It doesn't need to be a war. It's any armed conflict between Nations and this was one. Dawn explained it pretty well here.

Interestingly, I saw some part of the convention online which stated that this 'rule' regarded POWs release at the end of a war. Would look into it but not worth it, if the Armed forces in Kashmir arrest you, no convention gonna save you![]()
