Clouds of uncertainty overhang the polls in Punjab and Khyber Pakhtunkhwa, with military and civilian intelligence agencies joining the chorus of voices opposing general elections in the two provinces at this point in time.

An important meeting of the Election Commission of Pakistan (ECP) was held on Friday to discuss security arrangements for the general elections for the two provincial assemblies.

Chief Election Commis*sioner Sikandar Sultan Raja chaired the meeting, which was attended by ECP officials and representatives from the Inter-Services Inte*lli*gence (ISI), Intelligence Bureau (IB) and counterterrorism departments (CTDs) of the two provinces.


Sources privy to the developments told Dawn that all the representatives of intelligence agencies and CTDs were unanimous in their opinion that the time was not ripe for elections because of a fresh wave of terrorism, and intelligence reports suggesting that more attacks were possible in the two provinces.

An ISI representative sought the postponement of polls for three to four months because of the ongoing war against terrorism. IB’s joint director for Punjab talked about the presence of armed militants from Afghanistan in Punjab.

Painting a bleak picture, they said the country was passing through a difficult security situation, as evidenced by a recent spike in terrorism incidents. The meeting was told that in view of the multi-dimensional security concerns, going to general polls could be a big risk.

The ECP told the participants that holding general polls for the two provincial assemblies was a constitutional obligation. It also referred to the recent judgement of the Supreme Court, which ruled that the elections should take place within the stipulated timeframe of 90 days but allowed the barest minimum delay in case of practical difficulties.

A press release issued by the ECP said the commission was briefed in detail about the prevailing law and order situation in Punjab and KP and other related matters. It said the purpose of the briefing was to ensure that peaceful elections are conducted in the two provinces.

Towards the end of the meeting, the chief election commissioner thanked the participants and said the briefing would help it take different decisions for holding peaceful elections.

A meeting with representatives of the Ministry of Defence and Directorate General of Military Operations (DGMOs) was also supposed to take place on Friday, but it could not happen.

An ECP official said the meeting would now take place on March 14 — the day when the commission has also invited the KP governor for consultation on an election date for the provincial assembly.

Punjab and KP assemblies were dissolved on Jan 14 and Jan 18, respectively. Under the law, the elections are to be held within 90 days of the assembly’s dissolution. The ECP, however, has been facing resistance from all sides from day one.

On Jan 25, the ECP proposed conducting polls for the two legislatures between April 9 and 17.

In separate letters sent to principal secretaries of the two provinces, the ECP had suggested elections in Punjab between April 9 and 13, and in KP between April 15 and 17, pointing out that these could not be taken beyond April 13 for Punjab and April 17 for KP.

In their responses, the two governors declined to give dates for general elections to the provincial assemblies, advising the electoral watchdog to consult relevant authorities and take stock of the current security and economic situation before deciding in this regard.

The relevant ministries also expressed an inability to provide the funds required for funds owing to the economic crunch and security personnel for election duties due to the alarming security situation.

Another challenge faced by the ECP was the position taken by the Punjab governor that he would not give an election date as he did not dissolve the assembly.

Another interesting twist to the story was President Arif Alvi’s unilateral decision to fix April 9 as the election date after the ECP turned down his invitation for consultation.

In a split verdict on March 1, the Supreme Court directed the ECP to consult with President Alvi for polls in Punjab and Governor Ghulam Ali for elections in KP, so that polls could be held within the stipulated time of 90 days, giving room for a minimum possible delay.

Following the Supreme Court’s verdict, the ECP wrote to the president proposing elections to the Punjab Assembly between April 30 and May 7, and the president fixed April 30 as the poll date the same day, followed by the issuance of a schedule for elections by the ECP.

The ECP had also sent a letter to the KP governor and a team nominated by the commission had met him for consultation at his invitation. However, apparently as a delaying tactic, the governor said he would come to the ECP next week for final consultation.

Meanwhile, going against its earlier decision to approach the provincial high courts of the two provinces to spare judicial officers for election duties, the commission has notified returning officers, and assistant and district returning officers from the bureaucracy for the general elections in Punjab. Accordingly, most of them are from the district administration.

The commission has also appointed Saeed Gul, a provincial election commissioner, as returning officer for women and minority seats.

Former prime minister and Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan on Saturday announced that he would lead his party’s election campaign with a huge public gathering in Lahore on Sunday.

"I ask my party and supporters to get ready. I will lead the election rally in Lahore tomorrow. I ask the people of Lahore to come out in numbers and you have to tell everyone that you are not cattle and will not accept oppression," he said while addressing his supporters from his Zaman Park residence in Lahore.

Imran accused the current rulers of trying to escape from general elections and impose an emergency. "I know they will do something to run away from elections. They might stage a bomb blast or get someone murdered. They're trying to kill me. They have made a plan and I have already told you [about it]," he added.

"Why do they want me in court so badly? There is no police there. No one is there for protection. They call us there where anyone can murder us because that is their intention."

The Election Commission of Pakistan (ECP) on Sunday suspended the election schedule for 37 National Assembly (NA) seats — which had fallen vacant after the resignation of PTI lawmakers — in light of the orders issued by the Islamabad, Peshawar, Sindh and Balochistan high courts.

