Imran, Qureshi sentenced to 10 years in jail in cipher case

A special court established under the Official Secrets Act on Tuesday handed both former premier Imran Khan and ex-foreign minister Shah Mahmood Qureshi 10 years in jail in the cipher case.

The verdict comes a little over a week to go before the February 8 general elections, which the PTI is contesting amid a state crackdown on the party and without an electoral symbol.

The cipher case pertains to a diplomatic document that the Federal Investigation Agency’s charge sheet alleges was never returned by Imran. The PTI has long held that the document contained a threat from the United States to oust Imran as prime minister.

In December, the Supreme Court had approved the post-arrest bails of Imran and Qureshi. While Imran remained incarcerated in other cases, Qureshi’s expected release was also stalled as he was manhandled and re-arrested in a fresh May 9 case.

Days later, Justice Miangul Hasan Aurangzeb had restrained the special court from proceeding against the suspects — including Qureshi — till Jan 11, noting that there were “legal errors” in the case.

The special court had begun the cipher trial afresh last month at the Adiala district jail after Imran and Qureshi were indicted for a second time in the case on December 13.

The former premier and Qureshi, who is also behind bars, were first indicted in the case in October. Both had pleaded not guilty. The IHC had termed the government’s notification for a jail trial “erroneous” and scrapped the entire proceedings.

Last week, state defence counsels had been appointed due to the previously appointed ones who had agreed to conduct cross-examinations not appearing in the next two court hearings.

Imran had said the trial was nothing less than a “joke” because the prosecution and defence team both belonged to the government.

Though never liked Imran as PM since he was very anti India but feeling sad as he was a great cricketer and didn't deserve this harsh punishment. He should have left Pakistan after his govt was toppled. Even Subhash Chandra Bose left India and fought his battle from overseas. 10 years jail time meaning his political career is over. Also who knows, the kangaroo court may keep him in jail even after 10 years.

This is on the pakistani people. Whatever his flaws may be, he intended well for his country. And if his supporters are allowing this to happen, then they do not have anyone else to blame. Some poster was calling it the resilience of pakistanis.

If you followed the case then you will know that even as bad as IHC and SC judges are, this case( if Isa isn't on it) will be thrown out in minutes

Happy that fake pir Qureshi got sentenced but feel kinda sad for Imran, probably the most elite athlete from subcontinent.
He was not sentenced as an athele. He was sentence as a pm who decided to leak confidential information causing chaos. He was high on power and thought he can do anything he wanted.

This is the result of not knowing the dos and donts of parliamentary and pmship.

Trump and him are alike and Trump is also dealing with a similar case.

You cant go around destroying diplomatic relations to save your own pmship.

No he did not.

Blocking the road to the city and making people hostage does not mean you intend well.

Deciding to gain theestablishment's helpt to sabotage an election in your favor does not mean you intend well.

Sabotaging the Constitution so that a constitutional VONC cannot be held is again not a well intended move.

Revealing state communication with USA, where there is years of dialogue involved and you destroy the relations in a one bad move, is not a well intended move.

That last move alone could had sropped us from ever recieving help from US in terms aid or anything.

There is alot of back and forth communication that takes place in embassy between the staff, if you start revealing each and everything to the public, foreign ministeries would be destroyed.

The fake pir got what he deserved as he gave the pm the cypher and than our ex pm decided to reveal everything thinking he is not accountable.

Thankfully in a parliamentary system the PM is accountable towards the court

Had this been Nawaz Sharef revealing state secrets and dialogues and being sentenced to 10 years, the mood of people would had been different.

I said this back than, once Imran decided to wave the diplomatic message, it will come back to bite. Just like i mentioned the Malik riaz case aswell...

Reacting strongle to the 10-year imprisonment handed down to former prime minister Imran Khan and ex-foreign minister Shah Mahmood Qureshi on Tuesday, the party declared the cypher trial "a complete disgusting mockery of law".

The party, wary of a repeat of the May 9, 2023 riots, maintained that "such sham trials have their future written in dustbin", and added that "revenge will be taken through vote". Several PTI leaders urged party supporters to 'stay calm and vote for Khan' on February 8.

