Truth about Qatari letters JIT’s biggest challenge

ISLAMABAD: As the joint investigation team (JIT) prepares to wrap up its investigation into the Sharif family’s offshore properties, it faces a big challenge of unraveling the truth about the two letters provided by a Qatari prince during the course of the Panamagate proceedings in the Supreme Court.

The letters from Prince Sheikh Hamad bin Jassim bin Jaber Al-Thani came confirming his business ties with the ruling Sharif family in a bid to complete the money trail to their properties in London.

But with the six-member probe team – which is to submit its final report in the Supreme Court on July 10 at the end of its 60-day tenure – still unable to record the Qatari prince’s statement, the question looms: Are the two letters a myth or reality?

A debate has already started over what legal implications will be there in case the key testimony of Prince Hamad – who insists on recording his statement at his office and not at the Pakistan mission in Doha as demanded by the JIT – is not obtained.

The Sharif family’s legal team is eyeing at taking advantage of the situation where the statement of a key witness would be missing.

A member of the team told The Express Tribune that it would be a good ground to contend before the Supreme Court that the JIT had missed out on the most important link with respect to the money trail.

A final strategy on this particular point will be devised by Khawaja Haris, a senior member of the legal team who is keenly observing the events.

It is leant that the Sharif family is very satisfied with the legal strategy devised by Haris regarding their appearance before the JIT.

Those close to the ruling family confided to The Express Tribune that the Prime Minister and his family are very confident over the last couple of days which is surprising for them as well.

The top court in its majority judgment on April 20 asked the JIT to probe “whether the sudden appearance of the letter of Hamad bin Jassim bin Jaber Al-Thani is a myth or a reality”.

To fulfill this task, the JIT gave a few options to the Qatari prince for recording his statement. Despite efforts from Salman Alsam Butt, the former attorney general, and Saifur Rehman, a close aide of the Sharif family, the prince did not avail any of the options for recording his statement to prove the money trial to the Landon flats owned by the Sharif family.

The Qatari prince is reported to have shown willingness to record his statement at his palace in Doha but the JIT offered him to do so at the Pakistani embassy. However, he declined the JIT’s offer, saying that laws do not permit him to do so.

Some legal experts believe that the JIT is acting on the directives of the Supreme Court which had, on May 29, asked the JIT to disregard the Qatari prince’s letter if he did not appear in person before them. The investigating body has sent him at least two letters, requesting him to personally appear to record his statement.

Former senior law officer Shah Khawar believes that the JIT is not bound to visit Al-Thani’s residence under the law. Likewise, it was the duty of the ruling family to bring their witness before the JIT.

“If the prince does not come to verify the contents of his letters, it will be established that his communication [letters] to the top court of the country is just a myth,” Khawar opines.

However, the ruling family’s legal team that was part of the hearings in the Supreme Court believes that the family could use it to their huge advantage if the JIT is unable to record statement of his main witness.

Legal eagles think that the JIT may again seek guidance over the elusive Al-Thani testimony from the apex court which has the authority to extend the time and allow the JIT to visit at his palace in this regard.

A senior official believes that it will be interesting to see whether the court allows the Sharif family to submit their objections to the final JIT report, adding that if the court allows the respondents, then it will be a huge benefit for them. “Both the sides are smartly playing their cards,” says the official.

The five-judge larger bench of the apex court had observed in its April 20 verdict that after the receipt of the final report from the inquiry panel, the matter of the PM’s disqualification shall be considered.

“If found necessary for passing an appropriate order in this behalf, respondent No 1 [PM Nawaz] or any other person may be summoned and examined,” said the order.

It is learnt that the legal team of the Sharif family may raise objection to the implementation bench and make a request for the constitution of a larger bench for giving a final verdict in the Panamagate case. However, their legal team will evolve a final strategy after going through the final JIT report.

2 of the most senior apex court judges already sent the qatari letter to "radi ki tokri" by giving the decision against Nawaz 3 months ago. Other 3 judges also had similar views about the letter if you read the verdict...

