Pervaiz Elahi freed from jail after Lahore High Court order [Post# 577]

LHC dismisses Elahi's nomination papers appeal

The Lahore High Court (LHC) dismissed on Saturday an appeal by senior PTI leader Chaudhry Parvez Elahi against an earlier rejection of his papers by the returning officer.

The court, however, granted permission to his wife, Qaisara Elahi, to contest the upcoming general elections.

Elahi's lawyer, Shahzad Shoukat, said that allegations of concealing facts in the nomination papers have been made. "The accusations include not mentioning a license for seven weapons and the absence of a mention of a special account in the nomination papers."

The lawyer emphasised that "according to the law, everything is stated in the papers, and an attempt was made to snatch the nomination papers. Pervez Elahi is a senior politician; he should be allowed to contest the elections".

"They arrested their appointed representative when he went to submit the nomination papers," said the lawyer while responding to queries from Justice Najafi.

Justice Najafi questioned if it "is the responsibility of the ECP to issue timely orders? Did you file any complaint with the ECP?"

"We approached the court, and after court orders, we were allowed to go to the RO office."

Subsequently, the court announced its verdict and rejected Elahi's appeal.

Previously, the LHC directed the Regional Police Officer (RPO) of Gujranwala, along with the District Police Officers (DPOs) of Gujrat and Mandi Bahauddin, to adhere strictly to legal protocols, emphasising that they must not impede Qaisara Elahi, from submitting nomination papers for the upcoming general elections before the relevant officers.

Qaisara contended that she, her husband Elahi, and Moonis intended to contest the forthcoming general elections scheduled for February 8.

To facilitate the submission of their nomination papers, authorised individuals were appointed to represent them before the returning officers of the respective constituencies. However, Qaisara Elahi claimed that these authorised individuals were facing obstruction from the Punjab police, including illegal abduction.

Elahi says he stands firm with Imran amidst political turmoil

Elahi, a key figure within PTI, expressed solidarity, taking a veiled swipe at political rivals Nawaz Sharif and Bilawal Bhutto-Zardari. "I am standing with Imran Khan. For fear of Imran Khan and PTI, both ladlas (darlings) have lost sleep," Elahi remarked, addressing the alleged unease of Sharif and Bilawal.

Speaking informally to journalists, Elahi emphasised his loyalty, stating, "I have never left anyone in difficult times; I stand with Imran Khan."

The former chief Mminister of Punjab raised concerns about the democratic process, questioning the denial of PTI, the largest political party in the country, to contest elections. Elahi confidently predicted success for PTI nominees on February 8, expressing determination.

Elahi did not mince words in his criticism of the Pakistan Muslim League-Nawaz (PML-N), stating that the sparse attendance at PML-N public gatherings is evidence of the public's rejection of these "ladlas" (darlings).

He accused political opponents of resorting to fear tactics, claiming that the fear of Imran Khan and PTI has made sleep "haram" (forbidden) for them.

Responding to allegations of interference in PTI's election campaign, Elahi asserted, "We are not being allowed to run the election campaign with full freedom. The houses and election offices of our candidates are being raided." He questioned the motives behind spreading fear and panic within PTI, challenging those responsible.

Despite the challenges, Elahi declared PTI's readiness for political competition and affirmed their full participation in the upcoming national and provincial assembly elections.

Parvez Elahi will not quit PTI, says his wife Qaisra

In an exclusive interview with ARY News, Qaisra Elahi while commenting on the family differences said it hurts when Chaudhry Shujaat’s sons talk about playing “aurat card”.

The wife of former Punjab CM said she decided not to comment on the differences within the Chaudhry family, but she was forced to respond to the “lies” being said.

Responding to a question about her incarcerated husband, Qaisra Elahi said her brother Chaudhry Shujaat Hussain says he [Parvez] can come out of the jail the day he leaves Pakistan Tehreek-e-Insaf.

Parvez Elahi has vowed not to leave PTI in any situation, she added.