On Jan 27, the ECP had announced by-elections for 33 NA seats on March 16. On February 3, the commission said by-elections for another 31 NA seats would take place on March 19.

But earlier this month, the high courts of Peshawar, Sindh and Balochistan had suspended by-elections in their respective provinces while the Islamabad High Court (IHC) had suspended the de-notification of three PTI leaders.

In four separate notifications issued on Sunday, the electoral watchdog said that until further orders from the relevant courts, it was suspending the election schedule for one NA seat in Balochistan, three in Islamabad, nine in Sindh and 24 in KP.

The bigger issue is something else, its the census they are doing digitally. Only some provinces are having a digital census going on and not the whole country. That is more concerning as some provinces that deserves more seats wont get them

Legal experts say Punjab govt exceeded authority in imposing ban on gatherings

The caretaker government once again prevented the Pakistan Tehreek-e-Insaf (PTI) from taking out a rally in Lahore under Section 144 of the Criminal Procedure Code (CrPC) but experts claimed on Sunday that the ban was imposed in contravention of the law.

It was stated that the PTI was conveyed via the Lahore deputy commissioner to postpone its rally in view of security threats, a cricket match, Jashan-e-Baharan, Marathon and the 7th population census.

In view of these concerns, the additional chief secretary (Home), imposed the ban on all political gatherings and rallies in Lahore in exercise of powers under Section 144 (6). The ban on political rallies came despite the start of the Punjab Assembly election process.

Earlier on Wednesday, the same day when election schedule was announced, Section 144 was imposed in Lahore, banning all kinds of public assemblies. Then the excuse of “undefined recent threat alerts”, and to ensure smooth flow of traffic, was given.

According to a senior government official, who spoke on the condition of anonymity, the power to impose the ban on rallies under Section 144 rested only with the district administration.

He added that both notifications were issued in contravention of the law. He explained that Section 144 (6) under which those powers were being used, only allowed the provincial government to extend the ban, and not to impose it.

Legal expert, Sabahat Rizwi Advocate, also endorsed the view that the powers to extend a ban order rested with the provincial government but the powers to issue a notification in the first place rested only with the district administrations.

In the order, a copy of which is available with Dawn.com, the ECP said that in exercise of the powers conferred upon it by Article 218(3) read with Section 58 and Section 8(c) of the Elections Act, 2017, the commission “hereby withdraws the election programme […] and fresh schedule will be issued in due course of time with poll date on October 8”.


On March 1, the Supreme Court had ruled that the elections to the Punjab and Khyber Pakhtunkhwa assemblies should be held within the stipulated period of 90 days. It had, however, allowed the ECP to propose a poll date that deviates from the 90-day deadline by the “barest minimum”, in case of any practical difficulty.

On Mar 10, the ECP later wrote separate letters to the president and the KP governor. In the letter to President Dr Arif Alvi, the electoral watchdog proposed dates between April 30 and May 7 for the elections. Alvi later the same day announced that elections in Punjab will be held on April 30.

The order said that the ECP approached the interior and defence ministries in February for the deployment of the army and Rangers in view of the “heightened security situation in the province and the recent terrorist wave”.

It added that the Punjab chief secretary and police chief were also summoned on February 8 for a briefing on the prevailing law and order situation, adding that the officials reported on the spate of terrorist attacks in the province since January, prevention of over 213 terrorist attacks in the province in the past two months, the “serious live terrorism threats” present, the cleanup operations under way for eradicating terrorists that would take four to five months and shortfall of 386,623 police personnel for election duty.

The order said that the interior ministry also conveyed to the ECP on Feb 8 that the deployment of civil and armed forces would not be possible due to the “spike in incidents of terrorism across the country” and threat alerts from intelligence agencies.

After the apex court’s order, the ECP said it again approached the interior and finance ministries on March 9 regarding conducting polls and their security arrangements to which it was informed that “elections are not possible due to deteriorating law and order situation, charged political environment, serious threat to politicians” while the finance secretary conveyed that it would be “very difficult” for the federal government to provide polling funds.

The ECP said that it convened a meeting with intelligence and security officials from Punjab and KP on March 10 and was apprised about their inability to help the commission in conducting elections, the possibility of election officials being kidnapped during polls and recommended that elections not be held at the present time.

The order added that on March 14 the ECP was informed that the Pakistan Army will not be available for poll-related duties due to the prevalent security situation within the country and on the borders while the Punjab chief secretary “categorically stated” that the provincial government would not be able to provide funds for the elections and foolproof security could not be assured with the assistance of the armed forces to the police.

Referring to the above briefings on the overall security situation in the country, the ECP order said that currently, only one security personnel on average was available per polling station due to a “massive shortfall in police personnel” and the non-provision of army personnel as a static force.

“The commission is unable to make alternate arrangements to ensure security of the election material, polling staff, voters and the candidates,” the order reads.

It added that the finance ministry had also shown an “inability to release funds due to financial crunch and unprecedented economic crisis in the country”.

The order pointed out that despite the ECP’s best efforts, the executive authorities and federal and provincial governments were not able to assist the electoral body in conducting free, fair and transparent elections in Punjab.

It added that after the briefings from the law enforcement agencies and federal ministries, the ECP had convened meetings on March 20, 21 and 22 to “deliberate extensively” on the matter of the Punjab elections.