And I expect that in future these (then retd) judges would be called by review/appeal court and it would hard for them to defend "radi ki tokri" comment.
(Calling NS mafia etc also established what they think about the case, but this also tells us that in future it woud be extremely easy for appeal court to overturn the verdict as this court is not impartial by making such comments)

No idea why PPP supporters defend PMLN so badly, considering PMLN's godfather murdered their founder, PMLN's leader insulted their founder's daughter (Benazir) and hounded her in disgraceful campaigns and they also jailed their present leader, Zardari, who faced torture for years under Nawaz.

I mean if there was one party's cause to despise PMLN it should be them.

Lol Qatari is a defense witness so Nawaz has to request him to come. JIT agreeing to meet him in Pakistan consulate is a favor to the defence. The Qatari is a thief just like Nawaz and has been promised billions through power projects in Pakistan if he can invest and make profits in Pakistan he can come and give statement actually his statement is also worth nothing unless he can show bank transactions as proof just saying he gave money is not enough so meeting him will bring nothing. He doesn't even need to come just email the bank transactions.

And it's not NS's responsibility to bring him to Islamabad.

Letter (written statement) is provided, if JIT, got follow up, ask in writing/video link/go to his place. (JIT wrote letters to Qatri and argued about non-existent jurisdiction of JIT, they could have easily asked the questions about the case instead, they also travelled to gulf countries and went to the offices of various financial institutes, why cannot they have video link?)

Most likely the verdict of JIT would be a toilet paper!

My concern is about the process.

Qatri has presented his written statement.And NS submitted that to SC and JIT, now if JIT want something additional, setup a Skype call.

Qatri is not seeking any answers, so no reason for him to be extra accommodating.

The Sharif family’s legal team has come with a three-pronged strategy to challenge the report the Joint Investigation Team (JIT) probing into the ruling family’s offshore assets will submit to the top court.

Sources privy to the Sharif family told The Express Tribune on the condition of anonymity that the legal team had been continuously working with all the witnesses summoned by the JIT.

These witnesses had been briefed before they appeared before the JIT and then also debriefed after their appearance, insiders said.

They added that the legal team had made notes of all the questions that the JIT had asked, the answers it received and the behaviour of the team’s members.

The challenges being prepared by the legal team will have three points to make the issue political as well as legal, sources explained.

The first part of the strategy is to attack the JIT on its conduct. PML-N leaders have already created an environment where they have questioned the whole process as well as JIT’s impartiality claiming that it actually did not know what allegations it was investigating.

Sources said there were a number of media stories that created doubts about the JIT.

The other important challenge will be questioning the Supreme Court bench itself.

In this case the legal attack will be directed at two judges — Justice Asif Saeed Khosa and Justice Gulzar Ahmed — if they are included in the bench that hears the final argument on the JIT report.

The argument that would be made here, according to insiders, is that the two judges had already made up their mind against the Sharif family and should not be a part of the bench.

The legal team is also contemplating filing a reference against Justice Khosa in the Supreme Judicial Council to put pressure on him and keep him out of the bench that hears the final arguments on the JIT.

Sources added that the legal team was also ready to immediately file a review petition in case the apex court bench disqualified the Prime Minister Nawaz Sharif and his family members.

This will help the Sharif family in giving hope to the electorate that Nawaz may still have a chance to make a comeback and also in keeping the party intact.

PML-N press conference will not affect outcome of JIT: lawyers

PML-N minister Khawaja Asif flanked by Khawaja Saad Rafique, Ahsan Iqbal and Shahid Khaqan Abbasi said on Saturday that if the Qatari royal was not included in the investigation then the JIT’s report will not be accepted. They also asked the probe body to make all the audio video recordings public.

Pakistan Today reached out to leading lawyers of the country and asked about the legal implications of PML-N presser on JIT and its submission of final report on Monday.

