Mumbai, March 14: The Supreme Court-appointed Committee of Administrators (CoA) has directed the BCCI to conduct a probe into the alleged financial dealings of disgraced pacer Mohammed Shami with his contacts in Pakistan.

Shami is currently the focus of an investigation of the Kolkata Police after his wife Hasin Jahan accused the pacer and his family of domestic violence, attempt to murder and extra-marital affairs.

Jahan has also released an alleged recording of her telephonic conversation with the pacer during which Shami rejected the accusations of adultery and claimed that he met a woman named Alisba in Dubai who was supposed to give him money sent by a certain Mohammed Bhai from the UK.

Following the controversy the Board of Control for Cricket in India (BCCI) decided to leave Shami out of its list of contracted players.

"The Committee of Administrators is concerned only with such portion of the said audio recording in which the person who it is claimed is Md. Shami is heard saying another person by the name of 'Mohammad Bhai' had sent money to Md. Shami through a Pakistani lady by the name of 'Alisba'," the CoA said in a letter to Neeraj Kumar, the head of the BCCI's anti-corruption unit.

"Please investigate the above assertions/allegations under the BCCI Anti-Corruption Code and submit a report to the Committee of Administrators with your findings as to whether there is any basis to proceed further in terms thereof. The investigation should cover (i) the identity and antecedents of "Mohammad Bhai" and "Alisba"; (ii) whether any money was in fact sent by the said Mohammad Bhai through the said Alisba to Md. Shami; and (iii) if yes, the purpose for which the said money was received by Md. Shami," the letter added.

India cricket team pacer Mohammed Shami has said he was not aware of his wife Hasin Jahan's first marriage and subsequent divorce when they tied the knot in 2014.

Shami has alleged that Jahan had not told him about two of her daughters from the first marriage and that the former Kolkata Knight Riders cheerleader had even said they were her sister's children.

Jahan, who was a former model, had married Sheikh Saifuddin, a general store owner in West Bengal before getting divorced in 2010. The two daughters have been staying with their father ever since, according to The Times of India.

"I was not aware that it was her second marriage with me and it was only after we got married that I was told about two of my daughters. My wife first told me that they were her sister's children, not hers," Shami told India News.

The ongoing domestic feud involving Shami is getting murkier with every passing day. Ever since Jahan took to Facebook to accuse the Bengal pacer of "adultery and domestic violence", both the parties have been relentlessly pointing fingers at each other over the disintegrating relationship.

Jahan even claimed Shami and his family had been torturing her for the last two years and that the 28-year-old even forced her to get intimate with his brother at their Uttar Pradesh residence last year.

The India cricket star, whose annual retainership contract with the Board of Control for Cricket in India (BCCI) was withheld last week, hit back at those claims, saying his wife had lost "mental stability".

Shami and four of his family members have been charged under several non-bailable sections, including rape and attempt to murder after his wife filed a police complaint at Kolkata's Jadavpur police station last week.

Meanwhile, Shami has rubbished Jahan's allegations of his involvement in match-fixing. Jahan had claimed that the cricketer had accepted money from a Pakistan girl named Alisbah on the insistence of England-based Mohammed Bhai.

The Supreme Court-appointed Committee of Administrators, which oversees the operation of the BCCI, has asked the board's Anti-Corruption Unit to investigate match-fixing claims against Shami. A report is expected to be filed by the ACU within a week.

Kolkata police had also sought details of Shami's travel details during India's recently concluded tour of South Africa, especially his stay in Dubai.

However, Shami has maintained that Alisbah was one his fans in Dubai and her name is being unnecessarily dragged into the controversy.

"Celebrities often have a lot of fans and she (Alisbah) is one of them, her name is being falsely dragged into the matter to cook up a controversy," Shami said.

India pacer Mohammed Shami is blaming “a third party” for the allegations of domestic violence and extra-marital affairs hurled against him by his wife Hasain Jahan. He has denied the charges.

Shami said this was not a work of Hasin and someone was involved, maybe due to greed of money.

