IHC declares all proceedings in cypher case after Dec 14 invalid

IKs lawyers brother in law killed. He was " kidnapped" and the kidnappers also killed. Faces change but the ISI methods don't change. Remember IKs assassination attempt and monkey that was supposed to be the killer.

According to Moed Pirzada, the purpose of IK's arrest and to keep him in squalid conditions apart from making an example out of him to future politicians is to demoralize him, mentally torture him, remind him of his desperate situation and that his fans, supporters can't do anything for him. The next target is Bushra Bibi and they are now gambling that IK might crack if Bushra Bibi is made to go through the same treatment i.e. Arrest and being confined in Squalid Conditions.

The Pakistan army like in the past is setting yet another precedent and this country will do nothing about it.

I don’t get the strategy behind this. It makes my mind go nuts thinking the country is in extreme crisis economically and awaam is in extreme depression. The country has to pay back $25 billion each year only in loans. The IMF gave them three billion in the last day.

If the country goes bankrupt or has no money to fund itself, how will the establishment survive?

The country needs a strong stable government to get out of the mess or it will get to a point of no return. Keeping IK in jail or harming him physically will only lead to more madness. Hafiz wants a lota weak government full of corrupts so he can control them.

If Pakistan thrives, the establishment will automatically get more stronger. What’s so hard to understand?

Only because a few guys have a personal vendetta against IK, the future of 250 million people is at risk. Rupee will keep falling and Pakistan will get burried for once and all in out lifetime. Its already been broken in 1971.

His supporters and fans can’t do anything because ten thousand workers and top leadership is in jail. PTI has seen one the worst of the worst crackdowns in modern history. This year has been hell for the PTI team. Lotas ran away as soon as they could in May.

Its a huge challenge to gather people to protest in a fear environment when Army is involved. The only way out is if awaam comes out in crores and sits on streets peacefully throughout big cities.

IK has done its part and now its upto the ordinary everyday people what they want.

When all this settles down the real PTI will form itself. In a way its been a blessing for the PTI to get rid itself of the lota mess. If only Shah Mehmood can be booted out somehow. Have you thought why SMK got off so easily? The guy is fishy. Probably establishment wants to use him to control PTI post IK.

Bitter but people of Pakistan do not have it in them to bring a revolution. They have been conditioned for too long by their system to give up all their rights for some delusional ideas that are not needed to be brought up here and open another pandora box.

That is what happens when people are brainwashed into unrealistic fantasies instead of living in the practical world and improving their own country.

LAHORE/ISLAMABAD: An anti-terrorism court (ATC) on Friday dismissed pre-arrest bail of PTI chairman Imran Khan in seven cases registered over his alleged involvement in the May 9 riots, including an attack on the Lahore corps commander’s residence.

In a separate case, the Islamabad High Court chief justice reserved verdict on Mr Khan’s request to transfer him to Adiala jail from Attock, where his lawyers claim he is “facing serious threats to life”.

The petitions were dismissed after Mr Khan’s counsel, Barrister Salman Safdar, failed to convince the court to exempt the PTI chairman from personal appearance due to his imprisonment in the Toshakhana case.

At the last hearing, the counsel had submitted an application for adjournment and to exempt his client from personal attendance as his current “circumstance was beyond his control”.

The application was fixed for hearing on Friday when Barrister Safdar again sought an adjournment saying he could not prepare his arguments.

He also stated the application should be accepted as after conviction, Mr Khan was in prison. For his appearance, a production order could be issued, Mr Safdar argued.

The ATC-III Judge Ejaz Ahmad Buttar observed the PTI chairman used to skip bail hearings even before going to jail.

In his written order, the judge said Mr Khan’s counsel failed to point out any specific provision of law based on which exemption from personal attendance in a pre-arrest bail can be granted after the imprisonment.

The court considered that conviction was not an explanation for adjournment with the order of exemption from personal appearance, rather it is a ground for dismissal of bail if the case is heard on merits, the judge observed.

The judge noted that the court already granted a short adjournment to the petitioner’s counsel for forwarding his arguments in this respect. No further adjournment could be granted as it would amount to misuse of process and extraordinary concession.

He maintained that as per the Supreme Court’s order in the case titled ‘Shahzaib and others Vs. The State’, the petitioner was bound to be present on every date of hearing in a case of pre-arrest bail.

The judge ruled the application was not maintainable and bail petitions in all cases were dismissed with similar observations.