“The commission after considering the reports, briefing and material brought before it, has arrived at the just conclusion that it is not possible to hold and organise the elections honestly, justly, fairly in a peaceful manner and in accordance with the Constitution and the law,” the order reads.

Punjab, KP election limbo amid terrorism surge
In a mammoth public gathering in November last year, former prime minister Imran Khan had announced that his party would disassociate itself from the “current corrupt political system” by quitting the two provincial assemblies where PTI was in power.

Despite several obstacles put up by the coalition government, the Punjab and KP assemblies were dissolved on Jan 14 and Jan 18, respectively. Under the law, the elections are to be held within 90 days after the dissolution of assemblies.

That means April 14 and April 17 were the deadlines for holding general elections to Punjab and KP assemblies, but the two governors instead of setting dates for elections after receiving the proposal from the ECP had advised the commission to consult stakeholders.

Chief secretaries and inspectors-general of the two provinces during meetings with the ECP had said they were short of police force and talked of terrorism threats, making out a case for putting off elections.

The finance division had also expressed its inability to provide funds and the interior ministry told the ECP that the army and civil armed forces will not be available.

On Feb 17, President Alvi had invited CEC Raja for an urgent meeting regarding consultations on election dates but the ECP told him he had no role in the announcement of dates for general elections to provincial assemblies and the commission was aware of its constitutional obligation in this regard.

Subsequently, the president unilaterally announced April 9 as the date for holding general elections for the Punjab and KP assemblies.

The move drew sharp criticism from his political opponents, who accused him of acting like a PTI worker while the ECP said it would announce the poll schedule only after the “competent authority” fixes the date.

Meanwhile, over the past few months, the law and order situation in the country has worsened, with terrorist groups executing attacks with near impunity across the country.

Since the talks with the banned militant group Tehreek-i-Taliban Pakistan (TTP) broke down in November, the outfit has intensified its attacks, particularly targeting the police in Khyber Pakhtunkhwa and areas bordering Afghanistan. Insurgents in Balochistan have also stepped up their violent activities and formalised a nexus with the TTP.

According to statistics released by the Pakistan Institute for Conflict and Security Studies, an Islamabad-based think-tank, January 2023 remained one of the deadliest months since July 2018, as 134 people lost their lives — a 139 per cent spike — and 254 received injuries in at least 44 militant attacks across the country.

The order said that the interior ministry also conveyed to the ECP on Feb 8 that the deployment of civil and armed forces would not be possible due to the “spike in incidents of terrorism across the country” and threat alerts from intelligence agencies.

After the apex court’s order, the ECP said it again approached the interior and finance ministries on March 9 regarding conducting polls and their security arrangements to which it was informed that “elections are not possible due to deteriorating law and order situation, charged political environment, serious threat to politicians” while the finance secretary conveyed that it would be “very difficult” for the federal government to provide polling funds.

The ECP said that it convened a meeting with intelligence and security officials from Punjab and KP on March 10 and was apprised about their inability to help the commission in conducting elections, the possibility of election officials being kidnapped during polls and recommended that elections not be held at the present time.

The order added that on March 14 the ECP was informed that the Pakistan Army will not be available for poll-related duties due to the prevalent security situation within the country and on the borders while the Punjab chief secretary “categorically stated” that the provincial government would not be able to provide funds for the elections and foolproof security could not be assured with the assistance of the armed forces to the police.

Referring to the above briefings on the overall security situation in the country, the ECP order said that currently, only one security personnel on average was available per polling station due to a “massive shortfall in police personnel” and the non-provision of army personnel as a static force.

“The commission is unable to make alternate arrangements to ensure security of the election material, polling staff, voters and the candidates,” the order reads.

It added that the finance ministry had also shown an “inability to release funds due to financial crunch and unprecedented economic crisis in the country”.

The order pointed out that despite the ECP’s best efforts, the executive authorities and federal and provincial governments were not able to assist the electoral body in conducting free, fair and transparent elections in Punjab.

It added that after the briefings from the law enforcement agencies and federal ministries, the ECP had convened meetings on March 20, 21 and 22 to “deliberate extensively” on the matter of the Punjab elections.

“The commission after considering the reports, briefing and material brought before it, has arrived at the just conclusion that it is not possible to hold and organise the elections honestly, justly, fairly in a peaceful manner and in accordance with the Constitution and the law,” the order reads.

Punjab, KP election limbo amid terrorism surge
In a mammoth public gathering in November last year, former prime minister Imran Khan had announced that his party would disassociate itself from the “current corrupt political system” by quitting the two provincial assemblies where PTI was in power.

Despite several obstacles put up by the coalition government, the Punjab and KP assemblies were dissolved on Jan 14 and Jan 18, respectively. Under the law, the elections are to be held within 90 days after the dissolution of assemblies.

That means April 14 and April 17 were the deadlines for holding general elections to Punjab and KP assemblies, but the two governors instead of setting dates for elections after receiving the proposal from the ECP had advised the commission to consult stakeholders.

Chief secretaries and inspectors-general of the two provinces during meetings with the ECP had said they were short of police force and talked of terrorism threats, making out a case for putting off elections.