Jahan had posted screenshots of Shami’s alleged WhatsApp and Facebook Messenger conversations with multiple women on her Facebook account.

If you read about it, its not really something someone does willingly. A lot of the times players are coerced, or even forced into doing by others.

Take the example of Shami. The story seems to be that he met a random fan who messaged him on Instagram. Lets take that at face value.

Mohammed Shami, Facing Assault Charge, Cleared Of Match-Fixing Allegations By BCCI

The Board of Control for Cricket in India (BCCI) on Thursday cleared India fast bowler Mohammed Shami's central contract after its Anti-Corruption Unit (ACU) exonerated him of corruption charges levelled by his wife Hasin Jahan. "The Hon'ble Supreme Court of India appointed Committee of Administrators (CoA) had requested Mr Neeraj Kumar, former Police Commissioner of Delhi and Head of BCCI Anti-Corruption Unit, to investigate the allegations against Mohd. Shami in so far as they pertain to the provisions of the BCCI Anti-Corruption Code," BCCI stated in a media release.

Shami has been given a Grade 'B' annual contract, which will make him richer by Rs 3 crore. He will also be free to play in the Indian Premier League, starting April 7, for his franchise the Delhi Daredevils.

Following the green light given by BCCI, a relieved Shami spoke exclusively to NDTV and said that he always had full faith in the Indian cricket board.

"I always had full faith in the BCCI. I was waiting for this verdict and I'm happy they investigated the matter properly and the truth has now come out. I started training from last week and I am trying to prepare mentally after these hardships," Shami told NDTV.

"I have done my best to come out clean from this matter. I hope to now return to my old routine, get my life back and just look after the future of my daughter.

"As far as cricket goes, it's a big relief for me. Hasin (Shami's wife) has already said that she does not want to reconcile so only way to sort out this matter now is legally," the Indian cricketer added.

The BCCI had decided to withhold Shami's contract after Jahan made a series of allegations, including adultery and domestic violence, and lodged a police complaint against him. Shami has denied all the allegations.

The Committee of Administrators (CoA) specifically asked its ACU chief Neeraj Kumar to investigate the charges that the bowler accepted money from one Mohammed Bhai through a Pakistani woman named Alishba.

"Mr Neeraj Kumar has submitted his confidential report to the CoA. Based on the conclusions in the said report, the CoA is of the view that no further actions/proceedings under the BCCI anti-corruption code are warranted in the matter.

"For this reason, the BCCI shall proceed with offering a Grade B' annual retainership contract to Mohd. Shami," the release further stated.

BCCI acting president CK Khanna told PTI :"This is a very good news for Shami and for Indian cricket. The charges of corruption against him looked too far-fetched. He has been a committed player for India. The BCCI is happy that he has come clean after a thorough investigation by its Anti-Corruption Unit (ACU). It is only fair that he can now earn his livelihood as a professional cricketer and should be back in the field for the upcoming IPL."

IPL chairman Rajeev Shukla had already clarified that Shami would be allowed to play the moment he gets a clean-chit from the ACU.

Delhi Daredevils CEO Hemant Dua was also happy with the development as Shami is an integral part of their bowling unit.

"I have just received the confirmation from the BCCI that Shami has been absolved of all charges related to corruption allegations. It's a welcome news for the franchise and we are happy to have him back. We expect him to join the camp from the very first day," CEO Dua said.

Days after meeting Board of Control for Cricket in India (BCCI) acting president CK Khanna, Mohammed Shami's wife Hasin Jahan urged Delhi Daredevils CEO Hemant Dua on Saturday, March 31, to bar the India pacer from featuring in the 11th season of Indian Premier League (IPL) until their family matters are resolved.

Jahan, who has accused Shami of adultery and domestic violence, did not get the desired response from Indian cricket's apex body as Khanna had said the BCCI won't be drawn into their "personal matter."

The former Kolkata Knight Riders cheerleader had urged the BCCI to "put personal pressure" on Shami in order to help her put an end to the much-publicized martial feud.

However, she was asked to seek the help of her family over the issue by the acting BCCI president, who insisted the apex body was concerned about Shami's performances in the IPL and in the upcoming tour of England.

