Former prime minister and PTI chief Imran Khan has been presented at the Islamabad Police Lines, which has been given the status of a court venue as a “one-time dispensation”, a day after he was arrested from the premises of the Islamabad High Court in relation to the Al-Qadir Trust investigation by the National Accountability Bureau (NAB).

At the outset of the hearing, NAB requested the court to grant 14-day physical remand of Imran.

The PTI chairman’s lawyer opposed the request and said that the case did not fall within the bureau’s ambit. He further said that NAB had not shared the inquiry report either.

“Everyone has the right to a fair trial,” he said, calling for the hearing to be held in an open court.

Subsequently, DawnNewsTV reported that the hearing had been adjourned for a brief period.

When it resumed, the NAB prosecutor told the court that Imran was shown the warrant at the time of his arrest. He also assured Imran’s lawyer that the necessary documentation would be provided.

“This is a corruption case which the UK’s National Crime Agency has probed,” he said, adding that the money received was meant to be transferred to the government of Pakistan.

“Instead of the government, the funds that were received were transferred to Bahria Town,” he said.

Meanwhile, the PTI chief told the court that he was shown the arrest warrant when he was taken to the NAB office and not at the time of his arrest.

A late-night notification issued by the Islamabad commissioner’s office said the ex-prime minister would appear in two cases at the venue, where sources say he is being detained.

One of the cases is in relation to the Toshakhana, in which Imran’s indictment is pending. The other case, which relates to the Al-Qadir Trust, will be heard by an accountability judge.

Funny how the UK crime agency probed the investigation into IK, but remain silent on the Shareefs and Zaradaris. It's all rigged, and in my opinion, Western agencies are text books of corruption.

An accountability court on Wednesday granted the National Accountability Bureau (NAB) eight-day remand of PTI Chairman Imran Khan, who was arrested a day earlier from the Islamabad High Court (IHC) premises in connection with the Al-Qadir Trust case.

Separately, a sessions court also indicted the PTI chief in the Toshakhana case. Both the hearings were held at the Islamabad Police Lines, which was given the status of a court venue as a “one-time dispensation” late on Tuesday night, amid tight security.

During the hearing of the Al-Qadir Trust case, the corruption watchdog requested the court to grant 14-day remand of Imran. Judge Mohammad Bashir presided over the hearing.

The PTI chairman’s lawyer, Khawaja Harris, opposed the request and said that the case did not fall within the bureau’s ambit. He further said that NAB had not shared the inquiry report either.

“Everyone has the right to a fair trial,” he said, calling for the hearing to be held in an open court. He further said a building had been constructed on the land belonging to Al-Qadir Trust, where people receive education free of cost.

He said that a “legal person”, who is not a public office holder, is meant to be in charge of the trust. Imran is no longer a public office holder, he said.

Meanwhile, the NAB prosecutor told the court that Imran was shown the warrant at the time of his arrest.

On the other hand, the PTI chief contradicted NAB’s version and told the court that he was shown the arrest warrant when he was taken to the bureau’s office and not at the time of his arrest.

“I haven’t gone to the washroom in 24 hours,” he told the court, adding that he wanted his physician, Dr Faisal, to be called in.

“I don’t want what happened to Maqsood chaprasi (peon) to happen to me,” he said, referring to one of the people involved in the Ramazan Sugar Mills case who died in UAE last year.

“They inject you and the person dies slowly,” he alleged. The court then reserved its verdict.

Imran indicted in Toshakhana case

Additional and District Sessions Judge Humayun Dilawar presided over the hearing concerning the Toshakhana case.

The Election Commission of Pakistan (ECP) had sought proceedings under the criminal law against the PTI chief. The ECP had approached the court on the matter on a reference filed by lawmakers from the ruling coalition last year.

The reference alleges that Imran had “deliberately concealed” details of the gifts he retained from the Toshaskhana — a repository where presents handed to government officials from foreign officials are kept — during his time as the prime minister and proceeds from their reported sales.

Imran Khan has become untouchable’ — Farooq Sattar

MQM-P leader Farooq Sattar has condemned violence from PTI protesters.