Qaisra Elahi claimed efforts were made to reject her nomination papers and went on to ask in what capacity the police and Elite Force are accompanying the sons of Chaudhry Shujaat Hussain.

Parvez Elahi’s wife said both the families agreed not to publicize the differences but the understanding was violated.

Younger brother Shajaat tried to settle the differences between Parvez and Shujaat families, but the PML-Q president said he ‘took retirement and suggested Elahi to take retirement too”.

The Supreme Court on Friday allowed incarcerated PTI President Parvez Elahi to contest the forthcoming general elections from PP-32 of Gujrat.

A three-member bench headed by Justice Mansoor Ali Shah and comprising Justice Jamal Khan Mandokhail and Justice Athar Minallah overturned the rejection of Elahi’s nomination papers by the Lahore High Court (LHC) and the election tribunal.

Elahi, who served as the Punjab chief minister, had filed his nomination for the Feb 8 general elections. However, his papers were rejected by the returning officers, a decision later affirmed by both the election tribunal and the LHC.

On Wednesday, Elahi had approached the Supreme Court, seeking to overturn the LHC ruling that upheld the ROs’ decision to reject his candidacy for the NA-64 and PP-32. He had filed two separate petitions in the apex court.

Today, Elahi’s lawyer Faisal Siddique told Dawn.com that they had decided to withdraw the petition for the NA seat.

“We decided to contest [the elections] on only one seat due to the shortness of time,” he said.

“By a series of pro-democracy judgments, the SC has ignited a series of candles in the darkness of a sham election,” Siddique said when asked to comment on the case proceedings.

Hearing
At the outset of today’s hearing, Siddique contended before the court that ballot papers were currently being printed. He called on the court to let him present his arguments in the case. The court subsequently gave the parties till 11am to present their arguments.

When the hearing resumed, Justice Minallah highlighted that it was the court’s responsibility to interpret the Election Act in a way that did not deprive the people from choosing a representative of their choice.

In his arguments, Siddique told the court that he had not yet received the complete order by the RO which rejected Elahi’s nomination papers. He said that Elahi’s papers were rejected on the basis that he failed to open separate bank accounts for campaigning in different constituencies.

“Elahi is contesting from five constituencies,” he said. At this, Justice Minallah asked where the law said that separate accounts were required for the different constituencies.

“If there is an overspending during campaigning, the accounts are scrutinised after the polls are conducted,” Siddique said. He said that police were present when the nomination papers had to be submitted.

“Another objection raised in the plea is that my client hid the ownership of a 10 marla property in Punjab,” he added.

“My client never purchased this plot. He was in jail at that time,” he contended, adding that the purchasing date was from when Elahi was in jail.

Justice Mandokhail asserted that the reason behind asking about a person’s assets was to compare what he owned before and after coming into power.

“It is fine if you are rejecting the ownership of the plot,” the judge said.

“He is not contesting the elections for the first time,” Elahi’s lawyer said. “He has remained chief minister of the province twice,” he added.

He further said that the deadline for declaring assets was June 30, 2024. “Surprisingly, at the same time, the declared properties of Elahi, his wife Qaisra, and his son Moonis came to light,” he said.

Justice Mandokhail remarked that Elahi was a lucky man as new properties in his name had surfaced. “You should give these additional properties for charity purposes,” he quipped.

At one point, Justice Minallah remarked that it seemed as if the caretaker government was involved in getting Elahi’s nomination papers rejected. He said the RO’s job was to facilitate election candidates instead of burdening them.

“Unfortunately all this is happening with only one political party,” Justice Minallah said.

After hearing the arguments, the court declared the decision to reject Elahi’s nomination papers null and void and allowed him to contest the elections from PP-32.

The Supreme Court also directed the authorities concerned to allot Elahi an election symbol and have it included in the ballot papers.

Four other PTI leaders granted relief
Separately, the apex court also allowed PTI leaders Umar Aslam, retired Major Tahir Sadiq, Sanam Javed and Shaukat Basra to contest the upcoming general elections.

