The highly-anticipated session of the Punjab Assembly, which will vote for the next chief minister of the province, commenced on Friday after a three-hour delay.

The sitting is being presided by Deputy Speaker Dost Muhammad Mazari.

As uncertainty around the election of the next chief minister of Punjab rose, PTI leader Shafqat Mahmood on Friday claimed that Deputy Speaker Dost Muhammad Mazari had “refused to chair” the Punjab Assembly session.

The crucial sitting, which was scheduled to commence at 4pm, has been facing an unexplained delay. Treasury benches in the assembly hall remained empty as PML-N lawmakers were absent.

Punjab Assembly deputy speaker says PML-Q votes not to be counted in light of Shujaat’s letter; session prorogued

In a shock development, Punjab Assembly Deputy Speaker Dost Mohammad Mazari has ruled that PML-Q members’ votes will not be counted in the election of Punjab chief minister in light of party head Chaudhry Shujaat’s letter.

His ruling was countered by PTI MPA Raja Basharat, who said that the law states that the parliamentary party could issue instructions to party members.

“The head of the parliamentary party is Parvez Elahi,” he contended.

However, Mazari said that the matter had been clarified by the Supreme Court, subsequently proroguing the session.

While the voting was underway inside the House, unconfirmed reports were circulating outside that PML-Q Chairperson Chaudhry Shujaat Hussain had written a letter distancing himself from Elahi’s candidacy.

The development comes a day after PPP co-chairperson Asif Ali Zardari met Shujaat. Earlier, in response to reports that PPP co-chairperson Asif Ali Zardari had asked Shujaat to write a letter instructing PML-Q MPAs not to vote for Elahi, Shujaat said there was “no question” of issuing a letter.

Geo News journalist Hamid Mir quoted PML-Q’s Moonis Elahi as saying that Shujaat had refused to back Parvez as PTI’s candidate. Soon after, however, Moonis tweeted that a joint parliamentary meeting of PML-Q and PTI had unanimously agreed upon Parvez as their candidate for the election.

Addressing these reports, PTI leader Hammad Azhar said that the law was very clear. “It states that members can only follow the instructions of the parliamentary party, not the party leader.”

Talking to ARY News, the former attorney general of Pakistan and legal expert Anwar Mansoor Khan explained the current situation in the context of Shujaat’s alleged letter.

“If a parliamentary party went into voting and if they don’t have any clear directions, then the lawmakers will have a choice. [Then], the directions of the parliamentary leader will also play an important role.”

To another question, Mansoor said that if the parliamentary party had already given a direction then “the same parliamentary leader will be the man to issue directions within the House, and hence, there will be no issue of defection”.

However, he added that the parliamentary leader could only take notice of defection if the party head conveyed the same to him.

Mansoor said the word used in the Constitution was in the context of the parliamentary party and not the party leader, which meant “the party as a whole”. “This is crucial and the matter will likely land in the court”.

The crucial session faced a three-hour long delay due to last-minute political wheeling and dealing.

Going against the directives of Chaudhry Shujaat, all ten PML-Q lawmakers in the Punjab Assembly reportedly voted for Pervaiz Elahi in the chief minister election.

However, Deputy Speaker Dost Mazari did not accept the votes of the PML-Q lawmakers.

“Hamza Shehbaz got 179 votes. PTI received 176 votes and PML-Q bagged 10 votes but I just received a letter from Chaudhry Shujaat,” said the deputy speaker while announcing the result of the CM election.

“As party president of PML-Q, I have directed my provincial members to vote for Hamza Shehbaz,” said the deputy speaker while reading from the letter received from Chaudhry Shujaat.

In line with the ruling of the Supreme Court verdict on Article 63-A related to the defection clause, the deputy speaker said he had rejected the votes of PML-Q lawmakers.

Speaking on the floor of the house, PTI leader Raja Basharat challenged the deputy speaker’s ruling, saying as custodian of the house he could not reject the lawmakers’ votes.

“Chaudhary Shujaat is not authorised to prevent members from voting… he does not have the authority to stop any member,” he said.

However, rejecting the objections of the PTI leader, the deputy speaker said he was performing his duties as per the orders of the Supreme Court.