"I kept my point in front of Hemant sir to not keep Shami in the IPL team until he resolves his family feud," Jahan was quoted as saying by news agency ANI.

Jahan had earlier alleged Shami was trying to pressure her after getting a clean-chit from the BCCI.

She also urged the apex body of Indian cricket to follow the Bangladesh Cricket Board, pointing out how the latter handled the case of Mohammad Shahid, who was accused of assaulting his pregnant wife in 2017.

Indian cricket team pacer Mohammed Shami's wife Hasin Jahan has alleged that she could have suffered the same fate as that of the victim of the Kathua rape case — a minor Barkwal community girl who has raped over eight days before killed in the north Indian state of Jammu and Kashmir.

Jahan, who has been relentlessly accusing Shami of adultery and domestic violence, claimed Shami, and his family tried to rape, kill and then dump her dead body in a forest.

Jaham empathized with the victim of Kathua and demanded punishment for the accused in the case during a protest rally in Kolkata earlier this week where she made the sensational claim.

"Those who are guilty of the crime should be punished. Even my case is similar to this. But I am alive. Even I have been subjected to what happened in that case," Jahan told media during the rally, as quoted by the DNA.

Notably, Jahan had opened a can of worms when she took to Facebook to share screenshots of Shami's alleged chats with multiple women in March. She followed it up with numerous allegations, including match-fixing claims, against the Delhi Daredevils fast bowler.

The former Kolkata Knight Riders cheerleader had said that Shami had forced her to get intimate with his brother at their Uttar Pradesh residence in December 2017. She also linked the India fast bowler with a Pakistan model named Alishba and claimed that the two did "ugly things" during her husband's visit to Dubai earlier this year.

Owing to the same, Shami's annual retainership contract was withheld by the Board of Control for Cricket in India (BCCI), the Kolkata Police filed an FIR against Shami and four of his family members under various non-bailable sections, including rape and attempt to murder.

The BCCI has handed back Shami's contract after the Anti Corruption Unit of the apex body of Indian cricket gave the pacer a clean chit over match-fixing allegations.

Jahan has now alleged that Shami had made a fake birth certificate and fooled the BCCI to get to play in the state and national-level cricket.

Jahan took to her Facebook account on Saturday, in which she posted an image of driving license which she claimed belonged to the Bengal cricketer. The document carries the UP-born cricketer's photograph attached to it. As per existing official records, Shami was born in 1990 but the image showed the cricketer's birth year as 1982.

The Facebook post was, however, was deleted. But Jahan made some sensational allegations in her post as she claimed that BCCI and Cricket Association of Bengal (CAB) were fooled by the cricketer.

The cricketer, however, received a major booster after BCCI's Anti-Corruption Unit (ACU) cleared him of match-fixing charges made against him.

However, it is being learnt that the cricketer admitted in front of the ACU that he had relationships outside his marriage and went to meet his girlfriend Alishba, from Pakistan, in Dubai while returning from South Africa tour. KOLKATA: Cricketer Mohammad Shami has been summoned by the Alipore Court in Kolkata in connection with a case filed by his wife Hasin Jahan. Hasin had filed a case against Shami and claimed that the Rs 1 lakh cheque that he had given her had bounced and she had no money to pay for the monthly expenses.

She had filed a petition against her husband at a Kolkata court and sought a monthly maintenance of Rs 10 lakh, Rs 7 lakh as family maintenance while Rs three lakh per month for the child.. Hasin had claimed that he had stopped paying for her daily maintenance. She also filed a case of domestic violence against Shami and his family members.

On March 8, Hasin had filed a complaint against Shami with the Kolkata Police. A case was registered under non-bailable sections 307 (attempt to murder), 498-A (subjecting a woman to cruelty) and 376 (punishment for rape). Five persons, including Shami, have been booked under bailable sections 323 (causing hurt) and 506 (criminal intimidation) among others.

Hasin had even met West Bengal Chief Minister Mamata Banerjee seeking her support to fight the case against her husband. She later said that while Mamata Banerjee and the police protected her, they supported Shami and not her which is why he was not arrested.