Sadiq had submitted his nomination papers from NA-49 (Attock) but his candidature was rejected by the returning officer (RO) after completion of the scrutiny process. Besides him, the papers of his wife Naz Tahir were also rejected on various grounds.

The PTI leader had approached the Lahore High Court against the decision but faced a similar fate there as well. He had subsequently approached the SC.

Today, a three-member bench comprising Justice Mansoor Ali Shah, Justice Athar Minallah and Justice Jamal Khan Mandokhail accepted Tahir’s petition and allowed him and his wife to participate in the polls.

Separately, the bench also allowed Aslam to contest elections. The PTI leader, representing the party from NA-87 (Khushab), was arrested last month and his nomination papers were snatched.

During the hearing, Justice Shah remarked that there was no law which prevented a “fugitive” from exercising his fundamental right to participate in elections. Meanwhile, Justice Minallah said the ECP was answerable to the public and should let them decide “who is what”.

Meanwhile, another SC bench comprising Justice Munib Akhtar and Justice Irfan Saadat Khan allowed Basra and Sanam to take part in the forthcoming polls.

Sanam petitioned the top court following the rejection of her nomination papers from NA-119 and PP-150, Lahore. Basra approached SC after his papers were rejected from NA-160.

During the proceedings, Sanam’s counsel contended that her client faced disqualification due to the absence of a separate bank account for election purposes. The counsel argued that it was impractical for an incarcerated individual to open a personal bank account.

Basra’s lawyer informed the court that a returning officer had rejected a single bank account, asserting that the deadline for accepting nomination papers had elapsed. Justice Saadat pointed out that the election schedule did not specify 3pm as the cutoff time for submitting nomination papers.

Elahi seeks replacement of election symbol

LHC’s Justice Shahid Bilal Hassan on Monday sought a response from the ECP on a plea filed by PTI's former chief minister Punjab Chaudhry Pervez Elahi for replacement of ‘donkey cart’, an election symbol granted to him by ECP, with another symbol, 'peacock'.

The petitioner's counsel Amir Saeed Rawn argued that the the Supreme Court allowed petitioner Elahi to contest general elections and that he is contesting from PP-32 Gujrat for the seat of provincial assembly.

Following this, petitioner Elahi submitted an application to the returning officer requesting the peacock as his election symbol.

However, the RO claimed not to have received the application. Subsequently, petitioner Elahi was granted the ‘donkey cart’ as his election symbol. He requested the court to set aside the RO's decision and direction to be passed to concerned quarters to allot them peacock as election symbol.

Elahi accuses Shehbaz of cruelty, refuses talks until ‘stolen seats’ returned

Chaudhry Pervez Elahi, a prominent leader of the Pakistan Tehreek-e-Insaf (PTI) party, launched a scathing attack on Shehbaz Sharif, the prime ministerial candidate for the Pakistan Muslim League-Nawaz (PML-N), accusing him of cruelty and harbouring resentment even within his own family.

Elahi's remarks came a day after Shehbaz Sharif's elder brother, Nawaz Sharif, nominated him for the post of prime minister, signaling a significant shift in the power dynamics within the PML-N. Nawaz Sharif himself decided to step back, taking a backseat in the political arena.

Speaking to the media after appearing in the anti-terrorism court in Islamabad on Thursday, Elahi asserted that the Sharif brothers had returned to the country with the aim of becoming the "darlings of the establishment", a term suggesting close ties with influential authorities, particularly the military.

Poor Pervez languishing in Jail
======
Chaudhry Pervez Elahi has filed a plea in the Lahore High Court(LHC) seeking details of criminal cases, first information reports (FIR), and pending inquiries against him.

Justice Shehbaz Rizvi of LHC has recused himself from hearing the plea and has referred the case to Justice Malik Shahzad Ahmad Khan to conduct further proceedings.

The former CM Punjab has filed a plea through his advocate, Amir Saeed Rawn, in the LHC. The petitioner has requested the court to direct the concerned authorities to provide all the details of cases in certain categories that have not been closed yet. Additionally, Elahi has also demanded copies of those cases to be handed over to him.