The political heavy weights including PPP co-chairman and former president Asif Ali Zardari had swung into action to make last-ditch effort to salvage CM Hamza-led provincial government earlier today.

The unconfirmed media reports claimed that PML-Q chief Chaudhry Shujaat Hussain could issue a letter to Deputy Speaker Punjab Assembly Mazari.

The reports said the content of the letter is unknown. However, the PML-Q chief via letter could direct his party lawmakers to vote for Hamza Shehbaz for Punjab CM slot.

PML-Q leader Moonis Elahi said that party president Chaudhry Shujaat Hussain has refused to back the PTI’s candidate — his cousin Pervaiz Elahi — for the slot of Punjab chief minister.

PML-Q leader Chaudhry Hussain Elahi said in a tweet that all ten provincial assembly lawmakers decided in the parliamentary meeting that Pervez Elahi will be the party’s candidate for Punjab chief minister.

“If Deputy Speaker does not allow these votes on basis of Ch Shujaat letter he will [be] violating the Constitution of Pakistan and his oath!,” he added.

Meanwhile, PML-N leader Ataullah Tarar has termed the letter of the PML-Q parliamentary meeting ‘fake’, saying election campaign had been going on for weeks “but you held party meeting only yesterday”.

“Legality of this letter side; this is an afterthought. Election campaign was going on since weeks and you held parl[iamnetary] party meeting yesterday??? No news or footage was given? What a shame. Total lies and a fake a letter, typical Moonis Elahi,” he said while responding to Moonis’ tweet.

Pakistan Institute of Legislative Development and Transparency (Pildat) President Ahmed Bilal Mehboob also said that according to Article 63-A (b) of Constitution, direction to vote for or against a candidate is issued to party legislators by parliamentary party in a legislature and not by the party head.

“So it is PML-Q parliamentary party in Punjab Assembly which directs its members & not Ch Shujaat,” he wrote on his official Twitter handle.

As the uncertainty surrounded the election of Punjab chief minister, PTI leader Fawad Chaudhry warned that the situation would get worse if people’s mandate and Supreme Court’s verdict were not respected.

“There is no such despair [among the party leadership]… the people have announced their verdict [in Punjab by-polls]… the decision of the people will be implemented, the procedure should be constitutional… hatred is increasing among the people, uncertainty and anxiety are at an extreme.”

Earlier, lawmakers from the Pakistan Tehreek-e-Insaf (PTI) and Pakistan Muslim League - Nawaz (PML-N) arrived at the Punjab Assembly as the two parties again go head-to-head to elect a chief minister for Punjab. However, the crucial session of the house could not commence amid reports of 'last-minute political wheeling and dealing'.

More than 180 PTI MPAs and their allies were bussed to the assembly, while PML-N members – backing Hamza Shahbaz – also reached the assembly.

Speaking to the media before arriving at the Punjab Assembly, incumbent CM Hamza Shahbaz said he "hoped for the best".

When asked if he saw himself continuing as the provincial chief executive, Hamza said "whatever is God's will, will come to pass" and that is where his hopes were pinned.

Zardari is a not just a simple thief, he is a cunning criminal. I would guess it was more likely blackmail, Zardari knows something which would embarrass/ruin Shujaat, otherwise there is no need for PPP head to be in dealing with Punjab where his party is dead.

I said after the no confidence vote against IK, this is suicide by PPP and PLMN. They chose to enter power when the economy was in a dangerous position. Now with these clowns infighting, kidnapping, threatening and looting, even their previous supporters want nothing to do with them.

General elections will come when Pak people will be desperate, a big majority win for PTI will see Zardari and co run out of the country.

PTI on its own has 178 votes, needed 186 to win assembly, Q party has 10 members who allied with PTI since 2018 elections, agreement was their leader would be CM
 
I am sorry to say Pakistan politics is really at banana republic level. There is a mandate for PTI and they should be allowed to form the government. Stuff like this will erode whatever confidence people have in the system, which is not much. Instead of this they can as well fix the election like they do in Bangladesh. Former prime minister and PTI Chairman Imran Khan has urged people to hold peaceful protests across the country against the Punjab Assembly deputy speaker ruling to discard the votes of PML-Q lawmakers in the chief minister election.