The finance division had also expressed its inability to provide funds and the interior ministry told the ECP that the army and civil armed forces will not be available.

On Feb 17, President Alvi had invited CEC Raja for an urgent meeting regarding consultations on election dates but the ECP told him he had no role in the announcement of dates for general elections to provincial assemblies and the commission was aware of its constitutional obligation in this regard.

Subsequently, the president unilaterally announced April 9 as the date for holding general elections for the Punjab and KP assemblies.

The move drew sharp criticism from his political opponents, who accused him of acting like a PTI worker while the ECP said it would announce the poll schedule only after the “competent authority” fixes the date.

Meanwhile, over the past few months, the law and order situation in the country has worsened, with terrorist groups executing attacks with near impunity across the country.

Since the talks with the banned militant group Tehreek-i-Taliban Pakistan (TTP) broke down in November, the outfit has intensified its attacks, particularly targeting the police in Khyber Pakhtunkhwa and areas bordering Afghanistan. Insurgents in Balochistan have also stepped up their violent activities and formalised a nexus with the TTP.

According to statistics released by the Pakistan Institute for Conflict and Security Studies, an Islamabad-based think-tank, January 2023 remained one of the deadliest months since July 2018, as 134 people lost their lives — a 139 per cent spike — and 254 received injuries in at least 44 militant attacks across the country.

As for the constitution part, yes that has been violated, and this will create issues in the long run, so supreme court should intervene.

Also, this delay benefits PTI more. If elections for both provincial and national are to be held in October that means population census would be conducted, thus increasing the number of seats. PTI has a better chance at getting a majority if the seats are increased

We know this is a soft coup that is getter harder by the day. This ECP can't take a piddle without the permission of the Generals. It seems to have a come as surprise to simpletons but not to us. Article 6 on all the ECP, Generals and the cabinet is the minimum. But as we know this CJP has facilitated the coup and will go down in history as the guy that sent PK back into the hands of the Generals. No he isn't. He had undeclared properties and his wife lied under oath . He never provided the money trail, he imposed a media ban after his Hudbiya decision, which closed a case that not only had a confession but the bank accounts that verified the confession. The Nooras have the goods on him, hence the desperation to delay until he becomes chief injustice

SC will intervene if ECP ‘misuses authority’: CJP

Chief Justice of Pakistan (CJP) Umar Ata Bandial said on Wednesday the Supreme Court protects the Election Commission of Pakistan (ECP) as it enjoys complete authority in accordance with the Constitution to perform statutory and constitutional functions, but the top court would interfere in case of any abuse of authority or mala fide on part of the commission.

Since it is the ECP’s responsibility to ensure free and fair elections and it can allow transfer and posting in accordance with the constitution, the SC will protect the commission just as it protects other constitutional bodies such as parliament, he noted.

The chief justice made these observations on Wednesday at the hearing of former Lahore CCPO Ghulam Mehmood Dogar case in which the Supreme Court on Feb 17 suspended the order for his repatriation to the federal government.

Pleading that he was being subjected to victimisation due to political vendetta between the centre and provincial governments, Mr Dogar through his counsel Abid Shahid Zuberi had challenged the Nov 24, 2022 direction of the federal services tribunal of allowing a notification issued for his repatriation to the federal government.

All eyes are set on Chief Justice of Pakistan (CJP) Umar Ata Bandial in the wake of the Election Commission of Pakistan’s (ECP) surprising volte-face on Wednesday to postpone the Punjab elections, originally scheduled for April 30, till October 8.

CJP Bandial – who has already made it clear that the Supreme Court would interfere in case the polls were delayed – had earlier invoked suo motu jurisdiction to hold general elections of both provincial assemblies within 90 days.

Now, the electoral watchdog’s announcement has potentially thrown the ball back to the SC’s court, renewing debate whether the top court – which was divided over ideological lines – would compel the ECP and executive authorities to hold elections of two provincial assemblies immediately.

The twist comes at a time when a section of SC judges is being accused of ‘tilting the scales’ in PTI’s favour is purportedly revealed in an alleged video leak of Muhammad Khan Bhatti, former principal secretary to ex-chief minister Chaudhry Pervaiz Elahi, in which he accused some judicial figures of supporting the PTI.

On the other hand, another group of SC judges was not in favour of invoking suo motu jurisdiction in this matter.

Senior lawyers believe that in order to end controversies, CJP Bandial should constitute a full court to hear the matter regarding the delay of elections.

PTI’s lawyer Chaudhry Faisal Hussain also agreed with the assertion that a full court should take up the matter and decide whether the constitution or the “law of the jungle” would prevail in the country.

Echoing Hussain, another PTI lawyer protested that it was high time that the jurists of the apex court raised above their egos and decided the matter. He pointed out that now the caretaker government’s ability to perform would also be called into question, recalling that the five-member larger bench had held that the caretaker government had no authority to spend public money beyond 120 days of its tenure.

“Now it remains to be seen as to how the Punjab government works in light of the constitution as well as SC ruling,” he wondered.

Moreover, senior lawyers agree that SC should have adjudicated Justice Athar Minallah's questions examining the constitutionality regarding the dissolution of provincial assemblies.

It is pertinent to note that the court in its order had said that Justice Minallah's questions would be considered at any other stage.