In a video message released soon after the verdict's announcement, PTI secretary general Omar Ayub Khan asked, "All PTI members and Pakistani's to remain calm and peaceful following the decision by this kangroo court against PM Imran Khan Sahib and Vice Chairman Makhdoom Shah Mehmood Qureishi sahib,"

The PTI leader asked voters to "concentrate on coming out in large numbers on 8th February, 2024 to ensure a high voter turnout and vote for PM Imran Khan sahib's nominated candidates whose names have been posted on PTIs website and social media channels".

Former prime minister Imran Khan's sister Aleema Khan stated that, "Today, justice was trampled upon due to the fear of two names being brought up during the cross-examination," she said, complaining about the judge misbehaving with them.

"If you don't accept this verdict for the sake of the coming generations then mark a 100 per cent attendance on February 8. There is no better revenge than this," she maintained.

Speaking to the media after the announcement of the verdict, Aleema said she needed some time to compose herself before she could address those present. "I had thought they would award him [Imran] the death penalty as Rizwan Abbasi had asked for the same."

Questioning the lawyers present, she asked what efforts have they made to bring change to the justice system in Pakistan. "It was our first experience in such a matter, but you [lawyers] knew what the system is like here."

"About this poor judge Hasnaat, someone was giving him instructions. Entire Pakistan knows that. The drama that he conducted yesterday, he was also mocked over it," said Imran's sister.

"They were trying to make a mockery of a former premier and a former foreign minister, but they themselves have been made a mockery of."

PTI leader Faisal Javed Khan also put up a post on X, formerly Twitter, with the hashtag #StayCalmVoteForKhan.

The case originated from Imran's public display of a paper during a rally in Islamabad on March 27, 2022, claiming it as evidence of an "international conspiracy" before a vote of no-confidence led to his government's ouster.

The FIA initiated its probe into the so-called “cypher-gate” on July 19, 2023, after the previous coalition government, led by the PML-N, announced an official inquiry against Imran and his close associates for violating the OSA.

Imran was arrested on August 5, 2023, following his conviction in the Toshakhana case by a local court of Islamabad. Later, he was also arrested in the cypher case on August 29.

As per the challan papers, both Imran and Qureshi, the former foreign minister, were charged under sections 5 and 9 of the OSA. These provisions entail the possibility of the death penalty or life imprisonment.

PTI lawyers had a chance to file a Writ till 11 am and this decision could have been stopped but they reached the courtroom late maybe deliberately.

Overthrowing a democratically elected government because you want to lick the boots of foreigners is considered criminal in countries where parties like PMLN and PPP don't exist. PDMers have been conditioned into acting like zombies for the sake of their corrupt party's survival.

And the blasphemy law? You don't have to be a puppet like your favourite leaders, you can have an opinion for yourself and disagree with parts of the law that aren't correct.

Your getting your knickers in a twist because everyone can see you for the munafiq that you are. So what was the confidential information? was it a message to a General to overthrow an elected govt? If yes, then who committed the crime, the guy who got the cabinets approval to let his electors know or the guy that hid the message.

I wil repeat myself again.

You cannot reveal confidential files to the public without geting appproval from the houses

A govt is made up of pm, parliament and judiciary. No matter who you are you cant go around doing what you want.

The pm decided to reveal confidential files without approval, he got charged for it.

I am not the one that made the law. The law states that death penalty can be given for such a case. He did nor SMQ got it, even thoug the harshest penalty should had been implemented.

Still the verdict is well within the law.

Next time, a pm should be careful of revealing confidential files. Lessons to be learned for everyone.

So if the case was so strong, why was Azam kidnapped? why did the Ambassador Majeed confirm what IK said? why was the judge in a hurry? Why did IK not get to question Bajwa? Why did the State prosecutors appoint his lawyers? Why was the trial not in open court?

What is this Shah Mehmood Qureshi's motivation to stick around with Imran Khan and be jailed? I recall him from the days of 26/11 - he was part of Zardari's PPP then. He was probably roped into the PTI as an electable from their perspective, and he rode the bandwagon from his perspective.

Surprised he didn't abandon ship with the rest of them.