The other cases include attacks on Askari Tower in Gulberg, Shadman police station, PML-N’s party office in Model Town and the torching of a container at Kalma Chowk.

IHC reserves verdict

Separately, IHC CJ Justice Amir Farooq has reserved verdict on Mr Khan’s transfer application, stating he will “issue an appropriate order” on it.

During a hearing on Friday, Punjab Assistant Advocate General Rao Shaukat and PTI chairman lawyer Sher Afzal Marwat appeared in court.

Mr Khan’s counsel said the trial court had sent Mr Khan to Adiala Jail but he was shifted to Attock Jail. Mr Shaukat then presented the transfer letter to Attock Jail on behalf of the Punjab government.

Later, during a press conference, Mr Khan’s lawyers Naeem Haider Panjutha and Ali Ijaz Buttar expressed “serious apprehensions” regarding the safety and security of the PTI chairman.

They said the former prime minister was facing serious threats to his life and demanded immediate steps to provide him with home-made food and other facilities.

Mr Panjutha said PTI’s legal team tried their best to meet with Mr Khan on Thursday but only his wife was allowed to meet him.

The counsel stated that it was their legal right to meet with Mr Khan as they needed his instructions regarding his various cases as well as signing the power of attorney to appear in court on his behalf.

Separately, PTI’s core committee on Friday held a virtual meeting chaired by vice chairman Shah Mehmood Qureshi.

The meeting denounced actions against the party’s chairman calling them “political victimisation”.

The core committee expressed resentment over “an illegal and unannounced ban” on the display and sale of PTI flags across the country.

The party leaders demanded that Mr Khan’s bail application Khan should be fixed for an immediate hearing to ensure his earliest release from “unlawful detention”.

Also on Friday, Lahore police sent mobile phones and other paraphernalia recovered from Mr Khan’s Zaman Park residence for forensic analysis.

An official told Dawn two mobile phones, a satellite phone and other items were recovered from Mr Khan’s home during the raid to arrest him on Saturday, which have been sent to Punjab Forensic Science Agency for analysis.

The establishment and their puppets have survived because they have guns. But unlike past generations, this generation isn't going to forgive or forget. As Bajwa and more recently Dalllawar found, you may get your ounce of flesh but you ain't getting peace to enjoy it. Todays establishment won't always stay as the establishment and it only takes one honest guy with the gun to smash all the crooks.

So the court wanted a personal appearance when he is jail. Clowns running a **** show

The Islamabad High Court (IHC) on Saturday directed the Attock Jail administration to provide PTI Chairman Imran Khan with “appropriate medical facilities” and allow him to hold meetings with friends and family as provided in the law.

“He (the former prime minister) may also be provided with the prayer mat and English version of the Holy Quran,” the court said.

On Aug 5, an Islamabad trial court had declared Imran guilty of “corrupt practices” in a case pertaining to concealing details of state gifts and sentenced him to three years in prison. Soon after the verdict, he was arrested by the Punjab police from his Zaman Park residence in Lahore.

The IHC Is a total disgrace. Justice Farooq has been appointed by the Junta and puppets to make sure IK never leaves jail. He knows that this case is fake,so he will have no choice but to give bail, but as soon he does the other 150 fake cases kick in. The news is that Malik Riaz has been threatened into becoming a witness against IK over the University case. Whatever the mafia throw at him, IA ultimately IK will prevail and IK needs to take revenge on all those that killed innocent people.

Its not that IHC is a disgrace, we all know that. IHC, SC or any other institutions are in a complete control of one guy. Whatever he wants will occur.

Nothing will happen because one person holds the complete power which itself is a disaster. Its so sad to see one guy running the show. When the power is controlled by a single guy in a country of 250 million - the hope of IK prevailing seems to be dying day by day. Considering IK has always won in the end - gives me a tiny bit of hope that there might be light at the end of the tunnel.

IK is a former legendary cricketer, PM and a huge name - at least we can provide him home prepared food and decent conditions in jail. The point is to break him mentally, emotionally and physically.

The fact is that Pakistan and all its institutions have always been controlled by a single person, and no one thinks about the people or the country. Because of this, Pakistan is continuously declining.

I don't see a happy ending for PK because if IK loses than the Generals and mafia puppets have won. You will have rule by a kleptocracy that will stay in power by force. Anyone that has lived through this won't forget and shouldn't forget.

Thank you Pakistan for catching this chor pm. Credit goes to our courts. This chor should had been dealt with a harsher punishment.

