BCCI-PCB MoU issue : ICC appoint 3-member panel; 3-day hearing to be conducted in Dubai [Post#328]

The first thing that these arbitrators decide with the two parties is their compensation. That has already been taken care of so they can give their judgement at their own sweet time,by which time a few more generations of U-19 cricketers would have graduated to test cricket.:tahir2
 
I think both parties have to honor the contract and move ahead.
If the BCCI had promised a cricket tour with no mention of GOI clearance in the MOU, I believe they should pay the penalty and move on. Though I wish India Pakistan cricket tours, going back and forth on promises and contracts is not taking anyone anywhere.
 
There are three stages to this process.

Stage 1: Can the PCB produce a document signed by a BCCI official commuting to several series?

If no, BCCI wins.

If yes, Progress to Stage 2.

Stage 2: Can the BCCI produce a contemporaneous letter to the Government of India requesting permission to play Pakistan?

If yes, proceed to stage 3.

If no, PCB wins.

Stage 3: Can the BCCI produce an official letter from the Gocernment of India prohibiting the series?

If yes, ICC Disputes Committee must determine whether the written commitment is invalidated .

If no, PCB wins.

By the way, if the PCB does win, the ICC will remove the damages from the BCCI’s annual payment from the ICC. Everybody knows the BCCI wouldn’t write a check: the ICC would just removed the money from the BCCI’s annual welfare handout.

Not surprising at all, ICC was never going to rule against BCCI even if the case was watertight, which it sounds like it was not anyway.

BCCI said it themselves, the MoU was delivered with moral intent not legal, and given the celebration at this decision, it is self-indictment of a morally bankrupt organization.

It's been quite simple to me. Either play Pakistan or don't. None of this bilateral vs. ICC tournament **, that's where the moral bankruptcy and hypocrisy comes in. What are a few points or an ICC tournament, or even a World Cup compared to the lives lost allegedly at the hands of Pakistan? BCCI/GOI's stance can only be interpreted as follows: we care about the lives of our soldiers, but not more than an ICC tournament hence we'll play Pakistan in those. Soldier's lives <<< ICC tournament points.