He said: “Cases against political leaders and workers are nothing new but the reaction to it, this is a new change in politics… Imran Khan has become untouchable.”

So, as expected all the claims about torture, throwing Imran from the building, injecting him with toxins, etc. we're all lies told by the PTI supporters.

Police arrest 23 more protesters in Karachi amid reports of violence, tear gas shelling

Police have arrested another 23 protesters in Karachi as demonstrations against PTI chief Imran Khan’s arrest continue.

Gulshan Superintendent of Police Zafar Siddique Chaanga said, “We have arrested a total of 23 miscreants —12 at the Insaf House on Sharea Faisal and 11 at Millenium Mall.”

Protests were staged at the Insaf House near Nursery on Shrea Faisal — the metropolis’ main thoroughfare — and the intersection between Rashid Minhas Road and Stadium Road near Millenium Mall.

Media reports say the protesters attacked the law enforces, who resorted to tear gas shelling and baton-charge.

case was on going in NAB. The last NAB was a ******* and did not want to investigate it.

Cases investigate and take time4, he was eventually going to get arrested for it.

But i agree right now he was arrested for the statements he made, because he was arrested before he was made to appear in court.

But while his arrest is illegal, the case itself exists and isn't a bogus one.

PTI will whine about this case, but i think instead they should be making statements that if Imran is guilty in this case so is Malik Riaz.

The 2 govts which have maximum leverage on PK Army are USA and Saudi Arabia

One phone call from King Salman can get Imran Khan released but I am following social media from Saudi govt sycophants and most of them are against Imran Khan. They cite his supposed lack of respect towards the King but in reality they hate him for trying to get Turkey and Pakistan and Malaysia into a camp

And the guy that didn't want to investigate was a SS appointee. And then he is forced to resign and a General is appointed and suddenly it becomes a big case. Why do you think SSs appointee thought it was rubbish? This is desperation showing up again. Remember Toshakhana and your posts and then all was revealed and Gilani, Khawaja Asif, And SH abbasi took dozens of watches and then you got humiliated and stopped posting on the issue. Remember when you accused IK of faking the shooting and then the ganja Shaitan stopped the FIR and you went quiet.

The claim was about Imran.

The burden of proof lies on PTI supporters who spread all sorts of lies yesterday without any evidence. He was handed over to NAB today and nothing in his appearance suggests that he was subjected to torture.

So what you are saying is that thet killed Dr RIZWAN and Maqsood Chaprasi with poison but they won't do it to IK even though they have already attempted to kill. You do know IK told judge that he hasn't been allowed to go to the toilet since his arrest. He was handed to NAB today but why was he held by the ISI? What has the ISI got to with a NAB investigation

Pakistan Tehreek-e-Insaf (PTI) chief Imran Khan told an accountability court on Wednesday that he was fearful for his life.

"I have not been to the washroom in 24 hours," the former prime minister said during the proceedings of the Al-Qadir Trust case, in which he was arrested a day earlier.

The PTI chief requested the court to grant his personal physician Dr Faisal Sultan access to him. "I am afraid I will meet the same fate as 'Maqsood Chaprasi'," Imran said in reference to an alleged key witness in Prime Minister Shehbaz Sharif's money laundering case who passed away due to a cardiac arrest last year. The PTI had termed the witness' death 'mysterious'.

"They give [you] an injection, and [you] slowly die," the ex-premier said.

Vast majorities of Saudis in the comments are supporting his comment

I can imagine India or USA not wanting Imran Khan. But why do PTI supporters and Pakistanis never introspect on why the Saudis are so against Imran Khan ?
What motive could they have in ensuring Pakistan is ruled by PML/PPP and not PTI?

Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan was indicted in the Toshakhana case on Wednesday, a day after he was arrested in the Al-Qadir Trust case from Islamabad High Court (IHC) premises, ARY News reported.

The PTI chairman was presented before the judges at Islamabad Police Lines, which was given the status of a court.

Additional and District Sessions Judge Humayun Dilawar presided over the hearing concerning the Toshakhana case as charge sheet was read out to Imran Khan in the courtroom.