Former SCBA president Barrister Ali Zafar was of the view that the ministers’ conference has certainly attacked the JIT and also indirectly and partially challenged the Supreme Court decision. ‘It seems to be a reaction rather than based on any legal expediency and I think no substantial legal defense has been put forward by them,’ he said.

When asked will the press conference affect in any way the Monday hearing in Supreme Court, Ali said that JIT may have finalised its report by now, so this was not going to affect that report. ‘It seems that the JIT report will be against the ruling family and that is why they held such a reactionary sort of conference. Barrister Ali, when asked whether some part of the press conference was tantamount to contempt of court, said that some parts certainly felt as if they planned to defy the court.

Ali ruled out any contempt action as he believed Supreme Court realised that it was a political case and a political parties needed to appease their voters as well.

Notable criminal lawyer and Pakistan Bar Council Member Supreme Court Azam Nazeer Tarar advocate was of the view that there was no legal implication of press conference by PML-N ministers. ‘Joint Investigation Team is a wholly legal affair and will not be affected by such statements. The court is all powerful to preside over this,’ he said. Tarar ruled that it was about time that we would have matured, ‘such things prove that our legal system hasn’t matured. As a mature system wouldn’t have cared for such careless statements,’ he said.

When asked the JIT will submit its report on Monday as usual, Tarar replied that the goddess of justice was blind and did not differentiate. ‘The cases are decided in technicalities, not moralities. The court will decide as per the record before it and not by the vague notions of right and wrong,’ he concluded.

Interestingly, the statement by Khawaja Asif is a complete U-turn from the plea entered by Khwaja Haris advocate, counsel of Hussain Nawaz Sharif on June 12, 2017 when JIT submitted its second fortnightly report before the Supreme Court of Pakistan.

When the petitioner’s counsel objected to the recording of JIT proceedings, the bench observed that there was no bar on recording proceedings, adding that video recording was also carried out to produce transcripts.

Barrister Ali Zafar, former President SCBA has said that the allegations, complaints by four ministers have no legal status as of now. ‘However, if the Supreme Court wants to take them up, it can hear them,’ he said.

PPP leader Aitzaz Ahsan was of the view that the four ministers in their presser were not pressure tactics or aimed to threaten opposition or JIT. ‘With their statements they’ve directly attacked the Supreme Court’.

FIA finds SECP chief guilty of tampering with record of Sharifs’ companies

ISLAMABAD:
In a major development, a Federal Investigation Agency (FIA) team has found the chairman of the Securities & Exchange Commission of Pakistan (SECP) guilty of tampering records of the companies owned by the Sharif family, and recommended registration of an FIR against him.

On June 19, a three-judge bench of the Supreme Court – headed by Justice Ejaz Afzal Khan – had directed the FIA director general to launch an inquiry into the allegations by the Joint Investigation Team (JIT) that the SECP had tampered with the records of the Sharifs’ companies.

Subsequently, the top court had constituted a four-member FIA team to probe into the allegations. On Saturday, the team submitted, in the apex court, a 28-page report in which it endorsed the JIT’s stance regarding record-tampering. A copy of the report is available with The Express Tribune.

Sources told this correspondent that the FIA team had found SECP Chairman Zafar Hijazi guilty of “misconduct by passing illegal orders and pressuring his subordinates to do illegal acts, therefore a criminal case under Sections 466, 472 PPC read with 5 (2) PCA 1947 be registered against him”.

The FIA team is also learnt to have recommended that two senior SECP officials — Ali Azeem and Maheen Fatima — who had complied with the illegal orders have been found negligent; therefore, departmental proceedings be initiated against these ‘irresponsible officers’.

Let me give it straight to you, the Nooras came up with the Qatari story as an after thought when they didnt have the receipts and then they quickly realised that it was worth less than dog $#$t, but by then the damage had been done. Then came all the melodrama about him not coming to PK but is happy to come and shoot endangered birds. The Nooras are the ones that have advised him not to appear because he would have been ripped to pieces, this way they can claim some sort of conspiracy. In the end the question was simple; how did the money get from PK to London and they have no receipts and hence no answer. As i said earlier i feel your pain, but the humiliation has just started.

