant to hand over his cellphone to the police.

The petition said the judicial magistrate, without realising the gravity of offence, rejected the police’s request of seeking an extension in the accused Shahbaz Gill’s physical remand and instead sent him to jail on the judicial remand, due to which the investigation process was halted, and the smear campaign and plot against the state institution could not be unearthed.

The petition requested the court to issue directives to hand over the accused to the police on physical remand, so that the case could be brought to logical end. The court admitted the petition and sitting Chief Justice Amir Farooque will hear the case on Monday.
 
Acting Islamabad High Court (IHC) Chief Justice Aamer Farooq on Monday questioned why authorities were seeking PTI leader Shahbaz Gill’s physical custody.

Justice Farooq raised the question while hearing arguments from the prosecution on the maintainability of a plea filed by Islamabad Advocate General Jahangir Khan Jadoon against the order of a sessions court which dismissed an application seeking Gill's physical remand.

"You are saying that an extension in the suspect's physical remand is necessary? What will you do after getting the extension?" Justice Farooq questioned.

Gill was arrested last week on charges of sedition and inciting mutiny in the armed forces after he made controversial remarks during an ARY News bulletin. Later, another charge of disappearing evidence and giving false information was added to the first information report registered against Gill.


On August 13, a judicial magistrate had rejected the police’s request to extend Gill’s physical remand and sent him to jail on judicial remand. The same day, the prosecution filed an appeal in a sessions court which was also dismissed.

Subsequently, the government filed a petition in the IHC for Gill’s physical custody, arguing that the ongoing investigation against him and collection of evidence could not be completed without it.

The prosecution has contended that the ongoing investigation against Gill and collection of evidence cannot be completed without an extension of his remand in police custody.

At the start of today's hearing, Justice Farooq asked the prosecution about the progress in the case.

Islamabad Advocate General Jadoon informed the judge of the lower courts' decisions regarding the PTI leader's physical remand. He added that the government had taken "serious notice" of Gill's comments on television that "targeted the country's institutions" and registered a case against him.

"His remarks were against institutions that have given many sacrifices for this country," he said.

Justice Farooq, however, pointed out to him that the expiry of Gill's physical remand and the subsequent rejection of an appeal against the decision not to extend the remand were a "reality".

He then sought arguments on the maintainability of the plea.

At that, the prosecution's lawyer, Raja Rizwan Abbasi, contended that the plea was maintainable and cited multiple court orders to support his argument.

Apart from him and Jadoon, the case's investigating officer and special prosecutor Haseeb Chaudhry also appeared before the court today.

The court adjourned the hearing after seeking a reply from Gill by tomorrow (Tuesday).

'PTI stands with Gill'
Meanwhile, PTI leader Fawad Chaudhry said that Gill was being persecuted as he was not among the "powerful".

Fawad, who was speaking to the media in Islamabad, took a jibe at the PML-N and said that Gill's father did not have a "setup" in Pakistan and did not serve as a prime minister which is why he was being tortured.

He said that the same treatment was being meted out to other party workers, saying: "This is the policy of Rana Sanaullah which is being practiced in the country".

He went on to say that the current government had also used indiscriminate force against children, women and unarmed citizens. "The same is happening with Shahbaz Gill."

Fawad was also amazed at the fact that the high court was entertaining a writ petition regarding a suspect's physical remand, especially when the case was of a political nature.

The government says it wants to recover Gill's mobile phone and wants custody of him so that they can torture him again. he claimed. He went on to say that Gill made the controversial comments on Muharram 10, when mobile phone services were suspended.

"The phone call was made via a landline and you have that number. The statement was broadcast live on ARY News and you have that too," he said, reiterating that the government was only seeking Gill's custody to torture him.

Fawad went on to say that the party was standing with Gill, adding that PTI chief Imran Khan had also raised the issue during Saturday's rally in Lahore.

"We hope this matter will be resolved soon [...] we are also approaching international organisations to come and see how political workers are being targeted and tortured."

In contrast, the Punjab government is moving in a "civilised manner" in the process of investigating the March 25 incident, he pointed out, referring to the violence during the PTI's 'Azadi March'.

Acting Islamabad High Court (IHC) Chief Justice Aamer Farooq on Monday questioned why authorities were seeking PTI leader Shahbaz Gill’s physical custody.

Justice Farooq raised the question while hearing arguments from the prosecution on the maintainability of a plea filed by Islamabad Advocate General Jahangir Khan Jadoon against the order of a sessions court which dismissed an application seeking Gill’s physical remand.

“You are saying that an extension in the suspect’s physical remand is necessary? What will you do after getting the extension?” Justice Farooq questioned.

Gill was arrested last week on charges of sedition and inciting mutiny in the armed forces after he made controversial remarks during an ARY News bulletin. Later, another charge of disappearing evidence and giving false information was added to the first information report registered against Gill.

PTI chairman and former prime minister Imran Khan has distanced himself from his chief of staff Shahbaz Gill’s controversial remarks aired on ARY News earlier this month, admitting that they were “wrong” and shouldn’t have been said.