Hiding behind women these cowards

The Pakistan Tehreek-e-Insaf (PTI) on Wednesday filed a petition in the Supreme Court challenging the Islamabad High Court’s (IHC) ruling that party chief Imran Khan’s arrest by the National Accountability Bureau (NAB) from the IHC premises on May 9 was “legal”.

After Imran’s arrest which sparked violent protests across the country, PTI Vice Chairman Shah Mahmood Qureshi called an emergency meeting of a seven-member party committee to review the situation and devise a comprehensive strategy to secure the former premier’s safe and early release.

And on Wednesday, the PTI’ legal team led by Fawad Chaudhry submitted a petition in the apex court, requesting the court to set aside the order passed by the IHC chief justice in the wake of the arrest.

“…Leave to appeal may please be granted against the impugned order 09-05-2023 passed by Hon’ble IHC […] may be set aside and further after hearing the parties the warrant dated 01-05-2023 issued by Chairman NAB [National Accountability Bureau] may be declared void and further be directed to release the petitioner/accused forthwith in the interest of justice,” it said.

At first, the SC registrar's office returned the petition immediately after it was submitted. It stated that the PTI did not approach the relevant forum, adding that the party could file an intra-court appeal in the IHC. It said the petition also did not carry signatures of the PTI chief.

The party, however, resubmitted the petition after addressing the objections and the SC registrar office later admitted the appeal and allotted it a number (641/2023).

The IHC on Tuesday termed the arrest of former prime minister Imran Khan in Al-Qadir Trust case “legal” but issued notices to the Islamabad inspector general police (IGP) and secretary interior for contempt of court.

The court also ordered its registrar to complete an inquiry into the incident—which involved manhandling of lawyers and court staff and damaging of court properties— by May 16 and get a first information report (FIR) registered against people responsible for it.

Officials of paramilitary Rangers and police arrested the PTI chief from the IHC premises on Monday afternoon while implementing an arrest warrant issued by NAB, the country’s top graft buster.

Govt denies political vendetta
Ministers say Imran arrested in NAB case

Federal ministers on Wednesday defended the arrest of Pakistan Tehreek-e-Insaf chairman Imran Khan in a NAB case, saying that the government had nothing to do with the arrest as it was made in a graft case by the National Accountability Bureau (NAB).

Talking to the foreign media, the minister said there was no political victimization in the arrest, adding that “NAB is an independent institution”.

Police said 945 of PTI supporters had been arrested in Punjab after 25 police vehicles and more than 14 government buildings were set on fire.

"This can't be tolerated, the law will take its course," Planning Minister Ahsan Iqbal told the news conference. "These violent attacks were not the outcome of any public outpouring, they were planned by the PTI rank and file."

Ahsan said the PTI chairman had “chosen a path of spreading anarchy, chaos and destruction” to “protect himself from accountability.” “I want to assure there is no political vendetta,” he added.

He clarified that the arrest was made under a warrant duly examined by the Islamabad High Court (IHC) that declared the custody in line with the ‘proper legal procedures and lawful authority’.

“The scenes that the media highlighted of loot and plunder are most deplorable as Khan had been lecturing the people of Pakistan about the rule of law in Western democracies.”

The planning minister said the PTI chief chose the path of spreading anarchy, chaos and destruction only to protect himself from accountability.

Climate Minister Sherry Rehman condemned the “violent reaction” of the PTI, describing it as alarming.

In a series of tweets, the minister said such a burning siege has never been seen in the country after a lawful arrest.

Minister Sherry said the attack on the residences of military officers and sensitive institutions was not a protest but an attack.

“PTI has made a sad history. Imran Khan arrested all the opponents during his regime,” she said, adding that they never reacted in the same manner.

Information Minister Marriyum Aurangzeb said that Imran Khan was arrested in a corruption case.

This is not about PDM or Nawaz Sharif or Bhutto. Cowards who can't confront the real culprit are going after puppets and not the puppeteers. Such is nature of things. Army is still holy grail. Still.

IK is not the first PM to be arrested. Won't be the last.