“We knew since yesterday that Asif Ali Zardari was playing some game in Lahore and using money to buy the loyalties of the lawmakers,” he said while addressing the party supporters via video link on Friday.

Earlier, Deputy Speaker Dost Muhammad Mazari declared Hamza Shehbaz winner of the chief minister election who bagged 179 votes against 186 of Chaudhry Pervez Elahi after rejecting 10 votes of the PML-Q citing a letter from the party head, Chaudhry Shujaat Hussain, who barred his party MPAs from voting for the PTI candidate.

The ousted premier also alleged that “conscious trader Asif Zardari” had been using stolen wealth to manage the Punjab CM election in favour of PML-N leader Hamza Shehbaz.

The former premier said PML-Q President Chaudhry Shujaat did not have any authority to issue instructions to his party members, saying as per the law it was the party’s parliamentary head prerogative.

“This ‘shameless speaker’ [Dost Mohammad Mazari] rejected the votes of PML-Q... they are making a mockery of the democracy because their billions of rupees are at stake.”

Imran said the PML-Q lawmakers voted in line with the instructions issued by the party parliamentary head, saying all “eyes are now on the Supreme Court”.

“It’s been clearly mentioned in Article 63-A that parliamentary head has the authority to issue directions to the party members.”

He went on to say, “I am surprised to see what happened in the Punjab Assembly today, everyone should come out of their homes and register their protest tonight,” he said, adding that the demonstration will send a message that the people of the country are politically conscious and well-informed.

“Chaudhry Shujaat's letter has no importance because the decision is taken by the parliamentary leader.”

The PTI chief said he was expecting that the “mafia” would go to any extent to cling to power as their billions of rupees were at stake. “They are not politicians but a mafia who have nothing to do with the people of the country and they are in power to plunder wealth and close down their corruption cases.”

Imran said his party ran a robust campaign for Punjab by-elections and defeated all coalition parties and “corrupt state machinery and won the polls despite their rigging attempts”.

He also expressed fear over the country’s economic condition, saying such happenings will give rise to instability in the country.

“They destroyed the economy and the rupee witnessed historic depreciation since they came into power… our economy is already in bad condition and the crisis is getting worse.”

Pakistan Muslim League-Quaid (PML-Q) Pervaiz Elahi has strongly rejected the Punjab Assembly Deputy Speaker Dost Muhammad Mazari’s ruling in the chief minister (CM) election, saying that the latter has committed treason, ARY News reported.

Talking to journalists outside Supreme Court’s (SC) Lahore Registry, Pervaiz Elahi said that he had a clear majority in the Punjab Assembly. “I have won the election, but the deputy speaker ruled against me,” he added.

Pervaiz Elahi refused to answer a question regarding PML-Q chief Chaudhry Shujaat Hussain, saying that his party members were not aware of the letter written to Dost Muhammad Mazari.

Terming Mazari’s ruling a contempt of court, he said the Punjab Assembly deputy speaker has committed treason and Article 6 reference should be filed against him.

The statement came after Pakistan Muslim League-Nawaz (PML-N) leader Hamza Shehbaz was re-elected as the chief minister (CM) of Punjab as Punjab Assembly Deputy Speaker Dost Muhammad Mazari rejected the PML-Q’s votes in light of Chaudhry Shujaat Hussain’s letter.

The nail-biting contest to elect the Punjab chief minister ended dramatically with PML-N’s Hamza Shehbaz retaining the coveted post and PML-Q’s PTI-backed candidate Pervez Elahi braving a shock defeat following the last-minute rejection of votes cast by his party members in his favour.

The ruling of Deputy Speaker Dost Muhammad Mazari has triggered an intense debate on whether his decision in the light of PML-Q head Chaudhry Shujaat Hussain’s letter — asking his MPAs to vote for Hamza in a volte-face at the eleventh hour — was legally valid, especially in light of the Supreme Court’s interpretation of Article 63-A.

Under the top court’s observation of the Constitution’s much-debated Article 63-A, it had said the votes of defecting lawmakers will not be counted. The verdict by the larger bench of the apex court was a 3-2 split decision, with a majority of the judges not allowing lawmakers to vote against party line.