Gill was arrested last week at Banigala Chowk in the capital after a video clip of his controversial remarks, aired on ARY News, went viral on social media. Later in the day, he was booked on charges of sedition and inciting the public against the state institutions.

In an interview with journalist Fereeha M Idrees on GNN News today, Imran said: “He [Gill] shouldn’t have said it because it falls under instigating the army […] it is completely right […] we want to see army as a strong institution.”

However, the PTI chief contended that statements against the establishment were also passed by coalition government leaders Maulana Fazlur Rehman, Maryam Nawaz, Ayaz Sadiq, Nawaz Sharif and others in the past.

“But what happened with them?”

Imran went on that he was “extremely upset” with the treatment meted out at Gill in prison. “It is extremely painful. I didn’t even know this […] Our lawyers told us that his clothes were stripped off and he was beaten up.

“They are torturing and trying to mentally break him. And they are forcing him to give statements against Imran Khan,” the ex-premier alleged, adding that if “Imran has to say something, he will say it himself […] he doesn’t need Shahbaz Gill for that”.

He further revealed that Gill was asked about “Imran and Lieutenant General Faiz Hameed’s meetings”.

Propaganda campaign against PTI

Imran also claimed that everything that happened with Gill was a conspiracy to “scare PTI supporters” and “create an impression that PTI is against the army and martyrs”.

“This propaganda campaign was created in the prime minister’s cell,” he alleged, adding that the closure of ARY News was also part of the conspiracy.

“This is all their plan to shut my supporters,” the former prime minister pointed out, continuing that the same was being done with YouTubers who spoke up in support of him.

“Their aim is to make a treason case against us and create misunderstanding between the army and PTI because we are the only party that represents all of the provinces.”

Gill’s controversial comments

Earlier this week, the Pakistan Electronic Media Regulatory Authority (Pemra) issued a show-cause notice to ARY News for airing comments from Gill, that it said were “highly hateful and seditious” remarks tantamount to “incite armed forces towards revolt”.

The notice went on to say that Gill was invited via a telephonic call for his comments and during his talk with the channel, Gill had alleged that the government was trying to provoke the lower and middle tier of the army against the PTI, saying the families of such “rank and file” support Imran Khan and his party “which is fuelling rage within the government”.

He had also alleged that the “strategic media cell” of the ruling PML-N was spreading false information and fake news to create divisions between PTI chief Imran Khan and the armed forces.

Gill had said the government leaders, including Javed Latif, Defence Minister Khawaja Asif and former National Assembly speaker Ayaz Sadiq, had lambasted the army in the past “and they were at the government positions now”.

“The statement made by the guest on ARY News is a violation of Article 19 of the Constitution as well as Pemra laws. Airing of such content on your news channel shows either weak editorial control on the content or the licensee is intentionally indulged in providing its platform to such individuals who intend to spread malice and hatred against state institutions for their vested interests,” the watchdog stated.

“Dr Gill tried to malign the federal government, claiming the government functionaries are spearheading a campaign through social media cell for propagating anti-army narrative,” the authority said.

The Islamabad High Court (IHC) on Tuesday referred a plea seeking PTI leader Shahbaz Gill's physical remand in a sedition case to a sessions court for hearing, declaring the petition to be admissible.

The development comes less than a week after a district and sessions court rejected a police request to extend Gill's two-day physical remand and an additional district and sessions judge (ADSJ) dismissed a plea seeking a review of the district court's order.

A plea challenging these orders was filed by Islamabad Advocate General Jahangir Khan Jadoon in the high court on Saturday last week.

The authorities maintained in the plea that the physical remand of Gill — who is currently in judicial custody on charges of sedition and inciting mutiny in the armed forces following his controversial remarks during an ARY News bulletin — is important for the completion of the case's investigation.


When acting IHC Chief Justice Aamer Farooq took up Jadoon's plea today, he made its hearing conditional on parties establishing that the review plea rejected by the ADSJ was maintainable in a sessions court.

"If the plea is maintainable in a sessions court, I will then hear arguments on the case's merits," he said, adding that if the petition was not maintainable, there was no need for any further proceedings on the matter.

Justice Farooq then reserved the verdict on the plea and later issued directives for the sessions court to hear it and decide the matter on the basis of merit.

He also directed the sessions judge to hear the petition today.

Make legal, not political arguments: judge
At the outset of the hearing, Justice Farooq stopped Gill's lawyers from speaking about political matters after they made some political references.

"Make legal, not political arguments in this case," he told the lawyers.

While the judge acknowledged that the case concerned a politician, he said the identity of the suspect was "meaningless" to the court. The court is only concerned with legal matters, he said.

Justice Farooq then sought arguments on the maintainability of the review petition that was earlier rejected by the ADSJ.

"The matter ends when the suspect is remanded in judicial custody," he observed, adding that sending a suspect on physical remand in police custody was a "serious matter".

The judge said the session's court was to determine whether the judicial magistrate's order to reject the police request for an extension in Gill's physical remand was right.

"I am not going into the case's merit at the moment. I will first hear arguments on the [review] petition's maintainability," he said.