According to a senior lawyer, the questions were still relevant.

The legal fraternity is of the view that it would have been better for the PTI if the assemblies had been restored, allowing it to control the largest province till the general election. However, one section of lawyers termed it a “constitutional conundrum”

They said that the SC should stay away and for a change compel the political parties to sort out this mess. Nonetheless, they agreed that now it will be impossible for the SC to be seen as an 'impartial arbiter'

The lawyers further opined that the top court’s contempt proceeding in this matter will risk further eroding public confidence as it had now turned into a political question.

"SC has put itself in a difficult position. The sou moto should not have been taken and LHC allowed to conclude its proceedings. But the five members were in a hurry and in the process, they damaged the institution,” said a lawyer.

They said that if the apex court stayed away, all political parties might sit for a political solution to the matter.

‘Blatant mockery of constitution’

Reacting to the development, ex-senator Mustafa Nawaz Khokhar said that delaying the elections by the ECP was a blatant mockery of the constitution and alleged that the body had surely decided this on the wishes of the government and the establishment which are terrified of the polls.

"With already a tarnished reputation sadly ECP now has no credibility left,” he said.

‘Constitutional overreach’

Lawyer Hafiz Ahsaan Ahmad Khokhar while commenting on the present situation said that in the presence of clear provisions of Article 112 read with 224 (2) of the Constitution as well as in view of SC judgement, such postponement and rescheduling could legally be considered to be constitutional overreach on the part of the commission, and totally against the spirit and beyond to their mandate given under the constitution.

He further said that the rescheduling of the election schedule in Punjab was beyond the mandate of the ECP both in view of the constitutional provisions and of the Election Act 2017.

If there was any need to change or reschedule the election under any circumstances, it could only be amended or changed or extended by the commission with the prior concurrence of the president, and not otherwise as clearly mentioned in the language of section 58 of the Election Act 2017.

The lawyer said that there was a strong chance that the ECP’s order would be struck down by the Supreme Court once challenged or brought to the notice of it with regard to the court’s continuation of earlier proceedings.

The legal expert also said that the country can only move on in all perspectives including in areas of political and economic stability if all state institutions would act in accordance with their legal mandate and perform their functions as per the spirit of the constitution.

Why wouldn't they be? That lot will continue to remain pro status-quo until you hit them where it hurts. Force their kids to attend government schools. Have their family members' ailments treated at hospitals inside Pakistan. Reduce their golf allowance by 75%. Drain their stocks of whiskey. Run a microscope over their side hustles.

All of this should've been done decades ago but like they say, it's never too late.
 
Information Minister Marriyum Aurangzeb on Thursday welcomed the Election Commission of Pakistan's (ECP) announcement delaying provincial assembly elections in Punjab as a decision 'in the best interest of the country'.

In a surprise move, the election regulatory body on Wednesday delayed the election in Punjab until October 8 on the grounds that it could not conduct transparent and peaceful polls on the previously scheduled date of April 30.

Subsequently, the ECP withdrew its notification regarding the elections in Punjab and postponed the voting for the provincial assembly until October 8, 2023, adding that a fresh election schedule would be announced in due course.

The ECP's announcement has renewed debate about whether the top court – being ideologically divided – would compel concerned authorities to hold elections in Punjab and K-P assemblies according to the previous schedule, as it had earlier invoked suo motu jurisdiction to push for polls to be held in both provincial assemblies within 90 days of their respective dissolution.

Meanwhile, in a statement issued today, the government threw its weight behind the ECP's decision deeming the postponement a move in the right direction "keeping in mind the economic, political and security situation".

"Under Article 218 of the Constitution, the ECP is duty bound to ensure transparent, impartial and fair elections," she said adding that "Article 224 provides that there must be caretaker set-ups in the centre and provinces at the time of elections".

Marriyum also revealed the electoral watchdog had announced its decision only after completing consultations with all stakeholders and hoped that the decision would pave the way for political stability in the country.

"There were reservations that elections might be imposed on two provinces only to feed one man's ego," she said, "[but] governments will be formed in the two provinces only after national assembly elections are held".

The statement also stressed that holding elections in April would have caused several issues due to the ongoing census. "It cannot be that elections are held in Punjab and K-P before the census and everywhere else after the census".

"If elections were held in the two provinces, they would have been controversial," the minister added predicting that if the earlier schedule had been followed, "Punjab and K-P assemblies would have dissolved in 6 months".

"The ECP has saved the country from a major constitutional crisis", she maintained, "the constitution cannot run at the whims of one man."

I don’t see how he could further increase his support base. The guy has been shot and survived multiple assassination attempts, his house had been attacked, his workers had been arrested, his government had been overthrown with the help of the establishment, and now the ECP have gone against the constitution by delaying the elections. If after all these events his support base hasn’t grown then nothing can.

Get rid of the Sharifs, Zardari’s and Munir and then who comes in his way? When you’re a wealthy man, you can do anything especially in Pakistan. If they can put hits on him, then why can’t he put a hit on them.

He’s yet to evolve as a politician, he doesn’t know how to remain in power using tactics that are used by the oppositions parties.
 
Pakistan Tehreek-e-Insaf (PTI) on Thursday announced to move Supreme Court (SC) of Pakistan against the Election Commission of Pakistan’s (ECP) decision to postpone general elections in Punjab, ARY News reported.