In its interpretation, the court had written:

If, at all, there is any conflict between the fundamental rights of the collectivity (i.e., the political party) and an individual member thereof it is the former that must prevail.

It is our view that the vote of any member (including a deemed member) of a Parliamentary Party in a House that is cast contrary to any direction issued by the latter in terms of para (b) of clause (1) of Article 63-A cannot be counted and must be disregarded, and this is so regardless of whether the Party Head, subsequent to such vote, proceeds to take, or refrains from taking, action that would result in a declaration of defection.

In case the Election Commission of Pakistan confirms the declaration sent by a Party Head against a member, he/she shall cease to be a Member of the House.

According to Article 63-A (1) of the Constitution, a parliamentarian can be disqualified on grounds of defection if he “votes or abstains from voting in the House contrary to any direction issued by the parliamentary party to which he belongs, in relation to election of the prime minister or chief minister; or a vote of confidence or a vote of no-confidence; or a money bill or a Constitution (amendment) bill”.

‘Deputy speaker misconstrued court orders’

Speaking to Dawn.com, Barrister Asad Rahim said he differed from Mazari’s observation.

“The text of Article 63-A is clear and it says you cast vote as per directions of the parliamentary party. The Constitution clarifies it and the letter of Chaudhry Shujaat has no legal and constitutional value.”

He said the deputy speaker should not have rejected the PML-Q votes.

Rahim said the ruling of SC was totally misconstrued by the deputy speaker.

He said linking the rejection of votes with Shujaat’s letter or his parliamentary status had no legal weight. He stated it was an unfortunate day that a “clear law has been distorted to take people back to April 10 situation” — when the no-confidence motion was approved against the then prime minister Imran Khan.

Mazari’s ruling is entirely illegal, and as bereft of the law as Qasim Suri’s ruling was in April, he added. “The text of Article 63A expressly mandates voting per the direction of the parliamentary party and not the party head.”

‘Ruling is illegal’

Abdul Moiz Jaferii, talking to Dawn.com, said Article 63-A referred to the parliamentary party and its directions, and then it went on to describe the process and procedure of going against your party by speaking of the role of the “party head”.

Jaferii said there was enough room to interpret that Shujaat had been inserted into the process. “It is prima facie illegitimate and it is an illegal ruling.” He stated that the Supreme Court clearly had a political party head in mind when it passed the short order, and not the parliamentary party. The order repeatedly refers to the political party being the bedrock of the democratic process, and clearly the parliamentary party is simply a procedural tool in this process.

He believed that the bigger issue was that the holder of a single-seat — which was the deputy speaker — “can hold hostage the majority opinion of the House.”

He stated that the members had been stopped from expressing their constitutional right of dissent as enshrined in 63-A albeit at the incurrence of the penalty of deseating.

‘Party head cannot issue directions under Article 63-A’
Lawyer Moiz Baig told Dawn.com “the legal position prior to the Supreme Court’s decision in the presidential reference No. 1 of 2022 was clear insofar as a parliamentarian could deviate from his party position but such defection came at the peril of being disqualified as the SC decision regarding the functions of the parliament leaves the legal position more convoluted than before.”

“The court observation clearly said when a parliamentarian deviated from the position espoused by his or her parliamentary party and cast his or her vote in a manner inconsistent with the directions issued by the parliamentary party, such votes ought to be disregarded.

“Moreover, the party head may thereafter declare such parliamentarian to have defected and seek such parliamentarian’s disqualification.”

He was of the view that the directions envisaged under Article 63-A of the Constitution could only be issued by the parliamentary party and not a party head whose role, especially “where the party head is not a member of the parliamentary party, may merely be that of a post office”.

Senior lawyer Barrister Aitzaz Ahsan was also categoric in his observation that the decision by the deputy speaker was not “right”.

“If you read Article 63-A, it has two segments with one part describing parliamentary dominance and the second is about the authority of a party head,” he said while talking to ARY News.

Ahsan said that a party head could take a better decision as he was an individual who travels all over the world, but “the parliamentary party are the few people who take part in parliament debates and have an eagle eye on such matters. They are the best judge rather than the party head.”

