I realize that there is a law against being a citizen/resident of another country and holding a position in the Pakistan govt but does it make sense? Shouldn't it be changed to be a Pakistani citizen and assess the role of the person based upon his qualifications?

Try and keep your arguments away from party politics.
 
When people give up old citizenship and take another one you should be even ready to fight and die for your new country if required. This is for common people who probably don’t even except to ever see such a scenario in their life time.

Now you want the guy making policies that might include national security and other critical decisions to be a guy who has taken such an oath? Or even worse if he is not honoring that oath, what makes you think he will suddenly develop a new found patriotism and responsibility and honesty?

Country should be run by people who have dedicated all their lives to the country.
 
I agree with the current law - any individual holding a foreign nationality should NOT be allowed to work for the Pakistani government.

It presents a huge conflict of interest scenario as the persons loyalty to both countries will me be questioned - not to mention national security issues...
 
Dual Nationality persons shouldn't hold the Top Position at their respective Govt. Offices. Otherwise it's the easiest way of penetration into echelons of power of any country.
 
Qualification doesn't prevent conflict of interest which can occur in many aspects and many of which will always be under the radar.
 
There is no law stating that a special assistant cant be a dual national.

Per the Islamabad High court

The bench ruled. “Rule 4(6) is one of such modes whereby the PM has been empowered to appoint Special Assistants. There is no restriction regarding the number of Special Assistants that can be appointed by the Prime Minster.”

“There is also no restriction of appointing persons having dual nationality. The only restriction provided in the Constitution is under Article 63(1)(c) and it is confined to disqualification of a person from “being elected or chosen as, and from being, a member of the Majlis-e-Shoora (Parliament)”. The chief justice maintained that the Pakistan Citizenship Act, 1951 expressly allows a citizen of Pakistan to hold dual nationality as has been described in section 14(3) ibid. It is not fair to raise doubts or to be skeptical regarding appointment of a dual national as a Special Assistant by the PM.

In order to apply it, one will require to define what is "Special Assistant" and its jurisdiction plus authority.

Holding a govt position and special assistant can be different aspects.

It’s fine imo. Don’t run elections but holding a position shouldn’t be an issue if you have something valuable to bring. Why wouldn’t you want people like Atif Mian or Tania Aidrus?

Well, to be honest, they should be barred. Giving up your motherland passport for a foreign passport simply means you have no business in your motherland country no matter how competent you are. I will not take up any other country citizenship even if there is an opportunity to do so. I will keep my pakistani passport and will use it for a travel purpose as long as I am alive.
I am in line with the thinking of that Pakistani scientist who did not take up any other country citizenship even if it was offered to him and he only preferred Pakistani citizenship.
 
Being a Pakistani national should be enough. Of course there should be other requirements in addition to being a Pakistani national such as education, experience and knowledge of local culture and languages but this is not even a huge problem.

IMO people going to Pakistan for few weeks and voting is a bigger issue. Pakistani national should not be eligible for vote if they hold multiple nationalities and spend most of their time outside Pakistan. Because they wouldn’t be dealing with Pakistan’s government most of the time and for that reason they shouldn’t be able to vote.
 
As a policy any law maker or senior bureaucrat should be only exclusively PK nationality. For advisers they should look at home but if competence or relevant experience doesn't exist at home , then look abroad at the PK diaspora with dual nationality.
 
Any high ranked or significant role should be exclusive to those residing in Pakistan, but for roles like special assistant, some flexibility should be allowed.

Should strictly be the best man for the job regardless of nationality but everyone must declare all their assets both inside, outside the country on a quarterly basis atleast.
 
Will not take a second to give up British citizenship if PM orders: Sayed Zulfikar Bukhari

SAPM Sayed Zulfikar Bukhari for overseas Pakistanis and human resource development has said that he will instantly give up his British citizenship if Prime Minister orders him to do so.

He said that our next eight years will be the best for Pakistan and before it, we are not going anywhere. For the next eight years, the opposition should find some job and work. Enough is enough. They have looted the country and now they should do some hard work.

Sayed Zulfikar Bukhari has further said that they accused us that we will run in the first chance. He said “I am in Pakistan and they ran to London, their children have fled abroad. I am in Pakistan and their Iqamas are surfacing.” On dual nationality, he will not agree to Khawaja Asif’s speech but decisions should be made in this regard after the debate.

On what basis 2000000 rupees are coming to Khawaja Asif from other countries, he inquired. “My whole business is abroad. But from where he is getting money. What type of work they are doing that he cannot declare it.”

The special assistant said that he is with the Prime Minister and will always be with him. He said they will continue to serve the country in whatever capacity we can, he added.