Addressing a press conference in Lahore, PTI Secretary-General Asad Umar announced that the party will challenge the electoral watchdog’s decision to postpone the date for general elections in Punjab from April 30 to October 8.

The International Monetary Fund (IMF) said on Thursday that decisions regarding the constitutionality, feasibility and timing of provincial and general elections “rest solely with Pakistan’s institutions”, clarifying that there was “no requirement under Pakistan’s Extended Fund Facility-supported programme which could interfere with the country’s ability to undertake constitutional activities”.

The statement from the international monetary lender comes a day after the Election Commission of Pakistan (ECP) decided to put off Punjab Assembly elections by more than five months, citing financial and security constraints.

The ECP’s order, a copy of which is available with Dawn.com, detailed a meeting held on March 9 wherein the Ministry of Finance secretary briefed the commission that “due to the paucity of funds and financial crunch, the country is facing an unprecedented economic crisis and it was under compulsion by IMF programme which has set targets for maintenance of fiscal discipline and deficit, and it would be difficult for [the] government to release funds now” for elections in Khyber Pakhtunkhwa and Punjab and later down the line for Sindh, Balochistan and the National Assembly polls.

The order also said that the Punjab chief secretary, in a meeting held on March 14, had said that “it shall not be possible for the provincial government to fund the elections”, citing various financial commitments as well as the IMF programme’s requirement that Punjab maintain a “cash surplus of Rs413/9 billion [sic]”.

Association says commission acting in blatant disregard of constitutional mandate, SC order ‘unfortunate'

The Supreme Court Bar Association on Thursday condemned the Election Commission of Pakistan's (ECP) move to postpone the elections in Punjab, describing it as “an absolute abrogation of the Constitution.”

A day earlier, the ECP delayed the election in Punjab until October 8 on the grounds that it could not conduct transparent and peaceful polls on the scheduled date of April 30.

In a statement, SCBA President Abid S Zuberi and Secretary Muqtedir Akthar Shabbir maintained that the commission could not change the date for elections “under any circumstances whatsoever”.

They pointed out that the apex court, through its order dated March 1, had made it “inexplicably clear that elections had to be held within the 90-day time period stipulated under Article 224 (2) of the Constitution”.

“However, it is unfortunate that the Election Commission has acted in such blatant disregard of its constitutional mandate and the order of the Supreme Court,” the statement added.

It further read that there was no provision in the Election Act or the Constitution that allowed the ECP to conduct polls beyond the 90-day time period stipulated under Article 224 (2).

“It is truly unfortunate to see that the Election Commission has grossly misinterpreted the Constitution, the law and order of the Supreme Court,” it stated.

The SCBA claimed that the commission had “acted in excess of jurisdiction and breached its constitutional mandate”.

‘ECP decision to postpone Punjab elections justified’

On the matter of the Punjab polls — originally scheduled for April 30 — being delayed by more than five months to Oct 8, Khawaja Asif said that the decision has been taken by the Election Commission of Pakistan (ECP), which is the “body empowered to hold elections according to the Constitution”.

Explaining the reasons the ECP has given for its decision, he highlighted the country’s “deteriorated” security situation and “tough” economic times.

“Since February, in the last one month or couple of months, the security situation has definitely deteriorated,” the minister acknowledged.

Regarding the funding issues, he said, “I am aware of the fact that the ministry of finance has said that under the present circumstances, we are going through some very tough times […] so we won’t be able to provide funds for these elections, which if you hold now on 30th of April and then in October, so you are providing funds for elections twice in a year.”

Asif then mentioned the unavailability of adequate security for the polling stations: “The commitment that our army has at the moment for the internal and external threats, they’ve said that […] it takes almost a month for the deployment of forces to the polling stations, especially the static duty — they have to take over the polling stations.”
 
President Dr Arif Alvi wrote a letter to Prime Minister Shehbaz Sharif on Friday emphasising that he should direct all the executive authorities concerned with federal and provincial governments to assist the Election Commission of Pakistan (ECP) in holding general elections in Punjab and Khyber-Pakhtunkhwa within the constitutional timeframe.

Through the letter, the president has conveyed to the premier that holding general elections in the two provinces was necessary to comply with an order of the Supreme Court issued on March 1, saying the order should be abided by to avoid further complications, including contempt of court proceedings.

Without mincing any words, Dr Alvi underlined that in his opinion “flagrant violation of the Constitution had been committed by the executive authorities and government departments”. He added that ECP had not implemented his announcement of holding general elections in Punjab on April 30, 2023, and also “blatantly violated the Supreme Court’s order dated 1st March 2023.”

Interior Minister Rana Sanaullah Khan has criticised President Dr Arif Alvi's recent letter to Prime Minister Shehbaz Sharif, stating that the president should "work within his constitutional domain."

In his response, the minister suggested that the president should focus on asking former prime minister and Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan to return 190 million pounds to the national exchequer, as well as seeking answers for "acts of terrorism", accepting Tyrian as his daughter, and facing the Toshakhana and foreign funding cases in court.