Qatari Prince is supposed to have evidences in favour of Sharif Family but this all will become irrelevant in coming days because we will see a lot of concrete evidences against Sharifs, from there dearest allies.

This case is now at stage of confessions and confess they will.

I was once a witness to a road accident and i gave a statement on behalf of one of the parties, i was then asked to appear in court to answer questions on my statement, do you think that i should have asked them to come to my house to ask me questions or do you think it was wise of me to go to them?

Unfortunately you are not a foreigner so pakistani court can send you summon if you refuse to appear.

Now imagine, you were visiting Qatar, and you saw a crime, and you gave statement to police about the incident and later returned to pakistan.

If Qatari judiciary needs to ask anything extra and ask you to appear in qatari court, then it's entirely up to you what level of cooperation you offer to them.

It's in the best interest of qatari judiciary to accommodate you as you can be the key to the truth/facts/justice.

I am at a loss for picking up a subject to write this week. There is so much that I may want to talk about, but so little by way of inspiration to do so. It is like your gaze fluttering along aisles and pathways looking for some place to stop. Whenever lost for ideas, I tend to take refuge in poetic reflections. And with who better than Faiz!


The hilarious and pitiable enactment of the post JIT-hearing dramas unfurling monotonously every time one or the other of the tediously pompous Sharif clan comes out after facing the probing questions is nauseating. The stage-managed acts are a sad reflection of the degenerate capacities of those who would happily suck out the last drop of blood of the emaciated beings they profess their devotion to. The feigned innocence hardly covers the frustration writ large on their faces, or the anger frothing at their mouths, telling a millions tales!

In this vast labyrinth pock-marked with man’s infidelity to his associates, both his mentors and those who may be subservient to him, one is truly lost. One does not know where to look, what to believe and what to shun. Every lie is spoken with the finality of the gospel. Every false errand is projected as a noble step ordained for changing people’s destinies. Every gesture is a reflection of the gushing floods of prosperity going to transform the fates of the poor and the underprivileged, the ill-treated and the malnourished. It is just a knock away as the people face the spectre of electing the marauding thieves again.

Away from the unceasing claims of innocence, there is a plethora of undeniable evidence that refuses to melt away. Through innumerable decades of misrule embedded with indoctrinations at the hands of that ultimate demonic dictator, General Ziaul Haq, the godfather and his attendant mafias have continued to plunder not only the wealth of the country, but also the spirit and resolve of its people. Looking frail, they seem to have lost faith not only in the individuals purporting to be the grandstand leaders, but in the very system that continues to throw up such criminals garbed as advocates of democracy.

But, there is no shame. Instead, they have the audacity to ask what crime they have committed? They know the answer, but they would not give up on their project of loot and plunder. They want to continue exploiting the poor’s helplessness and take away even the last morsels that may be stored away for a difficult day, or to feed an uncontrollably wailing child.

It is in these moments of pain that Faiz comes serenading his song of hope:

But beauty which has kept millions captivated in its bosom may be fading, and hope which has kept them going in spite of the daunting odds may be receding because difficult are the days to live, and heartless the nights to endure. The cyclic enchantments that have been heaped on unsuspecting people through laborious harangues promising the dawn of a glorious era resplendent with bounteous showering for their frail bodies and frailer spirits is nowhere on the horizon. It is a bland sky that people are tired of surveying through their moist eyes, and through the eyes of their elders who have perished, and the eyes of their young ones who refuse to put their faith to wasteful consumption.

At the crossroads, the hungry stomachs and empty hearts yearn for a candle to light up their paths. The promise of bounties has faded. There is dust of despondence piled on the lure of prosperous futures held out ad nauseam by the coterie of mafias of all hues and shades, of the dictatorial and democratic dispensations that have ruled the country by taking criminal turns.

But, behold! There is a promise that still holds out: a promise that beckons to take the fight to the doorsteps of those who have denuded the poor of hope and hearth. This is the promise that Faiz repeatedly extols for transforming into an indomitable strength.