Supreme Court's Justice Athar Minallah questioned why the National Accountability Bureau (NAB) took the law 'into its own hands' to arrest Pakistan Tehreek-e-Insaf chief Imran Khan in the Al-Qadir Trust case.

The top court is hearing the PTI's plea against the arrest of leader Imran on Thursday.

A three-member bench, led by Chief Justice of Pakistan (CJP) Umar Ata Bandial, is hearing the matter. The bench also includes Justice Muhammad Ali Mazhar and Justice Athar Minallah.

Imran's lawyer Hamid Khan informed the court that the former premier had appeared at the IHC to get bail in the NAB case, and that the Rangers appeared when Imran was getting his biometrics done. He continued that the PTI chief was arrested by Rangers personnel breaking down doors and windows.

"Imran Khan was ill-treated and violently arrested. Getting biometrics is part of the judicial procedure," he maintained.

The CJP commented that according to court orders, the bail application was filed but not fixed. He asked if, as per the record, the case scheduled was for another matter.

Justice Minallah questioned if the application was filed before the biometrics to which the lawyer stated that the application could not be filed without biometrics.

He remarked that the court was called for one case, while the other was being filed.

Justice Minallah questioned if the right of access to justice could be waived. He further asked if it would not "have been appropriate to take permission from the NAB registrar".

He also asked why the accountability bureau took the law into its own hands.

A day earlier, the PTI filed a petition in the top court challenging the Islamabad High Court’s (IHC) ruling that party chief Imran Khan’s arrest by the National Accountability Bureau (NAB) from the IHC premises on May 9 was “legal”.

After Imran’s arrest which sparked violent protests across the country, PTI Vice Chairperson Shah Mahmood Qureshi called an emergency meeting of a seven-member party committee to review the situation and devise a comprehensive strategy to secure the former premier’s safe and early release.

And on Wednesday, the PTI’s legal team led by Fawad Chaudhry submitted a petition in the apex court, requesting the court to set aside the order passed by the IHC chief justice in the wake of the arrest.

ISLAMABAD: The National Accountability Bureau (NAB) on Thursday inducted former prime minister and Pakistan Tehreek-e-Insaf (PTI) chairman Imran Khan in Al-Qadir Trust investigation, ARY News reported.

Former prime minister and Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan was arrested by National Accountability Bureau (NAB) in the Al-Qadir Trust case.

The combined Investigation Team of NAB handed over the questionnaire to Imran Khan. The former prime minister has been asked to respond to the questions of the graft-buster body.

Khan has been asked to respond to the following questions by NAB.

Why a summary was finalized for the return of the ‘illegal’ money from UK in 2019.?

2. Why did you give permission to surrender the money in December 2019?

3. Why did you receive ‘monetary’ benefits and land for Al-Qadir University in exchange for the accused?

4. Why did you ‘misuse’ powers as a public officer holder?

5. Why you committed a ‘criminal act’ by returning ‘illegal’ money received from the UK to the accused?

6. Why communication with the UK’s National Crime Agency was kept secret?

7. Why a summary of the Assets Recovery Unit was kept secret?

It may be noted that Imran Khan is kept at the Police Lines Headquarters in Islamabad as it has been declared a sub-jail by the government on the NAB’s request.

IK to be produced in SC as per Chief Justice Order

The Supreme Court (SC) on Thursday directed the National Accountability Bureau (NAB) to produce PTI Chairman Imran Khan within an hour.

The court issued the directives as a three-member Supreme Court (SC) bench, comprising Chief Justice of Pakistan Umar Ata Bandial, Justice Muhammad Ali Mazhar and Justice Athar Minallah, heard PTI Chairman Imran Khan’s plea against his arrest in the Al-Qadir Trust case.

“The court will issue an appropriate order today,” the CJP said, adding that the court was “very serious” about the matter.

At the outset of the hearing, one of Imran’s counsels, Hamid Khan, appeared on the rostrum and informed the apex court that his client had approached the Islamabad High Court (IHC) for pre-arrest bail.