Shami got into more trouble when she complained against him to the Board of Control for Cricket in India and alleged that he had taken money from a Pakistani woman named Alishba on the insistence of an England-based businessman, Mohammad Bhai. She sent documents related to her complaints to the BCCI's Committee of Administrators (CoA) chairman Vinod Rai for a probe into the allegations.

The BCCI, however, cleared Shami's central contract after its anti-corruption unit exonerated him of corruption charges levelled by Jahan.

The lawyer representing Mohammed Shami in the ongoing case filed by his wife Hasin Jahan over a domestic violence case says that the India fast bowler is not absconding and will turn report to authorities in Kolkata before the stipulated time frame given this week.

On Monday, it was reported that an arrest warrant had been issued by the Additional Chief Judicial Magistrate Court, Alipore, against Shami, who at the time was playing the second Test between India and West Indies in Kingston, Jamaica.

Speaking to Indian tabloid Mid-Day, Salim Rahaman rubbished the term ‘arrest warrant’.

“My client is not absconding. He is a national player and representing the country. He can be identified at any time. Why would he run away?” he said. “People have misinterpreted the warrant. The order clearly says that Shami has to surrender within 15 days of his return. We will take appropriate legal steps when he arrives.

“An arrest warrant can be effective only if he does not turn up 15 days after his return but I am sure that situation will not arise. He appeared twice before the police in Kolkata and there is no reason why he would not cooperate in the proceeding.”

Hasin Jahan, the estranged wife of India cricketer Mohammed Shami, has received death as well as rape threats from unknown people for sharing a congralutory messages on Ram temple Bhoomi Pujan in Ayodhya on her social networking sites, a police officer of Kolkata Police said on Monday.

Jahan has lodged a complaint with the Kolkata Police Cyber Crime department at its Lalbazar headquarters on Sunday, he added.

Jahan, currently working as a model, had posted congratulatory messages on her different social media accounts after the Bhoomi Puja of Ram Mandir was held in Ayodhya on August 5 and since then she started receiving several such threats.

“Congratulating all the Hindus for the Bhoomi Puja of Ram Mandir in Ayodha,” Jahan had posted on one of her social networking sites.

Several users started abusing her as well as threatened to rape and murder her following her posts, the officer said.

“This is very much unfortunate that I have been continuously harassed and abused by certain mean-minded people after I wished our Hindu brothers and sisters for the erection of the Ram Mandir at Ayodhya on 5th August 2020. Some people are continuously threatening me for taking my life (or) even raping and molesting also,” Jahan wrote in her complaint.

“In this situation, I am feeling helpless and worried about my daughter’s future also. The continuous attack through all the social media like Instagram, Facebook, Twitter makes me jeopardised. Please help me as I am feeling insecure every moment. If this continues, I will be mentally depressed,” she said.

“I will be highly obliged if you kindly take immediate action. I am feeling highly insecure as I live alone with my daughters. Now every second has become a nightmare for me. I hope you will be kind enough on humanitarian ground,” she added in her complaint. The police were yet to make any arrest in this matter as a probe was on, the officer said.

Jahan has previously leveled several serious allegations against Shami including that of domestic violence among other charges.

She had also blamed Shami for cheating on her and the pacer's family for torturing her. However, none of her allegations have been proved yet. Jahan recently took to Instagram to share a picture of her daughter and hinted that she has dropped Shami's surname from their daughter's name.

Jahan has been in the news over the past few years due to her differences with Shami. The Indian pacer had once even seen his contract from the BCCI being put on hold after allegations of domestic violence were levelled against him and his family. Shami, however, got back his contract after the allegations against him were proved untrue. He has since become a lynchpin of the Indian pace attack across formats and has been producing splendid performances with the ball consistently. He was last seen in action during India's recently-concluded tour of Australia Down Under.