Elahi complained during the hearing that although the court declared his arrest illegal and unlawful, he remains in custody.

The prominent PTI leader, who was initially arrested in the case of illegal recruitment to the Punjab Assembly on June 3 requested the court to order his release.

During the court hearing, Elahi implored the court to enforce his fundamental rights. He requested the authorities not to arrest him in any criminal case that is unknown to him.

He urged the court that he should be provided with copies of FIRs lodged against him - and a reasonable opportunity of at least ten days to apply for anticipatory protective bail before the relevant forum of law.

The PML-Q leader contended that the respondents had registered false and frivolous cases against him - with the intention of arresting him without providing him an opportunity to seek relief from the concerned court of law, in the form of anticipatory bail.

The petitioner argued that this was a violation of his fundamental rights, as guaranteed under Articles 4, 10, 10-A, and 25 of the Constitution.

Elahi further asserted that providing the details of the cases or FIRs registered against him or any pending inquiry is a crucial first step in due process, as guaranteed under the Constitution.

The petitioner claimed that denial of this right would amount to a violation of the Constitution.

The PTI leader further maintained that the respondents had violated this right with ulterior motives to keep him behind bars for as long as possible.

Elahi, after his initial arrest on June 3 last year was granted bail by LHC on Feburary 14 this year. He was again arrested on September 18 for allegedly illegally appointing Bhatti, following which a Lahore court sent him on judicial remand.

In October, a Lahore district and sessions court had granted police Elahi’s two-day physical remand in the case. Days later, the Punjab Anti-Corruption Establishment (ACE) had informed the court that it had allegedly recovered Rs4.1 million from the ex-CM’s house in the case.

Elahis reject reports of patch-up

Qaisera Elahi, the wife of former Punjab chief minister and PTI president Chaudhry Parvez Elahi, has rejected reports of family reconciliation.

She said PML-Q chief Chaudhary Shujaat Hussain had no role in the release of her spouse.

“We did not have any kind of family reconciliation, all these things are based on lies,” she said in a statement issued here on Thursday in response to reports of a reconciliatory meeting between Shujaat and Parvez Elahi.

Earlier in the day, a PML-Q spokesman claimed that Parvez Elahi had met Shujaat at his residence in Lahore. Without mentioning when the meeting took place, the spokesman claimed that both Chaudhrys had agreed to reunite the family, but every one would be free to pursue his political career.

Qaisera Elahi said the courts had dispensed justice to Parvez Elahi and her husband had given a clear message to Chaudhary Shujaat that there would be no discussion between both families until the stolen mandate was returned.

“Parvez Elahi is neither ready to join the PML-Q now nor in future because it has been reduced to a party standing on crutches of stolen mandate. No sane person will like to become even a member of PML-Q.”

When contacted, Chaudhry Moonis Elahi told Dawn that no formal meeting was held between both Chaudhrys as Mr Elahi had met Shujaat Hussain for a few minutes after he returned home after getting released on court orders.

“Since they could not break him in jail, the Shujaat family’s latest strategy was to spoil him within the PTI,” Moonis Elahi explained.

The Lahore High Court (LHC) on Monday ordered the federal government to remove the name of PTI leader Parvez Elahi from the passport control list (PCL), along with the names of his son Rasikh Elahi and daughter-in-law Zara Elahi

Justice Shams Mehmood Mirza pronounced the verdict on the petitions.

According to the petitioners, the names of the Elahi family members had been put on the PCL “illegally”.

During the hearing, the federal government’s counsel opposed the request to remove the names from the PCL.

In May, the LHC granted Parvez bail and ordered his release in a case related to an alleged illegal appointment made in the Punjab Assembly during his stint as the chief minister.

The court order, a copy of which is available with Dawn.com, said the case against Elahi called for further investigation into his guilt and his bail petition was thus being allowed with bail set at Rs500,000 with two sureties each in the like amount.

Elahi was initially arrested in the case of recruitments to the Punjab Assembly on June 3 last year. The case pertained to illegal recruitments of 12 Grade-17 officers in the provincial assembly, with Elahi being accused of getting the results of the testing service changed to select the candidates of his choice.