He said he has come to Pakistan for good. Moreover, the Supreme Court has also given the decision in favor of Sayed Zulfikar Bukhari on the issue of dual citizenship. Law is very clear about it that a special assistant to prime minister doesn’t need to quit the citizenship of another country. Even then if Prime Minister asked him to forsake his UK citizenship he would not take more than two seconds to do so.

He responded to the ongoing backlash after the release of asset details of advisers and assistants to Prime Minister.

Last month in July, Prime Minister Imran Khan’s 20 advisers and assistants had declared the details and nationality of their assets under strong pressures from media and opposition parties. The list of their possessions was published on the official website of the Pakistan government’s cabinet division. At least six advisers including Sayed Zulfikar Bukhari turned out to be dual nationals. SAPM on Overseas Pakistanis Syed Zulfiqar Abbas Bukhari turned out to be the United Kingdom citizen. Along with the declaration of nationality, the advisers and assistants also publicized the details of their movable and immovable assets of worth million dollars.

The details revealed that Sayed Zulfikar Bukhari has assets worth over Rs 2 billion. The details show Zulfikar Bukhari has four gifted or inherited properties in Pakistan. His properties in the United Kingdom include- a flat, furniture, and painting worth £5.28million (Rs1 billion). Bukhari also owns four luxury vehicles in the UK, worth more than £578,000 (Rs121million) and one Toyota Land Cruiser in Pakistan. He also owns around Rs357million in banks and cash and around Rs482m in business capital.

He is an active member of Pakistan Tehreek-e-Insaf and a close aid to the Prime Minister of Pakistan Imran Khan. After the 2018 elections victory, Imran Khan announced his cabinet, and Sayed Zulfikar Bukhari was appointed as a Minister of State. Sayed Zulfikar Bukhari led the major operations to manage the inflows of Overseas Pakistanis following the global coronavirus lockdown.

However, to date, Sayed Zulfikar Bukhari has not given up his British citizenship. He has asked people not to make his citizenship controversial since he is here to serve Pakistan with sincerity.

No. Should have single country passport to serve public office. Even Australia has same laws and Australia is an immigration nation. But if you want to run for public office, you have to declare your allegiance to Australia and leave your citizenship. Lots of senators here were disqualified because of that in 2018-2019.
 
PTI govt preparing to allow dual nationals to contest elections

ISLAMABAD: Pakistan Tehreek-e-Insaf (PTI) government has decided to make legislation for allowing Pakistanis to contest in the general elections who have dual nationality. The federal government has also decided to hold a session of joint-sitting of the Parliament after 10th of Muharram for passage of two FATF-related bills rejected by the Senate.

The Senate has rejected, “The Anti-Money Laundering (Second) Amendment Bill, 2020” and “The Islamabad Capital Territory Waqf Properties Bill, 2020”. According to the sources, the federal cabinet has approved Constitutional amendment in Article 63(1)(c).

They said that the Constitutional Amendment would remove the barrier of dual nationals not being able to contest elections; however, the foreign citizenship would have to be renounced, if the dual national wins the election. The sources said that the proposed amendment states that it would not be necessary to renounce dual citizenship in order to contest elections.

The draft of the amendment will be tabled in the National Assembly in the next few days. According to the sources, the federal government would also summon the session of the National Assembly before holding joint-sitting of the Parliament. They said that during the session of the National Assembly, the government would manage to hold joint-sitting of the Parliament. The Joint-sitting of the Parliament may continue two days only.

No one has problem in dual nationals holding office. Problem is, Imran Khan's hypocritical campaign. In his campaigns he talked against people holding dual nationals having position in the govt, and when he came into power he did the same thing.

Now read the above article and see that they are trying to amend laws.

Well during election he was not referring to special advisors. So he has a defense there.

However having dual nationals contest is unjustifiable. So even as a PTI supporter, i would have to agree with the hypocrisy charge on this one. Hopefully the opposition would oppose this.

But first you need to educate yourself. The bill proposes that you can contest elections on dual nationality but have to give up and show proof of giving up the dual nationality before taking oath as parliamentarian if elected.

This law is being brought about because a few people gave up their nationality ran for elections and lost, now they are neither here nor there.

I read that in the article posted above. I think the optics are bad. Basically what it lets politicians do is I will have only Pakistani citizenship if i win the election, otherwise i will keep both.

None of these dual nationals contesting elections are poor. They are living or can live in the in the most posh areas of Pakistan. There children can or do attend great schools. they can or they have great medical facilities,

If living in the most posh areas of Pakistan is not good enough, if you dont have dual citizenship, then imagine how bad it is for the rest of the population.

This law is being brought about because a few people gave up their nationality ran for elections and lost, now they are neither here nor there.

Thats there problem.
 