Shami made just one appearance in the Test series against the Aussies before returning back home due to an injured elbow. The Indian pacer is still recovering from his injury and will not be part of the upcoming Test series between India and England at home. In his absence, Shardul Thakur and Mohammed Siraj will partner with Jasprit Bumrah and Ishant Sharma in the pace attack against Joe Root & Co.

A Kolkata court on Monday ordered Indian pacer Mohammed Shami to pay a monthly alimony of Rs 1.30 lakh to his estranged wife Hasin Jahan.

Out of the Rs 1.30 lakh, Rs 50,000 will be the personal alimony to Hasin Jahan and the remaining Rs 80,000 will be the cost of maintenance of their daughter who is staying with her.

In 2018, Hasin Jahan filed a suit in the court demanding a Hasan monthly alimony of Rs 10 lakh, out of which Rs 7,00,000 will be her personal alimony and the remaining Rs 3,00,000 will be on account of the maintenance cost of their daughter.

Her counsel Mriganka Mistry informed the court that as per the income tax returns of the Indian pacer for the financial year 2020-1, his annual income for that fiscal was over Rs 7 crore, and on the basis of that, the demand for a monthly alimony of Rs 10 lakhs was not unjustified.

However, Selim Rahman, the counsel for Shami, claimed that since Hasin Jahan herself was having a steady income source by working as a professional fashion model, the demand for that high alimony amount was not justified.

Finally, after hearing both sides, the lower court, on Monday, fixed the monthly alimony amount at Rs 1.30 lakh. Although expressing gratitude over the court's directive, Hasin Jahan claimed that she would have been relieved had the monthly alimony amount been higher. There was no reaction from the Indian pacer on this count till the report was filed.

On September last year after the victory of the Indian team against Pakistan at Asia Cup, Hasin Jahan shared in social media a photo of Hardik Pandya, who led India to victory with a six and there she took a veiled attack against Shami, who was not in the Indian squad.

"Congratulations. A memorable victory. Thanks to our Tigers for helping the country win. This had to happen; the country's reputation and honour are protected by honest patriots rather than criminals and womanisers," her post then had read. In 2018, Jahan had lodged a police complaint, levelling a series of allegations which included match-fixing, adultery and domestic violence which led to BCCI upholding Shami's central contract. In regard to the match-fixing allegations, where Jahan claimed that the pacer had received money from a Pakistani woman, the Supreme Court-appointed Committee of Administrators (CoA) had urged BCCI to investigate into the matter. Shami was later cleared of all charges.

Ishant recalled BCCI's ACU approaching all the players of the Indian team during their investigation on Shami. He revealed that he told the Neeraj Kumar-led unit that he was “200 per cent” sure Shami was not involved in such matters, although he did not comment about his personal life.

"I had a word with him and he did share of lot on the topic. Whatever had happened, the Anti-Corruption Unit (ACU) had approached us all, and they had asked us whether Shami could do a match-fixing or not. Just like policemen lodge a complaint...I was asked everything and all was written down. I had told them, 'I don't know his personal things but I'm 200 per cent sure he can't do that because I know him that well." When he heard I said those words, he realised that what I think of him and our bond became stronger," he said.

A Sessions Court in West Bengal had stayed the arrest warrant issued against Shami.

The wife of current Indian Cricket Team player Mohammed Shami has moved the Supreme Court through her counsels Deepak Prakash, Advocate-on-Record, Nachiketa Vajpayee and Divyangna Malik Vajpayee, Advocate, alleging that Shami used to demand dowry from her and that he has been continuously involved in illicit extra-marital sexual affairs with prostitutes, especially during his BCCI tours, in the hotel rooms provided by the BCCI, even till the present day.

According to the petition, an arrest warrant was issued against Shami by the Additional Chief Judicial Magistrate, Alipore, on August 29 2019.

Mohammed Shami challenged the said order before the Sessions Court, which, on September 9 2019, stayed the arrest warrant and the entire proceedings of the criminal trial.

Consequently, Shami's wife moved to the High Court of Calcutta but failed to get any order in her favour.

She moved to the Supreme Court against the Calcutta High Court order dated March 28 2023.

She said that the impugned Order is manifestly erroneous in law, which is in blatant violation of her right to a speedy trial.