Remember how jubilant PTI fans were when Nawaz Sharif was disqualified by the same courts?

And if you have the receipts for his flats, please post them on here. If you can't then go back to sleep.
When did I claim Nawaz is innocent? The point is PTI fans are having a hard time with the court's verdict on Imran, despite them having no problem in accepting the same court's verdict on Nawaz.

I got no idea what you are on about. NS stole billions,he couldn't provide receipts and he was guilty and today he is on the run.

True! Now tell me why you have a problem in accepting the court's verdict on Imran?
Because IK has declared his earnings through tax and proper channels. He followed the law. He was not given a chance to defend himself, he was denied to call in witnesses and was put in jail on a bogus case. What court sentences somebody without listening both sides? Its been a complete mockery of legal system. He has about 200 fake cases upon him.

Its technically a wrong declaration on a form case. Interesting thing is that form has no column to fill out ‘toshakhana’ earnings.

In Pakistan, if someone needs to be punished, they impose any accusation and hand out the punishment, just like traffic police officers. Like in Pakistan If Traffic Police wants to extract money, they can do so by any excuse and issue a fine. The same is true for the judiciary system; if they receive directions from above to give a sentence, then no one can escape. This raises significant concerns about our judicial system

There is no law and Criminal justice system. The guy with most hands and biggest guns calls the tune

Because often criminals do not receive punishment, they are frequently released on bail, often due to their connections with powerful individuals. Upon release, they commit crimes again.
If someone who has granted bail to a person sees that the individual has committed another crime after being released on bail, the person who granted bail should also face consequences. This raises significant questions about Pakistan's judicial system.

but what has he done for poor people when he was in power . he even imposed taxes on them i mean it makes sense to levy them on rich people but poor people hardly earn money in pakistan .

he should have done this right from the beginning to hang all these crooks he got enough time and power.

what was his priority.

The only way I see him coming into as the next prime minster due to divine intervation from God otherwise there is no hope.

maybe he was a weak prime minister thats why he was ousted by God in teh first place and he may come by the power of public

Again there is so much you can expect on dreams and prayers

Again hoping against hope because we have already seen what army and these crooks had done for Pakistan over several decades.

After the Showbazi of 16 months I can guarantee you that if IK is given a free and fair chance he will certainly sweep the country. He lives in majority of peoples hearts. His first term was not a good one because of lotas and minority govt. PTI has been dry cleaned lota free from divine intervention. Only SMQ is a last remaining lota. An aam PTI worker swept an election last week or so in Peshawar. This upcoming PTI will be a fresh breath of air and you will see new and competent faces.

Nobody can stop him now even if he is in jail or na-ehal or whatever.

So on the one hand you have arrested 10,000 workers and reps, then 144 is imposed everywhere and anyone that dares to demonstrate is arrested and their families are beaten and kids are taken as collateral and then you claim, no one came. So why all these measures if no one came. If beghairati had a name
It shows they didn’t have the ability or capacity to make sacrifices and undertake hardship for the cause. This is what happens when you build a following on a cult of personality rather than ideas.

The women and thousands of people who have been in jail for months for no reason are not taking hardships? Anybody who was related to PTI in any shape was made to face the wrath of the danda. Their homes and businesses were destroyed, people and relatives were kidnapped, people went in hiding. I mean what the heck are you even talking about? Or do you live under the rock?

Despite the huge crackdown on PTI, the party is still intact 80-90%. If a fair election is held, PTI will sweep the country. People are angry and mad after the Showbazi of 16 months.

Imran Khan's nephew, Hassan Niazi, who is associated with PTI, has been arrested from Abotabad. He is accused of being involved in the events of May 9. Hassan Niazi is a significant member of PTI's legal team.

Th exodus of party leaders after the crackdown suggests otherwise. The thousands that are now in jail were not actually expecting to be given a thrashing by the state. Previously when the establishment was on IK's side they could protest easily without consequence. They got too comfortable with that.

Now unfortunately the establishment has turned against them and they have been frightened. The fact no one came onto the streets despite IK asking them to before his recent arrest shows that they don't want to go undergo actual hardship, hence their belief in the cause isn't as strong as they initially thought.

You got pictures? Doubt they would be replicant of the scenes on 9 May.
Have a look at the scenes from yesterday. People have been crushed by the fascists. The IG Punjab telling his police to beat PTI supporters as long as its not done on camera( leaked audio) and still we had People come out. It's OK for you guys( and me ) to tell people to brave but you have families to support and you are up against the worst Martial law in our recent history, any act of defiance is brave.

