Indian Judge to Rapist "Will you marry her?

Calls have been growing in India for the chief justice of the Supreme Court to resign "without a moment's delay" after his recent remarks in two cases of alleged rape.

In an "open letter" to Chief Justice Sharad Bobde, more than 5,000 feminists, rights activists and concerned citizens wrote that they were "outraged" and asked him to retract his statements and apologise.

So what did the chief justice say that has angered people so much?

He asked two "atrocious" questions.

Justice Bobde, who was heading a three-judge bench, asked a 23-year-old man accused of raping a girl whether he would marry her.

"If you want to marry (her) we can help you. If not, you lose your job and go to jail," he said.

His comments shocked many, especially considering the horrific accusations the girl - who was 16 at the time of the alleged rapes in 2014-15 - had made against the man, a distant relative.

According to the letter, he "is accused of stalking, tying up, gagging, repeatedly raping a minor school-going girl, and threatening to douse her in petrol and set her alight, to hurl acid at her, and to have her brother killed".

It added that "the rape came to light when the minor school-going victim attempted suicide".

The girl's family also alleged that they had agreed not to go to the police because they were promised by the accused's mother that once the girl became an adult, they would marry the two.

In a country where victims are often blamed for rape, and sexual assault carries lifelong stigma, her family agreed to the arrangement.

But after the accused backtracked from his promise and married someone else, the survivor went to the police.

The accused, who is a government employee in the western state of Maharashtra, had been granted anticipatory bail by a lower court after he pleaded that he would lose his job if arrested. But the Bombay High Court called the order "atrocious" and cancelled his bail.

The man then approached the Supreme Court - which on Monday granted him protection from arrest for four weeks and where the infamous exchange took place between his lawyer and Justice Bobde.

Is this normal in India for a Judge to offer marriage to the victim to the alleged rapist?
 
Looks like the judge is from old school of moustache twirling oil headed uncles group. The judge needs to be fired and discharged with beizzati.

Thanks. Agree. This is an absolute disgrace to the legal sytem. Poor victim must be suicidal after hearing such a thing.
 
Just a strange case all round. Seems the girl only went to the police after the accused backed out of marrying her. Seems in India rape can be mitigated if the perpetrator agrees to marry the victim.

There also seems a need to protect the accused rapists job.
 
This is often what is happening, especially in small towns and villages. The rapist is many times forced to marry the victim.
 
Happens a lot in many socially conservative (backwards in many cases) cultures. I remember a similar case in Afghanistan too. I know Jordan outlawed this rule not too long ago, and great for them, but they are generally pretty progressive in the Middle East. Rulings like these should never happen anywhere.

Typical boomer Desi buddha. In an ideal world he should have been raped for suggesting something such inhumane.

I know of a case where a guy from poor family cleared prestigious exams and got into indian police service. The daughter of a constable befriended him and the stupid guy who had not seen the real world yet fell into the trap. When he refused marriage, the father and daughter protested before his office. Their demand was that he marry the girl or else rape charges. Finally he settled for marriage.
 
India is a really a ****ed up region, girl's parents also should be punished for not reporting the rape initially and agreeing to the suggestion of rapist, they might have still kept the incident as a secret if someone came up with a better proposal or the boy were doing some menial job, age difference between both the accused and victim is not more than one or two years so the guy also might be a teenager when he raped her first so whole thing once again clearly exposes the so called indian culture and education system.

This is blackmailing.What a way to blackmail innocent man to bound him for life #MGTOW
 
Atrocious on part of the judge. However, playing the devil’s advocate, had he married her and then later on divorced her, he would have saved himself a lot of hassle.
 
However, a rapist should never be allowed a way out, as they can then do exactly as I stated above. 15 years in prison for first time offenders and prison + castration for reoffenders.