His lawyer said that Imran was in the process of getting his biometrics done when he was arrested. “Rangers misbehaved with Imran Khan and arrested him,” the lawyer said.

CJP Bandial observed that court records showed that the case had not been fixed for hearing. The lawyer told the court that the appeal could not be filed without completing the biometric process.

Here, Justice Minallah observed that Imran had indeed entered court premises. “How can anyone be denied the right to justice?” he asked.

CJP Bandial said that there was a certain “respect” for the courts. Recalling a past incident, he said, “NAB had arrested a suspect from the Supreme Court’s parking [lot]. The court had then reversed the arrest.”

The CJP asked Imran’s counsel about the number of Rangers personnel who had carried out the arrest of the former premier. Imran’s lawyer responded that “100 rangers personnel entered court premises” in order to arrest the PTI chief.

“What dignity remains of the court if 90 people entered its premises? How can any individual be arrested from court premises?” he asked.

“In the past, action has been taken against lawyers for vandalism inside the court,” he observed. “If an individual has surrendered to the court, then what does arresting them mean?”

He further said that NAB had committed “contempt of court”. “They should have taken permission from the court’s registrar before the arrest. Court staffers were also subjected to abuse,” he added.

CJP Bandial emphasised that courts should be accessible to everyone for relief and that individuals should feel safe to approach the courts.

Imran’s lawyer then demanded that his client be released from NAB custody, stating that the arrest was made without an investigation officer present.

The chief justice noted that the court was currently examining the manner in which the arrest was conducted and whether contempt had taken place.

Imran’s lawyer then said that the PTI chief was on terrorists’ “radar”. Only after the arrest was made did it emerge that the warrant was issued on May 1, he said.

Imran’s other lawyer, Advocate Salman Akram Raja, told the court that the interior ministry’s secretary had said he had not yet received the warrants for their execution.

At this point, the CJP said that whatever had happened after Imran’s arrest should have stopped.

“This does not mean that we shut our eyes to an illegal action. Such a verdict should be given that applies to all. Access to justice is the right of every accused,” he said.

“No one can be arrested from the Supreme Court, a high court or an accountability court,” the CJP said.

Imran’s lawyer Hamid said that if that the party would not have approached the SC if the PTI chief had been arrested from outside his home or outside the court.

Here, Justice Mazhar asked if Imran had responded to the NAB notice, to which the lawyer replied in the affirmative.

“According to the law, an arrest cannot be made when an inquiry is still being carried out,” Hamid said.

Justice Minallah then said that NAB had arrested elected public representatives in a humiliating manner, adding that this needed to come to an end. “The act of surrendering to the court cannot be sabotaged,” he said.

“The real issue is not of the NAB warrant but of the manner in which it was executed,” he said. “NAB talks about the implementation of the law but does not act upon it itself.”

Justice Mazhar then noted that the NAB warrant had not been challenged and asked, “Why did Imran Khan not take part in the investigation?”

The PTI chief’s counsel said that the PTI chief had responded to the notice issued by the graft watchdog.

At this point during the hearing, Justice Mazhar observed, “It is clear that Imran Khan did not act upon the NAB notice. A NAB notice means that the receiver will be considered a suspect. Many people obtain bail upon receiving a NAB notice.”

“A March notice was responded to in May. Did Imran not violate the law?” he asked. At this, Imran’s counsel said that the PTI chairman had only received one notice.

Justice Minallah then said that Justice Mazhar was talking about the implementation of the law, adding that the matter at hand concerned access to justice.

NAB Prosecutor General Asghar Haider said that the accountability bureau respected the country’s courts.

But Justice Minallah said that NAB had “not learnt its lessons”. He observed that NAB had been accused of many things, including “political engineering”. “Had NAB taken permission from the registrar?” he asked, adding that a letter had been written to the interior ministry for the warrant’s execution.

The NAB official responded to the judge’s queries by saying that he was not aware of the realities and had been posted at 1:30pm.

Justice Minallah then said that a common citizen could also execute an arrest warrant. “Did NAB issue directives to arrest [Imran] from inside the court? How many notices were issued to Imran Khan?” he asked.