And Pakistani majority remains politically impotent.

Cowered into submission by their own people.

Gen Zia remains the architect of modern Pakistan.

And that 'Purana Pakistan' is still the 'Naya Pakistan.'

There cant be a revolution when half the country is opposed to PTI and is happy they are suffering a crackdown, since they know they cant beat them in the election.

Ideal situation would be for all political parties to work together to eliminate the establishment involvement in politics, however that seems unlikely right now.

We aren't having elections because IK has a 2/3rd majority waiting. This would put the kleptocracy at serious risk.

I stay away from politics as much as possible and never make political comments but it pains me to see a cricketing legend like Imran Khan being treated like this. A national hero.

When do you guys have elections? Why can't this be just settled by the people voting for their party?

I think it was necessary for IK as leader to lead by example by being in jail. You can't keep expecting your second tier and other senior leaders, lower tier leaders and workers to keep facing police, state brutality, going to jail while the main leader is in comfortable surroundings in Zaman Park, Bani Gala. Even the opposition has mocked that IK has never seriously gone to jail and use it to mock his political cause.

Elections have been cancelled because IK will win a 2/3rd majority.

How is it possible? There has to be a timeframe within which Elections have to happen. They can't continue without elections beyond a certain time.

Whatever backing they have doesn’t really matter when the awaam is against the backing. Sooner or later they will have to go to elections. Be it now or one year later. The country has to pay back $25 billion in loans only and with rupee falling day by day, it will only lead to more chaos and zalalat for establishment.

I hope senses prevail and democracy is given a chance and people elect whoever they want. Pak desperately needs a strong and stable govt.

You underestimate the project. The boys have decided that democracy is a waste of time and they will handle things from now on. For years I would hear the chatter about how the politicians are corrupt and a technocratic govt is what we need with the boys in charge in the background. Well Khan will now most likely rot in jail. He may die there. The boys will be banking on their foreign support and the technocrats they will be imposing on the nation.

Welcome to the Real one party state. The king will be the coas. Most likely Munir and then a chosen groomed successor in about 10 years. You will like it because if you don't you'll be asked to leave or join Khan. They will now proceed to implement their plans. Corporate fauj farms. The expansion of the civil service to include retired officers. Every dept will be headed by a retired or serving officer. Now in normal countries ex military personnel are lauded for their skills and given employment. In Pakistan its the only thing that now matters.

The environmental issues are a myth sold by Khan and his cult. Ignore. Helping the poor? They are the boys..they are the poor.

Modern universal healthcare? The boys get it free. Everyone else must show Resilience like a true sipahi.

Education? There will be some quotas for the poorer officers and their children. Oh the non uniform? They are civilians. They must show jazba and make their way up like the great leader.

Finally foreign policy. America is the devil but we work with the devil what can you do? India is also the enemy and we will fight them on pubg. Kashmir zindabaad but talk about it next year. We have some problems this year. But don't worry we will get some foreign investment in the shape of more Tim Hortons and maybe finally an AlBaik franchise lead bynan officer of course..

As for sport. Well cricket isn't really a game but ok since the masses like it. But don't mention Imran Khan the anarchist. So any videos in which he is present must be shown. So make sure you edit it well.

Athletics is good for the fauji but there isn't any money. Hockey yes I think maybe...football..yes as long as fifa keeps giving us cash..but sports is for civilians. So they must show jazba and make do with scraps. The great leader's inspiration should be enough.

Welcome to Naya Pakistan. A land ruled by a small man in a big office.

Its all good and dandy and seems like boys will have fun running the show behind curtains until when its time to pay back about $25 billion and some say $32 billion in loans per year. Where will they get money from? Amreeka?

Well said. The boys have decided. Khan has exposed them and they know it can't get any worse so nothing to lose for them anymore. A really sad state of affairs.

The people of Pakistan have failed Imran Khan. The least they can do is cause enough uproar to have him released and sent back to his children. But no - snooze it is.

Can't blame him for thinking - as I type - that it isn't worth it to fight for the rights of such no-hopers.

They will not happen for us to find out the actual truth. But you can harp on about how Khan apparently has the majority on a forum predominantly visited by PTI supporters

So if I understand your rants correctly- IK doesn't have the support of the people and the only way we can solve this conundrum( sarcasm) is to hold elections but they won't happen because Kaptaan will win around 70%. Thanks mate

Stealing what? Do you even know why has been convicted. You are just getting silly. At least do some work. BTW do you think a guy a charged with a crime should be allowed to introduce witnesses in his own defense? BTW it's not a trick question

So back to the question on elections, why haven't they been held? Who has stopped the elections? Is that illegal? Why did the SC have to say about it?