He observed that the parliamentary party had the authority in the first place to determine either to vote in favour or against, then the party head comes next to decide if any member should be prosecuted.

Matter to likely end in court, says former AGP
Talking to ARY News prior to the counting of the votes, former attorney general of Pakistan and legal expert Anwar Mansoor Khan explained the current situation in the context of Shujaat’s letter.

He said that if the parliamentary party had already given a direction then “the same parliamentary leader will be the person to issue directions within the House, and hence, there will be no issue of defection”.

However, he added that the parliamentary leader could only take notice of defection if the party head conveyed the same to him.

Mansoor said the word used in the Constitution was in the context of the parliamentary party and not the party leader, which meant “the party as a whole”. “This is crucial and the matter will likely land in the court”.

‘Party head is supreme’
Anchorperson Muneeb Farooq told Geo News that there were instances where several party heads were not a part of an assembly but they had the right to issue a show-cause notice or expel member.

In contrast, a parliamentary leader cannot direct a “party line” to any member and the decision in this regard has to be made by the party head who is not bound to be a part of the assembly, Farooq explained.

‘Minority view in SC judgement carries more weight’
Sharing his take on the CM election, Supreme Court Bar Association President Ahsan Bhoon told Geo News that the minority view in the Article 63-A observation was more accurate than the majority view of three other judges.

“Article 63-A provides that if member votes against directions of party head, his vote will be counted but thereafter the party can move to de-seat that member, but unfortunately the honourable Supreme Court gave a reference of party head which is not in the Constitution.”

He said his review of Article 63-A as president of SCBA was sub-judice and the court had to decide on it.

I am not sure but the tactic on one level has worked well without many lives being put at risk. We lost 5 people to Qatil Rana, and they were someone's family. The establishment are in a deep hole and Bajwa will have to come out sooner or later, this game today destroys any idea that these crooks are constitutionalists, they have been out thought by Kaptaan. Not surprised to see defenders of the constitution gone missing when it benefits them. PDM have to be the most power hungry yet short sighted people. In their desperation to come into power they overthrew stable federal and provincial governments. They are holding it through any means necessary not realizing each dirty trick just digs them deeper into the ground. To get into power for at max 1 year they threw away an easy win next general elections to get power for 5+ years. GG, you played yourself.

LAHORE: The Supreme Court of Pakistan has admitted a plea filed by PTI candidate for CM Punjab Parvez Elahi on Saturday night against Deputy Speaker Dost Muhammad Mazari’s ruling to reject 10 PML-Q votes, ARY NEWS reported.

The counsel representing Parvez Elahi submitted the plea to deputy registrar of the Supreme Court at the Lahore Registry.

It stated that the election for CM Punjab was held today where Parvez Elahi secured 186 votes, however, the deputy speaker in an unconstitutional and illegal manner gave a ruling to reject the 10 votes.

The petition stated that the ruling violated the apex court’s decision with regard to the interpretation of Article 63 A of the Constitution and asked the court to annul the ruling.

PML-Q votes rejected by deputy speaker in light of SC decision in Punjab CM election, Shujaat's letter

Chaudhry Pervaiz Elahi stood for the chief minister of Punjab but he was knocked out in the Punjab Assembly on Friday when Deputy Speaker Dost Mazari, who chaired the session in his place, rejected his personal vote along with his party’s lawmakers on technical ground.

Elahi – the joint candidate of his own Pakistan Muslim League-Quaid (PML-Q) and major ally the Pakistan Tehreek-e-Insaf (PTI) – voted for himself but little did he imagine that at the end of day his own vote would be rejected, paving for his rival Hamza Shehbaz to win the contest.

Strange as it may seem but it has apparently happened for the first time in the recent democratic history that the vote of a candidate contesting election was rejected along with his party members just because they didn’t obey the instructions of the party head.

To add insult to injury, Elahi and other PML-Q lawmakers may lose their provincial assembly seats if the party head – Chaudhry Shujaat Hussain in this case – decides to declare them as defectors and asks the Election Commission of Pakistan (ECP) to proceed against them.