Shami's wife in a plea before the Supreme Court raised concerns that there shall not be any special treatment for celebrities under the law.

Notably, from the last 4 years, the trial has not progressed and has remained stayed, she said.

"Criminal Trial in the present case has been stayed for the past 4 years, without any just circumstances, in a case wherein Respondent No. 3 did not even pray for the stay of criminal trial and his sole grievance was only against the issuance of Arrest warrants against them, thus, the Sessions Court acted in an erroneous and biased manner, by virtue of which the rights and interests of the Petitioner have been severally jeopardized and prejudiced," the petitioner said.

"That such stay has been granted in favour of the accused person is bad in law and has caused a grave prejudice who has been a victim of the illegal act of brutal assault and violence against the petitioner herein by this high profile accused in favour of whom the District and Sessions court, Alipore, as well as High Court at Calcutta, vide impugned order has granted a one-sided undue advantage in favour of the accused which is not only bad in law but is also against the principle of Natural Justice," the petitioner said.

The Supreme Court on Monday issued notice to concerned respondents on the plea filed by cricketer Mohammad Shami's wife seeking to frame guidelines for "gender-neutral religion-neutral uniform grounds of divorce and uniform procedure of divorce for all".

A bench headed by Justice DY Chandrachud tagged the plea with other similar petitions raising common issues.

The plea has been filed by advocate Deepak Prakash. The petitioner said that she is aggrieved by the unilateral form of extra-judicial Talaq, Talaq-Ul-Hasan, and has received a notice of first pronouncement of divorce under Talaq-Ul-Hasan dated July 23, 2022, issued by Mohammad Shami, husband of the Petitioner. Upon receiving such notice, the Petitioner contacted her near and dear ones, who also put forth their similar grievances, whereby their husbands had unilaterally divorced them, at their own whims and fancies.

Thus, the petitioner has approached the court seeking adjudication of larger issues related to "Talaq-E-Hasan and all other forms of Unilateral Extra-Judicial Talaq" which are still prevalent and in force under the Muslim Personal Laws (Shariat), by way of The Muslim Personal Law (Shariat) Application Act, 1937.

The Petitioner said that she is an aggrieved wife, subjected to the abuse of the draconian practices being followed under the Muslim Personal Laws (Shariat), wherein, except Talaq-e Biddat, there exist numerous other forms of unilateral Divorce, known as Talaq, which provide unfettered powers over the Muslim man, to divorce a Muslim woman, in a whimsical and capricious manner, without affording any right of reconciliation or being heard in any manner, to the Muslim women, being discriminatory on the basis of sex and gender, thereby violating the basic Fundamental Rights of the women, guaranteed under Article 14,15 and 21 in the Constitution of India, 1950.

Notably, such forms of Talaq include one Talaq-E-Hassan also known as Talaq-Ul-Hassan, which is being grossly abused by Muslim men, as by way of this form of Talaq, the Muslim man has the unilateral extra-judicial form of power to make three pronouncements of talaq, spread over a period of three consecutive months, completing which, the marriage shall stand dissolved, without hearing the Muslim women, the plea said.

Therefore, the petitioner has sought to frame guidelines for "gender-neutral religion-neutral uniform grounds of divorce and uniform procedure of divorce for all". The petitioner also sought to declare the practice of "Talaq-E-Hasan and all other forms of unilateral extra-judicial talaq" void and unconstitutional for being arbitrary, irrational and violative of Articles 14, 15, 21, 25.

The petition also sought to declare that Section 2 of the Muslim Personal Law (Shariat) Application Act, 1937 is void and unconstitutional for being violative of Articles 14, 15, 21, 25, in so far as it validates the practice of "Talaq-E-Hasan and other forms of unilateral extra-judicial talaq".

The petition also sought to declare the Dissolution of Muslim Marriages Act, 1939, void and unconstitutional for being violative of Articles 14, 15, 21, 25 in so far as it fails to secure for Muslim women the protection from "Talaq-E-Hasan and other forms of unilateral extra-judicial talaq".