ISLAMABAD: The Islamabad High Court (IHC) has fixed for hearing former prime minister and Pakistan Tehreek-e-Insaf (PTI) chairman Imran Khan’s appeal against the Toshakhana verdict next week.
A two-member bench of the IHC comprising Chief Justice Aamer Farooq and Justice Tariq Mehmood Jahangiri will conduct hearing on the matter on August 22.

The PTI chief had approached the high court challenging the trial court's verdict and sentence against him, requesting that the court declare the judgement "illegal".
"It is most respectfully prayed that the Hon'ble Court may graciously be pleased to set aside the impugned judgement dated 05.08.2023, and declare the conviction, sentence imposed upon the Appellant to be illegal and without lawful authority and to acquit the Appellant of the charges framed against him," the petition read.
The PTI chairman was sentenced to three years in prison and imposed a fine of Rs100,000 by Additional District and Sessions Judge (ADSJ) Humayun Dilawar on August 5, 2023, after the judge found Khan guilty of graft in the Toshakhana case — a develoment that disqualified him for five years.
The petition seeks the denunciation and overturning of the conviction altogether on a number of grounds. One of the reasons cited in the petition for the request is that the impugned judgement is "totally misdirected".
"The prosecution has miserably failed to discharge its onus against the appellant and, as such, the impugned judgement is unwarranted by law," the petition added.
Moreover, the petition contended that ADSJ Dilawar's verdict had been based on "hyper-technical" grounds and "misreading".
"The learned trial judge has returned a finding of guilt against the accused on hyper-technical grounds, and that too by misreading and misconceiving the law, and not on the basis of any tangible evidence in support of the charge framed against the accused, which evidence, nonetheless, is utterly lacking in the instant case."
The petition also alleged that the judge had not given due consideration to a number of pertinent matters, including the fact that Khan's accountant has mentioned the cost at which these assets were acquired in the "relevant column of Form-B", under "Precious Items" as per his expertise.
"As a matter of fact all that the learned judge has to say regarding the defence of the appellant is to make a cursory almost derisive reference to it," the complaint added.
The petition also alleged that the trial was not fair and the verdict — “tainted with bias and a nullity in the eye of the law" — pre-decided in that it "seemingly took him [the judge] just 30 minutes to dictate more than 35 pages which constitute the impugned judgement".
"The impugned judgement having been written even before hearing the appellant's counsel in support of the defence is a nullity in the eye of the law and liable to be set aside as such," the petition contended.

What is the case?

Under the rules governing Toshakhana — a Persian word meaning "treasure house" — government officials can keep gifts if they have a low worth, while they must pay a dramatically reduced fee to the government for extravagant items.
The Toshakhana has been under a microscope ever since the emergence of the allegations that Imran Khan purchased the gifts he received as prime minister at throwaway rates and sold them off in the open market for staggering profits.
The 70-year-old cricketer-turned-politician was accused of misusing his 2018 to 2022 premiership to buy and sell gifts in state possession that were received during visits abroad and worth more than Rs140 million ($635,000).
The gifts included watches given by a royal family, according to government officials, who have alleged previously that Khan's aides sold them in Dubai.
Moreover, seven wristwatches, six made by watchmaker Rolex, and the most expensive a "Master Graff limited edition" valued at 85 million Pakistani rupees ($385,000), were also among the gifts.

Bushra Bibi, the wife of former prime minister Imran Khan, has voiced concerns about the possibility of her husband being “poisoned” while he is incarcerated at District Jail Attock, it emerged today.

On Aug 5, an Islamabad trial court had convicted Imran in a case pertaining to concealing details of state gifts and sentenced him to three years in prison. Soon after the verdict, he was arrested by the Punjab police from his Zaman Park residence in Lahore and taken to the prison in Attock.

Imran’s lawyer, Naeem Haider Panjutha, has on several occasions criticised the conditions the PTI chief is allegedly being kept in.

May Allah give strength to Kaptaan. These evil people will face their judgment, may Allah make it happen sooner rather than later. I remember Mamoon saying us Insafians saw a conspiracy at every corner, but not only has time proved us right, we underestimated what lengths the evil powers will go to. We were right on Bajwa,we were right about our courts, we were right about the Americans.