He was then arrested on September 18 in the case of allegedly illegally appointing Muhammad Khan Bhatti, following which a Lahore court sent him on judicial remand.

In October, a Lahore district and sessions court had granted police Elahi’s two-day physical remand in the case. Days later, the Punjab Anti-Corruption Establishment had informed the court that it had allegedly recovered Rs4.1 million from the ex-CM’s house in the case.

The next month, a judicial magistrate had discharged Bhatti in the case but he remained in jail as he was on judicial remand in other corruption cases. Later the same month, Elahi was denied bail in the case.

The former chief minister was released from Kot Lakhpat jail after being granted bail by the Lahore High Court (LHC) on May 21.

Parvez briefly hospitalised after breathing issue

Pakistan Tehreek-i-Insaf President Chaudhry Parvez Elahi was briefly hospitalised on Thursday after facing difficulty in breathing due to his broken ribs.

Mr Elahi was brought to a hospital in the city for medical examination, where a team of doctors examined him for 45 minutes, conducted echo cardiogram and other heart tests, besides taking his blood samples.

The doctors later discharged Mr Elahi, advising him complete bed-rest. The doctors say further treatment will continue in the light of test reports. On July 29, a special anti-corruption court had expressed displeasure over the continuous absence of Parvez Elahi in a case relating to illegal appointments in the Punjab Assembly, giving him one last opportunity to appear.

Mr Elahi’s lawyer presented a medical report before the court, saying doctors had advised his client a complete rest. He requested the court to allow his client a one-time exemption from personal appearance for health reasons.

The court accepted the request, but made it clear to the lawyer that it would be a last opportunity. Mr Elahi has not joined a single hearing of the case since his release on bail in May.

The Anti-Corruption Establishment registered the FIR alleging that illegal appointments of BS-17 posts were made in the assembly when Mr Elahi was the chief minister and co-suspect Muhammad Khan Bhatti was his principal secretary in 2021.

The prosecution alleged that favourite candidates were appointed to the posts despite being declared failed in the written examination.

Parvez Elahi challenges inclusion of his name in passport control list

Former Punjab chief minister Chaudhry Parvez Elahi, along with Rasikh Elahi and Zara Elahi, challenged the decision to add their names to the passport control list in the Lahore High Court.

Ministry of Interior, FIA, and other relevant parties were made respondents. The petitioners argued that their fundamental rights were being violated by the inclusion of their names on the list.

They requested the court to overturn the decision to include their names on the list and order their removal.

It is also said that the courts have granted bail and that former CM Elahi wanted to leave for the UK and Saudi Arabia to perform Umrah from Sept 20 to Oct 5, 2024.

It is to be recalled that a banking court had granted bail to former CM in money laundering case.

Judge Aslam Gondal announced the verdict.

The court ordered Elahi to submit bonds worth Rs500,000 and remarked that the Federal Investigation Agency (FIA) did not cooperate. The agency had failed to present the record despite the court’s order.

Arguments sought on election petitions of Elahi, spouse in Gujrat constituencies

An election tribunal on Monday sought arguments on the maintainability of election petitions by former chief minister Parvez Elahi and his wife Qaisera Elahi challenging the results of Feb 8 polls in their respective constituencies in Gujrat.

The couple filed petitions challenging the results of NA-64 (National Assembly) and PP-32 (Punjab Assembly) constituencies.

The petitions allege that the election commission altered the results from Form 45 to Form 47, leading to discrepancies.

Ms Elahi claimed she secured 172,000 votes in NA-64 against her nephew Salik Hussain, who also contested election from PP-32 for the provincial assembly seat.

However, according to the ECP results Mr Hussain of PML-Q bagged 105205 votes and Ms Elahi obtained 80946.

Similarly, Mr Elahi obtained 44713 votes in PP-32 against 55615 of Mr Hussain, who later relinquished the provincial assembly’s seat and took oath as member of the national assembly.