When Gill's lawyer pointed out that the authorities had filed a petition for Gill's physical remand in the IHC as well, Justice Farooq observed that high courts did not grant remands.

"It is not the high court's jurisdiction to see for how long a suspect has to be remanded. No matter how serious the offence is, it is the judicial magistrate who decides about remands," he remarked.

"At present, I am hearing arguments only on the maintainability of the plea in the sessions court."

Separately, Justice Farooq also heard a plea seeking the quashing of the first information report (FIR) against Gill in connection with his remarks during the ARY News bulletin.

Presenting his arguments on the plea, Gill's lawyer, Shoaib Shaheen maintained that the case against the PTI leader was based on "mala fide".

He contended that the approval for the charges under which Gill was booked had to be taken from the government but it was not taken.

After a transcript of Gill's remarks during the ARY News bulletin was submitted to the court, his lawyer further argued that only a part of the PTI leader's statement was referred to in the case and that the context of those remarks was not explained.

He also mentioned the case filed against lawyer Imaan Zainab Mazari-Hazir by the Pakistan Army for allegedly "abusing and defaming the senior command" of the institution.

"This case was not filed at the JAG branch's behest but that of the government," the lawyer claimed. He added that federal ministers' recent statements had been more critical than those by Gill and Mazari-Hazir.

Following his arguments, Justice Farooq adjourned the hearing till next week.

“Shahbaz Gill is perfectly alright in the jail. He is the prisoner of the federal government and the Punjab government has no authority to cut short his imprisonment,” Dogar told the media after visiting the Central Jail Adiala in Rawalpindi on Tuesday where Gill is imprisoned.

Deputy Inspector General (DIG) Jail Rawalpindi Region Abdul Rauf and Superintendent Central Adiala Jail Rawalpindi Chaudhry Asghar Ali were removed from their positions following the request of the home minister Hashim Dogar.

A district and sessions court in Islamabad on Wednesday reserved its verdict on a review petition filed by the police against the dismissal of its earlier application seeking an extension in the physical remand of PTI leader Shahbaz Gill in a sedition case filed against him.

Additional District and Sessions Judge (ADSJ) Zeba Chaudhry will announce the verdict in the case at 3pm today.

An Islamabad district and sessions court on Wednesday approved a two-day physical remand of PTI leader Shahbaz Gill at the request of the capital police.

Additional District and Sessions Judge Zeba Chaudhry announced a verdict that was reserved earlier today.

“Muhammad Shahbaz Shabbir Gill is given in the custody of the investigating officer for the purpose of investigation for 48 hours,” the court order reads.

The judge also directed the investigation officer to get the respondent medically examined and submit a report to the court.

The PTI has alleged that Gill was tortured in police custody previously and remains in danger of being subjected to further torture if he is handed back to the Islamabad police.

Gill was arrested by the Islamabad police on August 9, soon after he made controversial remarks on television that the Pakistan Electronic Media Regulatory Authority (Pemra) deemed were “highly hateful and seditious”.

The court’s remanding of Gill to Islamabad police custody comes less than a week after a court rejected a police request to extend Gill’s two-day physical remand and an additional district and sessions judge dismissed a plea requesting a review of the district court’s order.

A plea challenging these orders was filed by Islamabad Advocate General Jahangir Khan Jadoon in the Islamabad High Court on Saturday last week.

Today’s hearing

Earlier in the day, the district and sessions court in Islamabad took up the plea for Gill’s remand as the prosecution and defence lawyer furnished arguments.

Prosecutor Raja Rizwan Abbasi told the court that the detained party leader was “repeatedly telling lies” and that a polygraph test had to be conducted.

He said the investigators also needed the suspect’s mobile phone records which could potentially lead to more evidence.

“We are yet to investigate the person who allegedly approved the script of the suspect (Gill), which [led him to utter seditious remarks].”

The prosecutor also questioned how a judicial magistrate, who refused Gill’s physical remand, accepted the suspect’s statement as “conclusive”.

He also rejected the claim by the PTI, saying that “a justification of suspension of mobile network signals due to Ashura is also incorrect”.

Abbasi urged the court to allow the physical remand of Gill to process the investigation.

Defending his client, Gill’s lawyer Salman Safdar sought copies of the questions that the PTI leader faced during interrogation.

“The public’s response to determine whether Gill’s remarks were seditious should have been awaited before a case was filed against him,” the lawyer argued.

He criticised the prosecution’s argument for what he said was its emphasis on Gill’s remarks being made at someone’s behest.

“Some of the things could be wrong but they do not fall under sedition, conspiracy or crime,” Gill’s lawyer contended.

He insisted that a person who had been sent on judicial remand could not be sent back on physical remand again.

Nature of ‘torture’

“Shahbaz Gill said his private parts came under torture,” his lawyer told the court, adding: “I also asked him whether he was being tortured by the police or someone else.”

To which, the lawyer said, Gill told him that he was blindfolded when subjected to the alleged beating.

His counsel also quoted Gill as saying the investigators were asking whether “Imran Khan is an alcoholic”.

Safdar said his client would cooperate with authorities even if he was granted bail.