This cascading strength should become the power to bare the marauders of the veneer of civility that they wear so guilefully and be shown as the vile creatures they really are. Let their wickedness be drowned in the nectar of people’s resoluteness and their deviousness be ironed out under the heat of their conviction. And let their feigned and sanctimonious righteousness be buried in the putrid heaps of their misdemeanours and calumnies.

Let this strength be the sword to cut out the inequities and injustices so rampant all around. Let the pain of Parachinar be as intense as the pain of Bahawalpur and let the stamp of faith not become a license to kill.

Let the shroud of discrimination be torn away and let no one be singled out on the basis of faith, caste, creed or colour.

Let this strength proclaim that no one is beyond law. Let the courts rise above their doctrines of necessity and help Pakistan move into a trajectory to redemption.

Let the state prevail, let the people be its guardians and let the institutions defend its polity and sanctity.

That is the day Pakistan has waited for. That is the day which will be. So it is writ.

FIA finds SECP chief guilty of tampering with record of Sharifs’ companies

ISLAMABAD: In a major development, a Federal Investigation Agency (FIA) team has found the chairman of the Securities & Exchange Commission of Pakistan (SECP) guilty of tampering records of the companies owned by the Sharif family, and recommended registration of an FIR against him.

On June 19, a three-judge bench of the Supreme Court – headed by Justice Ejaz Afzal Khan – had directed the FIA director general to launch an inquiry into the allegations by the Joint Investigation Team (JIT) that the SECP had tampered with the records of the Sharifs’ companies.

Subsequently, the top court had constituted a four-member FIA team to probe into the allegations. On Saturday, the team submitted, in the apex court, a 28-page report in which it endorsed the JIT’s stance regarding record-tampering. A copy of the report is available with The Express Tribune.

Sources told this correspondent that the FIA team had found SECP Chairman Zafar Hijazi guilty of “misconduct by passing illegal orders and pressuring his subordinates to do illegal acts, therefore a criminal case under Sections 466, 472 PPC read with 5 (2) PCA 1947 be registered against him”.

The FIA team is also learnt to have recommended that two senior SECP officials — Ali Azeem and Maheen Fatima — who had complied with the illegal orders have been found negligent; therefore, departmental proceedings be initiated against these ‘irresponsible officers’.

Lost count how many departments have been caught tampering with records in favour of Nawaz Sharif and almost entire top leadership and federal ministers can be seen complaining about JIT for leaking pictures, it is absolutely beyond belief how some people can actually defend Nawaz Sharif's harassment of Supreme court and JIT.

I can understand PMLN hardcore supporters but absolutely disgusted to see our so called roshan khayaal liberals like Imtiaz Alam, Marvi Sirmed, Nusrat Javed, Najam Sethi, entire Geo team (except Shahzaib and Hamid Mir) totally supporting PMLN propaganda that an international level conspiracy is behind Panama case backed by establishment and judiciary to support Imran Khan.

It's totally fine being anti establishment but why do you have to blame establishment in every case? How does it actually help democracy or institutions? In fact most are blaming top most Supreme court judges to be dishonest for being involved in conspiracy.
 
Unfortunately you are not a foreigner so pakistani court can send you summon if you refuse to appear.

Now imagine, you were visiting Qatar, and you saw a crime, and you gave statement to police about the incident and later returned to pakistan.

If Qatari judiciary needs to ask anything extra and ask you to appear in qatari court, then it's entirely up to you what level of cooperation you offer to them.

It's in the best interest of qatari judiciary to accommodate you as you can be the key to the truth/facts/justice.

As usual you are confused and biased towards criminals. The Qatari has not seen anything; he just gave a statement in favour of one party and he has has been asked to corroborate it and he doesnt want to and that should be the end of the matter. If the Sharifs want his evidence to be taken into consideration then they need to make this fraudster appear before the committee. He is their liar so he's their responsibility.
 