Both petitioners requested the tribunal to set aside the official notifications declaring their rivals as winners in both constituencies.

The tribunal comprising retired justice Mehboob Maqbool Bajwa directed the lawyers for the petitioners to present arguments on the maintainability of the petitions first.

The tribunal adjourned further hearing till Jan 13.

FIA: A special court (Central-I) on Monday summoned the wife of former federal minister Moonis Elahi in a money laundering case of the Federal Investigation Agency (FIA).

Earlier, a lawyer for the family of PTI president Pervaiz Elahi filed an application, requesting the court to allow permanent exemption to the women suspects from personal appearance in the trial.

He alleged that the FIA registered the case on political grounds and the women of Mr Elahi’s family were unnecessarily implicated. He also claimed that the FIA’s investigation had yet to establish any criminal evidence against the suspects.

Judge Salman Ghumman observed that the women suspects should appear for one or two initial hearings, after which the request for permanent exemption would be considered.

The judge adjourned further hearing till Jan 6 with a direction to Tehreem Elahi, the wife of Moonis, to appear in person.

The FIA alleged that the sons and the daughters-in-law of former chief minister Elahi committed money laundering through a low cadre employee of the Punjab Assembly.

It said the suspects used bank accounts of Qaiser Iqbal Bhatti, a peon of the assembly, to launder money.

The agency said unexplained transactions of millions of rupees had been traced in the accounts of the peon and the children of Elahi. It alleged that the assets of the peon had been found beyond his known sources of income.

The FIA said the inquiry in question had no relation with any previous probe as it had been initiated against a government servant, the assembly`s peon.

Lahore court indicts former Punjab CM Parvez Elahi in corruption reference

An accountability court in Lahore on Tuesday indicted former Punjab chief minister Parvez Elahi over allegations of corruption in development scheme funds.

In December 2023, the National Accountability Bureau (NAB) had filed a corruption reference in Lahore’s accountability court against Elahi, his son Moonis, and 11 others, alleging the receipt of Rs1.23 billion in bribes in connection with development project contracts in Gujrat.

The father-son duo has been identified as prime suspects, who, according to the reference, have allegedly received the highest kickbacks among all others, totalling Rs744 million.

Today, Judge Zubair Shahzad Kayani resumed hearing the case, however, Elahi’s counsel, Amjad Pervaiz, said his client pleaded not guilty to the charges.

The lawyer added that Elahi had arrived at the court premises, however, he could not get out of the car due to health issues, adding that he was technically on the premises of the court.

“We want to submit a request for complete exemption from court appearances for Chaudhry Pervaiz Elahi,” the counsel said.

Elahi’s lawyer added that his client wanted “to take the case forward now, there will be no problem from our side in the case”.

The accountability court summoned NAB witnesses on January 21.

Initially taken into custody on June 1 2023, Elahi has faced a series of releases and re-arrests, remaining in detention ever since.

The legal challenges coincided with the state’s crackdown on the PTI that followed the violent May 9 protests that saw important government and military installations vandalised.

Court clears Moonis Elahi of murder charges

The murder and abetment case against Moonis Elahi, filed in Gujrat, has been proven false, and the court has revoked the decision to declare him a proclaimed offender.

Begum Qaisra Elahi's lawyer, Amir Saeed Rana, informed the court that the case was registered on June 29, 2023, while Moonis Elahi had been residing abroad since December 28, 2022. He argued that Elahi was included in the case and later declared a proclaimed offender due to malicious intent, which was an illegal act.

During the hearing, the complainant, Mohammad Akram, and witnesses Mohammad Asjad and Sajjad Ashraf, in their affidavits, stated that they had never accused Moonis Elahi, nor did he have any connection to the case. They expressed no intention to take action against him in this matter.

According to the complainant, the police had unlawfully obtained the arrest warrant, and he requested the court to annul the warrant.

After the statements of the complainant and witnesses, Additional Sessions Judge Gujrat, Saifullah Tarar, revoked the decision to declare Moonis Elahi a proclaimed offender and referred the case back to the same court for reconsideration.