Its okay to step back sometimes and realize that the people you support are complicit in a corrupt system and they shouldn't be allowed to do whatever they want to gain power. If you have any semblance of morality then maybe, just maybe, self reflect a little and see if power for the sake of power is even worth it.

To these guys power is power to play god. AZ,NS and the Generals all believe that they can play God but as BB fouund to her cost, life isnt linear and IA they will face their day.

It doesnt matter, and he will abandon this ship aswell when the time comes.

Thing is, as foreign minister, who is looking after all the foreign embassies and relations, he was the one controlling all the information and ciphers between all embassies of pakistan.

Without his involvement the pm would not had been given the ciper i believe ( i could be wrong here)

When imran decided to reveal the message which was confidential, he not only wrote the death sentence for himself but also for SMQ.

This is just a start. Imram can still get more jail time or death sentence for stalling the VONC and going against the Constitution. And it that case he can take down Qasim Suri and Asad Qaiser eho were the speakers following imrans orders.

Asad Qaiser can save himself because he gave in at the last minute, but Qasim Suri might be the next one.

This is why the pm and there chamchas need to be careful in violating laws very openly

It is a democratic process and that is what happened.

The fans cant accept it and cry as victims.

Oddly enough, a vonc took place in UK and the same posters had no issues eith that.

This is, when it benefits you its ok, but when you are at the recieving end of same law than its a victim crying.

Pakistans constitution is very similar to UKs in this regard

You seem to be more worried about IK leaking the cipher (which he didn’t) than what’s actually inside the cipher.
 
From a neutral perspective, it looks like all of the parties involved have acted in pretty bad faith in this situation - the United States Government, Imran Khan and the Pakistani Elite-Military-Judicial complex.

It's obvious the sentence is an opening gambit. They'd prefer not to actually have Imran Khan in jail 10 years. That would only turn him into a mythic figure and make him a lightning rod for opposition to the ruling junta.

What they'd really prefer I'd guess, is for Imran to accept exile to the UK or some similar country like so many Pakistani politicians before him. That way, he's out of the way or now but he's always around if needed in the future. There's always a second chance in Pakistani politics (or maybe politics in general).

Only question is whether Imran's ego and sense of self-righteousness will allow him to accept this compromise. I think they'll only keep ratcheting up the pressure until he does.

The cypher wasnt leaked, its an encrypted code. And what should happen to all the guys that said it didnt exist when we know that it did. Where are Billo, SS, SKA and Diesel. The contents of the cypher were shown to the public and he got cabinet approval to do that. So what are you arguing? That a Foreign power telling a General what to do should have been kept secret?

One thing you will see with certain posters, not naming any names so please don't delete mods - they generally cheer for hindutva leadership in Bharat, although some have done a U-turn since their favourite Master 10% is in line for the leadership of the country - they lament on failures of Pakistan but never hitch their wagon to a party which will offer a solution. Is it any wonder that the country is going nowhere if this is their vision? Having been around bureaucrates while growing up, especially people from the foreign ministry, there is alot of dialogue that takes back and forth between every country.

These messages and documents are not very pleasant which is why they are never really open to public. The contents of being that oh we dont support your govt etc is actually very normal... But messages are relayed back and forth.

But when the govt decides to reveal these contents to the public without approval, than that ends up breaking the whole dialogue between the embassy. The trust gets broken, and the next thing you know the Foreign Minister wont be attending your ambassadors calls.

IK was so desperate to get a calll from Biden and he never hid this fact.

So think about if the pm of the country is that desperate than how things work in the Foreign Ministey.

Bureaucrates in the civil govt went crazy with the move that imran made by mentioned the contents of the file. Because everyone knew that it was goinf to be a self inflicted wound that the bureaucracy would have to deal with.

Fans dont like the law and will act as victim, but imran and smq placed pakistan in a vulnerable state when they revealed the contents and thankfull the judiciary served them both right

In the not too distant future the establishment will seek to hitch their wagon onto IK and PTI yet again. These things run in circles, so never say never.
 
The man is 71 years old. He’ll be 81 if he ends up serving his complete prison term.