The prosecutor general responded by saying that only one notice had been issued to the PTI chief.

“It appears that NAB’s warrant was not in accordance with the law. Was an attempt to arrest made after the warrant was issued?” Justice Minallah asked.

CJP Bandial noted that the warrant was issued on May 1 and the arrest took place on May 9. “Why did NAB not try [to arrest Imran] itself for eight days? Did NAB want to arrest Imran from court? Why was a letter written to the interior ministry on May 8?” he asked.

He also asked who had carried Imran’s arrest. The NAB official replied that according to the IHC order, the arrest was overseen by the police.

Justice Minallah then asked why NAB didn’t write to the Punjab government regarding the warrant, observing that the bureau had contributed to the country’s destruction.

10 key points from the SC hearing so far

Supreme Court directs the NAB to produce PTI Chairman Imran Khan within an hour during a hearing of his plea against his arrest in the Al-Qadir Trust case.

Security is beefed up outside the apex court, with contingents of the Rangers and bomb disposal squads called in.

CJP emphasises importance of courts being accessible to everyone for relief and individuals feeling safe to approach them.

Imran’s lawyer argues arrest was made without an investigation officer present and accused NAB of committing contempt of court.

The court is looking at the manner in which the arrest was conducted and whether contempt had taken place.

Imran’s lawyer claims arrest warrant dated May 1 was not in accordance with the law and questions why NAB did not try to arrest him itself for eight days.

AGP states NAB is an independent institution and had requested Rangers to be present at the scene but not carry out the arrest.

Justice Minallah expresses concern about NAB’s actions, accusing them of “political engineering” and “contributing to the country’s destruction”.

Lawyers comment that the arrest from court’s premises is inconsistent with precedents laid down by the SC and express belief that the SC might set aside the High Court’s decision.

he might get 1 day bail.

What will he do in those 24 hours thats the question

Aftab Iqbal now abducted from his residence. They are not going to let IK get bail so easily and abducting a guy like Aftab Iqbal who has pretty solid connections in establishment just suggests things are going to get worse now.

Aftab is a key influencer of the undereducated Pakistani masses.

He is a key figure detained and most likely to be gagged so that he cannot influence national views in this critical hour of the country’s history

Do not underestimate his importance

Detaining Aftab is another masterstroke from the establishment’s perspective

Boy these guys know how to make moves

SC declares IK arrest illegal. Now lets see what they say

Now he can do two things..

Show up at high court Islamabad. But no point as they will still arrest him.

The second thing he can do is use his free time to give a speech and tell his supporters what to do next. I think this is what Imran should do. Screw the IHC, do a rally in the free tim he has and get them to do the biggest protest and burn down certain areas

CJP tells Imran Khan that the arrest was unlawful

The CJP said that Imran Khan’s arrest was unlawful and that it will be reversed.

Imran Khan has been directed by the CJP to approach the Islamabad High Court, from where he was arrested by paramilitary soldiers on Tuesday.

The Islamabad High Court had found that the arrest was within the parameters of the law.

Federal Information Minister Marriyum Aurangzeb censured the Supreme Court on Thursday for providing "relief" to Pakistan Tehreek-e-Insaf (PTI) chief and former premier Imran Khan.

"The SC is giving relief to a criminal, a terrorist, a gangster who leads armed groups," said Marriyum Aurangzeb.

The remarks came as the minister addressed a press conference in Islamabad minutes after the apex court ordered Imran to be produced in court within an hour on Thursday, as it heard the PTI's plea challenging Imran's arrest in the Al-Qadir Trust case.

The former premier was arrested on May 9 by the paramilitary force from the Islamabad High Court (IHC), over allegations of having looted Rs50 billion from the national treasury, along with a property tycoon, and getting the Al-Qadir University Trust registered on 450-kanal of land.

The Supreme Court of Pakistan on Thursday declared former prime minister and Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan’s arrest as illegal and ordered his immediate release in the Al-Qadir Trust case.

The apex court has advised the PTI chief to approach the Islamabad High Court again.