ISLAMABAD: Pakistan Muslim League-Nawaz (PML-N) has decided not to accept the minus-one formula in case the disqualification of Prime Minister Nawaz Sharif emerges out of the JIT report. The party leadership has decided to take other political parties into confidence over a “conspiracy brewing” against the prime minister.

A well-placed source in the ruling party told Pakistan Today that the party leadership feels that a conspiracy is being targeted at the prime minister for ulterior motives but the party would fight out to defeat any such plan.

“You know this is not the first time that a minus-one formula has emerged. It was against Benazir Bhutto, Asif Zardari, Altaf Hussain and now Nawaz Sharif. Some powers want to expel all top politicians so they could play around with minnows,” the source added.

“We have sufficient evidence to ascertain the fact that a conspiracy is being hatched. First, a WhatsApp call was detected to include specific persons into the JIT. Then evidence came to the fore to prove that the JIT members only sign the investigation papers and that the original investigation is being done somewhere else. Then there is evidence suggesting that ISI was managing the security of the JIT proceedings. All these facts were never contradicted or challenged,” the source said.

The source said that the ruling party has devised a political strategy to thwart the game plan against the prime minister.

Asked to elaborate the political strategy, the source said that the ruling party would directly attack those who are playing a role in the plan against Sharif.

“We will directly target the JIT members; those judges who used terms like Sicilian Mafia and Godfather and the elements in the establishment who want to throw the PM out,” the source said.

Asked to elaborate more, the source said that as the biggest political party of the country, the PML-N wants to mobilise its workers so they could not be isolated and disappointed.

“We would discredit those JIT members who have targeted the premier. Since we don’t expect justice from them, we would discredit them. Moreover, we would also target the establishment too,” he added.

He said that the ruling party’s legal team would raise technical questions to discredit those who have been targeting the prime minister.

Meanwhile, PM Nawaz Sharif was briefed on Sunday about the possible legal scenarios following the Joint Investigation Team’s submission of a report to the three-member Supreme Court bench today.

A well-placed source told Pakistan Today that the meeting covered all possible angles of the report while the legal team, led by lead counsel, Khawaja Haris also detailed the available legal options with the PM and his family.

PTI only managed to win 5100 votes in Karachi by-election, even behind N-League 5400. The top two were PPP and MQM with 23k and 18k respectively. Really dismayed by my city. :facepalm: :facepalm:


These ghulaam will keep voting for status-quo parties and then turn around and cry about social issues.

I doubt anyone will be able to crack Karachi, the two local players have it sewn up. Something bonkers like PTI/Imran Khan convincing Javed Miandad to run on his ticket. It's really sad cos no other city comes close to having the potential that Karachi does.

Yaar.. this mentality is endemic throughout Pakistan. People only vote for parties who their baap dada have been voting for. Even if tomorrow national elections are held Noon League will again form government. The only people who have shown some semblance of true electoral politics are the people of KPK.

I agree, my province Punjab has shown shameful political illiteracy over the years , keep electing corrupt politicians again and again, but solute to people of KPK, the only ones who keep provincial and national interest in mind when voting.
 
It is looking like that most people of Punjab loves Nawaz Sharif and PML-N and will still vote for them in the next elections for the next government.

I know the past of Fawad and his love for Bilawal but still the man is an asset for PTI on media and i am glad they realized it during Panama hearing! people like Shafqat Mehmood and Naeem ul Haq can't handle media...
 
I wouldn't dismiss Noorani's story right away. He has been right in the past but he is no one to pass the judgement on whether Nawaz Sharif is responsible or his children. Remember under NAB law, public office holder has to be responsible for children's wealth.
 
JIT brings up along with them a box of files, journalists clamor to get a photo of it like some celebrity. :))

That true most of the people think it will take a couple of weeks at least or a month before final verdict and now there is another rumor of commission in the market after JIT :13:

Yea that is clearly contempt of court but he isn't the first from PMLN to do it in last few months almost every PMLN leader did it on media specially Rana Sanaullah and Khawaja Saad did it multiple times.