Elahi’s shocking defeat was a result of Hussain’s letter that he sent to Punjab Assembly Deputy Speaker Dost Muhammad Mazari, stating that he had directed his party’s members of the provincial assembly (MPAs) to vote for Hamza Shehbaz of the PML-Nawaz.

As per law, voting for any other candidate could lead to defection. Since Hussain had barred the PML-Q MPAs, including Elahi, from voting for the PTI candidate, Mazari declared that the votes that 10 PML-Q lawmakers had cast were in violation of the party head’s direction and a recent order of the Supreme Court, which ruled that defecting lawmakers’ votes could not be counted.

Hussain’s letter emerged after his consecutive meetings with Pakistan Peoples Party Parliamentarians (PPPP) President Asif Zardari at the time, when the PTI Chairman Imran Khan and the PML-Q leadership were busy protecting their lawmakers from being allegedly bought by the rival parties.

For the past several weeks, the PTI and the PML-Q leaderships had been slogging it out in the heat and dust of legal cases to win back the country’s political capital. The PTI had got a boost in the July 17 by-elections when it won 15 out of 20 seats.

Soon after PTI’s resounding victory in the by-elections, the party leadership felt that the stars were aligned for it and it could change the situation in its favour any time. The PTI decided to form a government in Punjab and threw its weight behind Elahi for the province’s top slot.

Zardari along with Hussain, however, made it look that they were so near yet so far from the destination. They foiled the PTI’s plan to bring the ruling alliance to its knees, as Friday night turned out to be a nightmare for PTI and PML-Q.

The result is particularly humiliating for Elahi as he found himself jumping out of the frying pan into the fire when he voted for himself and left red-faced by Hussain’s letter and Mazari’s ruling.

LAHORE: The Supreme Court is hearing PML-Q leader Pervez Elahi's petition against Deputy Speaker Dost Mazari's ruling in the Punjab chief minister's election.

A three-member bench — headed by Chief Justice Umar Ata Bandial, and comprising Justice Ijaz Ul Ahsan and Justice Munib Akhtar — is holding the hearing at the Supreme Court's Lahore registry.

At the outset of the hearing, PTI's counsel Barrister Ali Zafar informed the court that during yesterday's Punjab Assembly session, a re-election of the province's chief minister took place.

Justice Ahsan asked the lawyer how many lawmakers were present during the session, to which he responded that 370 members of the assembly were in attendance.

Zafar argued that Elahi secured 186 votes and Hamza bagged 179 votes, therefore, in line with the Constitution of Pakistan, the PML-Q leader is the chief minister.

The SC's opinion in the May order, Zafar said, states that the parliamentary party can give directions to lawmakers on whom to vote for, and the PML-Q's parliamentary party decided to back Elahi, but despite that, Mazari dismissed 10 PML-Q votes.

"They ignored the parliamentary party's decision," Zafar said.

At this, the chief justice said that all the relevant parties — deputy speaker, chief minister, and Punjab attorney-general — should be issued notices so they can provide their version.

"We wish to personally hear from the deputy speaker. Only the deputy speaker can tell us which paragraph he was referring to," Justice Bandial said.

The deputy speaker has been summoned by the court at 2pm.

In addition, the top court has sent notices to Chief Minister Punjab Hamza Shahbaz, the Punjab chief secretary and the advocate general for Punjab.

CJP Bandial said that the deputy speaker should come to the court with all the relevant documents and not be "frightened" as this is "just a legal procedure".

The CJP then adjourned the hearing till 2pm.

What Mazari did
The deputy speaker rejected 10 votes of the PML-Q, citing the apex court's opinion in the presidential reference for the interpretation of Article 63A, dealing a major blow to Pervez Elahi and paving the way for Hamza Shahbaz to retain the chief minister's slot.

Opposition (PTI and PML-Q) candidate Elahi managed to receive 186 votes, but after the deputy speaker's ruling, the PML-Q leader got only 176 votes, whereas Hamza received 179 votes.

The petition was filed late last night after the Opposition — which was confident of a victory — suffered the setback and vowed to challenge the ruling.

SC order on Article 63(A): Who can give directions to MPs?
The Supreme Court of Pakistan, back in May, had ruled that the votes of dissident members of the Parliament (MPs), cast against their parliamentary party's directives, cannot be counted.