While the hearing was underway, Chief Justice of Pakistan (CJP) Umar Ata Bandial reportedly commented that the Islamabad High Court (IHC) would resume hearing of the case the following day.

"You must abide by the decision of the IHC," the CJP was quoted as telling Khan during the proceedings.

The top court had ordered the authorities concerned to produce Khan in an hour as it heard the PTI's plea challenging Imran's arrest from the Islamabad High Court premises.

The court had directed the authorities to present the PTI chief by 4:30pm but he was produced in the court at around 5:40pm with a delay of over an hour.

Strict security arrangements were made in the federal capital’s Red Zone area to avoid any untoward incident from happening.

After Imran's arrival, the courtroom was closed, and subsequently, the top court resumed the hearing of the case.

A three-member apex court bench, headed by Chief Justice of Pakistan (CJP) Umar Ata Bandial and comprising Justice Athar Minallah and Justice Mohammad Ali Mazhar, had earlier stated that PTI workers will not be allowed to come to the court.

Dismissing the attorney general's request to be given a day's time, the CJP stated that the court would issue an appropriate order today, and was "very serious" about the matter.

The attorney general argued that an accountability court had already approved the former prime minister's physical remand, Justice Minallah stated that if the "foundation" [of the arrest] was illegal then a "structure cannot be allowed to be built on it". He continued that the time had come to set an example for the future.

"The manner in which the arrest was conducted cannot be tolerated," he stated, as the apex court took up issue with the way Imran was arrested from the premises of the Islamabad High Court (IHC).

According to the court, the arrest will "set a wrong precedent".

Commenting on the PTI chief's arrest, Justice Minallah questioned why the National Accountability Bureau (NAB) took the law "into its own hands".

Imran's lawyer Hamid Khan informed the court that the former premier had appeared before the IHC to get bail in the NAB case, and that the Rangers appeared when Imran was getting his biometrics done. He continued that the PTI chief was arrested by Rangers personnel who broke down doors and windows.

"Imran Khan was ill-treated and violently arrested. Getting biometrics is part of the judicial procedure," he maintained.

The CJP commented that according to court orders, the bail application was filed but not fixed. He asked if, as per the record, the case scheduled was for another matter.

Justice Minallah questioned if the application was filed before the biometrics. To this the lawyer stated that the application could not be filed without biometrics.

He remarked that the court was called for one case, while the other was being filed.

Justice Minallah questioned if the right of access to justice could be waived. He further asked if it would not "have been appropriate for NAB to take permission from the registrar".

He also asked why the accountability bureau took the law into its own hands.

The chief justice stated that the incident was a matter of respect for the judiciary. He recalled a previous case where the NAB arrested an accused from the SC parking lot, but returned the individual after the court took action.

He continued that NAB had assured the court that no similar action would be taken again, after which the SC spared nine officers of the bureau from contempt proceedings.

When asked by the CJP about how many people came to arrest Imran, the PTI chief's lawyer Salman Safdar informed him that 80-100 Rangers personnel were present at the scene.

Justice Minallah questioned what the PTI wanted from the apex court, to which Khan stated that the court should order Imran's release.

The chief justice remarked that 100 people entering the court premises spread fear. Justice Minallah asked why anyone would trust the judiciary if those who surrendered in the court were arrested.

Shoaib Shaheen said that the court staff was also a target of torture.

The CJP maintained that the court would review the legality of the warrant and its compliance.

Justice Minallah stated that the process of surrendering before the court could not be sabotaged.

Safdar informed the court that Imran was attacked and his security was also withdrawn, despite him being on the radar of terrorists.

Read Faceoff with establishment: Will SC come to PTI’s rescue this time?

Justice Minallah maintained that the court would only consider the right of access to justice.

Safdar continued that the investigating officer (IO) for NAB was not present at the time of the arrest and Imran was brought from the Judges' Gate of the SC.

Justice Minallah remarked that NAB had been doing similar things to elected representatives for many years, adding that the time had come for the bureau to "end its work".