The president's letter to the prime minister urged him to direct all executive authorities to assist the Election Commission of Pakistan (ECP) in holding general elections in Punjab and Khyber-Pakhtunkhwa within the constitutional timeframe.

However, the interior minister accused the president of acting on the orders of Imran Khan and becoming his puppet, stating that a person breaking the constitution and law had been appointed to the constitutional position.

The minister went on to criticise the president for not acting over human rights violations when a person was arrested in a fake case of 15 kg of heroin. He questioned whether putting the opposition leader and the sisters and daughters of political opponents in death cells were not violations of human rights. The minister also accused the president of remaining silent when journalists were tortured during Imran Khan's tenure, stating that this was a violation of human rights.

Furthermore, the minister questioned the president's silence over human rights violations of policemen, who were targeted with petrol bombs, grenades, and slingshots during recent clashes between law enforcers and PTI workers.
 
Taking a cue from the Election Commission of Pakistan’s (ECP) move to postpone general elections in Punjab until October 8, Khyber Pakhtunkhwa Gover**nor Ghulam Ali on Friday proposed the same date for holding of elections in his province as well.

On the same day when the governor wrote to the ECP, President Dr Arif Alvi also wrote a letter to Prime Minister Shehbaz Sharif, asking him and all the relevant executive authorities of the federal and provincial governments to assist the commission in holding elections in both provinces, in compliance with Supreme Court’s March 1 order.

The SC had ruled that elections in KP and Punjab should be held within 90 days, after the dissolution of provincial assemblies in January, or on a date that ‘deviates to the barest minimum’ from the constitutional deadline.

The KP governor, in his fourth letter to the ECP — seen by Dawn — invited the commission’s attention to several militant attacks, including cross-border firing in North Waziristan, an IED blast on an army vehicle in Kohat and a heavy exchange of fire with terrorists in South Waziristan.

SC APPROVES PTI’S PLEA AGAINST POSTPONEMENT OF PUNJAB ELECTIONS

The Supreme Court (SC) on Saturday approved a plea of Pakistan Tehreek-e-Insaf (PTI), submitted against the delay in the Punjab assembly election on Saturday, ARY News reported.

The Supreme Court registrar’s office did not raise any objection to the petition and allotted a number for hearing the plea of Pakistan Tehreek-e-Insaf (PTI).

Earlier in the day, the PTI challenged the election commission’s decision to change the date of the election in Punjab and KP.

Punjab and KPK assemblies’ speakers Sibtain Khan and Mushtaq Ghani have filed a joint constitutional petition on behalf of the Pakistan Tehrik-i-Insaf.

Assad Umar, Mian Mehmood ur Rasheed and Abdul Rehman have been among the joint petitioners.

The federation, Punjab and KPK have been made parties along with the ministry of parliamentary affairs, ministry of law and the cabinet in the PTI petition.

A contempt of court petition has also been filed in Supreme Court against the postponement of elections in Punjab and Khyber Pakhtunkhwa provinces.

The prime minister, chief ministers, Governor KP and Chief Election Commissioner has been made a party in the contempt petition filed by G.M. Chaudhry advocate, a resident of Islamabad.

Jamaat-e-Islami (JI) chief Sirajul Haq has said that the tussle between the Pakistan Democratic Movement (PDM) and the Pakistan Tehreek-e-Insaf (PTI) could result in imposition of martial law in the country.

“The incumbent PDM government has become a burden on the nation,” the JI chief said while addressing the media here on Friday.

Proposing nationwide elections, Siraj condemned the government's attempts to suppress protests, saying: “Peaceful demonstrations are the constitutional right of every political party.”

He said, “The government and the Election Commission of Pakistan (ECP) are violating the Constitution and the orders of the Supreme Court by running away from elections.”

Siraj said that the caretaker Punjab government was a part of the PDM.

“It seems from their [the caretaker government’s] statements that they will stay for a long time. I want to make it clear that this country has come into existence through a democratic process and can only be sustained through democratic action,” he said, adding that unconstitutional measures should be avoided.

Warning of grave consequences, he announced that he would resist those who “undermine the Constitution”.

President Alvi on Friday had penned a letter to PM Shehbaz, urging him to ensure the implementation of the Supreme Court’s orders in relation to the general elections in both provinces.

PM Shehbaz Sharif in his five-page letter response to the president stated that he is compelled to say that your [President] letter is more like a press release of Pakistan Tehreek-e-Pakistan.

Prime Minister Shehbaz Sharif, in his reply, wrote that the letter did not reflect the constitutional position of the president and that is what you have constantly been doing۔ “Your letter contains one-sided, anti-government views that you express openly.”

The premier further added that on April 3, 2022, he dissolved the National Assembly and followed the unconstitutional directive of the former prime minister۔

“Your [president] order to dissolve the National Assembly was declared unconstitutional by the Supreme Court on April 7۔

PM Shehbaz Sharif in a letter penned to President Arif Alvi said you have also failed to fulfill the constitutional duty in the case of my oath as prime minister while on several occasions you have been actively ‘working against’ the elected government۔

Shehbaz Sharif alleged the president of neglecting attacks on law enforcement personnel due to party affialtion۔

“You ignored attempts to disrupt private property, create chaos۔ You ignored PTI’s efforts to bring the country to the brink of economic default,” a letter penned to the president said.