But according to you and your criminal friends IK was lying and it didnt exist. So why did you guys lie?
 
Currently he is blabbering about "Pakistan law" but when May 9th incident was happening, he was openly posting here and saying PTI supporters should attack GHQ, etc.

Under section 3 of the Act the sentencing has been done. The s3 of the Act entails the following clauses.

[3. Offence.— (1) A person shall commit an offence under this section If he intentionally for any purpose prejudicial to public order, defence, safety or interests of the State,—
The s3 states that the "intentions" need to be proven if defendant has committed offence to harm defence, safety or interest of State. Have the intention been proven in this case?

(a) approaches, inspects, passes over or is in the vicinity of, or enters, attacks, destroys or otherwise undermines any prohibited place; or
This clause not relevant as there were no "attacks of physical nature"

(b) makes any sketch, plan, model, or note which is calculated to be or might be or is intended to be, directly or indirectly, useful to an enemy;
This clause is not relevant either as that would need the prosecution to prove Imran was acting in interest of another country or State. No proof of that were identified either.

(c) obtains, collects, records or publishes or communicates to any other person any secret official code or password, or any electronic or modern device, sketch, plan, model, article or note or other document or information, in any manner whatsoever, which is calculated to be or might be or is intended to be, directly or indirectly, useful to an enemy of the State;
The above is the point you are pointlessly bringing up again and again. As stated above Imran did not leak any official code or password. He discussed the content of the letter in public but never released the official letter or its code. Hence stating that he leaked to public is grossly incorrect.

(d) gains unauthorized access to document or information from within or outside of Pakistan with or without use of electronic or modern devices;
This clause not relevant as he was PM at the time hence has authorised access to information

(e) causes an unmanned vehicle or device to access, enter, inspect, pass over or under, approach or be in the vicinity of a prohibited place; and(f) disclosure or retention of any activity, information, document, related to invention, research, development, production, maintenance, operation, storage and disposal of weapons, equipment or any capability of these forces, and access to or unauthorized disclosure of which is prejudicial to the safety and interest of Pakistan.]
This clause is not relevant again as this involved attack of physical nature.

Now that the Law is in front of you please read and contemplate on what you have been writing all morning. We need to stop the spread of disinformation.

I don't think so, and that is IK's own doing - he has ensured that there will be no PTI after him.

In any case, the establishment will still have two balls to juggle - PMLN and PPP - more than enough for 3-4 year batches at a time.

Agreed....but I think this one will be less permanent than others.

It will be interesting to see if Khan is offered a way out and does he take it like Nawaz or if he wants to go down the Zardari route.

He's fought for decades to take leadership, I imagine the authorities probably figure if they can keep him locked up for another few years he'll have lost his fire and the public will have moved on. Then they can deal with less stubborn tried and tested politicians who are a bit easier to control. A backhander here, some gifted land there, and they'll read whatever script is put in front of them.

It was just a matter of 5 years ago when Nawaz Sharif was sentenced to 10 years in 2018, just before the general elections.

The script has remained the same; only the writers and actors have changed. The drama will continue, and viewers will get what they deserve, which is nothing.

The only positive aspect is that the public will get to know the reality behind the uniform. Their social media campaigns have turned to garbage, and there won't be any more release of stupid patriotic songs and dramas to hypnotize public

This itself is the biggest damage ever done by a political leader to an establishment
 
Though I agree that the punishment served to Imran Khan is harsh but isn't 'Vote of no confidence' on which Imran was removed is a democratic process too? You need majority MPs to stay in power.
Not sure if you followed the news, but there was widespread horse trading which led to the "no confidence" motion among many other factors one would call undemocratic. One of the factors is the foreign interference in domestic political affairs. Add to that the cipher diabolical(which gives relevance to the foreign interference angle) and you have clear manipulation of the "democratic process".

Read up on the intercept stories if you genuinely want to know more about the situation.

And when an army chief that supports pti will come and promoses them pmship, will pti accept it or not?

Because that is what pti did in 2018 when we called it and many were not ready to accept it. Today same group is bashing the same army

This is Pakistan. Its more likely next election is December 2024 than 2028!