The apex court, issuing its verdict on the presidential reference seeking the interpretation of Article 63(A) of the Constitution related to defecting lawmakers of the PTI, said that the law cannot be interpreted in isolation.

During yesterday's ruling, Article 63(A) was applied after PML-Q President Chaudhry Shujaat Hussain wrote a letter to the deputy speaker, saying that he had directed the party to vote for Hamza Shahbaz.

The ruling has invited criticism from legal wizards as several believe that Mazari's decision was not in line with the Supreme Court's order.

Speaking about the Punjab deputy speaker’s ruling, the PML-Q leader said that they had won the election as the parliamentary party had nominated him for the CM Punjab poll.

"Deputy speaker says that neither I nor my party can vote for me," he added. Criticising Mazari, the PML-Q leader said, “Even traitors can’t do what he [Deputy speaker PA] has done and no one has ever done such things in history.”

The Opposition parties had approached the apex court, challenging the controversial ruling given by Dost Mazari citing the court's opinion on Article 63A.

After a dramatic day, PML-N's candidate Hamza Shahbaz Friday retained the post of the Punjab chief minister after a three-vote victory against the PTI's candidate.

Dost Mazari rejected 10 votes cast by PML-Q members in favour of Elahi "against the party line."

As a result, Hamza received 179 votes, while Elahi, who was backed by the PTI, managed to bag 176 votes.

However, PML-Q challenged the ruling in the apex court through a petition filed late at night.

Pervez Elahi’s counsel Aamir Saeed Rawn filed the petition in the SC in which Hamza Shahbaz, Deputy Speaker Dost Mazari and the chief secretary have been made parties.

LAHORE: Reacting to the unexpected move by the PML-Q president amid the run-off election for the slot of Punjab chief minister, PTI leader Fawad Chaudhry on Saturday claimed that Chaudhry Shujaat Hussain’s ability to make decisions is limited due to illness.

Talking to journalists outside the Supreme Court’s Lahore registry, Fawad Chaudhry said, “Chaudhry Shujaat’s thumb impressions were taken on a blank paper.”

The PML-Q chief, in a letter to PA Deputy Speaker Dost Mazari, had informed him that he has directed his party MPs to vote for PML-N’s candidate Hamza Shahbaz. Consequently, Mazari rejected the votes polled by the PML-Q members in favour of Pervez Elahi and declared Hamza as the winner.

Lashing out at Dost Mazari for rejecting PML-Q votes, the PTI leader said that the deputy speaker stole the people’s mandate.

“Senior legal experts believe that the deputy speaker’s ruling is against the Constitution,” he said, adding that the Supreme Court should summon Dost Mazari under the charges of contempt of court. The PTI leader hoped that the top court would provide them justice.

Taking a jibe at PPP co-chairman Asif Ali Zardari, whose last-ditch effort paved the way for Hamza Shahbaz to retain the CM Punjab's position, the PTI leader said that Pakistan cannot bear the politics of Zardari.

Criticising Mazari, Fawad said that his yesterday’s move was not in line with ethical values and he also violated the Constitution.

“We moved the SC for justice,” the PTI leader said and urged the “powerful forces” not to play with the country.

Hamza Shahbaz is not an elected chief minister of Punjab, he claimed.

Responding to a question, the PTI leader warned that if justice is not provided then people will make their own way.

The Pakistan Tehreek-e-Insaf (PTI) workers protested across the country late Friday night against the ruling of the Punjab Assembly's deputy speaker that helped Pakistan Muslim League-Nawaz's (PML-N) candidate to retain his chief ministership of the province.

Disappointed with what happened during the run-off election in the provincial assembly's session on Friday, Chairman PTI Imran Khan gave the protest call in his late-night speech. The PTI chief said he was "in a state of shock" to see the incidents in the Punjab Assembly during the run-off election.

Imran Khan said that Article 63A of the Constitution states that it is the head of the parliamentary party, whose decision is binding on the members to vote.

Responding to his call, the PTI workers took to roads and streets in different cities and staged protest demonstrations. The PTI activists and supporters gathered in Islamabad at D Chowk and F9 Park and Lahore's Liberty Chowk and Karachi's Shahra-e-Faisal.