Safdar told the SC that PTI leader Asad Umar was arrested from the IHC as well. He said that after Imran's arrest, the PTI camp discovered that the warrant was issued on May 1. He further added that the interior secretary told the court that the warrant was not yet received for execution.

Justice Minallah stated that they expected a "good response" from the political leadership on the court appearance.

The chief justice said that whatever happened due to the arrest should have been prevented, and that it did not mean that legal action could be ignored. He stated that the court wanted to issue a decision that would be applicable to every citizen.

"Access to justice is the right of every accused," Justice Bandial said.

The CJP also commented on the attack on the Mianwali district court, stating that it was "very painful". He instructed that those responsible for the attack should be revealed.

Justice Mazhar asked if the NAB's notices were responded to. To this, Imran's lawyer answered in affirmative. He further clarified that according to the law, arrests could not be made at the inquiry level and that the inquiry report must be given to the lawyer of the accused after it is completed.

Shaheen added that Imran had sent a reply to NAB's notice and that the notice itself was "illegal".

To this, Justice Minallah said that the procedure for complying with NAB's warrant was not the real issue. However, Justice Mazhar said that the warrant was not challenged by Imran and questioned why the former premier was not involved in the investigation..

Imran's lawyer reiterated that the NAB notice was responded to.

Justice Minallah asked if the NAB had asked Imran to appear in a personal capacity. He continued that everyone spoke about following the law, but no one adhered to it themselves.

"Everyone wants the other to follow the law," he said, adding that it was evident that Imran did not follow the NAB notice.

Justice Mazhar stated that the NAB notice meant that the concerned person would be presumed to be an accused, and that many people receive bail after the notice only. He said that according to records, Imran responded to NAB's notice received in March.

Imran's lawyer argued that the PTI chief had only received one notice from the anti-graft watchdog.

Justice Minallah stated that Justice Mazhar was talking about the implementation of the law and that the "real issue" was the right of access to justice.

'NAB hasn't learnt any lessons'

NAB's prosecutor general Asghar Haider appeared before the court. Justice Minallah said that the bureau had not "learned any lessons" and was accused of many activities including political engineering. He questioned if the NAB took "permission from the Registrar".

The prosecutor maintained that a letter was written to the ministry of interior for compliance with the warrants and the ministry implemented it. When asked if the ministry took action in the courtroom, Haider said that he did not know the facts because he was appointed as the NAB prosecutor "at half past one today".

Justice Minallah asked how many notices were issued to Imran, to which the prosecutor said that only one notice was issued. The judge maintained that "apparently the warrant was not in accordance with law".

Petition

A day earlier, the PTI filed a petition in the top court challenging the IHC ruling that party chief Imran Khan’s arrest by the National Accountability Bureau (NAB) from the high court's premises on May 9 was “legal”.

After Imran’s arrest which sparked violent protests across the country, PTI vice chairperson Shah Mehmood Qureshi called an emergency meeting of a seven-member party committee to review the situation and devise a comprehensive strategy to secure the former premier’s safe and early release.

And on Wednesday, the PTI’s legal team led by Fawad Chaudhry submitted a petition in the apex court, requesting the court to set aside the order passed by the IHC chief justice in the wake of the arrest.

And Allah (swt) is the greatest of planners.

And then lose the lone support of SC CJP forever, right ?

And then lose the lone support of SC CJP forever, right ?

SC support wont really matter, if he supports him he will still even if he doesnt show up at IHC.

He goes to IHC he will get arrested. I dont know if there is an appeal in it or not.

Better to do a campaign in the 12-24 hours he has got. Would be more effective.

Credit goes to NAB though.

Atleast they fixed Imran's limping :))

the topi drama that all these politicians do.

Anyways, this will turn into a chief vs chief game. COAS vs PCJ.

Not a good day for the PTI and Imran Khan haters.

However I'm sure they'll be planning the next reason to arrest him again.

There is a reason why it is a banana republic. One of the very few countries where SC is even helpless, and monkeys can utter whatever they want about SC orders.

This might be a govt strategy to end the violence. SC has said that Khan still has to stay at police guest house.

Apparently another FIR is already issued

I recon there is still 142 to go after this