“Having tried my best to establish a relationship, I am compelled to respond to you by the tone you used in your letter,” Shehbaz further said.

The Supreme Court of Pakistan (SC) on Monday while issuing notice to all respondents asked the Election Commission of Pakistan (ECP) over the legal and factual questions raised in Pakistan Tehreek-e-Insaf’s (PTI) petition regarding the delay in elections of the Punjab Assembly on Tuesday (tomorrow).

A five-member larger bench, headed by Chief Justice of Pakistan (CJP) Umar Ata Bandial and comprising Justice Ijazul Ahsan, Justice Munib Akhtar, Justice Aminuddin Khan and Justice Jamal Khan Mandokhail presided over the hearing today.

During the hearing, CJP Bandial asked all political parties to give assurance to holding free and fair elections, adding that "political parties should restore calm and peace".

“We cannot interpret the Constitution in a vacuum,” remarked the CJP.

Justice Bandial furthered the court “needs assurance that elections would be held in a transparent manner”.

The apex court chief justice also said that the electoral watchdog “is just institution”, adding that “it may have gone a little off track, but it can be brought back”.

CJP Bandial stated that elections are important for democracy but can only be held in a conducive environment. He also questioned whether the ECP can annul the date of elections given by the president.

“Instead of amending the schedule, can it wipe out the schedule?” the CJP asked.

He also said that “Article 254 of the Constitution could not condone the wrongdoing which is referred by ECP”.

The apex court chief justice also noted that “there is a viewpoint that elections should be held in the country only when there is peace and order, elections should be free, transparent and fearless.”

“What are our politicians doing for stability in the country? This is a very disturbing situation”, remarked Justice Bandial.

Justice Jamal Khan Mandokhail also made his remarks during the hearing and raised questions on the maintainability of the petition.

“Why the petitioner did not approach the high court for the implementation of the order,” inquired Justice Mandokhail.

He also asked, “where is the order of the court in suo motu case regarding the announcement of the date to hold elections”. However, Justice Munib Akhtar said that “all five judges had signed the short order”.

ISLAMABAD: Asking the Election Commission of Pakistan (ECP) to come prepared to justify its decision to postpone elections to the Punjab Assembly, Chief Justice of Pakistan (CJP) Umar Ata Bandial on Monday observed that the spirit of the Constitution does not envisage the making or breaking of governments, rather focuses on ensuring good governance and bringing happiness to the people by protecting their rights.

At the same time, the CJP also shared his worries regarding the prevailing hostility, animosity, and bitterness which he said had been “sown into our polity”, while questioning the role political leaders were playing to restore peace and calm in society and seeking a ‘commitment’ from parties in this regard.

Justice Bandial made these obs*e*r*vations while heading a five-judge Supreme Court bench that had taken up PTI’s petition against the postponement of elections to the Punjab Assembly till October 8.

Some obscenely crazy logic being applied by the ECP / PDM.

Delaying / Cancelling elections is what cause the protests in the first place.
If they really cared about the security situation they would bring forward the elections, not delay them.

Hopefully, the SC is not stupid and in the pockets of the PDM and can come to this logical conclusions themselves.
 
Great decision by Umar Bandial. Doesnt matter if you pti or pmln, constitution needs to be upheld which he has always.

PTI fans are in a dillema as they cant praise this decision because than they would have to accept the VONC proceedings that supreme court order according to constitution, so you see them mum here :)).

Chief Justice of Pakistan (CJP) Justice Umar Ata Bandial on Tuesday observed that the Election Commission of Pakistan (ECP) had no authority and legal backing for postponing the elections in Punjab until October 8 and passed its order of March 22 in haste.

A five-member larger bench of the apex court, headed by Justice Bandial and comprising Justice Ijazul Ahsen, Justice Munib Akhtar, Justice Aminuddin Khan and Justice Jamal Khan Mandokhail, heard the petition of Pakistan Tehreek-e-Insaf (PTI) challenging the ECP order of March 22.

During the hearing that lasted for over three hours, CJP Bandial remarked: “Elections can only be postponed by declaring an emergency.” He also asked if the ECP’s decision recommended imposing an emergency. The chief justice observed that it was clear that the ECP had no authority to change the date given by the president for holding the election in Punjab. “In fact, the ECP passed its order on March 22 in haste, postponing the election until October 8,” the CJP remarked.

He said that the court would not prolong the instant matter, adding that they had raised a very simple question as to whether the ECP was competent to extend the date for the election. “And if the ECP has the authority then there will be no question and the matter will come to an end,” the CJP said. The chief justice further observed that maintaining the rule of law was necessary for the smooth functioning of democracy, adding that democracy cannot flourish without adhering to rule of law.

The Election Commission of Pakistan (ECP) has notified October 8 as the date for provincial elections for the Khyber Pakhtunkhwa Assembly, it emerged on Wednesday.

The ECP notification, available with Dawn.com and dated March 27, said the election programme would be issued in a due course of time.

It means that the electoral watchdog has pushed the KP election to the same date to which it postponed the elections for the Punjab Assembly — a matter that has since been taken to the Supreme Court.

The ECP’s decision came after KP Gover**nor Ghulam Ali on Friday proposed Oct 8 for elections in his province as well.