ISLAMABAD: Expressing displeasure over criticism of dual nationals holding public office, Prime Minister Imran Khan on Thursday stressed the need for tapping what he called “resource pool” of Pakistani experts and professionals living abroad for uplifting of the country.

“I don’t know why people say that dual nationals cannot get any public office and cannot become a minister and why they [people] move courts every other day,” the prime minister said while launching the Roshan Pakistan Digital Account — a facility which will provide innovative banking solutions to millions of non-resident Pakistanis seeking to undertake fund transfers, bill payments and investment activities in Pakistan.

“We do not have a bigger asset than that [overseas Pakistanis]. Best minds, professionals and entrepreneurs are outside the country. When we will create [conducive] conditions in the country, this big resource pool can return to the country,” he added.

The prime minister recalled that when he had established Shaukat Khanum Memorial Hospital, it created an opportunity for overseas Pakistani experts and they returned and ran the hospital. “Similarly, all major hospitals in the Middle East are being run by foreign doctors; rather the entire Middle East was established by foreigners,” he said.

Launches facility that will provide banking solutions to non-resident Pakistanis seeking to undertake fund transfers, bill payments and investment activities

The prime minister and members of his cabinet holding dual nationality recently came under severe criticism when the assets and status of dual nationality of all non-elected cabinet members — special assistants to the prime minister (SAPM) and advisers — were made public.

SAPM on Digital Pakistan Tania Aidrus resigned from her post due to the criticism levelled against her and the government because of her dual citizenship. In a tweet, Ms Aidrus (who also holds Canadian nationality) had said: “Criticism levied towards the state as a consequence of my citizenship status is clouding the purpose of Digital Pakistan.”

Prime Minister Khan said overseas Pakistanis were the most patriotic and their expertise was not utilised in the country. “I know many overseas Pakistanis; they are more patriotic than those living in the country,” he added.

The prime minister termed the launching of Roshan Pakistan Digital Account a historic step and expressed the hope that the facility would help increase investment by overseas Pakistanis in the country.

He expressed satisfaction that despite the Covid-19 pandemic, Pakistan’s exports had increased. “On the other hand, exports of India and Bangladesh declined during the pandemic,” he said.

Roshan Pakistan Digital Account is a major initiative by the State Bank together with eight other commercial banks operating in the country. These banks will provide innovative banking solutions for millions of non-resident Pakistanis and for the first time in Pakistan’s history, they will be able to open an account in any bank through an entirely digital and online process, without having to visit any bank, embassy or consulate.

In order to open an account, all documentation requirements will need to be completed and it will take 48 hours to open the account, according to an official statement. The customer can choose whether to open a rupee-dominated account, foreign currency or both and funds in the account will be fully repatriable, without the need for any regulatory approval.

Meanwhile, Prime Minister Khan chaired a meeting held to review availability of wheat in the country. The meeting expressed satisfaction over wheat supply and demand and decided that the Trade Corporation of Pakistan would also be allowed to import the commodity.

Meeting with Uzbek deputy PM

During a meeting with Uzbekistan’s Deputy Prime Minister for Investment and Foreign Economic Relations Sardor Umurzaqov, Prime Minister Khan underlined that there was no military solution to the conflict in Afghanistan and highlighted Pakistan’s positive contribution to the Afghan peace process.

The prime minister stressed that a peaceful and stable Afghanistan was of paramount importance for Pakistan and the region. He expressed the hope that intra-Afghan negotiations would commence at the earliest and culminate in a negotiated political settlement, thus contributing to peace, stability and prosperity in the region and beyond.

The prime minister reaffirmed Pakistan’s desire to work with Uzbekistan to strengthen mutually beneficial cooperation, bilaterally and in the region.

Matters of mutual interest, including the Covid-19 pandemic, bilateral cooperation, regional connectivity and regional peace and security, came under discussion during the meeting.

Prime Minister Khan underlined that Pakistan and Uzbekistan enjoyed cordial and brotherly relations. He warmly recalled his last meeting with President Mirziyoyev and mentioned that Pakistan keenly awaited his visit once the global pandemic situation settles down. He also highlighted the potential for enhanced trade with increased regional connectivity as a result of different planned railway projects.

The Uzbek deputy prime minister conveyed the cordial greetings and best wishes of the Uzbek president and noted that President Mirziyoyev looked forward to visiting Pakistan.

'Now' never came in to it. Being born in London with one parent British made him British to start off with.
However, he moved to Australia when only two and is dual nationalist.

But thats neither here nor there... You spoke about special assistant that oversee sensitive government matters and not having loyalties with Pakistan, well the example I gave you was of an ex Aussie Prime Minister, you cannot get more conflict of interest.

Australia is not a model to follow, there are counter examples of America and Canada and those countries are even more of "immigration nations" than Australia (a country that doesn't even have birthright citizenship).
